The prospect of layoffs and ongoing downsizing in governments due to budget cuts has generated growing concern about termination benefits for public employees, such as severance pay, transition assistance, and advance notice. This study analyzes the organizational reasons why governments should provide such benefits. The study also uses advance notice as an example, and the CPS-Displaced Worker Survey to assess whether such a benefit lessens the economic loss of layoffs for affected employees. The findings show that termination benefits are integral parts of organizational commitment to preser

This paper analyses the consequences of this new model and, specifically, of dramatically increased exposure to the risk of arbitrary termination or termination flowing from the impact of an ‘exogenous’ financial or policy shock upon Governmen

Abstract:
This chapter discusses the nature of termination for breach. Termination for breach can be seen both as a process and as a remedy. Traditionally, the topic has been dealt with under the broader umbrella of ‘discharge’, alongside such topics as performance, frustration, and agreement. Problems arise, however, when the notion of discharge is pressed too far; in particular, the idea of the contract ‘coming to an end’ can be a misleading one, and has given rise to various errors and misconceptions. For this and other reasons, more emphasis is now given to termination in the context of remedies. Termination can be one of the most useful weapons in the armoury for the victim of a breach of contract, not least because, unlike many other remedies, it does not require recourse to the courts. However, this notion of termination as a remedy should not obscure the close relationship between termination and the other modes of discharge, most notably frustration. The chapter then looks at the problems in this area of the law, including problems of terminology, the different ways in which common law and equity have approached the question, and the relationship between discharge and damages. It also considers the most important aspects of the right to terminate, including the right to refuse performance.

One of the features which distinguish a contract of employment from other contractual situations is that a contract of employment is one of continuous obligation, with, generally speaking, no specified time for its ending. If either the employer or employee wishes to terminate the contract, notice of such termination must be given. This chapter explores the rights and duties of both the parties to give and receive lawful notice in the event of a termination, ie if there is a dismissal or resignation. It also considers the taxation of payments, pay in lieu of notice, rights during the notice period, ‘garden leave’, notice pay on insolvency and time limits.

Abstract:
The US Nuclear Regulatory Commission (NRC) established criteria for acceptable residual radioactivity related to decommissioning nuclear power plants in the US [1]. A level of 25 mRem per year to the maximum exposed individual by site-specific pathways analysis, with ALARA is acceptable to the NRC. Systems and structures containing very low levels of radioactivity that meet this criteria are deemed acceptable to abandon in place as part of the decommissioning process and termination of the license. Upon license termination by the NRC, the owner may then demolish and remove remaining structures

Abstract:
In India, abortion has been legal for over 30 years, following the enactment of the Medical Termination of Pregnancy (MTP) Act in 1971. While the MTP Act permits abortion for a broad range of social and medical reasons, it also includes provisions regarding delivery of services that have proved to constrain access to safe and legal abortion for the great majority of women in India. Due in part to these constraints, up to 90 percent of the six million induced abortions estimated to occur annually in India are illegal—provided in uncertified settings and/or by uncertified providers.
