Abstract:
The last book of Plutarch’s Quaestiones convivales contains several discussions of literary and grammatical topics. The present article focuses on Quaest. conv. 9.3, which deals with the number of the letters in the alphabet. This question is raised by ‘Plutarch’ to Hermeias the geometer. It is first argued that this qualifies as an excellent sympotic question (according to Plutarch’s own standards). Then, attention is given to the solution proposed by ‘Plutarch’ himself (738DE), to the learned reply by Hermeias (738EF), and to the final critical evaluation by Zopyrio (738F-739A). This detailed interpretation of the Quaestio should help in revealing the argumentative dynamics of Plutarch’s philosophical approach in the Quaestiones convivales.

Il lavoro, partendo dalla disamina delle molte convenzioni che utilizziamo nel-la vita quotidiana e che non corrispondono a teorie scientifiche comprovate, pro-pone alcuni vertici di speculazione intorno alla ormai diffusa dicotomia con cui si mettono in relazione la mente e il corpo. A sostegno di questa idea ostinata viene ricordata la posizione di Cartesio in materia. Una ulteriore disanima è suggerita ci-tando l'idea del "velo di Maya" proposta da Schopenhauer per sostenere che la nostra visione ordinaria del mondo è una fiction illusoria che ci tiene a distanza dalla verità profonda delle cose, idea suggerita già dal pensiero indiano antico e dalla Grecia. Successivamente viene considerata la posizione di Freud: nonostante egli abbia avuto sostanzialmente nel corso della sua vita una posizione unicista, vengono evidenziati i suoi dubbi nel formulare il concetto centrale di "pulsione", che risente totalmente delle ambiguità dell'idea dicotomica. Successivamente si accennerà alla posizione di Bion e di Jung ed infine si proporrà la posizione "emer-gentista" proposta da molti neuroscienziati, come quella che tenta di superare le pastoie epistemologiche della dicotomia.

Síntese: A reforma no processo de nulidade matrimonial promulgada pelo Papa Francisco teve sua origem no Sínodo extraordinário dos Bispos com a justificativa de aproximar a justiça eclesiástica à vida dos fiéis, refletindo a pastoralidade do direito eclesial. O matrimônio como realidade antropológica, teológica, jurídica e social exige um processo de natureza judicial e não apenas administrativo para a declaração de nulidade. O conceito de certeza moral na verificação da quaestio facti (sobre a realidade dos fatos) requer o encontro com a verdade sobre o laço conjugal e uma absoluta fidelidade à quaestio iuris (sobre os motivos tipificados pelo legislador que podem tornar um matrimônio nulo). A reforma considera que a caridade e a misericórdia são atitudes eclesiais como uma atitude pastoral que se torna próxima dos filhos, não com o objetivo de favorecer a nulidade do matrimônio, mas a celeridade dos processos.Palavras-chaves: Sínodo dos bispos. Nulidade matrimonial.Abstract: The reform of matrimonial nullity process promulgated by Pope Francisco had its origin in the extraordinary Synod of Bishops with the justification of bringing justice to the ecclesiastical life of the faithful, reflecting the pastoral care of the Church’s right. The marriage as anthropological, theological, legal and social reality requires a judicial nature and not solely for the administrative declaration of nullity. The concept of moral certainty in verifying the “facti quaestio” (on the actual facts) requires the encounter with the truth about the conjugal bond and an absolute fidelity to “iuris quaestio” (on the grounds typified by the legislature that can make a null marriage). The reform believes that charity and mercy are ecclesial attitudes as it becomes close to the children, not with the goal of favoring the nullity of the marriage, but the speed of the processes.Keywords: Synod of Bishops. THE LEX CALPURNIA DE PECUNIIS REPTETUNDIS AND ITS INFLUENCE ON THE EVOLUTION OF ROMAN CRIMINAL LAW Summary This paper concerns the contribution to Roman Criminal Law which has been undoubtedly done by lex Calpurnia de pecuniis repetundis. There is a possibility of presenting three aspects of the influence. The establishment of a first standing court (quaestio perpetua) should be perceived as a most outstanding achievement of the lex Calpurnia de pecuniis repetundis. In the later period (until Sulla dictatorship) quaestio perpetua de repetundis was treated as an example for the other standing courts and each of them were established by lex (or plebiscitum) to deal with one crime (or group of crimes). This solution has enabled a creation of a few standing courts which gradually deprived the Assemblies of the People (also concilia plebis) of competence concerning to penal practice. The other aspect of the influence concentrates on procedure that has been used during the trials in quaestio perpetua. It can be observed that the private law (ius civile) put emphasis on the character of the standing court established by lex Calpurnia. Quaestio perpetua did not have all features of criminal court (procedure legis actio sacramento in personam). On one hand it seems quite natural to take advantage of private law. There has not been any penal procedure that could have been adopted to the quaestio perpetua. Perhaps the civil procedure (legis actio sacramrnto in personam) was merely reasonable one for application in the standing court. On the other hand it cannot be rejected that the choice of legis actio sacramento in personam had to disable everyone without Roman citizenship to act as a plaintiff. It is worth remembering that the other standing courts had also something in common with private law (e.g. litis aestimantio mentioned in the lex Acilia repetundarum). The third possible influence on Roman criminal law can be seen in the character of provision of lex Calpurnia. It is beyond any doubts that the lex had provisions referring to procedure (above mentioned legis actio sacramento in personam), but it is not certain that there were a sanction (sanctio) which had a typical of penal character. The rogator established a sanctio as in simplum which proves that kind of sanction had not been commonly used in the Roman criminal law. It is very difficult to explain why such a santio had been put to the lex Calpurnia. One of the possibilities of solving this mystery regards the rogator as a weak person who was not able to enforce harsher penalty. It should be also taken into account that some objections may raise during the process of passing a law. The upper class of populus Romanus were not interested in establishing a harsher sanction. Having considered the overall arguments the lex Calpurnia de pecuniis repetundis had a great influence on the Roman criminal law. The first standing court (quaestio perpetua de repetundis) became an example for the other established later. Abstract Hamlet’s ‘To be or not to be’ speech has long been the subject of intense scholarly attention. By situating the speech against the backdrop of classical and Renaissance rhetorical theory, this essay demonstrates that there is still much more to be said about it. The speech ostensibly examines a quaestio infinita or a thesis, and follows the rhetorical rule that the right way to do so is by the invocation of commonplaces. This reading of Hamlet’s speech is not only consistent with Shakespeare’s characterization of the university-educated prince, who frequently invokes commonplaces, but also has significant implications for our understanding of the play and Shakespeare’s own practice as a writer. The book that Hamlet is reading could well be his own commonplace collection, and it is perhaps in looking up his entries under the heading of ‘Death’ that Hamlet finds what he needs in order to examine his quaestio.

Among Plutarch’s Moralia, the Platonicae Quaestiones are ten exegetical exercises on both contradictory and obscure passages of text by Plato. In the third quaestio (1001c-1002e), Plutarch examines a theoretical problem related to the similarity of the “Divided Line” (Resp. 509d6-511e5), i.e. whether the sensible segment is “greater” (meizon, 1001d) than the intelligible one, or vice versa. In briefly summing up the content of the Platonic similarity, Plutarch surprisingly leaves out Plato’s reference to the “criterion” which should mark the difference between the upper and the lower segments of the line: the sapheneia (Resp. 511e: ὥσπερ ἐφ᾽ οἷς ἐστιν ληθείας μετέχει, οὕτω ταῦτα σαφηνείας ἡγησάμενος μετέχειν). How are we expected to understand this “silence”? My purpose is to demonstrate that Plutarch’s omission is voluntary, since this is meant to provide the quaestio with a more original, step-by-step analytical development, along with a clearer solution. Plutarch’s initial silence gives him the opportunity to accurately argue against any quantitative or materialistic reading of the word meizon. Any interpretation of Plato’s ontology which reduces the intelligible dimension to an “elementary” level (i.e. to one based on elachista) should be rejected. The difference between the sensible segment and the intelligible one (and, hence, the superiority of the latter over the former) has to be described in ontological terms. But sapheneia had this precise meaning in its original Platonic context: so, its omission at the very beginning of the quaestio turns out to be of use to Plutarch in order to guide the reader gradually towards the solution of the zetema.

La produzione scritta è un’attività complessa che richiede l’attivazione di competenze linguistiche, sociolinguistiche e pragmatiche. Il presente articolo mira a presentare la problematica della ricchezza linguistica nonché della complessità testuale in riferimento alle macro-operazioni descrittive proposte da Adam (1989, 2011), ai campi semantici, alla quaestio e ai mezzi stilistici. Il suo scopo consiste nella verifica dell’ipotesi della presenza della descrizione in quanto genere particolare di discorso scolastico regolato da norme specifiche.Różnorodność technik językowych i strategii tekstualnych opisów zredagowanych przez osoby uczące się języka włoskiego na poziomie średnio zaawansowanymNiniejszy artykuł ma na celu przedstawienie charakterystycznych cech tekstu opisowego redagowanego w sformalizowanym środowisku uniwersyteckim. W tym celu wypracowania studentów poddane zostały analizie według zestawienia makrooperacji zaproponowanego przez J.-M. Adam (1989, 2011). Dodatkowo zwrócono uwagę na obecność pól semantycznych, quaestio oraz figur stylistycznych. Wyniki dowodzą, że opis w procesie nauczania stanowi rodzaj tekstu należącego do dyskursu ćwiczeniowego, który jest regulowany swoistymi normami i nie ewoluuje wraz z doskonaleniem kompetencji językowych.

Abstract<title> SUMMARY </title>This article analyses some XVIIth-XVIIIth century tentative solutions of a problem of the theory of vision, posed to the attention of the scholars by Isaac Barrow in 1669: that one consisting in the noneffect of distance, and in the confused appearance taking place in the case of an object seen through a biconvex lens, or a concave mirror. Berkeley's solution, exposed in his Essay towards a new theory of vision (1709), seems particularly important. At the end of the article we briefly refer some present neuropsychological developments of Barrow's problem and, in general, of the problem of visual perception.

Paul DeHart has recently proposed that Thomas Aquinas did not elaborate on the ethical and anthropological implications of his position on the divine ideas. The author challenges DeHart’s interpretive assumption by demonstrating that Thomas consciously and deliberately extended the divine ideas into his vision of virtue through a network of subtle allusions to the doctrine in the Summa Theologiae. Specifically, the article considers the place of the divine ideas in Thomas’s appeal to Macrobius’s categorical division of the cardinal virtues into political, purifying, purified-in-mind, and exemplar. It further examines the relation of this gradation of virtue to Thomas’s thought on the ontological correlation between each person’s creational formation and the eschatological perfection of virtue.

Benjamin DeSpain has taken issue with my claim that the divine ideas according to Aquinas’s conception cannot be the objects of our moral striving, nor can they be approximated by us. I argue that he has not attended to a necessary distinction between the divine essence as single exemplar and the ideas as multiple exemplars of the varied imitability of that essence. The result is that Macrobius’s “exemplar virtues” are the divine essence; they are not divine ideas, nor are they eternal law. Approximation to these virtues is possible, but not to the ideas. I conclude with some reflections on Aquinas’s use of tradition, and on the question of his “Platonism.”

AbstractThis article examines Gerald Odonis' view on the nature of place as found in his commentary on the Sentences (Sent. II, d. 2, qq. 3-5) and in an anonymous question (Utrum locus sit ultima superficies corporis ambientis immobile primum) extant in manuscript Madrid, Biblioteca Nacional, 4229. Both texts defend a thoroughly un-Aristotelian conception of place as three-dimensional space. Odonis not only deviates from Aristotle's definition of place as the inner surface of a surrounding body, but also from the positions of his contemporaries, including fellow Franciscans. Despite some remarkable doctrinal similarities between Odonis' view and that of Renaissance innovators like Francesco Patrizi and Bernardino Telesio, it seems unlikely that Gerald played a role in the rise of new conceptions of place in the sixteenth and seventeenth century. An edition of the anonymous Quaestio de loco is given in an appendix.

Abstract The paper discusses John Italos’ (d. after 1082) position on the eternity of the world. Italos was condemned for a series of heretical views including the thesis that the visible world was eternal. However, a treatise of Italos has been transmitted, in which he refutes the idea of an eternal kosmos and argues for its createdness in the beginning of time. The present study provides a critical edition of the Greek text of Italos’ treatise (Quaestio 71 of his Quaestiones quodlibetales), provided with a first English translation and followed by a commentary that develops Italos’ main arguments and identifies some of his sources. It is argued that Italos sincerely defended an anti-eternalist standpoint by adopting arguments, first and foremost, of the sixth-century philosopher John Philoponos. Moreover, Italos seems to react in Quaestio 71 to specific charges that had been brought up against him during his repeated synodal investigations in 1076/77 and 1082. His treatise against the eternity of the world appears to be a comprehensive apology of his orthodoxy.

O funderentismo, teoria epistemológica concebida por Susan Haack, baseia-se na noção de inferência justificada. A teoria tem perfil conciliador: integra a ideia de processo de partes com uma perspectiva que não repele a interação do juiz com a prova. Haack é representante do realismo moderado, o qual se contrapõe ao relativismo filosófico pós-moderno, que nega a possibilidade de juízos cognitivos de aproximação da verdade. Mas a teoria não é isenta de críticas, notadamente a fragilidade da concepção coerencial. O critério independência-multiplicidade de fontes de prova, aliado ao método de encadeamento inferencial (Toulmin), apresenta-se como uma via epistêmica mais promissora
