Full textThe aim of this dissertation is to re-construct the role of modern civil mediator and examine its content in terms of homogeneity, clarity and consistency. The first part of the dissertation focuses on socially constructed structural requirements of the role, the second is dedicated to the personal definitions of the role. Description of structurally imposed requirements of the role is based on the analysis of national law, ethical regulations created by the community of mediators and reference literature. Re-construction of the personal role definitions is based on dedicated exploratory research. The research shows that the structural requirements of the role might fall into two categories: role facilitations and role dilemmas. The requirements concerning the principles of mediation, rules of conduct and personal qualities of mediator are quite clear and unambiguous, and so they are categorized as a set of role facilitations. The requirements concerning mediator’s direct impact on mediation are significantly less clearly defined. As they are not clear, they are being categorized as role dilemmas. Dissertation describes many parallel narratives and theoretical conceptions featuring proper ways of helping the parties attain the goals of mediation. Nine most popular models of mediation are being presented in details that is: facilitative, evaluative, transformative, therapeutic, humanistic, structural, systemic and strategic. Additionally in further research there was also included an integrative model, that is an eclectic style encompassing presumptions, as well as tactics and tools from different models. The final choice of the particular model (one or more) creates an essential role dilemma. Socially required personal qualities of mediator might be divided into two categories: professional qualifications and personal traits affecting the course of mediation. The research shows that expectations are the same regardless of the mediator's nationality and profession. The most important personal characteristics seem to be: self-analysis skills, emotional competencies (specifically emotional intelligence and empathy), and multidimensional thinking. There are also two other important, though more controversial traits on this list: machiavellianism and directive (autocratic) communication style. Second part of the research aims at re-constructing the personal definition of the mediator’s role, including the role concept and role-playing. The Questionnaire of Mediation Map and Model was created for the purpose of the research. It enables identification of the philosophical map of mediation (role concept) and the applied model of mediation (role playing) as declared by the respondents). The results of the research prove that personal definition of mediator role is generally compatible with the structural definition. There is just one important difference connected with perceived goal of mediation: most of the mediators believe that mediation aim is not only a conflict resolution, but also some deeper change and transition in relation between the parties. Respondents taking part in the research played their role as mediators using only two mediation models described in the literature: facilitative mediation and therapeutic mediation. The most important discovery coming from the research is that mediators cannot correctly identify their own mediation style, less than half of them can identify and name their own model of mediation in terms of mediation theory. The results of the research show that even though some of the mediator role requirements are unclear and ambiguous, generally the mediator role seems to be homogenous and most certainly it is of the professional character. Research analysis confirms that mediators create a distinct and specific socio-professional group. Members of this group act according to particular norms and standards, observe common values and cultivate particular attitudes and behaviors.
