Abstract:
This thesis re-evaluates the traditionally held view that Lyon in the fifteenth and sixteenth centuries was a city without a sacred polyphonic tradition. Chapter 1 explores the dichotomy between the powerful conservative archbishopric, staunchly against the use of sacred polyphony in the church, and the vibrant cultural life of the city. Lyon had a flourishing music publishing industry, frequently hosted the courts of the French kings, and was home to a large Italian community whose churches employed some prominent musicians. Chapters 2 and 3 present case studies of two manuscripts with links to Lyon: Copenhagen, Royal Library, Ny Kgl. Samling 1848 2°, and Lyon, Bibliotheque Municipale, MS 6632. The first case study focuses on segments of the sacred repertoire in the large composite manuscript Cop 1848. The possibility of a local sacred polyphonic practice in Lyon is traced through an examination of settings of Stabat mater, 0 salutaris, and Marian votive texts. Problematic terms such as 'provincial' and 'parochial' are reconsidered in an attempt to identify more accurate ways of categorizing and describing this music. The second case study looks at a set of little-known fragments removed from the binding of a book published in Lyon in 1542. Lyon 6632 was previously believed to contain Continental music from c. 1500, but one of these compositions is here identified as a three-voice English mass, composed in the mid-fifteenth century, with known concordances in four other manuscripts. The version in Lyon 6632 is unique, however, in that it includes a fourth voice below the original three-voice texture that appears to be the work of a later composer. Chapter 4 looks at the adaptation of existing works through the addition of a new voice. While this practice was widespread in secular repertoire in the late fifteenth and sixteenth centuries, it was unusual for large-scale sacred works to be adapted in this way. The mass from Lyon 6632 and a comparable example from Cop 1848 are considered as possible evidence of a Lyonnais practice of adaptation arising in response to the city's unusual approach to sacred polyphony.

Abstract:
In March of 1992, Marion Goldwasser, a teacher at Carroll County High School in Virginia, came under fire for her use of the book, The Floatplane Notebooks, in her classroom. A local preacher and several parents objected to six pages which contained sexual content. Over the next three months, residents throughout Southwest Virginia entered into a debate over the merits of the book, and more broadly the purpose of education. This debate roughly divided into three camps with different perspectives not just on how to proceed, but on the very nature of the controversy itself. These camps were those who felt the controversy was primarily about the censoring of books, those who were primarily concerned with the proper procedure by which the book should be reviewed, and those who saw the book as a moral affront to religious, Christian values. These disputes remained intractable throughout the controversy reflecting underlying disagreements about the ethical role of state power, the public nature of public schools, and the connection between power and knowledge. By understanding these underlying intellectual causes for the intractability of censorship disputes, historians can engage other academics and the public on this important issue. Engagement can take multiple forms, including writing in handbooks designed to help educators deal with such controversies, writing amici curiae briefs on relevant First Amendment cases, and encouraging a broader and more lucid public discussion on censorship and free speech.

Marion Goldwasser was a high school teacher in Carroll County, Virginia in 1992. That year, she taught a book called The Floatplane Notebooks in her classroom. A parent and a local preacher objected to her use of the book because they did not like its sexual references. They demanded that the book never be used again and that the school board fire Goldwasser. The teacher, the preacher, the school board, and the community debated what to do for four months. Finally, Superintendent Oliver McBride ended the controversy by compromising and allowing the book to be used for advanced senior classes but not junior classes. This controversy matters because it tells us something about censorship controversies in general. They have been going on for a long time and are likely to continue. People disagree about when the government should get involved. They disagree about why we have public schools. They disagree on who should make decisions for the classroom and how the media talks about censorship. Historians need to understand this. When they do, they can help the public become more informed on the issue of censorship.

Au debut du xviieme siecle, montauban est une ville d'environ 15 000 habitants, entierement protestante. La bourgeoisie est dominante et detient pouvoir et richesse. Progressivement, le pouvoir royal et catholique tente de reprendre le controle de la ville. Sa politique de reconquete s'appuie sur des mesures discriminatoires a l'encontre des protestants, sur la diminution de l'autonomie municipale et sur l'implantation de catholiques et d'institutions royales dans la ville. Prenant comme point de depart des registres d'imposition, l'auteur s'attache a obtenir une evaluation quantitative des bourgeois. Leur cadre de vie, leurs habitudes vestimentaires, leur lieu de vie. . . Sont particulierement etudies. Ensuite une approche plus micro-historique est privilegiee avec l'etude plus complete de trois groupes patronymiques choisis a partir des registres d'imposition : les bardon, constans, vialetes. A partir principalement des registres notaries et de l'etat civil, leurs comportements familiaux sont observes (enfants, strategies matrimoniales. . . ) mais aussi leur patrimoine, leur education, leur culture, leur attitude face a la mort. Dans une derniere partie, l'auteur s'interesse aux bourgeois dans les institutions qu'elles soient royales (les achats d'offices) ou municipales (election ou participation au consulat et aux conseils generaux). Enfin, la revocation de l'edit de nantes, le refuge et leurs consequences pour les bourgeois montalbanais sont analyses. Cette these met en valeur la diversite de ce groupe social mais aussi les points communs qui la rapprochent. L'importance du groupe familial et de ses liens sont particulierement soulignes. De meme, on voit comment le pouvoir royal a agi pour tenter de reconquerir une ville protestante et quelles difficultes il a du affronter
At the beginning on the 17th century, montauban is a completely protestant town of about 15,000 inhabitants. The burghers are ruling and controlling power and wealth. Step by step, the royal and catholic power tries to get the upper hand on the town again. Its policy of reconquest is based on discriminatory measures against protestants, on a reduction of the local self-government and the settling of catholics and royal institutions in the city. From taxation registers the author applies herself to a quantitative estimate of burghers. Their living conditions, their clothing habits, the place where they lived are especially studied. Then a more micro-historical approach is given a greater place with a more complete study of three patronymic groups : the bardon, the constans, the vialetes. Mainly from notarized registers and from the register general's office, their family behaviors are observed (children, marriage strategies) and also their patrimony, their education, their culture and their attitude towards death. In a last part, the author interests herself in burghers in the royal or local institutions. Then the revocation of the edict of nantes, the "refuge" and their consequences for the burghers of montauban are analysed. This thesis brings out the diversity of this social group and the common points which draw them together. The importance of the family group and of its links are especially underlined. Besides, we can see how the royal power acted to try to reconquer a protestant town and the difficulties it had to cope with

Abstract:
Coups d'état have occurred around the world since time immemorial but have been more commonplace amongst African states. They have typically yielded bloodshed and instability and, they inevitably culminate in the gross violation of the most basic human rights. They also arguably constitute a perennial threat in the politics of African states and, they have been condemned in numerous instances. Such condemnation brings to the fore, questions as to international law's position on coups d'état. In light of International law placing a high premium on the doctrine of national sovereignty, it is tempting to conclude that coups d'état are beyond the scope of international law thus not being proscribed. This position is further strengthened by the absence of international treaties/conventions proscribing coups d'état. It can, however, be argued that the recognition given to the notion of democracy by some treaties/conventions such as the UDHR, CEDAW, and ICCPR, may amount to an implicit proscription of coups d'état under international law. There is also, a right to democracy, along with a proscription of coups d'état under customary international law as reflected by state practice. African states, being specially affected by the scourge of coups d'état, have played a leading role in the development of the customary international law proscription of coups d'état. Regardless of it being difficult for state responsibility to ensue, coups d'état constitute wrongful acts at international law.

Abstract:
This thesis extends recent scholarly interest in the practical processes of Late Antique Roman law and on the integration of the episcopate into Roman power structures in the fourth century, the first century of imperial patronage of Christian communities. It confirms the "minimalist" model of Roman governance and provides a non-medieval example of the persecution of minorities as a contingent effect of competing claims to authority. This thesis argues that fourth-century elite Roman men disputing episcopal status via the Roman courts led to a transformation of episcopal polity, and that this development has been obscured by a subsequent paradigm shift in the norms concerning episcopal use of Roman law towards the end of that century. This paradigm shift identified by this thesis has three important aspects:1. With the change in imperial dynasty from the Valentinians to Theodosians, imperial favour moved from non-Nicene to Nicene bishops. Disparity of access to imperial favour during the fourth century required Nicene-identified bishops to invent tools to succeed in spite of their poor position. After the Theodosian-Nicene takeover, the Nicene-identified bishops retained these tools while also inheriting the legal framework that the non-Nicene bishops had crafted during their mid-century period of patronage.2. The power structures through which imperial favour was granted also changed. The typical fourth-century use of Roman law to resolve inter-episcopal disputes was different from that which would become established as a more enduring precedent in the Theodosian era. 3. The episcopal rhetoric used in claiming imperial favour changed from a focus on affirming one's own privilege to a focus on the proscription of others. The terminology of orthodox versus heretical is significant but must be understood as relational: even once heretics were proscribed by law, orthodoxy remained a status granted by the emperor. The methodology of this thesis argues for the importance of interpreting the relevant fourth-century sources in the context of their own time and norms, rather than in the light of the significantly different fifth-century practice as previous scholarship has done. This thesis first discusses two case studies before the paradigm shift: in Chapter One, Athanasius of Alexandria, as an example typical of the fourth century, and in Chapter Two, Priscillian of Avila, as an example at the cusp of the transition in the 380s who still demonstrates conformance with earlier practice. The thesis then describes the transition to the Theodosian-Nicene mode with an extended focus on Ambrose of Milan. Chapter Three shows Ambrose, contemporary with Priscillian, refusing to engage with existing episcopal legal practices and inventing a new strategy to survive the threat of Roman law. Chapter Four shows how Ambrose further refined this strategy in other conflicts and in doing so created a new place for bishops within the power structures of the Roman Empire.

A mi-chemin entre histoire locale et régionale, le présent travail entend revisiter l'histoire de la proscription du catholicisme en Chine, en Corée et au Japon depuis le XVIIe jusqu'au XIXe siècle. La répression de cette religion dépasse à nos yeux l'idée d'un supposé choc culturel entre deux civilisations antithétiques, celles de l'Europe et l'Asie. Notre idée-force est que la trajectoire adoptée par le catholicisme en Asie orientale fut aussi et surtout le résultat de relations bien plus complexes entre la Chine, la Corée, le Japon, les missionnaires européens et leurs fidèles. L'attitude des élites intellectuelles et politiques à l'égard de cette religion découlait non seulement de problèmes intérieurs au sein de chaque État, mais aussi d'influences réciproques et de perceptions particulières des mesures antichrétiennes adoptées dans les pays voisins. Placées sous le signe de l'histoire croisée, ces considérations nous permettront d'envisager une histoire régionale du catholicisme en Asie orientale et d'illustrer la dynamique des échanges dans cette aire culturelle sinisée
Situated between local and regional history, this dissertation aims to rethink the proscription of Catholicism in China, Korea and Japan from the seventeenth to the nineteenth century. In our view, the repression of this religion goes beyond the idea of a supposed clash of civilizations between two antithetical civilizations, Europe and Asia. Our main idea is that the historical trajectory of Catholicism in East Asia was merely the result of much more complex relations involving China, Korea, Japan, Western missionaries and local converts. The attitude of intellectual and political elite~ toward this religion resulted not only from domestic issues, but also from reciprocal influences and particular perceptions of antichristian measures adopted in neighboring countries. Placed under the banner of crossed history, these considerations will allow us to consider the history of Catholicism in East Asia as a whole, and to illustrate the dynamics of exchanges within this sinicized cultural area

Cette thèse propose une analyse des dispositifs publics de protection de la jeunesse face aux médias et de leurs évolutions, en France, de 1949 à 2002. Elle offre ainsi une contribution aux analyses de la censure et vise à rendre compte des conditions de définition et de transformation des modalités de l'interventionnisme symbolique de l'Etat. Deux dispositifs y sont principalement étudiés: la loi du 16 juillet 1949 sur les publications destinées à la jeunesse et la signalétique télévisée mise en place par le CSA et les chaînes depuis novembre 1996. L'hypothèse défendue est celle d'une euphémisation de la censure, produite par les évolutions spécifiques des configurations sociales au sein desquelles le contrôle des contenus est conçu et mis en oeuvre. Les logiques de l'évolution renvoient donc aux contextes politiques, sociaux, économiques et institutionnels du contrôle. Cette hypothèse s'appuie sur l'exploitation de matériaux écrits et d'entretiens et une observation ethnographique
This study offers an analysis of the public systems of protection of youth from the media and of their evolutions, in France, from 1949 to 2002. Il thus contributes to the analyses of censorship and gives an account of the conditions of definition and transformation of the methods of the symbolic interventionism of the State. Two systems are specifically studied: the law of July 16" 1949, on publications for children and adolescents, and the television "signalétique" implemented by the Conseil Supérieur de l'Audiovisuel (CSA) and the national channels since November 1996. The main argument here is the euphemisation of censorship, resulting from evolutions specific to the social configurations in which the control is conceived and implemented. Therefore, the logics of the evolution are linked to the political, social, economic and institutional contexts of the control. This argument is based on the use of written materials, interviews and an ethnographic observation

L’accession de la reine Hatchepsout à la royauté durant le règne d’un autre roi, Thoutmosis III, dont elle est la régente est en tout point remarquable puisqu’elle aboutit à l’existence de deux co-rois contemporains. L’exceptionnalité de la situation offre un prisme singulier permettant d’identifier des mécanismes iconographiques et phraséologiques liés à l’expression de l’identité royale en Égypte ancienne. Un examen critique des abondants vestiges de cette période et une nouvelle lecture des principales inscriptions à caractère politique de la reine conduiront à formuler une série d’hypothèses relatives au déroulement et aux motivations de cette prise de pouvoir. Une nouvelle datation pour les premières attestations d’hostilité vis-à-vis de la mémoire de la reine sera également proposée à la lumière de découvertes récentes faites dans le temple de Karnak. La question du rapport de la reine à son histoire sera également examinée et les soupçons de manipulations historiques liées à sa « corégence fictive » avec son père, roi défunt, écartées. La confrontation des éléments relatifs à l’expression de l’identité du roi au début de la XVIIIe dynastie issus du corpus phraséologique réuni dans ce travail avec la documentation historique du règne d’Hatchepsout nourrira la réflexion engagée sur la définition des éléments qui fondent la légitimité d’un individu à être roi
The accession of queen Hatshepsut as king during the reign of another king for whom she was regent, Thutmosis III, is remarkable in all respects since it resulted in co-rulers. This unparalleled situation offers a unique opportunity to identify the iconographic and phraseological mechanisms that could be mobilised in the expression of royal identity. Critical examination of the historical evidence from this period, including new readings of Hatshepsut’s main political inscriptions, leads to a number of new hypotheses for understanding this process and the underlying motivations. The suggested date for the first attested hostility toward the queen’s memory is challenged in light of recent discoveries in the temple of Karnak. Questions relating to how Hatshepsut’s history was presented are discussed, and her “fictitious co-regency” with her father Thutmosis I is dismissed. A corpus of expressions of royal identity from the early eighteenth dynasty is compared with the historical documentation from Hatshepsut’s reign, offering new perspectives on how individual royal legitimacy could be defined

A travers l’exemple de la commercialisation du gibier sur les marchés de Libreville, cette recherche vise à déconstruire les deux imaginaires contradictoires qui mobilisent plusieurs catégories d’acteurs multi-situés dans les problématiques respectives de la consommation et de la protection animales. Comme telle, elle se propose de réévaluer les modèles culturels applicables aux rapports de l’homme à l’animal, et à leurs transformations historiques dans le contexte du Gabon contemporain. Ce contexte est notoirement marqué par la confrontation frontale de conceptions et comportements endogènes opposables à des prescriptions conceptuelles et comportementales exogènes. Le but de notre étude est de montrer qu’à une vision dualiste sommaire entre tenants de la consommation animale et tenants de la protection animale, il convient de substituer une analyse beaucoup plus fine des positions des uns et des autres sur l’échiquier des rapports institutionnels et culturels à l’animal qu’il est permis ou au contraire interdit de chasser. Ces rapports se traduisent par des savoirs et des savoir-faire sur l’animal qui semblent passer à certains moments de la totémisation à la marchandisation, sans que l’on sache clairement dans quels cas l’animal est considéré comme sujet ou comme objet de connaissance et d’action. Il importe donc de développer un travail circonstancié des imaginaires en contexte dans le jeu des acteurs d’un pays confronté tout à la fois à des questions de réponses alimentaires, de développement durable, et de conservation des espèces fauniques de ses écosystèmes forestiers
Through the example of the marketing game market in Libreville, this research aims to deconstruct the two imaginary contradictory that mobilize several categories of actors located in multiple issues of the respective consumer and animal protection. As such, it proposes to reassess the cultural models applicable to man's relationship to animals, and their historical transformations in the contemporary context of Gabon. This context is well marked by the confrontation of ideas and behaviors front endogenous binding requirements to conceptual and behavioral exogenous. The aim of our study is to show that a dualistic view summary between advocates of animal feed and animal protection advocates, should be replaced by a more detailed analysis of the positions of each other on the chessboard reports institutional and cultural to the animal that is permitted or otherwise not hunt. These reports are translated into knowledge and expertise on the animal who seems to spend some moments in the commodification totemisation, not as we know clearly where the animal is considered as subject or object knowledge and action. It is therefore important to develop a detailed work of imaginary context in the acting of a country faced at the same time answers to questions of food, sustainable development and conservation of wildlife in its forest ecosystems

TITLE: YOUR WORLD OFFENDS ME: A STUDY OF DISCOUNTING SENSITIVE SOCIETAL PROSCRIPTIONS MAJOR PROFESSOR: Dr. Mark R. Dixon The present study used delay, probability and social discounting procedures to determine relationships of impulsive choice behaviors pertinent to relevant attitudes on sex, religion, and politics. Participants were presented with discounting choices in reference to hypothetical monetary outcomes coupled with separate metrics for measuring religious attitudes, political attitudes, and sexual attitudes. Thirty-three participants took part in the study; however, the data from 9 participants were excluded based on a priori exclusion criteria. The data showed there was significant relationship between AUC and sexual attitudes on the birth control subscale (n(24)=.047, p<.05). A significant relationship was also shown between delay k and communion (n(24)=.017, p<.05). A significant relationship was shown between social AUC and permissiveness (n(24)=.036, p<.05). The relationship indicates that sexual attitudes are correlated at a steeper level of discounting than with political attitudes and religious attitudes. Significant relationships were also shown between various attitudes with implications for further understanding of impulsivity and attitudes.

Abstract:
Conventional interpretations agree that Islamic jurisprudence officially prohibits adoption. Anthropologists have thus tended to presume that adoption does not exist in the Muslim world. This dissertation explores a conflicted and complex array of practices--extra-legal, illegal, customary, and religiously valorized--that fill the lacuna which official proscription leaves open. It focuses particularly upon two such practices: secret adoptions, which are considered a criminal activity and therefore create a fragile legal fiction of family continuity; and kafala (tutelage-fostering) which is religiously encouraged but creates an equally fragile family unit in which there is no continuity. The dissertation further addresses the failure of the one legal practice (kafala) to absorb the rapidly increasing number of "illegitimate" and unwanted children, and the consequent emergence of what has recently been identified as a national crisis: that of abandoned children. The dissertation explores legal, historic, literary, sociological, and administrative literature, and is based on field research combining interviews and participant volunteering. I examine adoption as a practice and juxtapose legal apparatus, state and bureaucratic edifice, the world of development and philanthropy, individual and family stories, and elements of the cultural repertoire to depict the highly fluid world of secret adoptions and kafala within Moroccan society. Through adoptions, kafala, and abandoned children, this dissertation analyzes core symbols and institutions in Moroccan society--family, state, social politics, affect--and performs a cultural critique of their internal mechanisms.

Abstract:
The regulation of the market conduct of dominant firms is an entrenched part of the competition laws in many jurisdictions. The conduct which such laws proscribe has been variously described as "abuse of dominance", "anticompetitive conduct", "monopolization" or "improper use of market power". Each description is used by way of contrast to "normal competitive conduct". In all jurisdictions the courts have experienced considerable difficulty in articulating the distinction between lawful competitive behaviour and unlawful market rivalry, principally because both may exclude rivals and lead to concentrated markets, and the same conduct may be competitive or anticompetitive depending upon context. We argue, based upon an understanding of competition as a dynamic process (a cycle of innovation and imitation), driven by rivalry between firms in which the possibility of achieving dominance is a necessary element of the dynamic, that there is no market conduct unique to dominant firms that is socially undesirable. Rather, the prospect of dominance motivates all firms to pursue either competitive or rent seeking strategies to secure the supra-normal profits attendant to a dominant position. Competitive strategies are socially desirable as they seek to meet (or influence) consumer needs and thereby promote total welfare. Rent seeking strategies are undesirable as their purpose is to prevent other firms from meeting (or influencing) consumer needs and thus represent investments in the distribution rather than the creation of wealth. We propose the rejection of existing laws, which require proof of dominance, and their replacement by a law which proscribes rent seeking by all firms. We contend that such a law would articulate with greater precision the distinction between desirable competitive behaviour and unlawful rivalry providing the courts with improved direction as to the evidentiary enquiry to be undertaken when a complaint of anticompetitive conduct is made. It would also relieve dominant firms from the vagaries of the uncertainties inherent in the existing approach to the regulation of market conduct associated with dominance.
