Article 17 in the Warsaw Convention 1929, the core provision to all liability for passenger injury and death, has been the most litigated Article of the Warsaw Convention. The main reason for this is that the Warsaw Convention, the axis of private international air law, unfortunately did not provide clear definitions regarding "accident" and "bodily injury" in the Article 17. Its amendments, the Hague Protocol 1955 and the Guatemala Protocol 1971, did not succeed in clarifying the meanings. Although the Montreal Conference 1999 witnessed strong debates regarding the amendment of Article 17, the Montreal Convention 1999 did not succeed in changing Article 17. Since the Warsaw System did not provide definitions of "accident" and "bodily injury", each State has interpreted the two terms individually. Inconsistency in interpreting "accident" and "bodily injury" has emerged, since every State has a different jurisprudence. This phenomenon has created confusion in the international air transport community. In order to clear up the confusion, the International Civil Aviation Organization should amend Article 17 to specify and clarify the terms: "accident" and "bodily injury", while balancing the interests of all parties in the international air transport community.

A dissertação elaborada tem como objeto de estudo um tipo de abertura, do ambiente construído, muito conhecida pelo ser humano - a "Janela". A janela é a responsável direta pela possibilidade de um contato com o exterior, seja através do fornecimento de luz natural, de vista ou de ar fresco à um ambiente interno. Por isso, ela exerce grande iniluência sobre este e, portanto, sobre seus usuários. O objetivo do trabalho é o estudo da relação 'homem-janela', através de uma abordagem psicológica. Buscou-se a investigação e obtenção dos atributos que as pessoas conferem à uma janela, à fim de contribuir para os poucos trabalhos existentes sobre este tema. O trabalho é dividido em duas partes: a conceitual e a experimental. A parte conceitual aborda definições da Ergonomia e da Arquitetura, enquanto ciências que regem esta Dissertação; a relação 'homem-ambiente construído'; alguns tipos de aberturas e, por fim, a "janela" - suas definições, sua história, importância, funções e beneficios gerados ao homem. Na parte experimental são apresentados os dois métodos utilizados no estudo: o "Método dos Qualificativos Associados", que foi aplicado junto à uma amostra de 200 pessoas, para a obtenção dos atributos que as pessoas conferem à janela; e o "Método das Constelações de Atributos", utilizado quando da organização em gráficos, dos resultados obtidos. A análise dos resultados demonstrou o desejo das pessoas por ambientes providos de janelas, e que além da importância das funções de iluminação, vista exterior e ventilação, tanto os homens quanto as mulheres, perceberam a janela como um elemento essencial para uma distração mental, uma sensação de liberdade, de vida, de saúde, de felicidade, ou seja, os aspectos funcionais e afetivos foram muito mais citados que os aspectos técnicos, tais como as formas, dimensões e tipos de janelas. Estes dados são importantes porque podem servir de base para auxiliar os projetistas na elaboração de projetos mais adequados ao ser humano. Além disso, os métodos apresentados são de grande valia, pois são simples, rápidos, eficientes e podem ser utilizados para estudos e projetos, tanto de Arquitetura quanto de Ergonomia.

Este trabalho consiste no estudo e implementação de um NO-BREAK empregando um Conversor Quase-Ressonante com Comutação na Passagem por Zero da Corrente (Quasi-Resonant Converter Zero-Current Switching - QRC-ZCS) associado a um inversor convencional do tipo 180o em ponte. A contribuição fundamental desta dissertação está no fato de apresentar uma tecnologia recente. Com conceitos totalmente novos (ex: comutação não dissipativa na realização de um equipamento para aplicações industriais. A grande característica desta nova tecnologia reside no fato de operar em altas freqüências sem que o rendimento seja prejudicado, reduzindo assim o peso e volume do equipamento. Neste trabalho é apresentado um estudo analítico do sistema com projeto e validações por simulação. Um protótipo de laboratório foi implementado e os resultados experimentais se mostraram satisfatórios.

Este trabalho visa fornecer um retrato etnográfico do cotidano de crianças pobres no centro da cidade de Florianópolis, popularmente conhecidos como "meninos e meninas de rua", para uma comparação com retratos fornecidos pela literatura ficcional e jornalística sobre o tema. Também compara seus resultados com os de outras investigações etnográficas feitas no país. A pesquisa de campo realizou-se de abril a agosto de 1991, tendo sido feitas anteriormente várias outras aproximações ao universo do estudo. Através de uma convivência intensa com os sujeitos observados, busca-se uma descrição detalhada de vários aspectos de sua vida na rua, longe da supervisão dos pais, professores e instituições de atendimento. Assim, a sexualidade, o uso de drogas, as relações afetivas, a liderança, as estratégias de sobrevivência, a politização, as relações com a polícia, com instituições de atendimento e com a família, são investigadas como forma de se construir uma "ficção etnográfica".

Esta tese analisa as práticas discursivas e não discursivas que historicamente possibilitaram a construção das noções de ?honra sexual? e ?honra moral? correlacionadas com as formas de violência sexual e moral vigentes na Paraíba, no período entre 1950 e 1970. Ao descrever e problematizar os casos de crimes sexuais, como estupro e defloramento, com base em processos-crime vinculados ao Tribunal de Justiça da Paraíba, Fórum Afonso Campos, em Campina Grande, e Fórum Criminal, em João Pessoa, foi possível perceber como tais noções eram correlatas às práticas sociais, tais como a valorização da virgindade, do casamento e da família, bem como à maneira como médicos, juristas e jornalistas percebiam como o sexo deveria ser praticado dentro da perspectiva da maternidade, emergindo daqueles discursos certos códigos moralizantes que eram impostos às moças da época e que eram pautados por regras de ?decência?, ?pudor? e ?honestidade?. Com base nos Estudos de Gênero e em uma leitura historicamente situada por meio dos movimentos feministas, objetivamos problematizar como o uso dos termos ?honra sexual? e ?honra moral? foram norteadores para a construção das imagens das ?moças honestas? e ?desonestas? em relação àquelas classificadas como ?raparigas emancipadas? e ?virgens sem pudor?, no momento em que os discursos jurídicos e jornalísticos apontavam para a ?ameaça dos costumes? da época frente às mudanças advindas com os ?tempos modernos?, bem como a expansão do mercado de trabalho feminino. A análise atenta para as tramas de paixões e sofrimentos experimentados pelos/as envolvidos/as, problematizando relações de gênero, vetores de raça, cor, condição social e formas de violência sofridas pelas jovens, buscando perceber como eram construídas as defesas dos acusados de crimes sexuais e como se davam as relações de poder entre promotores e advogados de defesa, tendo como pauta de discussão a sexualidade e as formas de comportamento das moças envolvidas em crimes sexuais na Paraíba.
Abstract : This thesis analyses discursive and non-discursive practices that historically made possible the conceptual construction of ?sexual honor? and ?moral honor?, which are correlated with types of sexual and moral violence in Paraíba, at the period from 1950 to 1970. Sexual crimes, such as rape and defloration, were studied based on criminal cases obtained from two law-courts, i.e., ?Tribunal de Justiça da Paraíba (Fórum Afonso Campos - Campina Grande)? and ?Fórum Criminal (João Pessoa)?. It was possible to perceive how the aforementioned concepts were correlated to social practices such as the appreciation of virginity, marriage and family. In addition to this, it was noticed the way doctors, jurists and journalists understand sex as restricted to maternity perspective, which emerged from moral codes imposed to the girls of that time and were guided by rules of ?decency?, ?modesty? and ?honesty?. Based on gender studies as well as feminist movement historical perspectives, the aim was to discuss how the use of the terms ?sexual honor? and ?moral honor? were oriented to build the image of a ?honest girl? in comparison to the ones classified as ?emancipated girls? and ?shameless virgins?. This image building was situated in a historical scenario where the legal and journalistic discourses put focus on the ?threat to traditional customs? against the changes arising from ?modern times?. Criminal case analysis points to passion and suffering stories, experienced by the ones involved, which were marked by gender relations and also by a sort of aspects concerning to race, skin color, social condition and types of violence. This analysis attempts to understand how were performed the defenses for the accused of sexual crimes as well as how prosecutors and defense counsels act in power relationships discussing the sexuality and behavior of the girls involved in sexual crimes in Paraíba.

A constante heterogênea de transferência de elétrons dos complexos metálicos Fe[(tpen)]2+, Co[(tepen)]2+ e Cu[(tpen)]2+ foram estudadas em eletrodos de platina usando como técnica de investigação a voltametria cíclica e a impedância eletroquímica de AC. As constantes de velocidade foram corrigidas para os efeitos da dupla camada em função dos potenciais de eletrodo, a partir das correspondentes constantes observadas kobs. Os valores das constantes de transferência heterogênea de elétrons (ke) foram então determinados como sendo 21,7 x 10-2 cm.s-1, 7,70 x 10-2 cm.s-1 e 6,0 x 10-2cm.s-1 para os complexos Fe[(tpen)]2+, Co[(tepen)]2+ e Cu[(tpen)]2+ respectivamente. A baixa constante de velocidade para a transferência de elétrons do par redox Cu[(tpen)]2+/1+ pode ter origem na alta barreira de energia induzido pela forte distorção estrutural induzida pelo efeito de Jahn-Teller.

Overexpression of the epidermal growth factor receptor (EGFR), a member of the ErbB family, and its closest homologue HER2, have been associated with aggressive tumour progression and reduced sensitivity to DNA-damaging agents. In order to block the proliferation of refractory tumors overexpressing EGFR, a novel strategy has been developed that sought to design molecules capable of not only blocking EGFR-TK, but also damaging DNA. These molecules, termed combi-molecules (CMs), have been shown to degrade under physical conditions to release another inhibitor of EGFR, and to be potent against tumor cells of various origins including breast, prostate and carcinoma of the vulva. However, despite their potency, their growth inhibitory IC50 values were still in the high micromolar range. In order to augment the potency of the CMs, here they were re-designed to contain two quinazoline moieties and a central N,N-bis(2-aminoethyl)methylamine spacer which, following degradation, could yield higher concentrations of free inhibitors and a more cytotoxic bifunctional DNA damaging species. Here, we describe the mechanism of action of the first prototype of this approach, JDE52, which we now classify as a double-arm CM, in comparison with ZRBA1, its closest single-arm counterpart. The results indicated that JDE52 was capable of inducing significant blockade of EGFR, DNA single-strand breaks and inter-strand cross-links. ZRBA1, its single-arm counterpart, was capable of only forming DNA single-strand breaks. The fluorescent property of FD105, the secondary inhibitor that both JDE52 and ZRBA1 are capable of releasing, has permitted the analysis of its levels in tumor cells by UV flowcytometry. It was found that JDE52 was indeed capable of significantly releasing higher levels of fluorescence (p<0.05) in human tumor cells, compared with levels of fluorescence released by ZRBA1. More importantly, JDE52 induced higher levels of apoptosis and cell killing than ZRBA1. Apoptosis was triggered by JDE52 at a faster rate than ZRBA1. The results in toto suggest that the superior potency of JDE52, when compared with ZRBA1, may be imputed to mechanisms associated with the generation of higher levels of FD105 intracellularly, and the induction of DNA cross-links, which are known to be more cytotoxic. These combined mechanisms (blockade of EGFR-TK and formation of cross-links) contributed to an accelerated rate of apoptosis in cells treated with JDE52. This study conclusively demonstrated that designing molecules as prodrugs of high levels of quinazoline inhibitors of EGFR and bifunctional DNA cross-linking species is a valid strategy to enhance the potency of CMs against refractory tumors.

This thesis focuses on the design of an electrical drive system for the purpose of
high precision motion control. A modern electrical drive is usually equipped with a
current regulated voltage source along with powerful motion controller system
utilizing one or more micro-controllers and/or digital signal processors (DSPs).
That is, the motor drive control is mostly performed by a dedicated digital-motion
controller system.
Such a motor drive mostly interfaces with its host processor via various serial
communication protocols such as Profibus, CAN+, RS-485 etc. for the purpose of
receiving commands and sending out important status/control signals. Considering
that the motor drives lie at the heart of every (multi-axis) motion control system, the
aim of this thesis is to explore the design and implementation of a conventional DC
motor drive system suitable for most industrial applications that require precision
and accuracy. To achieve this goal, various underlying control concepts and
important implementation details are rigorously investigated in this study.
A low power DC motor drive system with a power module, a current regulator and
a motion controller is built and tested. Several design revisions on these subsystems
are made so as to improve the overall performance of the drive system itself.
Consequently, important &ldquoknow-how&rdquo
required for building high performance (and high power) DC motor drives is gained in this research.

In this Thesis, the problems of the Free Flexural (or Bending) Vibrations of Composite, Orthotropic Plates and/or Panels with Various Bonded Joints are formulated and investigated in detail. The composite bonded plate system is composed of Plate Adherends adhesively bonded by relatively very thin adhesive layers. The general problem is considered in terms of the three Main PROBLEMS, namely Main PROBLEM I, Main PROBLEM II and Main PROBLEM III.
The theoretical formulation of the Main PROBLEMS is based on Mindlin Plate Theory which is a First Order Shear Deformation Plate Theory (FSDPT). Thus, the transverse shear deformations, the transverse and the rotary moments of inertia of the plates are included in the formulation. Very thin, elastic deformable adhesive layers are considered as continua with transverse normal and shear stresses. The
damping effects in the plates and the adhesive layers are neglected.
The entire composite bonded joint assembly is assumed to be simple supported along the two opposite edges, so that the Classical Levy’
s Solutions can be applied in this direction. The dynamic equations of the Bonded Joint System which combines together the Mindlin Plate dynamic equations with the adhesive layer equations are reduced to a system of First Order Ordinary Differential Equations in the state vector form. The Main PROBLEMS are investigated and presented in terms of the mode shapes and the corresponding natural frequencies for various sets of boundary conditions. The significant effects of the hard and the soft adhesive layer elastic constants on the mode shapes and on the natural frequencies are demonstrated. Some important parametric studies such as the influences of the Joint Length Ratio, the Joint Position Ratio, the Bending Stiffness Ratio, etc. on the natural frequencies are computed and plotted for the hard and soft adhesive cases for several support conditions.

As from the beginning of the 20th century, there has been a shift in the scale of architectural production as an outcome of advanced construction technologies, new range of building materials, automation of building services and progressive infrastructural networks. The increased physical capacity -the deeper and taller buildings- not only increased the scale of the
architectural practice in relation with urban planning, but also presented architecture the possibility to offer a wider social programmation for the reorganization of the urban territory. The increase in the scale of architectural production, this study would argue, has given rise to a critical tension between the fields of architecture and urbanism.
The aim of this study is to understand alternative positions towards the relationship between architecture and urbanism in the production of the city through a cross-reading of the architectural-urban theories of Le Corbusier and Rem Koolhaas.
At a very preliminary investigation, the urban thinking of Le Corbusier represents the modernist ideal in architecture that is after the rational and linear architectural production of the city with all its social, cultural and economic components. The theory generated by Rem Koolhaas, on the other hand, represents the end of the modernist ideal on the city, since it refuses the possibility of imposing a rigid, definitive and stable program on the city through the mediation of architecture. What separates these two positions is the turning point in the social and cultural structure that was experienced in 1960&rsquos, but what makes possible a continuous reading is the both architect&rsquo
s attempt to radicalize the scale of the architectural production, with diverse approaches towards its programmation. The study is an attempt to make this comparative analysis in order to understand what has changed from one to another in terms of their understanding of form, scale, program and context in architectural production, as well as their position towards social programmation of the urban organization.

firstly that of a historical personage and secondly of a researcher in the present day. Through the use of such a structure, Ackroyd parodies biography writing (by rewriting and distorting the life of a historical Londoner), and detective fiction (by making the contemporary researcher ineffectual and underqualified). These narratives, while being clearly separate and linear in themselves, focus on London, which acts as a bridge between the characters and themes in the separate centuries, culminating in their merge at the end. Thus, methods of rewriting in Ackroyd&rsquo

This thesis analyzes the effects of portfolio assessment on preschool teachers, preschool children and their parents. In addition, the effects on school education system of portfolio assessment were examined. This study was conducted in a private preschool in Ankara and the participants included 6 preschool teachers, 10 6 year-old children and their parents. The study had been applied in this school for one year by the researcher. Observations, interviews and questionnaires were used during data collection. Participants were interviewed and questionnaires were used during and at the end of the study. Given the focus of the study to examine and describe the use of portfolio assessment in a preschool, qualitative procedure were used. An interpretive case study was selected to be the method of research design. In order to analyze the data coding system was developed and was used to organize and clarify data gathered from teachers, parents and children. Results of the study were examined based on the research questions. It was found that, preschool teachers had positive attitudes toward portfolio assessment. In addition, this study showed that portfolio assessment supported preschool children&rsquos self-expression skills, self-confidence and their self-responsibilities. Parents also thought that portfolio assessment helped them to investigate their children&rsquo
s attitudes, interests and capabilities. Lastly, portfolio assessment application affected the preschool education system.

acknowledgement of the weakness, identification with the victor&rdquo

Nationalism constitutes the kernel of this psychology. Nation is the community of simple-minded ordinary people free of conflict: its inner harmony is disturbed only by external forces through conspiracies. This thesis investigates Bektashi responses to the abolition of religious orders in Turkey in 1925. In order to understand the immediate impact of the legislation among Bektashis, I analyze three series of articles and a novel written in that period, while also tracing the repercussions of similar narratives which were continued to be used by Bektashis in the subsequent decades. I, thereby, explore the ways in which Bektashis developed alternative narratives rationalizing and justifying the abolition of their religious order.
Since its proclamation, Law #677 regarding the abolition of religious orders has been subjected to many different readings by both the decision-makers of that period and the dervishes who were affected by the Law. In this thesis, I try to give an empathetic account of Bektashi readings, and argue that it is impossible to present a homogeneous stance by Bektashis towards the abolition of their religious orders, since there is a great diversity in their perceptions of the legislation, which are shaped by Bektashi cosmologies. Bektashis&rsquoresponses range from their harsh criticisms of the state policy to their imaginative strategies for accommodating the legislation. While arguing that Bektashis&rsquo
strategies exhibit common patterns that take shape around the strategies which I identify as accommodation, I still point out the significance of grasping the subjectivity within these strategies. Particularly Spiderman was chosen as a typical symbol of the superhero genre, futhermore Spiderman is found to be the favorite cartoon character in Turkey.The study was conducted in the preschool of Middle East Technical University in Spring 2007. Ten children
five girls and five boys, attending to the preschoolprogram participated in the study. The main emphasis in the present study is given to children'
s own expressionsvia drawings, play and interviews, to understand their ways to make sense of the superheroscenarios. Therefore selecting qualitative methods and aphenomenological approach in particular was considered to be a valid form of nquiry. At the end of the analysis procedure the total number of meaning units (MUs)was 40. In order to verify the results of the study, randomly selected 30 MUs were presented to completely independent and separate reviewers. The feedback from the reviewers indicated a high rate concordance of established at 86.6 %. After the results of this auditing process, confirmability of the present study is maintained. The results indicated that superhero theme was enjoyable for participant children, as it provided a sense of well-being. Aggressive behavior, which is generally linked to superhero issue, was hardly ever observed. However, gender is found to be a central factor on children'
s understanding of superheroes, and stereotypical thinking was perpetuated via superhero animations.

iragan Palace, built in 1841 but demolished in 1857. The English article system is extremely complex because of its conceptual abstractness and context-dependent usage. For these specific features, some second language learners (e.g., Japanese) find article acquisition to be very difficult. Traditionally, the definite article the is thought to express exclusively the referential function of "identifiability", that is, the is there to identify or pick out the referent so the hearer can identify what is being discussed (Lyons, 1999). This view has been widely accepted and has served as the foundation of research as well as for pedagogical orientations. Recently, however, these traditional notions have been heavily criticized as 'insufficient'. As a result, a cognitive, mental space notion of "accessibility" has been introduced (Epstein, 2002).This study was designed to investigate the effectiveness in teaching the English article the by comparing two instructional approaches: a traditionally-based approach and a cognitively-based approach. The study hypothesized, first, that article usage is contextually and conceptually configured; therefore, not all definite articles the exhibit the same level of difficulty (some are conceptually more complex than others). Second, the higher the complexity, the more difficult it is for learners to understand. Third, in light of these hypotheses, learners are predicted to benefit more from conceptually oriented instruction than structurally oriented traditional instruction.
In order to measure the effectiveness of these approaches, two comparable, computerized instructional treatments were created. The mental space treatment shows the learners the framework in which 'accessibility' to the object is emphasized, whereas the traditional treatment shows learners the framework in which 'identifiability' of the object is emphasized.
Eighty-three Japanese learners of English (41 in the mental space treatment and 42 in the traditional treatment) were recruited to test the hypotheses. Three lessons were administered individually; each lasted 1.5 to 2 hours (4.5 to 6 hours per participant). As predicted, the results revealed that there is a distinct order of complexity according to the conceptual load of the article the. The study also confirmed that the higher the complexity levels, the more difficult it is for the learners to learn. However, this conceptual complexity can be significantly alleviated when the conceptual framework is taught.

The implementation of this obligation remains a matter of state discretion. Since this Treaty came into force the world has evolved to become reliant on space based utilities to enable the global economy and state governance. Today, space faring states are increasingly dependent upon the supervision practices of other states to assure its space interests as the attribution of state responsibility becomes more difficult to ascribe.Therefore, the absence of binding supervision standards may become an impediment to future space applications due to three identified trends. First, the trend towards space commercialization requires active state supervision. Second, the rise in environmental hazards requires minimal safety standards to decrease the harmful effects on space applications. Third, space security requires identification of intentional acts and prudent measures to safeguard vital space applications.

Este trabalho divide-se em: a) estudo do extrato acetato de etila-hexânico de Leonotis nepetaefolia; b) estudo do extrato hidroalcoólico de Leonotis nepetaefolia. Do primeiro, isolou-se uma mistura de três esteróis, posteriormente identificados como campesterol 1, stigmasterol 2 e b-sitosterol 3. Também isolou-se uma amida derivada da fenilalanina, identificada como anomalamida 4, inédita na família. A determinação estrutural da amida foi realizada por análises de espectros, empregando-se técnicas de APT, HETCOR e espectrometria de massas. Os esteróis foram identificados por CGAR através de coinjeções com padrões. Do extrato hidroalcoólico, isolou-se uma mistura de flavonóides posteriormente identificados como Apigenin 5 e Luteolin 6, cuja determinação estrutural foi realizada por métodos espectroscópicos e por comparação com padrões por HPTLC.

My dissertation challenges the longstanding dismissal of love in James Joyce's texts by examining the ethical and political implications of his love stories. Primarily using Martin Buber's works (but also including perspectives derived from bell hooks and Julia Kristeva), I define love as an affirmation of otherness and adopt a critical framework that promotes the love of others over the narcissistic devotion to oneself. In so doing, I highlight love as the ultimate challenge to authoritarian systems because the embrace of the other is necessary to transcend the boundaries that alienate individuals from each other and that justify imperialist and racist political structures. I thus offer a love ethic that not only compels meaningful individual interaction, but also establishes a model for effective social and civic participation, encouraging a climate of cooperation that embraces the solidarity and empathy needed for progressive politics. I also argue that analyzing Joyce's works provides a fruitful opportunity to recognize the individual and political viability of this love ethic. Focusing on Dubliners, Stephen Hero, A Portrait of the Artist as a Young Man, Exiles, and Ulysses, I examine the relationships between his characters' pursuits of love and their socio-political struggles, arguing that their love for others directly influences their acceptance of otherness within the colonialist discourses of Joyce's Dublin. For example, James Duffy's refusal of Emily Sinico in "A Painful Case" also rejects her advice to engage in the political cooperation that would promote his socialist ideas. Similarly, Stephen Dedalus's promotion of symbolic romance over real-world attachments focuses his aesthetics on ideal beauty instead of everyday Dublin, which alienates him from his audience and limits the practical success of his art. By contrast, Leopold Bloom's love for his wife Molly reflects a broader empathy for others that encourages social dialogue and counteracts what Joyce called "the old pap of racial hatred," an element in both British imperialism and Irish nationalism. My dissertation's afterword anticipates the amorous potential of Finnegans Wake, reading ALP's concluding soliloquy as a demonstration of her enduring affection for HCE that is reignited through each iteration of the text's cyclical narrative.

After the terrorist attacks that took place on September 11, 2001, on American soil, a plethora of norms that enable military forces to shoot-down hijacked civil aircraft have been passed in several countries. Although these laws, decrees and executive orders are grounded on security reasons and they are allegedly aimed to protect people and vital interests on ground, this assertion does not emasculate the main difficulty they face in legal terms, which is the existence of an international provision that forbids the use of force against civilian aircraft. This thesis contains a detailed list of such domestic norms and conducts an analysis of their validity from the perspective of Article 3bis of the Chicago Convention and the right of self-defense granted to states by the Charter of the United Nations.

Looking at John Duncan's 1980 art performance, BLIND DATE, and its morally controversial content, I propose to investigate the nature of art's relationship to morality. My research consists of determining whether "immorality" represents an obstacle to the ontological identity of art and to artistic value. To question the authority of ethical criticism in art, I review a contemporary philosophical debate, which opposes two main schools, one in support of the validity of ethical criticism in art and the other against it. Following up on the second position, I elaborate a definition of art and a system of evaluation that aims to determine artistic value, both of which allow space for the potential artistic legitimacy of immoral art.

Foram medidas distribuições angulares do espalhamento elástico 17O + p e da reação de transferência p(17O,a)14N nas energias ECM = 1,39 e 2,33 MeV. Foi utilizado feixe de 17O produzido no Laboratório Pelletron, com energias de 25 e 42 MeV. As medidas foram efetuadas utilizando-se alvos plásticos de mylar aluminizado (C10H10O4) e polietileno (CH2) com espessuras de 354µg/cm² e 6mg/cm², respectivamente. As distribuições angulares experimentais do espalhamento elástico e da reação de transferência foram analisadas por cálculos de Modelo Óptico e Aproximação de Born de Ondas Distorcidas (DWBA), ambos levando em conta uma estimativa da contribuição do núcleo composto através de cálculos de Hauser-Feshbach. Em 42 MeV, foi medida uma função de excitação do espalhamento elástico utilizando o Método de Espalhamento Ressonante com alvo grosso de (CH2). Várias ressonâncias do núcleo composto 18F são observadas.Angular distributions of the elastic scattering 17O + p and of the transfer reaction p(17O, a)14N have been measured at the energies, ECM = 1.39 and 2.33 MeV. The experimental angular distributions of the elastic scattering and of the transfer reaction have been analyzed by optical model and Distorted Waves Born Approximation (DWBA) calculations, both taking into account the compound nucleus contribution via Hauser-Feshbach calculations. At 42 MeV, an excitation function of the elastic scattering has been measured using the Resonant Scattering Method with thick targets of (CH2). Resonances in the 18F compound nucleus are observed.

Com o motivo de explorar completamente o potencial que o processo de fabricação "filament winding" oferece, máquinas automáticas mais flexíveis e produtivas que as convencionais, estão sendo requeridas pelos fabricantes de produtos de materiais compostos. Algumas das características desejadas destas novas máquinas são: controle microprocessado; eixos servo-controlados; fabricação de peças variadas; fácil programação. Este trabalho descreve a automação de uma máquina de "filament winding" com dois eixos controlados e com as características detalhadas anteriormente. Para isto foram realizados: o dimensionamento dos acionamentos, o projeto e realização de um comando numérico dedicado ao processo, a integração eletromecânica e o desenvolvimento de um sistema do tipo CAM+DNC (em ambiente PC) para apoio à programação e à manufatura. Até o ponto de sua instalação em ambiente industrial.

This thesis aims to reflect on the expansion of guidelines in legal systems today. More specifically, the investigation aims at assessing the impact that these instruments may have on the production of regulations, questioning, where possible, the risks and benefits connected to their adoption. With this in mind, the study conducted in these pages begins by attempting to trace the first uses of the term "guidelines" within the domestic legal system and offers some interpretations of the reasons that may have favoured their use and subsequent diffusion. Later on, the observation of the most recurrent features of the instruments under examination opens some reflections on the dogmatic practicability of a regulatory model for guidelines, identifying the possible peculiarities and salient aspects both with reference to its expressions in domestic law, and with regard to the forms it has taken in other legal systems (national and supranational). Going beyond the more theoretical approach of the first part, the continuation of the work reports, instead, a review of the main examples of guidelines used within the domestic system, paying particular attention to those developed in the subsystem of independent authorities, those drawn up for clinical practice and those that, in various ways, have, finally, integrated the recent discipline of contrast to Sars-CoV-2. In this part of the work, the model hypothetically underlying the use of guidelines is put in relation with other and more classic constructions, giving rise to a comparison between the expressions of this new figure and the main characteristics of other and older legal institutions.
The last part of the text, proposing some summary considerations, aims to illustrate the possible results of the investigation, highlighting the consequences that the use of this model may have on the functioning of the system of sources and on the constitutional order.

s reforms turned into an uncompromising secularism, and consequently humanist culture and &ldquo
humanism&rdquo
became the quasi-formal ideology of the state. In order to spread the newly designed cultural policy, then unnamed &ldquo
Turkish Humanism Project&rdquo
was developed. The present dissertation starts with debates on humanism among those intellectuals who were influential over the decision of the state to support humanist culture. Following that, it analyzes the three pillars of the project, namely, Greek and Latin lessons in high school curriculum, establishment of the Translation Office, and opening of the Village Institutes, respectively. In the dissertation, the emergence of humanism in the country is discussed in an historical perspective. Moreover, the general understanding of both the intellectuals and the state of humanism as a solution to the problems faced in cultural and national identity-building process and in westernization movement is demonstrated. As that perception evolved into another perception that humanism was now the cure to all kinds of problems in the society, humanism was charged with tasks too burdensome for such a project to accomplish. This evolution is also demonstrated in the dissertation. The failure of all three pillars of Turkish Humanism Project is attributed not only to the political turmoil during the period but also to the inability of country&rsquo
s intellectuals to conceptualize any phenomena in question as well as their turning the project into a &ldquo
utopian romanticism&rdquo
in the course of time. Nevertheless, the most important factor behind the failure is defined as the rejection by then existing social structure of a concept to alien Turkish national-being, imposed on the society. Researchers currently are according a great deal of importance to the genetic analysis of Gabrielle Roy's writings. Indeed, the author's manuscripts reveal important details about her creative process. In this thesis, we study the changes the author made to both style and content at different stages of the writing of "Jeannot-la-Corneille", one of the recits making up Cet ete qui chantait. The latter is one of Roy's least studied books. Our analysis of the modifications the author made to the content and style of her texts allows us to understand the reasons behind these changes and gives us as well a sense of Gabrielle Roy's creative work. Admired for the apparent ease with which she writes, the author reworks her text tirelessly in order to achieve the desired effects: precision, accuracy and musicality. Adjectives, adverbs, nouns, all parts of speech are subject to change in this quest to improve descriptions and, in so doing, deliver more effectively a message of hope.

Leitura ou análise da obra poética de Antônio Gonçalves Dias - (1823/1864) fundamentou-se numa orientação específica da moderna teoria do discurso - a semiótica. Esta análise evidenciou a existência de dois projetos imbricados no poema gonçalvino, ou indianista e o mítico. O primeiro para colocar em relevo a superioridade do homem primitivo brasileiro - o índio é o segundo, para realçar a força de uma história sempre renovada - o mito. Esta dissertação comprovou a utilidade do modelo semiótico como um instrumento eficiente de análise do texto literário.

Uma série de 11 b-alcoxifeniletilaminas, das quais 7 são compostos novos, foram sintetizadas e caracterizadas na forma de seus cloridratos. Ensaios farmacológicos in vitro destas substâncias permitirarn obter as afinidades aparentes desses compostos por receptores serotonérgicos 5-HT2A e adrenérgicos a1, a partir de medidas de sua capacidade de induzir a contração de aorta torácica de rato. Cálculos teóricos semi-empíricos baseados no método AM1 foram realizados para estes compostos. As conformações mais estáveis foram deduzidas a partir destes cálculos e de estimativas baseadas em espectros de ressonância magnética nuclear de hidrogênio. As conformações resultantes foram então usadas na determinação de propriedades eletrônicas dependentes da estrutura de todos os compostos preparados. Estimativas de suas lipofilicidades globais (log P) foram obtidas a partir de valores de lipofilicidades locais por métodos descritos na literatura para compostos análogos. No estudo da relação estrutura-atividade, a análise estatística dos dados revelou que o valor obtido de afinidade (pD2) mostrou uma significante correlação com a lipofilicidade total das moléculas e a carga calculada para o átomo de carbono em para à cadeia etilamina. As afinidades in vitro correlacionaram pobremente com as energias HOMO dos compostos estudados, questionando um eventual processo de transferência de carga entre o receptor e o anel aromático. Ainda, os valores de afinidade correlacionaram razoavelmente bem com as potências descritas para algumas dessas drogas em humanos.
