Full textThe visual artists display right is a new part of the author’s copyright, introduced by the French supreme court in 2002. It implies, for the author, the right to authorize or prohibit the public exhibition of his works, such as paintings, sculptures, photographs, architectural works or any work of graphic or plastic art. This right also gives the author a control over the conditions of presentation of the work and allows him to exploit it financially. It is similar to the performing right for dramatic and musical works. But the visual artists display right is the cause of new problems about intellectual property. Indeed, the exhibition is based on a physical thing in which the work is embodied. Therefore, we need to examine the nature of copyright, which is considered to have an intangible subject-matter. This concept is more convenient for literary, dramatic and musical works. This development calls the terms “intangible property” into questions, as they are used by the French copyright law. The visual artists display right shakes the very foundations of copyright and upsets its own structure. This thesis is intended to examine theses problems. Thus it appears that the terms “intangible property” refer to the property of the author’s right itself, as a possession, instead of the property of the work. That’s why the distinction between this property and the property of the tangible item should be considered as a distinction between two rights. In addition, the innovative nature of the visual artists display right shows that copyright has more been provided for literary, dramatic and musical works, than for the artistic works. This right also contributes to the harmonization of the literary and artistic property

Full textThis present stydy investigates the composition-property of corn flour based materials. Lipids and cellulosic residue act like defects in these materials, starch controls the mechanical properties of corn flour based material and their variations with temperature and humidity. The interactions between starch, water and plasticizers have been highlighted in a phase diagram, in which we distinguished two transitions. The different phenomenons discussed in the literature (antiplasticization – plasticization – phase separation) were correlated with the phase diagram. The characterization of interactions between starch and plasticizers, by water sorption, was interpreted in terms of interaction stoichiometry. This method was applied for three plasticizers: glycerol, ethylene glycol and 1,3-propandiol; Amphiphilic polycondensates, obtained from itaconic acid, were used to improve the compatibilization of poly(butylene succinate) and glycerol-plasticized thermoplastic starch blends. Full textThis Ph.D dissertation aimed at the comprehensive understanding and the constitutive modeling of the mechanical behaviours of the surface mechanical attrition treatment (SMAT) treated AISI304 stainless steel sheet under a large range of loading rates. SMAT treated AISI304 stainless steel sheets are multi-layered functionally graded materials (FGM). The main research results and conclusions are summarized as followed:(1) The overall rate sensitivity SMAT treated AISI304 stainless steel sheet is characterized by the double shearing test under quasi-static and dynamic loading where a large strain can be achieved without geometry instability. Impact double shear test are performed with a large diameter Hopkinson bar system and an adapted equal-impedance clamping device. Significant rate sensitivity is found. It is also observed that such a rate enhancement does not induce an important reduction of the ductility.(2) In order to extract accurate material information from the double shear tests, their testing conditions are thoroughly analyzed using numerical simulation. Numerical models including clamping devices have been built to investigate the influence of this clamping device at the early stage of loading. A limited effect was found for various imperfect testing conditions such as the clamping device stiffness, non-homogeneous stress and strain fields, non-equilibrium state, etc. On the contrary, numerical and analytical study shows that the simple small strain assumption usually used in double shear tests are not accurate enough. Eulerian cumulated strain definition should be used to get consistent numerical results. From this finding, the experimental rate sensitivity obtained for the SMAT treated AISI304 stainless steel sheet are recalculated.(3) A multi-layers elastic plastic damageable constitutive model is proposed to model SMAT treated AISI304 stainless steel sheet. The parameters are identified using tensile testing results. The elastic plastic behavior is curve fitted with a simple Ludwig hardening model. However, the damage parameters should be identified using an inverse method on the basis of numerical simulation of these tensile tests. In order to validate this multi-layer elastic plastic damageable constitutive model, indentation/piercing tests on SMAT treated AISI304 stainless steel sheet are performed. Numerical simulation of this indentation/piercing tests is also realized. It is found that the identified multi-layer elastic plastic damageable constitutive model allows for a quite accurate prediction of the experimental piercing tests.(4) In order to evaluate the impact anti-piercing capacity of the SMAT treated AISI304 stainless steel sheet, the impact perforation tests using Hopkinson bar are carried out. Numerical simulation of these impact perforation tests are realized with a similar FEM model as the quasi-static case. As the rate sensitivity of SMAT treated AISI304 stainless steel sheet is experimentally characterized with double shear test, a rate sensitive multi-layer elastic plastic damageable constitutive model is introduced. The numerical results agree well with the experimental ones, which indicates the effectiveness of the numerical model as well as the rate sensitive multi-layer elastic plastic damageable constitutive model

Full textResale royalty rights came into being in France with the growing awareness of the difficult financial conditions faced by otherwise successful artists. The prevailing image was one of the artist’s family watching the price of his works soar yet with no financial gain for itself. The early 20th century saw increasing numbers of initiatives taken to resolve the difficulties caused by this unfair situation, resale royalty rights becoming enshrined in French law with the law of 20 May, 1920, before subsequently spreading abroad. Through an interesting lobbying process, the European Union has also enshrined resale royalty rights, and the movement appears to be spreading. Despite this laudable movement and its spread, resale royalty rights continue to be criticised, thus bringing their very legitimacy into question. These rights, the system of which was rapidly established, are still in search of a true rationale

Full textFrom basic and essential to unnecessary and optional consumer products, packaging, particularly plastic, is today an indispensable part of our daily life. Its extensive use in the food industry for a single use and for a short shelf-life encourages us today to move towards new renewable and biodegradable materials with similar characteristics than their counterparts from fossil resources. Biopolymers and biopolyesters blends can be a good alternative. Within the framework of this present work, wheat flour, thermoplasticised by glycerol and water, and biobased and biodegradable polyesters such as PLA and/or PHB, were blended using an industrial twin screw extruder and were injection-molded into thermoplastic materials. Thermal, dynamic thermomechanical, morphological, mechanical and barriers properties of these new materials were studied. Citric acid was used as a compatibilizer to improve the interface starch/PLA. The different investigations have allowed us to develop various types of formulations, with mechanical characteristics and barrier properties to water vapor, very attractive for manufacturing plastic food packaging which can be used for meats or cheeses. Food contact suitability and biodegradability of thermoplasticised wheat flour/polyester materials have also studied

Full textWhen subjecting a metallic structure to an impact or a crash, two kinds of fracture can be seen to appear jointly: rupture initiated in the sheet and rupture located on the joint areas. Depending on the type of transportation mean and materials used for the design of the vehicles, structures can be assembled either by rivets, spotwelds or weld beads. To prevent the failure of these joints, which can lead to a complete and particularly brutal structural disarticulation, their behaviour must be studied. The aims of this work are to measure the response of a spotwelded joint under quasi-static and dynamic loadings, to determine the load velocity influence on its behaviour, to understand how and where the failure starts and propagates in the assembly. Original tests, which make it possible to mix loading directions and to control the boundary conditions around the spotweld and the deformation of the metal sheet, were developed and performed under quasi-static and dynamic loadings on an hydraulic jack in a range of velocities from 5mm/mn to 1m/s. A new device was also developed to test spotwelds in pure tensile direction on SHB. This device uses SHB in a no-direct tensile testing configuration and a velocity of 13 m/s is reached. Load-displacement responses, failure mechanisms and topographies were obtained. To complete experiments, a fine numerical model of the spotweld was performed. The elastoplastic properties of the HAZ were experimentaly identified using some materials having undergone heat treatments. This model allows us to understand where the deformations are located

Full textTo increase in value the agricultural waste products of the date palm tree -phoenix dactylifera l-, especially the fibers from the leaflets, their use as filler in polyepoxide matrix (dgeba / ipd) was investigated to prepare new bio-based composites. Our goal in the first part is to study the chemical modification of palm fiber by oxidation mediated by 2,2,6,6-tetramethylpiperidine-1-oxyl (tempo). The kinetic and the topology of the reaction, as well as the characterization of fibres in rough and oxidized state, were also studied. An original kinetic model was proposed taking into account the heterogeneous character of this chemical reaction. The second part was devoted to study the kinetics and rheokinetic of the polymerization of dgeba / ipd with and without modified and unmodified fibers. This enabled to show the effect of the introduction of the date palm tree fibers (oxidized and non oxidized) on the composite formation. The thermal properties of the prepared composites were also investigated in this part of work. In the last part of this work, the mechanical properties of these composites were investigated and enabled to highlight the effect of the fibers oxidation on these properties. In addition, the effect of oxidation on the course of the injection during the rtm process (moulding by transfer of resin) was investigated. A positive effect of the oxidation of the fibers on the course of the injection was obtained and was attributed to the higher wettability of oxidized fibres by the resin

Full textThe use of polyamides in the automotive industry has grown significantly over the last years with the demand to reduce vehicle weight and also to increase fuel efficiency. Polyamide 66 having excellent chemical resistance, mechanical strength and toughness becomes the largest engineering thermoplastic used in automotive components. These latter are often submitted to repeated stress during service and their mechanical properties decline progressively until the failure. E. Mourglia-Seignobos (thesis 2009), pointed out that damage of polyamide 66 involves voids nucleation and growth in the amorphous phase. In order to improve the durability of this material, we tailored the cohesive energy of its amorphous phase by introducing phenolic moieties offering strong intermolecular H-bonds interactions. We proposed a preparation method of block copolyamides containing aliphatic polyamide 66 and phenolic groups (PA6HIA) by reactive extrusion. Microstructural characterizations pointed out that crystalline properties of resulting copolymers are not significantly altered at low PA6HIA content and that reactive extrusion is more appropriate than the in-situ copolymerization for the preparation of these materials. We showed that PA66/6HIA copolyamides having undisturbed crystalline features exhibit superior mechanical performance than the standard PA66, particularly longer lifetime under cyclic loading. The results of this work put in evidence the impact of the amorphous phase on the ultimate properties of semi-crystalline polymers in one hand, and open the way to a better increase of the durability of these materials by improving their crystalline features in another hand
