Abstract:
This Spring 2021 issue of Historical Reflections/Réflexions Historiques is about cultural heritages and their transmission, focusing on the period from the middle of the eighteenth century to the present. An important stimulus for the creation of the issue was the European Year of Cultural Heritage (EYCH) in 2018. There were four main themes for the EYCH: protection, engagement, sustainability, and innovation. National coordinators and local organizers of events and initiatives across the continent adopted the unifying slogan “Our Heritage. Where the past meets the future.” The articles brought together here serve as an invitation to readers to continue reflecting on subjects and questions that were at the heart of planning for and supporting public participation in EYCH 2018. The European Year of Cultural Heritage provided myriad opportunities to discover the roles played by individuals and groups in the preservation and valorization of natural sites and landscapes, public monuments, cultural institutions, artifacts, digital resources, and intangible cultural heritage. It highlighted educational initiatives to raise awareness of multiple, diverse cultural heritages within communities and to promote intercultural dialogue. It pushed governments and nongovernmental organizations to address matters of financial investment, legal accountability, partnership management, and the shaping of policies on conservation and ownership rights. It challenged professional historians as well as archivists, librarians, archeologists, conservators, and curators to think hard about widening access and about ways of integrating local, national, and international perspectives when communicating with audiences about surviving traces of the past.

Abstract:
Cet article examine les facteurs de production des risques dits « naturels » dans les grandes villes du Cameroun. D’une approche historique, il ressort que l’établissement d’agglomérations dans des sites d’aménagement difficile est à la base du problème. Le manque de ressources ainsi que la forte croissance démographique qui caractérisent les pays les moins avancés (PMA) en général et le Cameroun en particulier sont du point de vue anthropique les causes de la forte sensibilité aux risques naturels. Il se pose aussi le problème de l’ambiguïté du système foncier qui n’aide pas à la maîtrise de l’espace. L’incapacité des autorités et de la protection civile à gérer l’espace urbain consolide la vulnérabilité. Les changements climatiques diminuent la perception et l’acceptation des risques par les populations et augmentent leur fréquence.

Depuis, plus de 260 édifices ont reçu la désignation d’édifices historiques et sont, à cette fin, protégés en vertu de la loi. En 2003, la province a lancé sa participation officielle à l’Initiative des endroits historiques, qui a pour mandat de promouvoir et de reconnaître les endroits historiques désignés par la province et par les municipalités. Cet exposé présente le programme de protection des lieux historiques de la Nouvelle-Écosse et aborde la manière dont la province a contribué à la mise en place de l’Initiative des endroits historiques, qui est une initiative pancanadienne.

Résumé Benjamin Sulte (1841-1923) a été un historien notoire du Canada français. Pendant soixante ans, ce fonctionnaire et érudit autodidacte a écrit plusieurs milliers d'articles et une trentaine d'ouvrages, tout en participant aux délibérations des principales sociétés savantes de son époque, notamment la Société royale du Canada. Mais il s'est aussi investi dans la commémoration sociopolitique, soit comme initiateur de comités pour l'érection de monuments, soit comme membre fondateur de la Société des sites historiques et de la Commission des lieux et monuments historiques du Canada. Sulte a donc été partie prenante à la fois de l'institutionnalisation des sciences historiques et de l'utilisation commemorative de l'histoire. Le témoignage de Sulte montre comment se sont enchevêtrées à leur origine ces deux pratiques aujourd'hui reconnues comme distinctes.

La situation, plutôt préoccupante, dans laquelle se trouvent actuellement les monuments et les sites historiques du monde, incite tous les acteurs dans ce domaine à fournir un effort particulier pour pallier aux problèmes de la préservation du patrimoine existant, et à développer de nouvelles méthodes de conception, de sauvetage et de sauvegarde assurant une plus grande stabilité et durabilité de ces ouvrages. C'est dans ce cadre que s'intègre la présente étude. Un panorama des phénomènes qui conduisent à leur dégradation est abordé et s'attache à établir les liens entre les désordres constatés sur les monuments et les facteurs d'environnements. Le développement des dégradations ne peut être dissocié du rôle permanent joué par l'eau salée, qui est le principal vecteur des agents destructeurs. La diminution de la perméabilité des matériaux représentés dans ce cas est un facteur déterminant à atteindre dans le cas d'un traitement préventif ou curatif. L'objectif du procédé vise à traiter les matériaux fragiles ou fragilisés en améliorant la consolidation et/ou en réduisant la perméabilité. [. . . ]

Cette recherche est consacrée aux pratiques de protection des monuments à Athènes, et ce depuis l’Indépendance. Elle est ainsi associée à une analyse précise de la législation, des débats qui l’ont accompagnée et des pratiques de sauvegarde des monuments historiques et des sites archéologiques de la capitale. Ce travail espère contribuer ainsi à une meilleure connaissance de l’évolution de la notion de patrimoine en Grèce. Une évolution qui est ponctuée par les évènements politiques qui ont mené à la construction de l’État grec pendant tout un siècle, mais aussi par les différentes ratifications des conventions européennes et internationales relatives à la protection du patrimoine. Cependant, la traduction de ces instruments normatifs s’avère contraignante dans un pays où l’héritage culturel est associé essentiellement aux témoignages matériels conformes à l’histoire nationale. Le régime patrimonial grec s’orchestre de ce fait, non sans difficultés, à une notion de patrimoine en perpétuelle évolution. Cet héritage qui était un bien national à l’image d’un peuple homogène héritier de la Grèce antique et de l’Empire byzantin devient aujourd’hui synonyme de legs diversifiés et produits de différentes « communautés ». This research is devoted to the practical conservation of monuments in Athens since Independence. It is thus associated with a precise analysis of the legislation, debates that accompanied it, as well as practical conservation of historical monuments and the capital of archaeological sites. This work hopes to contribute to a better understanding of the evolution of the concept of heritage in Greece. This evolution is punctuated by political events that led to the construction of the Greek State for a whole century, but also by the different ratifications of European and international conventions concerning the heritage protection. However, the translation of these normative instruments proves compelling in a country where cultural heritage is associated primarily with material evidence in accordance with the national history. Greek patrimonial regime orchestra thus not without difficulty, to a notion of heritage in constant evolution. This legacy was a national asset for the image of a homogeneous people heir of ancient Greece and the Byzantine Empire now becoming synonymous with diverse legacies and products of different "communities". Préoccupation du pouvoir politique depuis la Révolution française, le monument historique est au service de la construction de la Nation.L'Etat impulse, sous la Monarchie de Juillet, une véritable politique publique animée par une administration spécifique dotée de moyens financiers et d'un corpus législatif et réglementaire. Cette politique a conduit à une véritable étatisation du patrimoine culturel à travers les monuments historiques, les monuments naturels et les sites, puis le patrimoine urbain (secteurs sauvegardés). Cette centralisation étatique a rapidement montré ses limites et ses lacunes : l'importance des moyens financiers nécessaires et la lourdeur de l'action étatique ont alors poussé à rechercher d'autres voies. L'ampleur de la tâche, sans cesse accentuée par l'élargissement du champ patrimonial, et l'émergence du principe de subsidiarité, ont conduit l'Etat à associer les collectivités territoriales à cette mission d'intérêt public, puis à organiser progressivement certains transferts de compétences. Les collectivités territoriales ont également pris conscience de l'importance de leur patrimoine comme symbole identitaire et source de développement. Dans le même temps les citoyens en ont mesuré l'intérêt dans leur environnement quotidien. Dans cette évolution qui amène l'Etat à se recentrer sur ses fonctions régaliennes et les collectivités territoriales à assumer des responsabilités patrimoniales, l'équilibre demeure difficile à trouver, d'autant que l'exigence de démocratie participative implique d'associer plus étroitement les citoyens à cette politique publique patrimoniale.

Cette thèse vise à démontrer comment le patrimoine au Canada émerge dès le début du 20ème siècle d'une tension entre la volonté politique de construire une identité nationale, et une pression économique qui pousse les autorités à développer le tourisme international. L’étude porte sur l'action partagée de la Commission des lieux et monuments historiques du Canada, la première et principale institution patrimoniale canadienne, et des organismes de tourisme, notamment de l’Association canadienne de tourisme et de l'Office du tourisme du Canada. Créée en 1919, la Commission possède le mandat d'identifier les sites, les personnages et les événements d'importance nationale qui doivent être commémorés, protégés et conservés par le gouvernement fédéral. Faute de moyens, elle doit limiter son action à l'érection de mémoriaux sur lesquels elle accroche des plaques commémoratives. Au tournant de la Seconde Guerre mondiale, l'essor fulgurant du tourisme transforme les sites historiques en attractions touristiques et pousse le gouvernement fédéral à considérer le problème de leur lente dégradation. Les organismes de tourisme font pression sur les institutions fédérales pour qu’elles réalisent que derrière les plaques, les sites du pays dépérissent. Grâce à leur militantisme, la première loi de conservation de bâtiments historiques du pays est votée en 1953, et elle est suivie, en 1955 et 1956, de plusieurs décisions qui marquent durablement le milieu de la conservation historique. Cette étude montre donc que le tourisme ajout un rôle aussi important que les politiques publiques dans la sauvegarde de l’architecture et dans les processus publics de reconnaissance du patrimoine
The aim of this thesis is to demonstrate that Canadian heritage policies and practices emerge, at the very beginning of the century, largely as the result of a tension between the political will to construct a national identity and economic concerns that encourage the government to invest into international tourism. The following study will examine the joint actions of the Historic Sites and Monuments Board of Canada, the first and main heritage institution in Canada and of tourist organizations, particularly the Canadian Tourism Association and the Canadian Government Travel Bureau. Created in 1919, the Board holds the mandate to identify sites and important national events, which require commemoration, safeguarding and protection by the government. However, lacking financial resources, the Board's action was limited to the establishment of monuments and plaques at historical sites and to the commemoration of historical heroes and events for the country's inhabitants and tourists. Shortly after the Second World War, Canada experienced a sharp increase in tourism. These historical sites were transformed into tourist attractions, which prompted the federal government to acknowledge the problem caused by the slow degradation of the sites due to neglect. The activism of tourist organizations led to the establishment of the first Historic Sites and Monuments Act in 1953, followed by other legislation in 1955 and 1956. This study contends, then, that tourism has played a role as important as public policies in safeguarding historical architecture and in raising public awareness to heritage

La présente thèse s'efforce de prouver l'influence grandissante du droit communautaire et de celui du Conseil de l'Europe, aussi dans une approche de droit comparé, sur un thème qui de prime abord relève des droits nationaux des États membres de l'UE. Cependant, les notions dynamiques de l'environnement et du développement durable, qui couvrent aussi le patrimoine culturel, fait naître de nouvelles pistes de réflexion sur la prise en compte suffisante de la particularité de ce patrimoine. Le droit de la concurrence au sein de l'UE rend encore plus problématique l'invocation d'une «exception culturelle» généralisée, tandis que le 'rapprochement' des législations nationales d'urbanisme, d'aménagement du territoire et de celles fiscales sur le patrimoine culturel a beaucoup de chemin à parcourir. Le travail effectué par le Conseil de l'Europe a grandement contribué à poser de hauts standards de protection et de valorisation du patrimoine culturel.

Le projet de cette thèse est d’analyser l’utilisation des techniques d’information et de communication dans des sites des Guerres mondiales (Verdun, la Somme, la Normandie, le Vercors, l’Alsace, Oradour-sur-Glane). Leur insertion récurrente, à partir des années 1990, a participé à la transformation des paysages mémoriels. Les sites sont progressivement mis en communication par de nouvelles structurations des territoires, des stratégies d’image, une redéfinition de l’exposition et une architecture utilisée comme media. Ces différents niveaux de modification influent sur la perception de ces espaces qui jouent sur les ressentis des visiteurs et la reconstitution des événements historiques. Les techniques d’information et de communication installent une médiation entre le visiteur et ses perceptions. Cette recherche a également permis de souligner le jeu complexe du passé/présent. Ces techniques sont des marqueurs du présent et elles ont dû s’agencer avec le passé
The objective of this thesis is to analyse the use of information technologies in the locations of the World Wars (Verdun, the Somme, Normandie, Alsace, the Vercors, Oradour-sur-Glane). Their recurrent insertion since the 1990s has participated in the transformation of memorial sceneries. The locations are gradually communicated by new structuring of territories, image strategies, a redefinition of exposure, and architecture used as a media. These different levels of modification influence the perception of these spaces and play on visitors experiences and the reconstitution of historical event. The information and communication technologies provide a mediation between the visitor and their perceptions. This research has also allowed us to underline the intricate game of past/present. These technologies are representative of the present and yet they had to combine with the past

Cette recherche se fonde sur l’hypothèse que l’ensemble des lois et règlements qui assurent la protection et la conservation des monuments historiques constitue un modèle, c’est-à-dire un système cohérent de règles se référant à des principes et des fondements dont l’origine, datée par l’Histoire, est sociétale et philosophique. La question étant alors d’apprécier la validité et la solidité du modèle en regard de l’évolution de notre droit positif. C’est pourquoi la première partie de la thèse examine l’histoire de la construction du modèle depuis ses fondements intellectuels nés sous les Lumières et la Révolution, sa construction pragmatique par l’administration du XIXème siècle, sa consécration par la loi de 1913 qui tient compte de l’esprit de toutes les grandes lois de la République et notamment du bouleversement induit par la loi de séparation de l’Eglise et de l’Etat et, finalement, de sa refondation théorique et intellectuelle par André Malraux et les doctrines du Ministère de la Culture. Durant cette période de construction, le modèle s’est enrichi de concepts nouveaux comme celui de la protection des abords et s’est affranchi des querelles de l’histoire de l’art, optant pour une conception intransigeante de la conservation qui est la cause de la protection des monuments et non l’inverse. Or, et c’est la seconde partie de la thèse, il semble qu’aujourd’hui, le concept de patrimoine tend à transformer l’objet juridique monument historique en donnant la priorité à la protection et à la mise en valeur des monuments sur leur conservation. L’évolution des idées, sous l’influence de la mondialisation et des autres modèles européens, d’une part, et la décentralisation qui tend à reporter sur les collectivités territoriales et leurs propriétaires le soin des monuments, sont porteurs du risque de réduction des protections à un label, ce qui condamnerait le modèle patiemment construit. L’examen des décisions du juge mis « au pied du monument », marquées par l’hésitation et des positions contradictoires, conforte ce sentiment d’une ruine possible d’un modèle qui paraît topique de tous les modèles juridiques créés par la tradition républicaine depuis plus d’un siècle pour répondre aux questions sociales, économiques et culturelles de la société française. Relire le modèle pour l’adapter à notre époque, c’est donc s’interroger sur les valeurs fondamentales qui doivent présider à sa confirmation
This research bases itself on the assumption that all the laws and regulations which ensure the protection and preservation of historical monuments constitutes a model, that is to say a coherent system of rules referring to principles and foundations whose origin, dated by the History, is societal and philosophical. The question being then to assess the validity and the strength of model in the light of the development of our positive law. That is why the first part of the thesis examines the history of the construction of the model since its intellectual foundations born under the Lights and the Revolution, its pragmatic construction by the administration of the nineteenth century, its consecration by the law of 1913 which takes account of the spirit of all the major laws of the Republic and in particular of the disruption induced by the law of separation of Church and State and, finally, of its theoretical and intellectual reorganization by André Malraux and doctrines of the Ministry of Culture. During this period of construction, the model is enriched of new concepts such as the protection of the approaches and is freed of quarrels of the history of art, opting for a design intransigent conservation, which is the cause of the protection of monuments and not reverse. The second part of the thesis is based on the idea that, as it seems today, the concept of heritage tends to transform juridical object of historical monuments in giving priority to the protection and the development of monuments on their conservation. The evolution of ideas, under the influence of globalization and the other European models, and the decentralization which tends to defer on territorial authorities and their owners the care of monuments, include risk reduction of protections to a label, which would condemn the model patiently built. La présente thèse, portant sur la protection du patrimoine architectural à la croisée des droits de l'urbanisme et du patrimoine obéit à une construction simple et claire (Partie I : les normes de protection du patrimoine et, partie II : leur sanction aux travers des procédures d'autorisation et de déclaration des travaux). Elle se propose de revenir sur l'analyse de la protection du patrimoine architectural par les droits de l'urbanisme et du patrimoine en vue de mettre en lumière les grands équilibres, tant entre les nombreux instruments juridiques spécifiques qui existent à cette fin qu'entre les acteurs qui y concourent (Etat et collectivités territoriales). Sa dimension professionnelle assumée (thèse financée par le dispositif CIFRE et réalisée au sein d'un cabinet d'avocats) lui permet de renforcer l'analyse juridique classique au moyen d'illustrations tirées de la pratique quotidienne de ces deux droits et, le cas échéant, de formuler des propositions d'amélioration des dispositifs existants. Elle s'emploie également à souligner le deséquilibre de la protection de l'esthétique sur le territoire français entre les centres historiques, très protégés et les périphéries urbaines, souvent laissées à l'abandon. Unanimement saluée par le jury comme présentant un réel intérêt scientifique en raison de l'éclairage précieux et inédit qu'elle apporte sur la question, cette thèse a fait l'objet d'une autorisation de publication en l'état
The plan of this thesis which deals with the protection of architectural heritage analysed though planning law and heritage law is clear and simple. (Part I : standards of architectural protection, and part II : the sanctions due to licence and declaration procedures in relation with a construction work). Its main purpuse is to analyse the protection of architectural estate thanks to planning and patrimony legislation in order to enlighten the main lines between the numerous specific legal elements that already exist in that purpose, and the contributing characters (the State and territorial authorities). For the doctoral thesis was realized in a professional contexte (it was financed by the French Ministry of Education through the "CIFRE" programme and realized in a law firm) the usual legal analysis of the issue was intensified thanks to the daily practice of cases of the law in question. The thesis also suggests improvements to the already existing law. Another of its lines is the emphasis on the imbalence in the conservation of the design on the french territory between highly protected historical sites and often forgotten urban suburbs. The jury was unanimous in thinking the thesis represents a real scientific interest, for this analysis of the subject is valuable and has previously not been studied. It received an authorization to be published without necessary modifications
