Full textThis research is devoted to the practical conservation of monuments in Athens since Independence. It is thus associated with a precise analysis of the legislation, debates that accompanied it, as well as practical conservation of historical monuments and the capital of archaeological sites. This work hopes to contribute to a better understanding of the evolution of the concept of heritage in Greece. This evolution is punctuated by political events that led to the construction of the Greek State for a whole century, but also by the different ratifications of European and international conventions concerning the heritage protection. However, the translation of these normative instruments proves compelling in a country where cultural heritage is associated primarily with material evidence in accordance with the national history. Greek patrimonial regime orchestra thus not without difficulty, to a notion of heritage in constant evolution. This legacy was a national asset for the image of a homogeneous people heir of ancient Greece and the Byzantine Empire now becoming synonymous with diverse legacies and products of different "communities". Full textThe aim of this thesis is to demonstrate that Canadian heritage policies and practices emerge, at the very beginning of the century, largely as the result of a tension between the political will to construct a national identity and economic concerns that encourage the government to invest into international tourism. The following study will examine the joint actions of the Historic Sites and Monuments Board of Canada, the first and main heritage institution in Canada and of tourist organizations, particularly the Canadian Tourism Association and the Canadian Government Travel Bureau. Created in 1919, the Board holds the mandate to identify sites and important national events, which require commemoration, safeguarding and protection by the government. However, lacking financial resources, the Board's action was limited to the establishment of monuments and plaques at historical sites and to the commemoration of historical heroes and events for the country's inhabitants and tourists. Shortly after the Second World War, Canada experienced a sharp increase in tourism. These historical sites were transformed into tourist attractions, which prompted the federal government to acknowledge the problem caused by the slow degradation of the sites due to neglect. The activism of tourist organizations led to the establishment of the first Historic Sites and Monuments Act in 1953, followed by other legislation in 1955 and 1956. This study contends, then, that tourism has played a role as important as public policies in safeguarding historical architecture and in raising public awareness to heritage

Full textThe objective of this thesis is to analyse the use of information technologies in the locations of the World Wars (Verdun, the Somme, Normandie, Alsace, the Vercors, Oradour-sur-Glane). Their recurrent insertion since the 1990s has participated in the transformation of memorial sceneries. The locations are gradually communicated by new structuring of territories, image strategies, a redefinition of exposure, and architecture used as a media. These different levels of modification influence the perception of these spaces and play on visitors experiences and the reconstitution of historical event. The information and communication technologies provide a mediation between the visitor and their perceptions. This research has also allowed us to underline the intricate game of past/present. These technologies are representative of the present and yet they had to combine with the past

Full textThis research bases itself on the assumption that all the laws and regulations which ensure the protection and preservation of historical monuments constitutes a model, that is to say a coherent system of rules referring to principles and foundations whose origin, dated by the History, is societal and philosophical. The question being then to assess the validity and the strength of model in the light of the development of our positive law. That is why the first part of the thesis examines the history of the construction of the model since its intellectual foundations born under the Lights and the Revolution, its pragmatic construction by the administration of the nineteenth century, its consecration by the law of 1913 which takes account of the spirit of all the major laws of the Republic and in particular of the disruption induced by the law of separation of Church and State and, finally, of its theoretical and intellectual reorganization by André Malraux and doctrines of the Ministry of Culture. During this period of construction, the model is enriched of new concepts such as the protection of the approaches and is freed of quarrels of the history of art, opting for a design intransigent conservation, which is the cause of the protection of monuments and not reverse. The second part of the thesis is based on the idea that, as it seems today, the concept of heritage tends to transform juridical object of historical monuments in giving priority to the protection and the development of monuments on their conservation. The evolution of ideas, under the influence of globalization and the other European models, and the decentralization which tends to defer on territorial authorities and their owners the care of monuments, include risk reduction of protections to a label, which would condemn the model patiently built. The review of decisions of the judge « driven to the wall of monument", marked by hesitations and contradictory positions, reinforces this feel of a possible ruin of a model which seems topical all legal models created by the republican tradition since more than a century to respond to social issues, economic and cultural of the French society. Reread the model to fit our times is therefore question the fundamental values that should govern its confirmation

Full textThe plan of this thesis which deals with the protection of architectural heritage analysed though planning law and heritage law is clear and simple. (Part I : standards of architectural protection, and part II : the sanctions due to licence and declaration procedures in relation with a construction work). Its main purpuse is to analyse the protection of architectural estate thanks to planning and patrimony legislation in order to enlighten the main lines between the numerous specific legal elements that already exist in that purpose, and the contributing characters (the State and territorial authorities). For the doctoral thesis was realized in a professional contexte (it was financed by the French Ministry of Education through the "CIFRE" programme and realized in a law firm) the usual legal analysis of the issue was intensified thanks to the daily practice of cases of the law in question. The thesis also suggests improvements to the already existing law. Another of its lines is the emphasis on the imbalence in the conservation of the design on the french territory between highly protected historical sites and often forgotten urban suburbs. The jury was unanimous in thinking the thesis represents a real scientific interest, for this analysis of the subject is valuable and has previously not been studied. It received an authorization to be published without necessary modifications

Full textIn France there are more than 44.236 listed buildings, whose diversity of architectural typolo-gies increased significantly these last decades (industrials buildings, modern constructions, etc.). However, this diversification will entail the loss of criteria specifying the monuments which are meant to be preserved. This doctoral thesis is thus focused on the processes of pat-rimonialisation and on selection rules of buildings considered for listing. To be precise, this study relates to the opposite fact: thereviews, the cancellations of protections and therefore the delisting of buildings, in France, since 1990. This research aims to highlight the intrinsic and extrinsic factors of delisting requests – a net increase, mostly in the city centres - and thus to get an overall picture of the situation on inheritance evolution and on process for listing or delisting

Full textThe “Caisse nationale des monuments historiques”, renamed “Centre des monuments nationaux” at the beginning of the XXIth century, was created in 1914, in a period of crisis for the Department of Historic Buildings in France, after the separation of churches and state. It was created as a public body like many others institutions during the same period in order to provide more money with flexibility; and it was transformed many times during the following decades. First, the institution was supposed to receive donations, legacies, and money from taxes, but finally it mainly received entrance fees that began to be collected after the War in historic buildings, and since the end of the 1920s, incomes from commercial activities. It discreetly provided money for the Department of Arts between the wars, but since the 1930s, World War II, and the 1950s, the institution has become more important because of the development of cultural tourism. After the creation of the Ministry of Culture, an important reform occurred in 1965, and the institution became in charge of the exploitation and presentation of historic buildings, in order to give them a second life. The administration grew progressively, new challenges appeared, and the relationships between the institution and the Ministry became sometimes difficult. This study deals about people, procedures, means, and results, in order to build the story of a cultural administration

Full textThe collection, the organization and the search for iconographic sources are certainly a main issue within the communities that are interested in the study, the conservation and the valorization of the architectural heritage. The organization and the structuring of these resources are an important problem if for researcher involved into the design of tomorrow's digital archives. Today, the most used method to classify and search iconographic contents within a database is the key words-based search. Nevertheless, the association between the research topics and the contents of images is not entirely developed. In particular, in the field of architectural documentation, according to the degree of complexity (in terms of wealth of information) and the heterogeneity (in terms of variety of supports and techniques of execution) of iconographic sources (photographs, drawings, paintings, etc), existing solutions for semantic annotation of images are ineffective. This thesis starts from the assumption that the interactive 3D model interactive can be an important support to access at the heritage information. In this direction, this work focuses on the use of the building's morphology representation as primary source to distribute/propagate semantic attributes on the whole of the iconographic sources (the 2D representations), which are under a condition of geometrical/spatial coherence with its three-dimensional model. A semantic description model (structuring the whole of terms which can describe the morphology of a building) is then used as common denominator in order to establish relations between the 3D representation of the architectural shapes that compose the building and the corresponding iconographic sources (collection of segmented 2D images). This work led to the definition and the development of an information system allowing visually search, within a 3D model, iconographic sources according to spatial, morphological and semantic criteria. This system is a Web application is usable by specialists in the field of architectural documentation as by the general public

Direct state intervention in the family came about in Great Britain by means of statutes withdrawing the child from his abusive family. Influenced by the evolution of British legislation, the Canadian common law provinces, Ontario in particular, adopted their own laws against child abuse relatively quickly. However, probably by reason of its existing social care network structure, the province of Quebec was much slower in contrast to adopt child welfare laws and recognizing the legal rights of the child.

Full textThis thesis focused on pollution by chlorinated solvents of alluvial systems. Chlorinated solvents have physicochemical characteristics that make their environmental evolution complicated. Two industrial sites, sill in activity, with a chlorinated solvents pollution problem are treated with a multidisciplinary approach. This approach can be summarized in four points : I) a summary of information and studies available at the beginning of the thesis ; II) a detailed analysis of the spatial and temporal variation of concentrations in the studied area ; III) further studies and works to better characterize the functioning of the aquifer system and pollution, in particular, in situ groundwater flow studies (multitracer) and field-laboratory studies of biodegradation of solvents and its possible stimulation by appropriate compounds ; IV) proposals for analysis and further action. This approach help us to define, for each site, a more detailed conceptual model of environmental (physical and biological) functioning and to make a first quantification of the processes that regulate the dissolved COHV becoming in space and time. Our results indicate that, in these two sites, the stimulation of the biodegradation activity of solvents, naturally occurring, could be an effective method for remediation of pollutions. This thesis demonstrates the need for a multidisciplinary approach to planning an appropriate method of treatment of such pollution

Full textAlthough it’s perfectly obvious that a company’s interest is subordinate to the interest of the associates who gave birth to it, and given that corporation law includes other legitimate interests - among which environment, it would nevertheless be untrue to confine the trading company to its profit making vocation. It comes down to a very simple question: how far is corporation law in the process of integrating environmental issues ? On one hand, the demand for environmental transparency imposes new regulations on companies in terms of communication. As far as our societal project is concerned, it seems that the openness of this information can be improved. When setting up a company, environmental information becomes a strategic issue if the set up involves either buying a polluted site, a listed installation or even a polluting business. Within this framework, the company is rather badly protected by information provision. The entry of environmental information has also attracted a lot of attention in corporate governance. Despite the fact that it is still insufficient, the information integrated in annual reports might lead to a change in management methods. Social performance pleads for replacing trading activities in a larger picture. This is the reason why we stand up for the opening of the social interest to the general interest that is environmental protection. On the other hand, the integration of environmental issues still clashes with corporate law specificities. The shield of legal personality, or corporate insolvency, makes it harder to deal with environmental backwardness. It prompts us to look for other ways to tackling these issues and integrating effectively environmental questions in the field of corporate law

Full textOnline social network sites have gained considerable importance in everyday life. Their use results in the unprecedented share of personal data : individuals from all over the globe share personal information in a quality and quantity never seen before. Employees and prospective employees are amongst users as well, which raises privacy and data protection issues specific to the context of employment. Although the “traditional” ways of employee monitoring, such as CCTV surveillance, monitoring of the use of Internet and e-mail, etc. are already regulated both at the international and at the national (French and Hungarian) level, the comprehensive regulation of social network sites with regard to the context of employment is yet to be elaborated. Social network sites have fundamentally influenced conceptions of privacy and data protection, resulting in the boundaries of work and personal life becoming increasingly blurred, both within and outside working hours. Yet, the processing of personal data obtained from social network sites increasingly raises the question of the protection of employees’ rights – particularly the protection of the right to privacy and the right to data protection. These rights must be balanced notably against the employer’s right to control and monitor, which ensue from the employer’s right to property (ensuring the equipment provided by the employer is used in accordance with the purpose of the employment relationship), the right to protect his/her economic interest (e.g. through ensuring productivity, the protection of reputation) and occupational safety and health (which confers obligations on the employer). Thus, the dissertation examines how the existing rules of labour law and of data protection law in France and in Hungary can be applied to social network sites and what the main challenge posed by them are, particularly in the phase of recruitment and during the use of social networks during and outside working hours. The main question to be answered by the dissertation is: in the light of the increasingly blurred boundaries, where should the balance be struck between the employees’ and the employer’s rights?
Az online közösségi oldalak jelentős szerepet játszanak a mindennapi életben. Használatuk során az egyének soha nem látott minőségben és mennyiségben osztják meg személyes adataikat, szerte az egész világon. A munkavállalók és a leendő munkavállalók szintén a felhasználók közé tartoznak, ami a foglalkoztatás kontextusában specifikus kérdéseket vet fel a magánélet és a személyes adatok védelme terén. Bár a munkavállalók megfigyelésének „hagyományos” módszereit, mint például a kamerás megfigyelést, az internet és az e-mail használatának megfigyelését, már mind nemzetközi, mind tagállami (francia és magyar) szinten szabályozzák, a közösségi oldalak foglalkoztatással összefüggő kimerítő szabályozása még kidolgozás alatt áll. A közösségi hálózati oldalak alapjaiban hatnak a magánéletre és a személyes adatok védelmére, aminek eredményeként a munka és magánélet határai egyre inkább elmosódnak, mind a munkaidőn belül, mind azon kívül. Ugyanakkor a közösségi oldalakról származó személyes adatok kezelése fokozottan felveti a munkavállalók jogainak védelmének kérdését – különös tekintettel a magánélet védelmére és a személyes adatok védelméhez való jogra. Ezeket a jogokat össze kell vetni különösen a munkáltató ellenőrzési és felügyeleti jogával, amely a munkáltató tulajdonhoz fűződő jogából (pl.: annak biztosítása, hogy a munkáltató által biztosított felszerelést a munkavállaló a munkaviszony céljának megfelelően használja), valamint a jogos gazdasági érdekeinek védelméből. (pl. produktivitás biztosítása, jó hírnév védelme) és a munkahelyi biztonság és egészségvédelemből (amely kötelezettségeket ró a munkáltatóra) következik. Következésképp, a disszertáció azt vizsgálja, hogy a Franciaországban és Magyarországon már létező munkajogi és adatvédelmi rendelkezések miként alkalmazhatók a közösségi oldalakra, és melyek az általuk felvetett legfőbb kihívások, különösen a munkaerőfelvétel, valamint a közösségi oldalak munkaidőben és azon kívül történő használata terén. A disszertáció által megválaszolandó fő kérdés az, hogy a fokozottan elmosódó határok fényében hol kell megtalálni az egyensúlyt a munkavállalók és a munkáltatók jogai között?

Full textThis study presents an analysis of the state of the Jordanian archaeological heritage and more particularly of the archeological site of Jarash in the North of Jordan. It has for objective the evaluation of the actions led for its development. How communities and the Jordanian State insures the integrity, the accessibility and the conservation of this remarkable site by the application of adequate measures of management, protection and touristic development. To reach this objective and to conceive a model of applicable evaluation in the Jordanian context and facilitating the archaeological development of sites, it was necessary to develop two areas of research. The first one allows examining the procedures of development of the historical heritage on an international scale and at the national level. The second axis corresponds to a case study, which express the acts of development of the archeological site of Jarash and the essential stages of the development regarding with the cultural and tourist development of the site of Jarash. The qualitative approach contributes, as for it to question the responsibility of the local public actors. A particular field study is based on interviews with the actors participating in the development and in the protection of the site. Two essential questions arise: -What is the importance granted to this magnificent romano-byzantine archeological site of Jarash by the local and governmental authorities in an essentially Muslim country? -How is this architectural heritage integrated into the cultural transmission between Jordanians' diverse generation. Full textThis thesis addresses the issue of the conservation of historic towns in central Iran, mostly built with raw earth materials. These have become ill-adapted to the evolution of society and inserted into a vast and dispersed modern urban fabric. The thesis reveals the close relationship between the historic town and its domestic architecture with the traditional society, family and social structure matters as well as the customs, ceremonies and festive rites that define the lives of urban populations. Heritage is clearly studied through the prism of history and the values of traditional society that aspires both to modernity and the preservation of its cultural heritage, thus dealing with conflicting and complex issues in the quest to incorporate heritage in a process of cultural and social evolution. Facing the development challenges posed by the modern city, the tourism industry and globalization, the preservation of cultural, social, economic, scientific and historic values in Iran and the transmission of a heritage that is highly exposed to degradation due to large mutations at different scales (architecture, city and territory), represent major challenges for today's Iranian society. Thus, the research analyzes the qualities of a heritage that has defined its character in a close and harmonious relationship with a desert environment. It demonstrates that it would be beneficial to take into full consideration a knowledge and know-how of proven high intelligence but now at risk of extinction, even though they remain fully relevant in view of the challenges of sustainable development today. This thesis illustrates the case of the city of Yazd, particularly representative of the issues covered by the research and at the heart of the paradox between urban development and conservation; it highlights the need for an integrated, holistic and multidisciplinary approach to the conservation of the historic towns of central Iran

Full textThe objective of this research is to understand and analyze the patrimonialization of historical monuments as a social process involving institutional, collective and individual actors. As the sequence by which certain goods acquire the heritage status, the patrimonialization begins with the attainment of patrimonial consciousness, then arrives to regulation of the field and finalizes in the concrete actions of classification and protection of cultural heritage. If the first stage unfolds in the long term and is diffuse, the last two ones, covering the official patrimonialization, are the object of specific actions of institutional actors, both at national and local level. The analysis of the legislation, the study of actors based on interviews and observation, conducted in the period 2006 - 2010, display the representations the actors are making about the historical monuments and the logics founding their actions. The Romanian patrimonialization will be grasped as an intertwined and effervescent process and the historical monument – as a notion incessantly negotiated and redefined

This thesis will explore what the U.S. Environmental Protection Agency's (EPA) direct and indirect roles should and could be in fostering place making for Superfund site redevelopment. The EPA manages the clean up of severely contaminated abandoned property under the Comprehensive Environmental Response Compensation Liability Act (CERCLA), a.k.a. the Superfund Program, in order to protect human health and the environment. These neglected places are often a blight to the surrounding communities, causing disinvestment and decay. Redevelopment of these abandoned sites is often difficult and plagued with challenging circumstances and uncertainties. Impediments to Superfund site redevelopment include fears associated with health risks and liability, uncertainty on the length of clean up time, lack of willingness of the property owner, and stigma. The revitalization of these sites is vital to improving the quality of life of the surrounding community and the region. The redevelopment design is a critical component of revitalization and needs to be thoughtfully constructed. Urban design goals should be geared towards enhancing the public realm, improving quality of life, and creating a sense of place. This is place making and should be inclusive and account for the needs of the occupants. EPA's current policies and tools under the Superfund Redevelopment Initiative do not achieve pace making results. Recommendation for change include the development of urban design principles and reuse planning guidance, providing education and training for both EPA staff and affected communities, shifting the expertise of the workforce, providing more funding for planning activities and changing legislative to incorporate regional environmental solutions.

Full textThe French parliament in 1930, standing from a text of 1906, has felt convenient to organize the preservation of naturel monuments and sites. This law has been extensively used in Aquitaine: 550 sites have been protected since 50 years. Two of the dispositions of this law are mere reproductions of the law on the preservation of historical monuments: the classification of sites. The third one, the protected zone around an historical monument or a site, has been only need 4 times in Aquitaine. The "protected zone" has been replaced, in 1983, by the "protected zone for architectural and rural patrimony". The regional study shows, though an exhaustive analysis of the field realities based on our 12 tiers classifications, the real impact of the 1930 legislation, and its limitations. The standard image of the protected site, the "rural landscape" counts only for 11% of sites. 18% have as main focus waters (lakes, rivers, ocean shores). Many sites are also centered on castles or villages. It would be logical to make the "service des sites" a section or the "direction du patrimoine" in the ministry of culture. A standardized inventory of sites would be also very useful. It would be good, finally, to promote the image of sites among the members of local councils and among the general population

Full textRwanda is a low income, landlocked and heavily populated country in Sub-Sahara Africa. Regardless of its majestic landscape, rich history and culture, it is not a country that is recognized as a tourism destination. Instead, Rwanda has become known for the genocide that took place in 1994 when over one million people were killed in within a hundred day period while the rest of the world watched in silence. Since then, Rwanda has been trying to uplift its image and economy. However, unlike other African countries, Rwanda does not have mineral resources and has to focus on improving its tourism to attract more people and thereby more funds into the country. Developing tourism can play a major role in reducing the poverty level, creating employment as well as contributing to the country’s revenue. So far Rwanda has strongly relied on its famous mountain gorillas to attract tourists which can be an expensive exercise for tourists in Rwanda. By creating a more diversified number of attractions, the number of tourists to the country should increase thereby injecting much needed capital into the economy. After the 1994 genocide, Rwanda inherited several genocide sites that have been preserved by government to remind people of the massacre that took place. Even though these sites are not used for tourism gain, they are acquiring popularity as tourists to Rwanda become aware of them and the history applicable thereto. This study has been undertaken to find ways to conserve, protect and market the genocide memorial sites as tourism destinations. It is important that these heritage museums be acknowledged through the World Heritage Organisation as authentic and educational facilities for future generations to enjoy. The research project was conducted in the Kigali and Bugesera areas. A sample of three hundred and sixty (360) questionnaires was given out to participants, and a total of a hundred and fifty-seven (157) were returned, coded and analysed. Data analysis applying descriptive statistics was utilised to acquire the frequencies, which were conveyed in percentages. The study disclosed that generally tourists were impressed by the genocide memorial sites and felt that it would be of great use to protect and market them as tourism assets as they believe that many people will learn from the harsh historical event that took place in Rwanda. This investigative study could strongly benefit Rwanda in planning and deciding on an appropriate tourism marketing strategy for the genocide memorial site. The Rwandan Government, policy makers and tourism stakeholders have a lot to gain by addressing the issues that are slowing down the tourism industry. It is anticipated that when these barriers have been removed, it will add toward sustainable tourism development in Rwanda.
