Abstract:
This chapter considers some aspects of the Indian Constitution and its judicial interpretation, as seen from abroad. To this end, it discusses a number of topics that compare India’s constitutional experience with those of other countries, beginning with unconstitutional constitutional amendments and the ‘Basic Structure’ doctrine. It then explores public interest litigation, affirmative action and reservations, and finally the mechanisms by which judicial independence has been secured in India. It also comments on the contentious relationship between constitutional courts and political elites in other institutions. The chapter concludes by noting how constitutional developments, including the growth of constitutional doctrine, are intertwined with a nation’s overall political system, especially the party system in place.

Abstract:
This chapter explores the hiring initiative as a historically, politically, and socially contingent event; and covers the period of greatest racial instability within ASNE, roughly 1977 through the 1980s. During the 1970s, public consciousness about lingering discrimination was heightened, as were a sense of racial and ethnic pride among nonwhites, and feminism among women. But the rising momentum of pro-equality efforts was checked by political cross-current. Many white Americans of the late 1970s, even if they believed opportunities for nonwhites were unjustly unequal, objected to the use of quotas to enforce equality, and the frequency of the term “reverse discrimination,” which referred to the denial of opportunities for whites to compensate nonwhites for past injustice, attested to the growth of an anti-affirmative action backlash.

Abstract:
This article examines the tendency of racial differences to support violations of distributive justice. It is thus a discussion in non-ideal theory and avoids discussion of ideal theory. It begins by showing that races are social constructions. Social constructions are sets of mainly false beliefs, and racial differences support violations of distributive justice because of the nature of these beliefs. The races as social constructions are generated by ideologies that are developed for some political purpose such as a defense of black slavery or the forced deportation of black people from America. Affirmative action is defended on the basis of a backward looking appeal to compensatory justice. The argument is that it can be designed so as to expunge the false beliefs that constitute the social constructions of race, and educate the public about racism.

In German politics, elections occur constantly. When voters are not being called upon to elect a new Bundestag, the next election at federal state level is just around the corner. Despite some commonalities, each federal state parliament is elected within a different legal framework. In both the public’s perception and electoral studies, however, those differences are not always duly taken into account. Therefore, this volume describes the electoral laws of the states in 16 specific chapters following a short introduction on their theoretical and historical foundations as well as on the requirements of the federal constitution. It provides a reliable basis for comparing the German electoral systems with one another. The electoral laws of the states do not appear as mere imitations of the federal system, but as autonomous legislative entities with their own structural decisions and emphases. The volume deals, in particular, with controversial reform projects, such as the reduction of the voting age and so-called affirmative action Legislation.
