Abstract:
Transparency is one of the fundamental principles in public procurement. At the same time, the General Data Protection Regulation (GDPR) requires all operators, whether public or private, to respect privacy and data protection. The study starts from the premise of avoiding sanctions and of complying with the obligations of the contracting authority by knowing the hierarchy of values protected by the regulations in force. An important role in ensuring compliance with the law is to correlate the activity of the data protection officer with the procurement department. The stages of the public procurement procedure will be analyzed in the most relevant aspects, from the publication in the Electronic Public Procurement System and the management of personal data submitted by bidders in the procurement procedures until the publication of the results. We will observe whether data protection can become an award criterion and the influence of bidding data breaches in procurement procedures. A sensitive issue is the protection of data transferred outside the European Union and, from the point of view of competition law, the consequences of the associations, and we will finally discuss some aspects regarding the corrective measures that the data protection authority may impose.

Abstract:
Corruption is an extraordinary crime that occurred in every country. The United Nations Office on Drugs and Crime (UNODC) reported in 2013 that about 10-25 percent of the value of public procurement in the whole world, including Indonesia, was corrupted. Based on the data of Indonesia’s Corruption Eradication Commission (KPK), corruption cases in public procurement is in the highest rank compared to the others. Using a game theoretical approach, this study aims to analyze the procurement process of public goods and services of the Indonesian Government, which has adopted the electronic system, called e-procurement. The game is played sequentially by two representative agents, namely the organizer (government) and the provider. It is assumed that the organizer has a non-corrupt nature. This study results that e-procurement is not significantly able to reduce corrupt behavior. It happens because, although the procurement process is conducted electronically, both sides still have the possibility to meet for negotiation, which can lead to corruption. Therefore, the key to preventing corrupt practices in public procurement is to avoid the two players’ meeting.

PurposeWhile the need for strategic alignment in public management has been recognized, there is a lack of conceptual clarity to support its application in practice. Focusing on the specific field of public procurement, this paper clarifies and illustrates how the concept of strategic alignment can be applied when strategizing the public procurement process.Design/methodology/approachThe current literature on strategic alignment in public procurement is critically reviewed to identify ambiguities that hamper its application in practice. Based on this review, an analytical framework is developed that conceptualizes strategic alignment as that between the procurement instruments used in a sourcing project and the corresponding higher-level strategies. The framework is empirically illustrated by applying it in a case study that reconstructs the procurement strategy for an innovation projectFindingsStrategic alignment in the public procurement process can be demonstrated by identifying, explicating and logically linking reasoning and trade-off decisions on competing priorities across multiple levels and dimensions of strategyOriginality/valueAlthough creating alignment between policy and public procurement practice is generally held to be important in the public management literature, it is only discussed on high levels of abstraction. AbstractE-public procurement has a great potential to improve public procurement processes. It helps to increase competitiveness, and the use of digital technologies also minimizes transaction costs for business, increases trust and the transparency of decisions made by public customers. The goal of this case study is to analyze the functionalities of the Kazakh e-procurement web portal EPP, to evaluate them in a national and comparative perspective and to propose recommendations with a focus on selected process issues and its cybersecurity in the condition of digital transformation of the Republic of Kazakhstan. The analysis of functionalities of EPP from planning to execution of the contract allows it to propose important changes with the potential to increase competitiveness and decrease transaction costs of procurement in the country. The specific focus is on cybersecurity and proposals how to increase it.

PurposeGovernment e-Procurement systems are generating tender-level process event data which are not being analyzed much. The purpose of this paper is to present a data visualization tool to benchmark the government tendering process. This tool collects, collates and presents e-Procurement process data in a meaningful way that enables comparisons and benchmarking leading to insights for process improvements and identification of the best practices. This tool is accessible on the website of South Asia’s first public procurement observatory (www.procurementobservatoryup.com) founded by the authors.Design/methodology/approachThe authors started with an initial set of key performance indicators (KPIs) based on extant literature and existing practices. The authors got them verified by various relevant stakeholders through a series of formal and informal discussions. Some of them were dropped due to observed variations or their inability to offer insights to arrive at the final set of KPIs. In this paper, the authors use actual process-level data. Government of India’s National Informatics Center has implemented e-Procurement portals in various states and public enterprises (PEs) in India which provide tender-wise detailed e-tendering process data. The authors designed a web crawler that collects these data in a tabular format, which allows an easy analysis and comparison to measure and compare government tendering process performance for the last five years for the two large PEs. The authors also engaged in discussions with the procurement executives of the two PSEs to derive meaningful managerial insights from the results obtained.FindingsUsing the public procurement data visualization tool, the authors compare the procurement process of two of the largest Indian PEs, Coal India Limited and Indian Oil Corporation on the developed KPIs and draw insights. The results show significant difference in their procurement process performance due to different practices followed by them. Through interaction with the procurement managers of these two organizations, the authors identify few good procurement practices that can be applied to improve public procurement process.Research limitations/implicationsThis paper uses actual process-level data which can be used not just to identify improvement opportunities but also to gauge the impact of any process-level change. It presents a data visualization tool to generate insights from data generated by a procurement/tendering system. Such visualization and benchmarking can uncover better procurement practices and provide an impetus toward data-driven policy formulation. Apart from the two PEs as reported in this paper, this tool has also been applied on the public procurement data of eight Indian states.Practical implicationsThe KPIs presented in this paper are aligned with the various dimensions of public procurement’s objectives. The visualization tool presented in this paper is based on the Open Contract Data Standard and has a universal application.Social implicationsThe use of technology and open data sharing as the enablers of benchmarking and process improvements help in establishing a dynamic competitive environment leading to financial savings, better services to citizens and proper use of taxpayers’ money.Originality/valueThis paper presents an original work carried out under the aegis of South Asia’s first procurement observatory at IIM Lucknow. The benchmarking tool presented in this paper uses open contract data standard and can be applied in most of the public procurement processes. This paper takes the discussions on e-Procurement to the next level, where the concern is no longer restricted to only adoption and assimilation issues, but also on how to make use of the data that these e-Procurement systems generate.

Abstract:
This study analyses how important is the influence of the procedure type and a number of received bids on the duration of the public procedure process. Efficiency and speed of public procurement process diminish inventory turnaround times, direct and indirect costs of procurement, hastens and improves manageability of core processes in the organizations obliged to the public procurement process. Our study focuses on the quantitative analysis of the influence of the procedural public procurement framework mostly determined by the central government and describes potential other factors of efficiency which can be influenced at the local level. Dataset was obtained from the Public Procurement Office of Serbia, and it included 42,850 cases of public procurement after the correction of missing and “dirty” data. Using statistical methods we have presented two linear models, where the type of procedure and number of received bids account for roughly 23% of the variability in the dependent variable. This paper provides suggestions for improvement of efficiency of public procurement, as well as for data that needs to be tracked to develop more comprehensive, accurate and reliable prediction model of the duration of the public procurement process.

Introduction. In the civilized world, the principles of public procurement are based on austerity criteria; fairness and impartiality of contract award decisions; publicity of the procurement process; efficiency of the procurement process; the importance of accountability. The purpose of the research is to analyze the transfer of the procurement system in electronic format as an effective tool for the goods acquisition, works and services in order to financially support the functioning of state structures to serve public needs, which are maintained mainly at the expense of the state and local budgets. Results. The article deals with the concept essence of «electronic procurement» – that is the newest way of procurement, because it is the passing and controlling in the electronic environment of all stages of the procurement cycle, including marketing research, determining the range of economic agents, procedures for purchasing, placing orders, delivering and paying for them, budgeting and planning for purchases by government agencies. An efficient e-procurement system is highlighted, the key to which is the electronicization of the procurement process, which helps to reduce the operating costs of customers and suppliers; speeding up the procurement process and saving time; a wide range of suppliers; simple and convenient management of the procurement process; clear and transparent access to purchasing information. Conclusions. The electronic public procurement system makes it easier for participants to get started with the state, find the right procurement, submit a bid and win bidding, since all the procurement information is available on the procurement page, and in the change case in the tender documentation, all previous revisions of documents remain in the system, which can be downloaded and viewed. Such transparency of the procedure makes it possible to prevent corruption risks and is a way to develop democratic and open processes in society. Purpose The purpose of this study is to promote clean technology development and diffusion through public procurement. Finland is ranked high among the countries that develop clean technology innovations. Innovative public procurement could be one means to boost the diffusion of such technologies. However, this potential is still somewhat unexploited, as innovative public procurement is an unsystematic method of procuring in Finland and the EU, partly because of an inability to understand innovation potential in the market and to implement innovative procurement. Design/methodology/approach In this paper, the authors illustrate how cleantech aspects can be integrated into the public procurement process. The authors study the key success factors and conditions that have led to a successful cleantech procurement process by exploring realized cases of innovative public clean technology procurement. Findings The results suggest that innovative public procurement, in which clean technology is an integrated part, may occur in different forms, from a procurement of a highly improved product or solution to a product-service system or a collaborative symbiosis system. Life cycle consideration, strategic commitment and recognition of needs of the procuring unit were prioritized as the most important factors leading to successful integration of cleantech aspects into procurement process.

Public procurement has been the subject of research for a long time in the work of scientists from both the economically developed countries and those undergoing the transformation of public finances. Their research comes from different points of view, namely from the essence of the definition, the process of their conduct, the problems of the legislative framework to their effective implementation. In addition, the issue of electronic public procurement, which can greatly enhance the transparency of this process and reduce the level of corruption inherent in this area in all countries without any exception, is becoming increasingly relevant in recent times.Based on the conducted analysis, the article proposes the definition of the term of public procurement, defines the principles of public procurement as a controlled subject in the electronic environment of their conduct, and systematizes the basic indicators characterizing the effectiveness of public procurement. Based on the Granger causality method, an analysis of efficiency was performed and the basic indicators determining the level of savings in the public procurement system were determined. It is established that the use of Granger causality in changing the amount of savings in the system of public procurement gives only a quantitative characteristic. For a more complete picture quantitative analysis is supplemented with qualitative parameters.

With an aim to achieve a more comprehensive monitoring of public procurement system implementation and an immediate application of the Public Procurement Law and secondary legislation for 2017/2018, I conducted a specific research activity on a sample of 54 respondents or about 9.57% of the total number of parties covered by application of this Law. It is a special-purpose sample, which is composed of individuals having the most experience and knowledge in public procurement affairs, public procurement officers employed in state administration bodies, local selfgovernment units, and business entities operating in the fields of water management, energy, transport and postal services.The aim of the research is to assess the situation regarding application of the Law from the respondents’ point of view, for the period of 12 x 2 months of the years 2017 and 2018.The research was done in a way that I have compiled a questionnaire and submitted it directly to selected representatives of the contracting authorities. The questionnaire contained questions related to the following: the method of organization of public procurement tasks within the contracting authority; the process of public procurement planning; the existence or non-existence of violation of anti-corruption rules and the rules for preventing conflict of interest within the contracting authority; the difficulties related to application of specific public procurement procedures and framework agreements; establishment of optional conditions for assessment of bidders’ capability; the method of conducting low value procurements and urgent procurements; the method of monitoring implementation of public procurement contracts; the training for public procurement tasks; the method of monitoring and observing the decisions of the State Commission for Control of Public Procurement Procedures; the inspection control.After having completed the questionnaire, the contracting authorities submitted their answers electronically, which I processed and analysed.

Implementation and training about changes in a procurement process are complex due to the complexity of the procurement process characterised by the adaptive stakeholder network and continuously changing market rules. Traditional training approaches for procurement split the process into separate steps; however, to be able to assess all training aspects, it is important to have a holistic look at procurement. This work explores how well gamification can address the complexity of the procurement process for training specialists in the road construction sector. A case study is carried out to train new business models for both experienced specialists and new employees. The steps for the development of gamification for training in procurement are shown. A comparison of results from experienced and less experienced participants is presented. The results show the relationships amongst the complexity of the real system, the gamification design and the results of gamification.

The basis of legal relations in public procurement are private and public interests. The purpose of the study is a substantive assessment of the authors hypothesis that the purpose of legal regulation and financial support of public procurement is to satisfy the public interest expressed in the form of a public need for goods, works, and services. The methodological basis of the study rests on historical and systematic approach, analysis, synthesis and comparative-legal methods. The results of the analysis of normative legal acts regulating public procurement, doctrinal literature and practice showed that public interest denounced in the form of public need is realized through public procurement. Public and private interests can be realized exclusively jointly since these needs cannot objectively be met individually. In general, ensuring public as well as private interests boils down to defining and legally securing the rights and obligations of the customer and their officials, which safeguards them in the process of meeting public needs through public procurement. The study revealed the dependence of the essence of public interest on the political regime, which determines the ratio of public and private interests. Public interest in public procurement is suggested to understand as the value-significant selective position of an official or another person authorized by the government, which is expressed in the form of the public need for the necessary benefit; gaining such benefit involves both legal regulation and financial security. The purpose of legal regulation of public procurement is to satisfy public interest. These concepts should be legally enshrined in Law No. 44-FZ.

The subject of the article is the research of public procurement in the context of budget expenditures efficiency.The purpose of the article is to confirm or disprove hypothesis that public procurement planning is the basis of a strategic relationship with the budget process. Their symbiosis can minimize any negative manifestations of a financial, economic and socio-political nature, including the consequences of crisis situations such as a pandemic.The methodology. The authors analyze many Russian and western scientific articles and monographs from the point of view of the budget process and planning of public procurement.The main results, scope of application. Planning of public procurement should be considered not as a separate need of one specific customer or a separate group of customers, but as a set of public consumption of all possible and necessary resources. The opposite approach will inevitably lead to additional budget costs for the elimination of consequences (natural, technological, etc.), associated, first of all, with the lack of a proper and clear understanding of the essence of planning public procurement and public demand for goods, works, services). Proper and carefully balanced procurement planning for all public needs not only ensures the immunity of the budget process for the current and subsequent periods, but also constitutes the basis for the prospective rational use of renewable and non-renewable resources, both internal (national) and external (foreign). This article has significant scientific and practical value. The study focuses on the key problem of public procurement in Russia-the lack of interaction between procurement planning and the budget process, pointing to the identified shortcomings of legal regulation that do not allow to quickly adapt to situational changes from outside. It is proposed to consider the introduction of strategic procurement planning for 5-10 years, which will not only determine the basis for financing public procurement from the budget, but also predict the revenues of the relevant budget, more accurately and correctly prioritize funding needs.The findings of the study allowed the authors to formulate proposals and recommendations. Consideration of the planning of public procurement, taking into account the budgetary process, will make it possible to develop recommendations in terms of adjusting certain norms of Law No. 44-FZ, which would allow the most efficient use of budget funds, both planned in advance and urgent purchases.Conclusions. A global crisis reveals the most pressing problems of governance of any state. The crisis obliges the government of any country to promptly analyze and rebuild the regulatory framework for effective financial, economic, social and political management. De-spite numerous reforms the budget process in the Russian Federation has retained significant bureaucratic costs that do not allow for rapid delivery of budget funds to each customer. The urgent need for rapid reallocation of budget funds for additional and priority purchases has shown the imperfection of the legal regulation of public procurement planning, which should be radically restructured. Since public procurement planning as an integral part of budget expenditure is not actually related to its revenues, such planning should be carried out based on the customer's needs for goods, works, and services for a longer period, which will allow a more meaningful and responsible approach to the issue of effective budget spending and overall resource consumption. Digital technologies in public procurement planning allow you to quickly compare all items of the plan with those planned and completed earlier in order to avoid duplication (unjustified repetition) of a similar purchase. Planning of budget purchases is not only an effective expenditure of budget funds, but also an efficient (lean) consumption of resources, including non-renewable ones.

Abstract:
Introduction. The main purpose of the public procurement system is determined by the need to ensure efficient use of budget funds in the development of competition, transparency and openness of the procurement process organization. The purpose of the research is to conduct the process analysis of contesting the public procurement procedure by tenderers. Results. The authors argue that evaluating the dispute resolution effectiveness between the complainant and the customer on the basis of the balance of rights, interests, and objectives of the procurement law is, in practice, an extremely difficult issue that must be resolved in each individual case. The specifics of determining the procurement subject by the customer are highlighted in such a way as to preserve the right to choose the product that suits him best and not to buy the cheapest existing product on the market, such as paper according to certain parameters of density and level of linen. But if the customer has already defined in the tender documentation technical and the qualitative characteristics of the procurement subject, he has no right to further deviate from them when selecting the winner. It is proved that the appeal procedure is created specifically to ensure a quick and professional settlement of conflicts between the participant or potential participant of the procurement procedure and the customer regarding the actions of the customer, which violate the right of such participant in the procurement procedure and the conclusion of the contract with the customer. Attention is drawn to the appeal terms of the tender documentation claim being challenged and the possible addition of justification for the need to amend the conditions of the tender documentation with the opportunity to give additional evidence. Conclusions. From the moment of the procurement contract conclusion between the state customer and the successful tenderer, classic private legal relations emerge, and consequently, after the conclusion of the procurement contract for public funds, which is the final stage of the procurement procedures, civil rights and obligations arise between the parties, and consequently civil rights and obligations arise to appeal the procurement procedure. Abstract:
Purpose This paper aims to focus on understanding and preventing corruption in procurement in public sector settings. Just as not all corruption is the same, not all procurement is the same. One purpose is to analyze different types of procurements: standard, customized, intangible and complex. Corruption in procurement undermines public administration, and the purpose of this paper is to identify different types of procurements and provide readers with a framework for analysis and subsequent intervention. Design/methodology/approach In all, 42 actual cases of public sector corruption in procurement are examined, and from these, an analytical matrix is developed. These cases are derived from the reports of the New South Wales (Australia) Independent Commission against Corruption. These cases represent all of the procurement cases that the ICAC has taken to a formal hearing in its 30 years of existence. Findings While fraud is a major feature of corruption in procurement, there are significant organizational facilitators, and a number of slippage points in organizations are identified. These include peer culture, lack of due process, temptation and managerial incompetence/willful disregard, and these are built into a matrix which can be used in different countries or settings by readers wishing to understand and prevent different types of corruption in procurement in their agencies. Originality/value This paper uses cases that have not previously been aggregated or analyzed and provides analytical tools for practitioners and academics.

Abstract:
Abstract Public procurement refers to the acquisition of goods and services by government in order to facilitate the efficient operationalisation of the state machinery. Public procurement however extends beyond transactions to acquire commodities to “the relationship between the state and its suppliers, and between the state and the commodity transaction”. Global political hierarchies, with affluent democracies at the apex, play a dominant role in how states like Lesotho, with little political agency internationally buy and sell commodities and what terms and conditions attach to such transactions. This paper argues that the architecture of public procurement policy in Africa generally and Lesotho specifically is anchored in neoliberalism which emerged as the dominant economic theory globally after the end of World War II. Corruption which is critical in public procurement because of the huge quantities of commodities often being transacted and the volume of money involved in the procurement process. This creates substantial opportunities for public officials with the propensity to be corrupt because of the high profitability attached to these large procurements. According to the director of the Directorate on Corruption and Economic Offences (DCEO), public procurement in Lesotho is the most vulnerable area to corruption and public procurement cases form 99% of corruption cases handled by the DCEO in 2016. The paper argues that he most combative and dictatorial mechanism of the neoliberal approach to anti-corruption and public procurement policies in Lesotho is the lack of consideration for local contexts, particularly when such policies are adopted litereratim. The slow erosion of corruption, particularly in public procurement in Lesotho is testimony to the futility of neoliberal policies in the country. Officials often adopt neoliberal policies disingenuously and masquerade them as actual reform. Alternatively, policies are adopted to comply with foreign aid requisites or to guarantee Lesotho’s place in global trade. At close inspection, the public procurement legal regime reveals weaknesses which are antithetical to the enthusiastic anti-corruption narratives that the Lesotho government performs to appease donors. Political agents in Lesotho often condemn corruption and reiterate a commitment to corruption-free procurement processes, however, overt corruption that permeates all sectors in the country contradicts this narrative. This paper provides an appraisal of the Public Procurement Regulations of Lesotho as anchored in the neoliberal approach. It argues that the socio-political nuances in Lesotho are in fundamental conflict with the neoliberal theory, making legal enforcement of the regulations extremely difficult.

Case overview/synopsis Primary and Secondary Healthcare Department (P&SHD), Government of the Punjab provides free public health-care services in the Punjab province. Public health-care services of P&SHD are organised in a tiered manner with almost 3,000 primary and secondary medical facilities dispersed throughout the Punjab province. P&SHD maintains inventories of approximately 300 medicines to support medical service provision. Complexity academic level This case can be taught in procurement and inventory management module of MBA level operations management course. It can also be used in executive course on public sector procurement management. The case aims to highlight the interrelation between inventory planning and procurement management process. This study investigated the effect of Public Procurement Act (PPA), 2007 in curbing corruption in public services in Nigeria. The research is prompted by the sheer waste of public resources in the process of public procurements which necessitated the enactment of the PPA in 2007. The operations of the Act requires constant appraisal in order to achieve the desired objectives, hence the main goal of this study. Convenience sampling technique was used to collect data from a sample of 50 staff from 3 select MDA’s operating at the FCT, Abuja. Questionnaires were used to collect data and this was administered through personal delivery. The survey questionnaire measured the different dimensions of corruption in public service in Nigeria. The research design used 2 scales to collect the data. The nominal scale was used to collect personal information about respondents while an open ended questionnaire format was used to measure the response of all dimensions on subject matter .Data analysis was performed with the aid of simple percentages and descriptive statistics. Result obtained establishes that the PPA has helped to curb corrupt practices, improved on transparency and accountability in procurement process. It has minimized discrimination in the awards of contract. It has also helped to facilitate the procurement of works, goods and services in the select MDA’s. Most of the respondents opined that they have adequate value for money in their procurements but that goods and services procured may not have been delivered on time. The major problems confronting procurement practice in some of the select MDA’s include lack of experienced staff and inadequate training. Thus, the study recommends a strong commitment to capacity building and the political will to implement the PPA at all tiers of government in Nigeria. The federal government should be determined in her resolve to fight corruption. This is very crucial for an effective public procurement practice in Nigeria

Public procurement of goods and services accounts for 25–30 percentage of GDP in developing countries. Since this involves public resources, it is important to optimise efficiency of procurement which in turn is positively correlated with the level of competition in the market. Paradoxically, various factors make public procurement especially vulnerable to a host of anti-competitive practices. The article examines various anti-competitive practices that may potentially affect the efficiency of public procurement as well as ‘red flags’ in various stages of the bidding process that could possibly point to bid rigging. However, by properly designing the procurement process, risks of bid rigging can be significantly reduced. Data from various countries show huge savings to public treasuries resulting from implementation of public procurement reforms. The article also attempts to discuss the evolution of competition law in India over the last seven years of operation of the Competition Act, 2002. Apart from the crucial role of the Competition Authorities, the article underlines the need for procurers to be proactive. Effective public procurement reforms in India would require close cooperation among various stakeholders, such as the Department of Expenditure, Central Vigilance Commission (CVC), Comptroller and Auditor General (CAG), Competition Commission of India (CCI) as well as procurers.

The complexity of public procurement and the related controls are a significant issue that public authorities are facing in Hungary. The “fear” of being controlled by state authorities and EU auditors is affecting decisions in public procurement. However, research on the effects of such a system is largely absent. The purpose of the article is to explore the functioning of the control system related to EU funded public procurements and to examine its actual and potential impact on the purchases of public authorities. The method is first an introduction of the features of the control system and then the analysis of data from the relevant bodies in order to see the effect of controls and possible difficulties with the system. The results show that despite the seemingly positive impact on the regularity of procedures, the interference in the decisions of public authorities and the delays caused are problematic. It is therefore suggested that the Hungarian government should consider streamlining the control process such as through checks based on samples or focusing on the most risky procedures. The research is the first academic analysis of data related to public procurement control in Hungary, yet it can already inspire the Hungarian and other governments to review the effectiveness of such procedures and to reduce administrative burdens for public authorities as much as possible.

Purpose The purpose of this paper is to report the experience of the Federal Public Institution with sustainable public procurement through the mechanism of shared acquisitions. Design/methodology/approach The analysis adopted a qualitative approach and an empirical investigation of MPF’s experience, based on a documentary research and participant observation. Findings The results allow the authors to demonstrate the economic, environmental and social advantages of the procurement made by MPF, thus granting to this new model of acquisition governance, the adherence to the organization’s institutional mission. Research limitations/implications This is a single case study. Practical implications It is a promising path that optimizes the institution’s use of its budgetary, human, logistical and information technology resources, focusing on the quality and sustainability of public biddings. Social implications The process of collective construction, improvement of knowledge management, standardization, procedural and scale economies, and the use of sustainability criteria are the main reasons for the implementation of the sustainable shared acquisitions system in the institution. Originality/value This is a development process of a new paradigm of procurement at MPF.

It has been determined that public procurements should be considered as a set of step-by-step actions, which form a holistic, regulated by the law (Law of Ukraine «On Public Procurement») procedure. The purpose of the public procurement procedure is to implement the functions of the public administration.The following definition of corruption risk in public procurement is given – this is the probability of a corrupt act, and will negatively affect the achievement of certain goals and objectives of public procurement. It is proved that corruption risks can arise at different stages of public procurement.The following possible corruption risks in the implementation of public procurement are defined: the creation of such a composition of participants, which makes it possible to avoid the use of bidding procedures with certain restrictions and, instead of using more simplified procedures, including direct conclusion of contracts or purchase from one executor; development of technical conditions or technical tasks with the purpose of promoting the sale of a particular product or service or preventing participation in the bidding of potential participants; determination of discriminatory criteria for the evaluation of tender (price) offers with respect to certain suppliers that are completely incompatible with the requirements of actual procurement; аbuse of «closed» tendering procedures (bidding with limited participation, request for quotations (quotations) or purchase from a single executor, etc.); development of contracting arrangements with the apparent intention of assisting a particular supplier; acceptance from the tenderers of incorrect information or tender (price) proposal prepared (th) in violation of the established requirements; manipulation of the decision-making process within the framework of the work of the tender committee.

The efficiency of the public finance system is conditioned also by the efficiency of public procurement processes. The Slovak healthcare system has been under pressure to increase long-term efficiency. With respect to achieve the efficiency in healthcare system, the efficient public procurement is necessary condition. It is important to examine the factors influencing the public procurement system in the health sector as well as the causal relationships that would provide a valuable platform for the evaluation mechanisms aimed at the effectiveness of the planned purchases. The healthcare sector is specific because it is difficult to consider the effectiveness of the medical equipment in public procurement as well as its long-term effects, the total cost of the treatment and the individual requirements of the patient. The aim of the study is to clarify, whether the use of GPA impact the occurrence of savings within the public procurement process and if application of GPA induces the competition among tenders, thus whether the use of GPA increase number of offers. We use data on public procurement in healthcare sector in Slovak republic in 2019. The focus of analysis is on the Agreement on Government Procurement use by Slovak public procurement bodies and its impact on competition and creation of savings in public procurement process. Our findings suggest that the use of Agreement on Government Procurement induce emergence of savings in public procurement and increases the level of competition. Analysis also indicates that there exists relatively tight correspondence between competition and emergence of savings within public procurement process. It holds that higher the number of offers is, the higher savings are.

AbstractOne of the key steps in the implementation of a public procurement process is the criteria selection that are associated with the bidders, which are intended to ensure that bidders will be able to meet the requirements from the contract. Implicitly, the criteria selection includes their evaluation in situations when the criterion of the lowest price is not applied, but instead the criterion of the most economically advantageous tender. The aim of the paper is to show that decision-makers in the public sector can use multi-criteria analysis for the efficient and fair public procurement process implementation and the establishment of objective conditions for the contract awarding in accordance with the general social interests. In this sense, the paper presents a comparative approach to the Analytic Hierarchy Process and Analytic Network Process as the methods of support in decision making, measurement and evaluation criteria for the selection of the best bids in the procurement process. Hierarchical model with five criteria and nine sub-criteria and the network model, which takes into account the mutual influences of criteria, were developed in a hypothetical public procurement selection procedure for the best performers for the construction of the infrastructure facility. Selection of the best bidder, i.e. bids for the realization of the work, is distinctive, multi-criteria problem which includes both qualitative and quantitative factors.

Public procurement accounts for a significant share of the country's budget. It is impossible to solve the problem of effective budget spending without establishing a rational and transparent system of public procurement. On the basis of international practice, a system of public procurement has been developed and implemented in the Russian Federation. The relevance of the study of this article is determined by the fact, that a large-scale reform of the practice of public procurement is continued in Russia due to the fact that in January 2014 entered into force a new Federal law dated on April 5, 2013 № 44-FZ “On the contract system in the procurement of goods, works, services for state and municipal needs”. The contract system plays an important system-forming role in Russian society. A free and mutually beneficial economic treaty remains one of the main institutions of the market. For this reason the order of the state and separate types of legal entities forms ecosystem, in which all Russian business develops and under which adapts. One of the fundamental principles of the state procurement policy is the principle of increasing efficiency. Currently the trend of the development of the informal relations, the insufficient level of quality meet the requirements of the society. The existing institutional model of public procurement management in Moscow does not fully ensure in practice the reproduction of the necessary economic and social effects, focusing on economic. The problems of poor quality of procurement management in Moscow require a deep study and evaluation of the necessary level of efficiency of tools to improve economic and social relations in the public sector. The purpose of this article is to develop proposals for improving the mechanism of public procurement. The authors of the article consider the possibility of using blockchain in public procurement. The use of this technology will reduce the time spent on the processing of documentation, reduce the degree of corruption in the process of public procurement, by creating reputational lists available to all participants in this process. In addition, the use of a smart contract allows to minimize the number of intermediaries in the conclusion of public contracts.

Public procurement is considered as one of the most powerful tools for solving social, environmental and economic challenges facing the world. The article is dedicated to the role of sustainable public procurement and substantiation of ways of changing the conceptual approach to procurement in order to achieve the goals of sustainable development in Ukraine. Based on the analysis of foreign experience, it is proposed to change the approach to public procurement in Ukraine in such a way as to emphasize not only reduction of costs and saving of public funds but also the support of the long-term goals of the state. Abstract:
At present, public procurement processes and their efficiency represent one of the key determinants of public finance system. Many countries of the European Union work intensively on reforming public procurement processes. The main aim of public procurement is to create an open competition in order to achieve the most efficient use of public funds. The Slovak hospitals, that have been inefficiently managed in the long run, are the weakest segment of the healthcare system. Also, the public hospitals continue to generate substantial losses even if many reforms had been implemented to increase cost efficiency. However, medical debt consolidation did not help the hospitals to set optimal functioning of the economic processes in order to improve their management permanently. The primary aim of the study is to examine an impact of selected determinants on an efficiency of public procurement processes in the healthcare system of the Slovak Republic during the 2014 – 2017. The data were obtained from the registers of the Public Procurement Office of the Slovak Republic. The multinomial logistic regression was used to determine the following findings: in case of zero, or positive savings, the number of offers, year of public procurement, type of public procurement procedure, NUTS level of procurement and participation of a subcontractor in procurement process are significant categorical variables. The study results enable a creation of multi-dimensional analyses and support models in order to make effective public procurement processes in the healthcare system. Similarly, these results enable to create comparative benchmarking analyses, and may lead to a creation of new agencies and institutions.

Between 2007 and 2013, public procurement systems in Latin America and the Caribbean underwent a critical reform process. However, not much is known about the elements of reform and their effect on the public sector. In order to assess this gap in knowledge, this study used an institutional evaluation multivariate tool developed and carried out by the Inter-American Development Bank called PRODEV. Based on a sample panel of countries, effects on the development of public procurement systems were calculated. The results indicated that, of the three main areas of procurement reform evaluated, the creation of a procurement agency2 had the largest impact. At the same time, evidence was found that backed the hypothesis that creating these agencies had a positive effect on the perception of public sector performance.

The purpose of this research is to identify and describe the transparency of the management of government procurement of goods / services electronically (e-procuremnet) in LPSE West Nusa Tenggara Province, and to find out how clear the information regarding the e-procurement process is presented by LPSE NTB. Using qualitative methods with a field study approach, literature studies and secondary and primary data processing from various existing sources. Data collection was also carried out by interviewing all parties involved and understanding the process of procuring government goods / services electronically (e-procurement). The research results show that procedurally the e-procurement process at LPSE NTB is good, because the public can access information related to the procurement of goods / services by the NTB Provincial Government on the LPSE NTB website. However, the information presented is not yet complete, there is information transparency regarding the auction process being carried out, such as 13 procurement packages that were not included Corrected Offer Value (Rp. 0) during 2017-2020 with a Budget Ceiling of Rp. 54,620,180,375. and there were 76 auction packages for the procurement of goods that failed so that a re-tender was carried out, but there was no clear information on why the auction could fail, there were also 76 auction packages that did not include the name of the winning company during 2017-2018 In the e-procurement system, one of the requirements that must be fulfilled is clarity of information regarding the entire process of procurement of goods / services from start to finish, clarity of information includes the type of procurement to be auctioned, budget ceiling value, value of HPS, corrected bid value, work unit conduct the procurement, the number of auction participants and the name of the winning company.

Kenya is one of the countries that are currently in the process of preparing a new law on government procurement as part of the anti-corruption efforts of a new democratically elected government which came into power in December 2002. Whereas it may be too early to judge the commitment of the new government to meaningful and consistent anti-corruption initiatives, one may already discern either a definite unwillingness to move forward with serious reforms or an implicit acquiescence towards corrupt practices, particularly in the government procurement process. In this paper, we shall examine Kenya's government procurement laws, and their practical application. We focus on two recent examples of the procurement process, one by a government ministry and the other by a parastatal body. The first example of application we shall look at is the controversy over the procurement of HIV-Aids testing equipment by the Ministry of Health, and the second is the procurement of cranes by the Kenya Ports Authority. We shall end with a brief examination of the proposed Public Procurement and Disposal Bill (2003)l which is currently before the Kenyan parliament and how it may revolutionalize the government procurement process in Kenya. This Bill has already received the approval of the Cabinet of Ministers and is due for the second reading in Parliament.2 Despite the Government having stated its commitment to have the bill enacted, the bill has not been passed yet.3 In the last substantive part of the paper, we assess the relevant international agreements and standards such as the UNCITRAL Model Law on Public Procurement and the WTO's Agreement on Government Procurement, and also highlight the regional procurement law.

In spite of the fact that public procurement is increasingly becoming a popular technique for small business empowerment, there are various challenges facing SMEs in public procurement. Using Nigeria as a platform, this paper examines barriers that hinder SMEs access to public procurement markets. Data were collected from literature review, analysis of documents and semi-structured interviews. The results show that lack of transparency in tendering often discourages SMEs from getting involved in public procurement in Nigeria. It further highlights the need for actions to address issues facing SMEs at different stages of the procurement process. By integrating research findings into existing knowledge, a taxonomy of techniques for enhancing SMEs access to public procurement is proposed. The taxonomy reveals specific schemes and measures to promote SME participation in public procurement. This will offer guidance to governments, policy makers and procurement experts on the implementation of SME-friendly procurement practices. The study adds to the on-going debates on the significance of public procurement policy on SME development.

Introduction. Ukraine is undergoing an extremely important and complex process of forming a modern and effective public procurement system aimed at creating a competitive environment and further developing fair competition in public procurement, as well as ensuring compliance with international obligations by consistently adapting Ukrainian legislation to EU standards. The task of public procurement reform is to significantly reduce financial fraud in this area and achieve savings in public funds. The purpose of the article is to analyze the process of reforming the public procurement in Ukraine, focusing on the latest changes, substantiation of proposals for ways to minimize financial fraud in the field of public procurement. Results. The main milestones of formation and improvement of the public procurement system in Ukraine are considered. Emphasis is placed on the features of the current stage, which are to create better conditions for bidders and prevent financial fraud in public procurement, expanding the list of violations and strengthening penalties. Data on the most common types of violations among procurement customers are given. Conclusions. The existing risks of unfair competition in procurement are indicated and the ways of minimizing financial fraud in this area are substantiated. Emphasis is placed on the importance of preventive measures that can be used to detect violations before the conclusion of the contract. In the context of strengthening the effectiveness of control measures, it is proposed to introduce a direct rule of criminal liability for violations in the field of public procurement. The implementation of the proposed measures will help increase the effectiveness of public policy in the field of public procurement, which will ultimately allow for more economical and efficient use of public funds.

The main purpose of the study was to establish the conformity of South African legislation and policies to the global principles of Open Contracting. The specific objective of the study was to establish whether South African legislation supports the application of Open Contracting in public sector procurement. The study employed a descriptive survey research design. Primary data was collected using questionnaires targeting members of the Chartered Institute of Procurement and Supply Chain (CIPS) employed in the South African public service. A total of 300 (100%) completed questionnaires were returned. Fifty-two (52) of the targeted 300 respondents were excluded from the study. They were found not to be “public procurement champions”. This would imply that a final total sample size of 248 was employed in this study, thus a realization of 82.7%. The study findings revealed that although government institutions have policy statements for Open Contracting, the principles are not fully implemented. The study recommends that the National Treasury put forward a single coherent, comprehensive and overarching procurement law to standardize and clarify the procurement process to be followed by procuring entities in South Africa. Particularly the study recommends the development of a policy framework for the implementation of Open Contracting in the South African public sector procurement system.

The designated topic is one of the most relevant today, since the general use of automation of processes leads to an increase in their efficiency and this is a phenomenon that has already been proven by time. The article considers an overview of the software support for public procurement. The basic principles and mechanisms of contract turnover and the use of various programs throughout the procurement procedure are considered, as well as a comparative analysis of popular programs for working with contracts and purchases with a designation of their features. The work also used a large amount of drawings reflecting the architecture of the process. As a result of writing the work, it was possible to get an idea of the ongoing processes, in public procurement, occurring in the field of those specialists who are responsible for accounting for government contracts, as well as the software used locally.
