Cílem příspěvku je představit, jak sledovaní začínající učitelé vnímají vliv pregraduální přípravy na své první roky praxe a jaké lze na základě toho vysledovat možnosti zkvalitnění přípravy budoucích učitelů.Metody. Výzkumný vzorek se skládá ze třinácti začínajících učitelů biologie/přírodopisu s praxí od jednoho do pěti let. Data byla získána prostřednictvím hloubkových polostrukturovaných rozhovorů a byla analyzována metodou zakotvené teorie.Z výsledků vyplývá, že nejlépe byla hodnocena složka odborné biologické přípravy, největší rezervy vykazovala složka pedagogicko-psychologická před oborově didaktickou. Obě složky pregraduální přípravy vykazující rezervy navrhovali respondenti posílit o pedagogické náslechy, aplikaci zážitkové výuky nebo zprostředkování výuky vysokoškolskými pedagogy či odborníky s reálnou pracovní zkušeností ve školství. Hodnocení pregraduální přípravy bylo ovlivněno šokem z reality vycházejícího z nepřiměřeného očekávání začínajících učitelů.Závěry. Za přínos této studie považujeme skutečnost, že přes jistou individuálnost názorů byly pozorovány určité trendy, které by bylo možné zohlednit při přípravě vzdělávacích programů budoucích učitelů, a dále to, že se nám podařilo rozkrýt klíčové spojitosti mezi jednotlivými složkami pregraduální přípravy ve vztahu ke zvládání školní reality začínajícími učiteli, což bylo vizualizováno abstraktním schématem v podobě tetraedru.

The aim of this diploma thesis is to analyse development in arranging of the real estate transactions in the Czech Republic after 1989 and describe contemporary condition. Contemporary condition was analysed as unsatisfactory. There does not exist any law that would regulate real estate market, neither is there a duty to proof a professional training or ability for the business. Real estate agencies do not have a good reputation in the Czech Republic and with many citizens they are unfavourable. As a reaction upon contemporary unsatisfactory situation, the Economic Bureau of the Czech Chamber of Deputies elected an operative group that is supposed to maintain a survey of the contemporary situation in the real estate market and suggest possible solutions. This work aims also to analyse the suggested solutions and to supply solutions that would be missing.

When after 1989 in our country have discovered the first real estate brokers and agents, were more or less a new professions, at times of socialism not existing. Since then have more than 2 decades passed, it will be interesting to compare the current state of the neighboring countries. First I will focus on the close one, Slovakia and then Austria, which belongs to the developed property market. I will look at various options of real estate agents and their functioning in all 3 states. The issue of legal liability of real estate activities will be submitted to the critical analysis and all the lessons learned will bring into mutual comparisons. I will also address the association of Realtors and appraise their position and function in different countries. An interesting part of this work will be determination of public opinion on public awareness of the importance of real estate services, I have made this research through polls.

The thesis maps the decision-making practice of courts in real estate cases and related areas. Judicial decisions are organized in logical parts and there was an effort to provide an overall and comprehensive overview of the opinions held by courts on the individual legal questions arising in real estate cases and thus define the most frequent causes of the disputes and their subject-matters. Explicated in the light of the decisions rendered by the Supreme Court of the Czech Republic and the Supreme Administrative Court of the Czech Republic, or even the findings of the Constitutional Court of the Czech Republic, are judiciary’s attitudes to the basic principles of real estate agency and real estate activity in general, as well as to relating legal questions, with special regard to the contracts usually entered into in real estate practice, primarily agency contracts and mediated contracts. So far, case-law of this kind has not been comprehensively studied, despite the fact that there still are uncertainties regarding both the real estate legislation and the approach to resolution of real estate cases, as well as ensuing typical contractual obligational relations between parties on the real estate market. This is also the reason why this particular topic was chosen for the thesis. Based on the coverage and a thorough analysis of the judicial decisions at issue a conclusion is made that decision-making practice has already stabilized in some real estate areas and these decisions are used as basis in future cases. Nevertheless, there still are some legal questions which have not yet been tackled by courts or conflicting judicial decisions, which may even be rendered in the most essential and fundamental issues of real estate activity. This is partly due to the fact that the real estate market is still a relatively young business field and partly due to missing or inadequate legislation which is to provide for real estate activity, including real estate agency.

On 1 January 2014 the new Civil Code no. 89/2012 Coll., which affected many areas, came into force. This thesis deals with the changes that have an impact on real estate activities. To the change of the Civil Code no. 40/1964 Coll. an introduction of new Cadastral law no. 256/2013 Coll. is closely related. Influence of this Cadastral law on a real estate practice is also described in this work. The conclusion summary of this work is a mapping of changes and an assessment of the extent to which they affect a real estate practice.

The thesis provides basic information on the activities of real estate agent, including accounting and tax solutions for selected topics. The thesis is divided into four chapters. The first chapter describes the real estate market with its basic elements. The second chapter examines the regulation of real estate activities in the Czech Republic and selected legislation relating to contracts in real estate. The section focusing on accounting transactions are shown as a result of the major real estate services, namely, the purchase, sale, rental properties and brokering. The last chapter deals with tax issues, which are selected from the provisions relating to real estate activities.

In the theorethical part of my dissertation I give characterization of legal treatment by real properties, including some selected problems and notification for drawing up of such contracts. Contracts are the main private- legal tool and with their help the owner carry out his proprietory rights. In the practical part my dissertation concentrates on selected real properte agency and on analyze of i´ts contracts praxis. I tried to identify differnces between contracts (particulary on bargain contracts and intermidiary contracts) according to civil code and commercial law. In the practical part there are further described and analysed some cases of unfair negotiations of this real properte agency

This paper is devoted to a critical analysis of the book I and Thou in the attempt to identify the main points of the dialogical philosophy as presented by Martin Buber. The introductory passages present the background of the book in terms of time (the era after WWI), cultural background (the influence of Hasidism), or the history of philosophy (an opposition to immanentism, monism, idealism, transcendental philosophy etc.). The main goal of the following interpretation is to try to understand man as a person in his complex existential situation, i.e. through his potential relationships or objectifying attitudes to the world. Being is described as a dual structure either of the basic pair of words I-Thou or of the basic pair of words I-It. As opposed to the usual use of the term, dialogue is defined as a specific interaction of man and the remaining world metaphorically expressible by the structure of addressing-responding. By this scheme, the characteristic reciprocity and direct continuity is expressed. The dialogue is also placed in the area "between" I and Thou, which mediates the genuine, immediate and transcendental knowledge constituting the reality.
