Both the field and the practice of public administration have been extraordinarily dynamic. While essential public services are not likely to disappear any time soon, the manner in which their administrative functions are carried out and evaluated is likely to change considerably. In a globalized world characterized by increasing uncertainty and growing expectations of demanding citizenry, the politics of budgetary austerity is pressing on public administrators at every level of government. They must think in radically different ways about what it means to govern in the 21st century. ‘The future of public administration’ predicts a future with new sets of challenges for the nation-state and its public administration systems.

This chapter concerns French administrative law. It examines the characteristic features and principal rules, procedures, and remedies related to administrative activities. The chapter also considers administrative law in its historical perspective and how this has led to a major structural distinction which has been applied in France since the 1789 Revolution the distinction between public and private ‘functions’. It is important to note that in the last decades, there has been a significant impact of EU law on the development of administrative law in the legal system of EU Member States, including France and the United Kingdom. In this respect, the common adoption by European states of general principles such as the principle of legitimate expectation and the principle of proportionality have had the effect of bringing the public law body of these countries closer together.

Abstract:
Contemporary public administration reflects its historical roots as well as contemporary ideas about how the public bureaucracy should be organized and function. This book argues that there are administrative traditions that have their roots centuries ago but continue to influence administrative behavior. Further, within Western Europe, North America, and the Antipodes there are four administrative traditions: Anglo-American, Napoleonic, Germanic, and Scandinavian. These are not the only traditions however, and the book also explores administrative traditions in Central and Eastern Europe, Latin America, Asia, and the Islamic world. In addition there is a discussion of how administrative traditions of the colonial powers influenced contemporary administration in Africa. These discussions of tradition and persistence also are discussed in light of the numerous attempts to reform and change public administration.

Modern, rationally structured, hierarchical state administrative bureaucracies coincided with the centralization of government authority and expansion of European imperialist military systems in the 18th and 19th centuries. ‘Progressive reform across the globe’ explains that the characteristics and dimensions of the modern nation-state helped lay the foundations of modern public administration and social welfare systems in America and Western Europe. The American Progressive era and the progressive reforms that shaped European welfare states are discussed. Public administrators were compelled to adopt new bureaucratic methods and processes to carry out their functions and mandates. These new administrative processes were rooted in principles and methods associated with the Gilded Age and the Scientific Revolution.
