Abstract:
International human rights laws are grossly violated by the hudud ordinances, with their extremely cruel punishments, including stoning for adultery, beheading for apostasy, and amputation for theft. Pakistan, Sudan, Brunei Darussalam and Saudi Arabia, for example, follow the doctrines of the four main Sunni schools of jurisprudence and enforce hudud ordinances, thereby violating some of the core international human rights law instruments to which they are State Parties. Orthodox Muslims generally defend the hudud ordinances, claiming that they are divine and immutable. This study refutes the aforementioned claim and demonstrates that it is legitimate and possible to reform hudud punishments to reconcile them with international human rights law. The thesis differentiates between Shariah and Islamic law. It argues that Shariah refers to the divine rulings recorded in the Qur'an and correct Sunnah, while Islamic law is not fully divine, for it includes also such prescriptions that have been developed by the human effort of Islamic jurists. The thesis demonstrates that reformation is an Islamic concept that requires that Muslims read the teachings of the Qur'an and the Sunnah in the context of their own time and environment. It is postulated, therefore, that the rulings of Islamic law need to be examined in the light of the Qur'an, the correct Sunnah and the Islamic core values promoted in them. These include several internationally protected human rights, such as the right to life, equality, and freedom of religion. The thesis points out that the main purpose of Shariah is to serve the benefit of the people and to protect them from harm. To this end, Shariah has provided the Islamic principles of reality and necessity. These require that the reality of life and the needs of the people be considered at all times. If necessary for the sake of the people, the principles allow for exceptions to be made to even definite provisions. It, further, demonstrates how these principles can be applied to reform the hudud ordinances to reconcile them with international human rights law.

Faced with a unique oppression due to their racial and gender identity, a great disservice has been done to Black female athletes (BFAs) within the sporting literature as they have historically been silenced and rendered invisible, either in failure to include them in research, or in fragmenting their identities along racial or gender lines, thus presenting incomplete and inaccurate representations of their experiences. Employing a theoretical framework grounded in Black feminist standpoint theory, this study explored BFAs’ conceptualizations of femininity and microaggressions, as well as how their racial, gender, class, and athletic identities affect them within and outside of sporting environments. This study sought BFAs at 83 Division I institutions, asking them to complete a survey including the Bem Sex Role Inventory-Short (BSRI-S), the Racial and Ethnic Microaggressions Scale (REMS), and the Black Racial Identity Attitude Scale (BRIAS). Six BFAs opted-in to a qualitative interview. These BFAs presented multiple interpretations of femininity, discussed experiences with microaggressions, and spoke to how they navigated various contexts given their racial, gender, and athletic identities. While identifying hardships of being BFAs on college campuses and Black women in the United States, interview participants also discussed how their ability to withstand the unique mistreatment of BFAs and Black women left them feeling empowered and resilient. Implications for practitioners and researchers are also included.

Abstract:
There is an increasing consensus that access to forests and forest resources can contribute positively to the reduction of poverty among rural households in developing countries. Furthermore, forests contribute global environmental services such as mitigation of climate change through carbon sequestration. Therefore, sustainable management of forest resources is paramount to ensuring that these resources and services are available for current and future generations of nearby rural populations as well as more distant stakeholders. For most governments and their partners one of the key challenges to achieving sustainable forest resources is identifying a forest management approach that reconciles community interests and forest conservation goals. Currently forest co-management approaches receive support from governments and the donor community because they are hypothesised to have the potential to simultaneously advance community livelihood goals and forest conservation. However, there is limited evidence to support this hypothesis. Therefore this study uses both quantitative and qualitative methods to provide empirical evidence on the extent to which co-management programmes achieve sustainable forest management and reconcile multiple stakeholders’ interest in forests and forest conservation goals. The study uses the case study of the Improved Forest Management for Sustainable Livelihoods Programme (IFMSLP) in Malawi, which is funded by the European Union. The study was conducted in with Zomba district (Zomba-Malosa forest reserve) and Ntchisi district (Ntchisi forest reserve). Household interviews and forest inventory were used to: explore what local actors perceive as criteria for measuring the success of a co-management programme; assess whether co-management can achieved true devolution of powers and responsibilities to local institutions; assess the impact of co-management on forest condition, and; estimate the current livelihood and welfare impacts of the programme. The study shows that, other aspects of co-management and sustainable forest management such as: community participation in decision making; access to and availability of forest resources; and infrastructure development (which are usually not included in forest management impact assessment studies), are also important criteria for assessing a co-management programme from local actor’s perspective. The study also reveals that it is difficult for co-management programmes to realize true devolution because governments retain ownership of the forest and there is limited political will among state authorities to devolve rights and responsibilities to local institutions. The findings of this study suggest that the impact of a co-management programme on forest conditions may vary depending on pre-existing forest conditions as well as on how participating communities understand and interpret the programme. Therefore, due to lack of information on forest condition before the programme, it is difficult to determine the effect of co-management on forest conditions from one-time study data, even with method triangulation. 63% of respondents perceive that co-management has had no impact on their livelihoods. However, 80% are willing to pay) annual membership fees (mean = 812 Malawi kwacha ≈ $2) to participate in the programme, because of perceived possible future benefits. This shows that local people are investing their time and labour in co-management based on optimistic expectations, which puts them at a risk of being taken advantage of by programme initiators as there is no guarantee of a future benefit. Therefore, the opportunity cost of communities’ participation in co-management activities which provide global environmental benefits, is an important reason for governments to consider inclusion of Payment of Ecosystems Services (PES) in the programmes. Finally, the finding of this study suggest that forest co-management has the potential to reconcile community interests and forest conservation, however local actors’ attitudes; unaccountable institutions; tenure systems and; limited knowledge and skill development among local actors may limit its effectiveness.

Abstract:
A narrative qualitative research design was used to understand the journeys of three lesbians with Oneness Pentecostal backgrounds who have reconciled their religious beliefs with their sexual orientation. Three participants were selected who met the following criteria: (a) the participant is a lesbian female who (b) grew up in a Oneness Pentecostal church and (c) has reconciled being a lesbian with her religious beliefs, and who is (d) willing to discuss her outing process. These participants were interviewed. The interview questions were submitted to participants prior to the scheduled interviews. The interviews began with an open-ended inquiry. In answer to the research question, the three participants’ stories revealed that reconciliation journeys are unique and complicated. The motivation to embark on a journey of reconciliation of religious beliefs with sexual orientation stemmed from the participants’ same-sex attractions. Further motivators for the participants to explore and reconstruct religious beliefs were feelings of shame and guilt. The participants arrived at a place where they could no longer deny their feelings. As I read the participants’ stories, I analyzed the stories by utilizing the narrative therapy term of “re-authoring.” I found that the three unifying aspects of re-authoring in the participants’ stories were re-authoring religious beliefs, re-authoring definitions of family and re-authoring self. .

Abstract:
Carlo Scarpa, Italian architect, designer, painter, had a vision of a deliberate juxtaposition of the presence of the past against the backdrop of the present. Such are the conditions that describe various palimpsests, partially legible windows into the past. Reconstructing the Ca'Foscari (1935-37), Scarpa's first real commission marked the realized reconciliation between the old and the new. The finished work of the Ca'Foscari reflects the poetic manner in which the presence of the history and the present moment are allowed to be what they are no more, no less; yet the two operate in ethereal symbiosis. A perforated semi-transparency and sophisticated manipulation of light evolved to become the governing strategies for future projects. Revelatory changes in materials establish a relationship with an evolving fabric. Scarpa believed that arranging such exhibits as the Ca'Foscari project kept these delicate reconciliations at the forefront of one's mind. In an era of placelessness, Niall Kirkwood states that history's failures are repeating themselves. In efforts to "Hold Our Ground" he make the revelation that spaces built from the 1990's on may deteriorate faster than expected as landscapes evolve. Spaces are redesigned with new forms masking what was. Kirkwood proposes a working paradigm, similar to a palimpsest, to provide legible insight into a site's past. This thesis investigation is intended to explore possible reconfigurations of history's artifacts, lending themselves to a dialogue between the past and the present as applied to a conceptual palimpsest. This is possible taking Scarpa's ability of weaving a new work into the ongoing dialogue of an evolving fabric paired with the fusions of modern/historical impulses of sculptor Isamu Noguchi strung with Walter Hood's improvisational analysis whereas the site informs the design. This design project will take form as a revelatory unveiling of Love Plaza's history, one of Philadelphia's many reused canvasses.

Abstract:
This thesis traces the contested scholarship between the three activity topics of learning and teaching, research and academic and professional development. 11 published articles and 7 others that have been prepared for publication were used as exemplar articles for analysis. This included the history and context of the writing and the way in which the three topics hold together and the patterns or relationships that can be seen between them. Most of the articles aim to bring something new to the public arena and challenge the current status quo in Higher Education. The Learning and Teaching articles show active ways of developing learning and seeing things in a new light rather than absorbing knowledge, constructing or working from educational theory. In particular a curriculum is defined for all stakeholders. There is no necessity for teaching and learning to be the same as research but on occasion it helps for it to be “research like”. Research articles are on collaborative qualitative research and detailed reviews of scientific research in my discipline. In my educational research articles I stand up to the dominance of subject-based research. Development articles articulate the practice and facilitation of individual and group reflection methods. They also further the networking, pan-organisation, pro-person approach of academic developers. The analysis produces a dynamic model for Higher Education scholarship that opens up space for academic development and the neglected area of professional and personal development. In particular, some articles articulate and demonstrate the role of academic developers in evaluating research. There is no evidence for the need of a single nexus to fulfil a magical link specifically between learning and teaching and research because links already exist within academic and professional development and through existing border subjects of curriculum, reflection, professional ethics and evaluation. I am grateful for the guidance I have received to create this analysis of my written work. From this it is possible to position myself academically as a developer.

A presente dissertação intitulada: A Eclesiologia Latino-americana como acolhimento criativo do Vaticano II: Um caminho para uma nova recepção da herança conciliar desenvolveu-se estimulada pela reflexão que se vive hoje diante a uma mudança de época que demanda, por parte da Igreja, novas respostas aos desafios que se apresentam à evangelização na cultura atual. Parte-se do Concílio Vaticano II, onde a Igreja sente-se compelida diante do mundo a tomar decisões e dar um novo rumo à sua missão de evangelizar, promovendo assim uma renovação e mudança que possibilita uma nova consciência eclesial, que, por sua vez, é reconhecida e valorizada nos Documentos das Conferências Gerais do Episcopado Latino-americano. Esta nova concepção de Igreja adquire forte vitalidade no pós-Concílio na América Latina. A Igreja latino-americana, atenta aos sinais dos tempos, procura compreender e atualizar sua missão assumindo a realidade e a partir dela testemunha o Evangelho. As consequências eclesiológicas desta tradição latino-americana, possibilitada pelo Vaticano II, iniciada com a Conferência de Medellín e intensificada mais recentemente com a Conferência de Aparecida se apresentam como contribuições atuais para toda a Igreja e situam-se na direção de uma nova recepção da herança conciliar.
This dissertation entitled: The Latin American Ecclesiology as a creative host of Vatican II: A path for a new receipt to reconcile the heritage was developed stimulated by the reflection that lives today on an era change that demands, by the Church, new answers to challenges that present themselves to evangelism in today’s culture. Stems from Vatican II council, where the Church feels compelled against the world to make decisions and grant a new direction in Its mission to evangelize, promoting a renewal and change that enables a new ecclesial consciousness, which is recognized and valued in the General Conferences of Latin American Bishops’ documents. This new conception of Church has strong vitality in the post-council on Latin America. The latin american Church, attentive to the signs of the times, seeking to understand and update their mission assuming the reality and taking from it to witness the gospel. The ecclesiological consequences of this Latin American tradition, made possible by Vatican II, which began with the Medellín’s Conference and intensified more recently with the Aparecida’s Conference, are presented as current contributions to the whole Church and are in the direction of a new reception of the heritage council.

Abstract:
With an eye on the current social and political situation in Europe, and with regards to the so-termed refugee crisis, this study aims to map the discourse on assumed good and evil shared among Western cultures, as represented by Sweden, Germany and the United States.  The thesis takes its point of departure from essayistic reflections of the philosophical tradition and theological and religious analytical positions respectively. These are then followed by two investigative main chapters, designed along the lines of Norman Fairclough’s approach to critical discourse analysis (CDA). The first of these chapters studies the narratives of good and evil employed in the mainstream cinema of the past ten years in the mentioned countries. The second analysis is made up of three case studies, in turn looking at similar narratives in the campaigns of the two main competitors in the 2016 presidential race, a German protest movement against free trade agreements, and the everyday political communication of Swedish Facebook users. In a final chapter, findings from all four preceding chapters are brought together in an attempt to sketch an image of the congruences and discrepancies of narratives on good and evil in the overall discursive field. The thesis finds that the discursive field shared by the three investigated societies is largely homogenous, with certain imagery permeating all analysed orders of discourse. Many of the reoccurring images are however likely rooted in the human psyche and therefore less dependent on discourse practice. Furthermore, certain principles are agreed upon in theory while not reproduced in social practice. Themes assigned to either good or evil often seem to take on secondary functions next to assumed fixed identities of in- and out-groups.  Being a qualitative study, this thesis aims at giving an overview and delivering a base for further investigations rather than providing definitive answers.

Martha Nussbaum has produced a compelling account of how we might do justice to non-human animals, but in doing so she seems to have committed us to a project of ‘policing nature’, which appears to be at odds with many of the ethical commitments of the contemporary environmental movement. Intervening to make the circumstances of wild animals more conducive to their flourishing may be in accordance with the principles of Nussbaum’s capabilities approach, but it is at odds with the concerns of environmentalists who wish to ensure the functioning of ecosystems and the survival of species as an ethical imperative. Superficially, at least, it appears that one cannot endorse the capabilities approach and simultaneously be an environmentalist. In this thesis, I attempt to reconcile these two positions through appeal to the exercise of the virtues. While many of the premises of the capabilities approach and of the environmentalist accounts of ethics that I discuss are mutually exclusive, I suggest that an environmental virtue ethic, such as that described by Ronald Sandler, can justify many of the ethical stances that the environmentalist wishes us to adopt. In particular, characteristics of the virtue of humility can inform the agent as to why extending justice to wild animals is not a warranted course of action. I also apply virtue ethical considerations to the issues of species extinction and ecosystem destruction, areas in which the capabilities approach seems to offer little guidance. Thus, I propose augmenting our capabilities-based account of justice with an environmentally conscious appeal to the virtues in order to produce more consistent moral guidance with regard to the non-human world.

This paper offers a balance of the debate between morality (Moralitdt) and ethical life (Sittlichkeit) that acted as conceptual framework ot the controversies on morals over the past decades. lt is here shown that, in spite of the different tentatives to find a way to reconcile both paradigms, thc debate has not had a positive outcome. The reason of this failure lies in the conflicting interpretations on the notion of practical rationality. This thesis is obtained from an immanent analysis of the debate's development.
El presente artículo es un balance del debate entre moralidad y eticidad que durante las últimas décadas sirvió de marco conceptual a las controversias de la moral. Se muestra aquí que, pese a los diferentes intentos por hallar una forma de conciliación entre ambos paradigmas, el debate no ha tenido un desenlace positivo. La razón de este fracaso radica en el conflicto de interpretaciones sobre la noción de racionalidad práctica. Esta tesis es extraída de un análisis inmanente del desarrollo mismo del debate.

There is a popular misconception in the world that Jehovah is too severe on occasion while Jesus Christ is always kind and merciful. The Latter-day Saint belief that Jehovah and Jesus are the same person presents a supposed conflict. There has not been much written on this subject by either non-Latter-day Saints or Latter-day Saints, thus, this thesis represents a unique contribution to a common perception prevalent in many Christian circles. The research of this thesis shows that the misconception is based on three problems: first, a misinterpretation of biblical stories in both the Old and New Testament; second, a lack of understanding biblical context and culture; and third, a lack of applying modern revelation to this subject. The research of this thesis focuses on these three areas in an effort to resolve this false perception. This thesis takes a deeper look into the acts of Jehovah and Jesus Christ as found in the Old and New Testaments respectively. Next, it looks as several doctrines related to this subject that have been revealed through latter-day prophets and incorporates them into the Old Testament. This analysis paints a broader picture of the Lord and illustrates that He was, indeed, merciful in the Old Testament but, at times, severe in the New Testament. Lastly, this thesis takes four of the most difficult Old Testament stories that seem to represent Jehovah as harsh, capricious, and unyielding, and puts them in their cultural setting. Though not every act can be completely explained, there is a high degree of similarity between Jehovah and Jesus. The study concludes, therefore, that much of the problem lies with perception and not with reality.

This study was motivated by the latest revision of the mathematics syllabuses of the Cape Education Department. The most important changes to content in the Senior Secondary Mathematics Syllabus (July 1984) are the introduction of calculus and linear programming, the substitution of a section on analytical geometry for vector algebra and the recall of the remainder and factor theorems. The way in which these changes were introduced left the task of integrating them into the teaching process in the hands of individual teachers. This is a task of extreme importance. If one's classroom practice is to simply plough one's way through the syllabus, one loses many opportunities to make the study of mathematics meaningful and worthwhile. Accepting the view of the spiral nature of the curriculum where one returns to concepts and procedures at increasing levels of sophistication, one needs to identify the position of topics in this spiral and to trace their conceptual foundations. Analytical geometry is in particular need of this treatment. Similarly there are many opportunities for preparing for the introduction of calculus. If the teaching of calculus is left until the last moments of the Standard 10 year without proper groundwork, the pupil will be left with little time to develop an understanding of the concepts involved. It is the advent of calculators which presents the greatest challenge to mathematics education. We ignore this challenge to the detriment of our teaching. Taken seriously calculators have the potential to exert a radical influence on the content of curricula and examinations. They bring into question the time we spend on teaching arithmetic algorithms and the priority given to algebraic manipulation. Numercial methods gain new prominence. Calculators can even breathe new life into the existing curriculum. Their computing power can be harnessed not only to carry out specific calculations but also to introduce new topics and for concept reinforcement. The purpose of this study has been to bring about a proper integration of the new sections into the existing syllabus and to give some instances of how the calculator can become an integral part of the teaching/learning process

Paid domestic work endures – with its oldest roots grounded in slavery and servitude, and newer ones in contemporary exploitative capitalism. Feminists the world over have analysed its occupational relations in depth to show how they reproduce race, class and gender inequalities, with many domestic workers experiencing inhumane treatment. But feminists also use domestic help. Should such feminists and paid domestic work be condemned, or can it be reconciled with the overarching feminist goals of equality and liberation that encompass all dimensions of discrimination? My thesis approaches this question through an interrogation of outsourced domestic cleaning in the UK and India. The primary data include 91 semi-structured interviews with White and Indian women working as cleaning service-providers and White and Indian female academics with an interest in feminism/gender and who were outsourcing domestic cleaning (or had outsourced previously), in the UK and India, respectively. My analytical approach, rooted in my particular varifocal diasporic gaze, draws on Mary Douglas’s anthropology-based cultural theory, which she used to show how comparative analysis enhances sociological understandings of the workings of the West’s own institutions and culture. My cross-cultural analysis thus takes into account similarities and differences between and within the four groups of participating women, as well as silences in the data. My findings reveal that in the modern urban context, outsourced domestic cleaning can be done as "work" (i.e. using mental and manual skills and effort and performed under decent, democratic work conditions) or as "labour" (requiring mainly manual labour, accompanied by exertion of "natural" emotional/affective labour and performed in undemocratic conditions). The issue at stake for feminism(s) is not just some women doing the demeaning work of other women but the classed evolution of the very meanings of work in contemporary societies.

This thesis examines the emergent role of the Scottish Police Authority (SPA) in delivering organisational accountability of the Police Service of Scotland, following reform in 2012. The Police and Fire Reform (Scotland) Act 2012 amalgamated the eight local police forces into a single force, ‘Police Scotland’, and replaced the concomitant local police authorities, responsible for maintaining and governing those forces, into a national governing body: the SPA. The study draws on a broad range of qualitative data that includes official policy documents, selected minutes of public meetings held by the Justice Committee, and the SPA, inspection reports by HMICS and Audit Scotland, and interviews with a cross-section of stakeholders including a former Minister, senior police officers, members of the SPA, and MSPs. This study chronicles the inception and early development of the SPA, and critically assesses the SPA’s emergent accountability processes in relation to the perennial problems of police governance. Firstly, the doctrine of operational independence of chief constables, rooted in the traditional, and to-date “sacrosanct”, notion of constabulary independence (Reiner, 2013: 169), makes organisational accountability of the police a complicated and contested matter (Lustgarten, 1986; Walker, 2000; Donnelly and Scott, 2002a; Jones, 2008; Reiner, 2010). Secondly, there is a perpetual debate about whether the governance of police should be situated within local government structures, or delivered through central government. There is consensus among policing scholars that the persistent trend towards greater centralisation, coupled with the operational independence doctrine, curtailed the performance of the local police boards and their ability to hold chief constables to account (Walker, 2000; Donnelly and Scott, 2002a; Scott, 2011; Reiner, 2013). Amidst the tussle between central and local political actors for democratic control of the police, the recent policy discourse in Scotland, that led to the reforms and the creation of the SPA, has highlighted that the governance of the police requires expertise, skills and capacities, which the previous local police authorities lacked (Tomkins, 2009; Laing and Fossey, 2011). In light of the persistent difficulties of democratic governance, and the creation of the SPA as an expert body, the study presents an original conceptual framework outlining an ‘epistocratic and deliberative’ approach to police governance. The framework seeks to reconcile democracy and expertise and offers a prescriptive solution to resolve the underlying problems of police governance. The study applies the notion of epistocracy or knowledge-based rule (Estlund, 2003, 2008) to the role of experts in institutional settings (Holst, 2012; Holst and Mollander, 2014). Conceiving the SPA as an institutional epistocracy, it is argued that such an arrangement needs to be underpinned by the right Composition, and that it needs Power, and Autonomy in order to function effectively and independently. It is further argued that principles of Deliberation, including reasoning and justification, can further strengthen epistocratic governance arrangements, as well as providing a crucial democratic dimension. The analysis of the SPA provides a strong empirical basis for the framework. The study shows that while the SPA was created as a professional body of experts, it was unable to resolve the underlying problems of police governance in its first three years. This was due to inadequacies in its composition resulting from insufficient expertise and a lack of training for new board members, differing interpretations of its role and statutory powers, and external pressures and impositions resulting in a lack of autonomy. Looking to recent developments, the study suggests that deliberative principles are now implicit in the SPA’s approach to more proactive scrutiny, which has started to serve to alleviate some shortcomings and problems it encountered in its formative years. However, the study concludes that further strengthening of the SPA’s composition, clarity around its role and powers, greater autonomy, and explicit focus on deliberative principles is needed.

Specific focus is drawn on higher education an important task if we are to consider the accusation that higher education like its society, is still undergoing transformation and is under pressure to provide quality education for all people whilst also considering the large numbers of cultures that exist. For much needs to be done in redressing the imbalances caused by the apartheid education system which was organized according to racial lines. In doing so, Nelson Mandela Metropolitan University is utilised as a case study with narrative presentations of how students perceive this traditional African value and its applicability to reconciliation in a post conflict society. For seemingly, there is something inherently important about this value in that it has been invoked and referred to in many important instances in South African history.

Since the EU-ETS was placed at the centre of EU climate governance in 2003,its influence has not been restricted to environmental policy but has spread to theeconomic and political domains. But its implementation remains blocked even after the EU revised it by the Climate and Energy Package (CEP). The larger problem is, the ‘East-West’ split toward the revised EU-ETS triggered by the ambitious but ‘missions complicated’ CEP and diffused to energy governance, which put EU's climate governance into the deadlock (Wettestad, 2014). Skjærseth and Wettestad (2009, 2010) argued that the revised EU-ETS could be the result of the changing MS’ preferences, but they did not unpack these preferences formulated during the EU-ETS implementation. This thesis fills the gap by reinvestigating the EU-ETS implementation to identify what the domestic contextual factors are and how they affect and reshape MS’ preferences to the EU-ETS. By applying the five stage policy-making cycle andthe multilevel governance (MLG) in this study, it is concluded that the difficulty offixing the EU-ETS is not merely limited to the revised climate governance structure, but also the need to reconcile MS’ energy-economic structures and coordinate with their climate and energy policy. To solve the MS’ problem of ‘asymmetrical energy-economic interests’, it is vital for the EU to improve the cross-level reconciliation between the EU-ETS and national energy policies and to increase the coordination between policy instruments when reforming the EU’s climate governance structure. The EU-ETS development encourages both national and EU’s climate governance structures to fall in line with MLG concepts (flexible design and more jurisdictional levels involved in the policy network). Therefore, it has become the turning point of European integration, by which the traditional dichotomy between ‘top-down’ and ‘bottom-up’ integration starts transitioning to the ‘two-way reconciliation.’

This paper deals with the causes behind policy divergence concerning non-product related production and process methods (nprPPMs), specifically Canada’s preference for voluntary labeling regimes and the European Union’s (EU) preference for mandatory labeling regimes. The causes behind this divergence are explored in three case studies: labels for genetically modified foods, animal welfare labels, and ecolabeling. Particular attention is paid to the differing approaches to risk analysis (RAF), namely that Canada employs a scientific-based approach to this framework, while the EU more often employs a social-based approach. While it has been common for many academics to attribute these diverging approaches to differences in consumer preferences and civic interests, this paper argues that these explanations do not fully account for these policy outcomes, as demonstrated by the similarities in consumer preferences and civic movements in these regions. Instead, diverging regulatory approaches are caused by systematic institutional differences. This paper then focuses on reconciling trade barriers caused by diverging regulatory approaches using methods of policy coordination, specifically mutual recognition agreements as a bilateral approach and policy harmonization as a multilateral approach. In regards to policy harmonization, relevant international agreements and organizations pertaining to nprPPM labeling regulations are discussed, most notably relevant WTO rules. This paper concludes that bilateral efforts to reduce the negative trade effects caused by the three case studies will be extremely difficult to resolve due to the fact that Canada and the EU are engaged in a regulatory competition between global powers for the dominance of either a science-based, or social based approach to RAF. This competition has resulted in vague international rules, which are therefore incapable of facilitating policy harmonization at the multilateral level. This paper will conclude that Canada and the EU are unlikely able to reconcile trade barriers caused by at least of the two case studies discussed here, GM food labels and animal welfare labels. Recommendations are made for bilateral and multilateral efforts to prevent further trade barriers caused by future nprPPM regulations.

Abstract:
This study enters into the dialog within Christian theology between annihilationism and traditionalism on the nature of eternal punishment. The positions and issues within the topic will be examined theologically and analyzed doctrinally. In my first chapter I will summarize the views and arguments in the debate, establish operating definitions, address preliminary issues, and provide some historical context. I will establish a thesis agenda with dual aspects: negatively, to examine and critique annihilationism on theological grounds, and positively to offer arguments for a modified traditionalism. Chapters two, three, and four primarily serve the negative purpose. Chapter two critically considers annihilationism on exegetical and hermeneutical issues, concluding that the view is inferior to traditionalism. Chapter three examines annihilationism for consistency with other areas of Christian theology, concluding that the view generates major theological problems in Christology. Chapter four considers both annihilationism and traditionalism regarding the disproportionality problem of hell, concluding that annihilationism and two types of traditionalism can resolve the problem but of these three only one sort of traditionalism can do so whilst also satisfying other important theological criteria. Regarding the negative aspect of the thesis, I conclude that the severe theological problems in annihilationism constitute sufficient reason to reject the view. In chapter five I accomplish the positive aspect of this thesis, offering six criteria of success for any view of eternal punishment. I then provide detailed argumentation for a modified traditionalism called reconciliationism, concluding it best meets these criteria and is the most theologically and exegetically satisfying view on offer. In the concluding chapter I state this thesis' contributions, suggest several areas for further research, and offer some implications for pastoral theology. I finally conclude that annihilationism has seemingly insurmountable theological problems, but a modified traditionalism can succeed as a doctrine of hell.

Software product line engineering promotes large software reuse by developing a system family that shares a set of developed core features, and enables the selection and customization of a set of variabilities that distinguish each software product family from the others. In order to address the time-to-market, the software industry has been using the clone-and-own technique to create and manage new software products or product lines. Despite its advantages, the clone-and-own approach brings several difficulties for the evolution and reconciliation of the software product lines, especially because of the code conflicts generated by the simultaneous evolution of the original software product line, called Source, and its cloned products, called Target. This thesis proposes an approach to evolve and reconcile cloned products based on mining software repositories and code conflict analysis techniques. The approach provides support to the identification of different kinds of code conflicts ? lexical, structural and semantics ? that can occur during development task integration ? bug correction, enhancements and new use cases ? from the original evolved software product line to the cloned product line. We have also conducted an empirical study of characterization of the code conflicts produced during the evolution and merging of two large-scale web information system product lines. The results of our study demonstrate the approach potential to automatically or semi-automatically solve several existing code conflicts thus contributing to reduce the complexity and costs of the reconciliation of cloned software product lines.

Among several consequences of the anthropocentric belief, the loss of nature's autonomy was one of them, resulting in creation of a space under humans' domain. This space is named housing, which used to be integrated with its surroundings. However, as time passed, it went rigid and was cut off from nature. This work examines the emergence of a new, autonomous, nature, fostered by electric power, by the new technologies and by a technical and informational culture, which has allowed housing to return to a now artificial nature. We appropriate the Media Ecology theory, which has Marshall McLuhan as its primary thinker, as our theoretical and conceptual substance. This is followed by a case study, on which we analyse the television series Downtown Abbey (2010) and the book Lady Almina e a Verdadeira Downtown Abbey: O Legado Perdido do Castelo de Highclere (2012), making an empirical corpus which juxtaposes another object: the experiences of Leonie M?ller, an german student who, since 2015, lives in the trains in her country. Within the case studies we adopted fitness to the pattern, using the Massimo Di Felice's dwelling triad, emp?tico, exot?pico and at?pico (2009). In conjunction to this analyses, the concepts of contemporary, by Agamben (2009) and heterotopia, by Foucault (2013), complement the comprehension tools for these objects.

The central theoretical argument of this study is that biblical mediation may be a useful short-term method for use in pastoral care, specifically within the bounds of reconciliation in troubled marriages. The goal of formulating a basis theory was to explore what the Biblical teaching is on marriage, marital conflict, mediation and reconciliation. In general, a revelation-historical approach was followed. Specific cases of marital conflict in the Bible were examined. In researching reconciliation the role of Jesus Christ and pastors as mediator was explored. A grammatical-historical exegesis was done on Mat. 59, Mat. 18:15-17 and Rom. 14:19. It was concluded that marriage is a union of companionship based on a covenant and ordained by God and foreshadowing the eternal joyous relationship between Christ and the Church. God hates divorce, which is permitted only in certain circumstances. It was found that biblical teaching on conflict in general may be applied to marital conflict. It was concluded that although not all conflict is caused by sin, sinful attitudes and behaviours, including sinful desires or legitimate desires elevated to demands and distortion of the husband - wife roles designed by God before the Fall, do play a part in causing conflict. With regard to reconciliation it was concluded that Jesus acted as Mediator on the cross, making possible reconciliation between God and man, which also reflects God's will for the horizontal relationship between his people, particularly in marriage. Several examples of informal mediations and of calls to peacemaking were found in the Bible. It was found that Mat. 185-17 allows for mediation or counselling by one or two others in the church in certain circumstances. For establishing a meta theory the goal was to examine biblical mediation as a third party intervention in pastoral care for reconciliation in troubled marriages. A literature study was conducted on mediation, biblical mediation as taught by Peacemaker Ministries and on marital conflict and intervention methods resembling mediation by a survey of the literature in the social sciences. A qualitative empirical study was conducted, by doing biblical mediation with three Christian couples. It was concluded that mediation, and particularly the biblical mediation model used by Peacemaker Ministries, may be used to advantage by pastors for reconciliation in troubled marriages. The aim of establishing 'a practice theory was to propose a biblical mediation model to guide pastors in working toward reconciliation in troubled marriages. This was done by an analysis and synthesis of the basis - and meta theory in hermeneutical interaction.

The thesis tracks the emergence of western forms of nationalism in republics of Post- Soviet Central Asia, and assesses the likelihood of ethnic conflict in the region, and its probably consequences. It also considers the means by which the heterogenous populations in Central Asia may be more effectively accommodated within the individual republics. The thesis is conceived in three sections. The first section examines the causes and consequences of ethnic conflict, and discusses the implications of ethnic conflict in Central Asia from the perspective of state sovereignty and international security. The second section assesses the evolution of ethnicity and identity in Central Asia, the impact of Soviet nationalities policies and the impact of newly enforceable territorial sovereignty on the interconnected populations of the region. The third, and concluding, section considers the impact of state actors and regional and international institutions on the Central Asian republics, and considers strategies that may mitigate the potential for ethnic conflict in the region. The thesis concludes that emerging ethnonationalism in Post-Soviet Central Asia poses a real threat to regional and international security. The individual republics are pursuing policies which discriminate against large proportions of their populations. The Central Asian republics are also struggling with their newly found sovereignty, especially in respect to their asymmetrical relationships with states such as Russia, China and the U.S.A. The republics should consider alternative forms of governance, such as national cultural autonomy or consociation, which may contribute to a lessening of the tensions between ethnic or identity groups. The international community, in the form of the United Nations or other appropriate organisations, should recognise the potential for ethnic conflict in the region, and should actively encourage the states to adopt innovative forms of government that accommodate the diverse needs of their heterogenous populations.

Este trabalho analisa a din?mica social de um grupo de ?guas em tr?s dimens?es: di?dica, tri?dica e coletiva. Est? dividido em tr?s Cap?tulos cujos objetivos s?o: 1) descrever intera??es di?dicas afiliativas e agon?sticas e caracterizar a din?mica social de parcerias preferenciais; 2) analisar ocorr?ncias e intera??es em conflitos (interven??es de terceiros) e p?s-conflitos (reconcilia??o, consolo e apaziguamento) e 3) caracterizar a din?mica de movimentos coletivos sob an?lises de fatores pr?prios do indiv?duo (idade, peso, ranque e estado reprodutivo). O estudo foi realizado no Haras Volta (Frei Paulo, SE, Brasil) em 2012 e 2013. Foi observado um grupo de 64 ?guas e 20 potros lactentes da ra?a manga-larga machador. Foram realizadas tr?s tipos de observa??es diurnas: 1) focal (ocorr?ncias de comportamentos agon?stico, afiliativos, sincronia e mudan?a de dire??o = 130 horas); 2) todas as ocorr?ncias de conflitos em 304 h e 3) varreduras (posicionamento e atividade = 117 varreduras) que geraram informa??es de proximidade (valor da rela??o), rede social e dist?ncias entre os animais. No Cap. 1 descreveu-se que as ?guas se envolveram mais em afilia??o do que em agonismo. ? poss?vel que a sincronia na dire??o possa ser um tipo de afilia??o tamb?m nessa esp?cie. ?guas mais velhas e mais pesadas tiveram ranques mais elevados, mas n?o houve categoria mais agressiva que outra. Parceiras preferenciais apresentaram similaridade em idade, peso, for?a nos relacionamentos e centralidade social, sendo que a din?mica social dessas parcerias caracterizou-se por proximidade e baixo agonismo entre parceiras. A afilia??o e a sincronia foram mais direcionadas para animais neutros do que para parceiras preferenciais. Animais mais jovens (potros) foram socialmente mais centrais e animais com necessidades nutricionais diferenciadas (prenhes e lactantes) e de alto ranque foram menos centrais socialmente. Mais da metade do rebanho esteve direcionado, com anteced?ncia, para o sentido que o grupo veio a seguir e o ?ndice de concord?ncia na dire??o (ICD) foi maior quando o grupo se deslocou mais. This study analyzes the social dynamics of a group of mares in three dimensions: dyadic, triadic, and collective. It is divided in three chapters which objectives are: 1) describe the dyadic affiliative and agonistic interactions and characterize the social dynamics of preferable partnerships; 2) analyze the occurrences and interactions in conflict (third part interventions) and post-conflicts (reconciliation, consolation, and appeasement); and 3) characterize collective movement dynamics under analyzes of individuals features (age, weight, rank, and reproductive state).The study was carried out at Volta Haras (Frei Paulo, Sergipe, Brazil) in 2012 and 2013. A group of 64 mares and 21 suckling foals of manga-larga marchador breed were observed. Three daytime methods of behavioral records were employed: 1) continuous animal-focal (registering occurrence of agonistic and affiliative behaviors, synchrony and change of direction) totaling 130 hours; 2) all occurrences of conflict in 304 hours; and 3) scan (position and activity) totaling 117 scans which generated closeness information (value of the relationship), social network, and distance among the animals. In the first chapter, we describe that the mares were more involved in affiliation than in agonisms. We suggest that synchrony in direction is a kind of affiliation in this species. Older and heavier mares had higher ranks, but there was not a category that was more aggressive than the other. Preferable partners presented similarities in age, weight, strength in the relationships, and social centrality, being the social dynamics of these partnerships characterized by closeness and low agonism among the partners. In the second chapter, we report that reconciliation, comfort/appeasement, and intervention in conflicts (IC) occurred in 57%, 37%, and 31% of the conflicts, respectively. The occurrence of reconciliation or dispersion may be strategies to reduce the social uncertainty/instability post-conflict. The conflicts occurred between mares with low closeness, and reconciliation was not dependent on the value of the relationship (friendship), but the comfort and appeasement did were. The intervention in conflicts were performed by mares with higher rank and age than the opponents of the conflict, and it was not directed to preferable partners, suggesting maintenance of the social stability. In the third chapter, we detected that there was not a category of individuals that positioned themselves to the center of the herd with higher frequency. Older mares tend to be ahead of the group. Younger animals (foals) were socially more central and animals with differentiated nutritional needs (pregnant mares and suckling ones) and high rank were less socially central. More than half of the herd was directed, with anticipation, to the direction that the group started to follow, and the agreement index in the direction (AID) was higher when the group moved more. This may suggest that the direction of the group?s movement was determined by the direction of the body of the majority of the animals (minimizing consensual costs), which may have occurred by the mimetic synchronization process, suggesting a simplified way of coordination (leadership) distributed in grazing. Empty and low rank mares adjusted more their directions in grazing towards the other mares. This indicates more occurrence of mimetic process of synchronism, which may lead to the coordination of the movement to be performed by animals that keep more consistency in direction or older animals.

Abstract:
The European Union (EU) and Faroe Islands, a small self-governing archipelago under the sovereignty of Denmark, both belong to the North-East Atlantic Fisheries Commission (NEAFC). NEAFC is a regional fisheries management organisation (RFMO) which is responsible for the management of, inter alia, Atlanto-Scandian herring. NEAFC parties have a long-term management plan in place for Atlanto-Scandian herring. Based on recommendations from the International Council for the Exploration of Seas (ICES) the parties set a total allowable catch (TAC) for the herring and divide this among the contracting parties each year. At the 2012 consultations between the NEAFC parties the Faroe Islands requested a larger share of the TAC. The Faroe Islands left the consultations after the other parties repeatedly refused this request. It was granted a share of the TAC by the other four states in its absence. It then set its own catch quota far above this allocated share. In response the EU put in place port state measures to prevent Atlanto-Scandian herring from entering the EU. This included an import ban and a ban on the use of EU ports by Faroese vessels. The EU took this action under Council Regulation (EC) No. 1026/2012 (Shared Stocks Regulation) which allows measures to be imposed against third countries that allow non-sustainable fishing of common or straddling stocks. This includes measures taken against RFMO partners for non-compliance with RMFO laws, as RFMOs are generally set up to conserve straddling fish stocks. This Regulation was promulgated in line with a number of multilateral environmental agreements (MEAs) such as UNCLOS and the United Nations Fish Stocks Agreement (UNFSA). The Faroe Islands challenged the Shared Stocks Regulation and the specific Implementing Regulation imposing the port state measures in both the World Trade Organisation (WTO) and a Tribunal constituted under the United Nations Convention on the Law of the Sea (UNCLOS). However the matter was settled before either of these tribunals could hear the case. The dissertation interrogates whether the EU Regulations are consistent with WTO law, specifically the General Agreement on Tariffs and Trade (GATT), using the facts of the Atlanto-Scandian herring dispute. Chapter I sets out the background to the dispute, and explains the concepts of illegal, unreported and unregulated (IUU) fishing, and port state measures. Chapters II and III of the dissertation consider the consistency of the EU Regulations with the GATT. Chapter II finds that the EU Regulations contravene one or more of Articles I, V and XI of the GATT (the substantive provisions). Chapter III considers whether these measures, having contravened one of the GATT substantive provisions, may be justified under Article XX of the GATT (the exceptions provision). Chapter III concludes that, although well-crafted, the EU Regulations may still not be justifiable under the Article XX Chapeau in the particular circumstances of the herring dispute, based on principles in previous WTO cases. Chapter IV considers the relationship between multilateral environmental agreements (MEAs) relevant to IUU fishing and WTO agreements, to determine whether the EU Regulations could be considered GATT-consistent by reference to these MEAs or whether the MEAs could override WTO law. Chapter V concludes.

This thesis is focused on problem data reconciliation of measurements. The objective of this thesis was reconciled measured value from electric drum dryer to suit exactly to the mathematical model of drying. For solution was used nonlinear data reconciliation with constrained nonlinear optimization. The entire calculation is processed in programme MATLAB and outputs are graphs of reconciled values of measurement on dryer such as inlet and outlet temperature and humidity, differential pressure of exhaust moisture air, weight of laundry, atmospheric pressure and electric supply. Achieved solution can by characterized by an amount of evaporated water. Weight of wet and dry laundry are 27,7 kg a 17,7 kg. The calculated amount of evaporated water from measurements was almost 18,8 kg. With reconciled measurements it was 9,7 kg. Goals of the thesis were found more realistic values.

With the progress of the times and an increased demand for family economy, homemakers have gradually gone out from the kitchen to join the workforce. As female supervisors, it is essential for the majority of them to know to reconcile between their work, marriages, and families. In this study, a grounded theory was adopted to conduct in-depth research on how female supervisors manage to reconcile their marriages and work and how they maintain their families. The study results are as follows: 1.How female supervisors do good jobs: The family environment is closely related to a female supervisor’s personality traits. Based on the research interviews, it was found that those that came from families with limited means displayed good power to overcome challenges and good critical thinking and they knew better how to manage their families and establish interpersonal networks. 2.How female supervisors reconcile their marriages and work: The past and present work experiences of husbands and the husbands’ recognition of their wives’ roles and positions are helpful in reconciling their work and marriages, with the husbands being able to focus on their careers, successful experience modes, and complementing the role of their better half. In terms of recognition of the roles and positions of wives, the first and most important thing is for couples to reach a consensus, and work should be separated from private space and time. 3.How female supervisors maintain their families: Whether or not the children in the family are independent, the husbands’ parents recognizing the position of their daughter in-laws, sharing a similar direction toward children’s education, giving children more learning opportunities and space, fostering children’s independent thinking ability, and receiving support and advice from the grandparents were all very helpful in reconciling between work and family.

The thesis examines representations of the matriarch in three Chinese Canadian texts: SKY Lee's Disappearing Moon Cafe, Wayson Choy's The Jade Peony, and Denise Chong's The Concubine's Children. The matriarch is the female head of the Chinese household who is able to gain substantial power by manipulating the assets granted to her in a patriarchal system. Dislocated from her home in China, she serves in these texts as the focal point for the collision between the New World, Canada, and the Old World, China. Confronted by a new environment, the matriarch must decide whether she will choose conformity or identity experimentation. The thesis is concerned with the way Chinese Canadian writers negotiate multiple identities through narrators who must come to terms with the divided loyalties of the women of the past. The analysis of the matriarch's identity shifts is informed by the work of the feminist theorists, Elspeth Probyn and Moira Gatens, who explore the productive potentials of rebelling against binary codes. The thesis is divided into three chapters that discuss how the texts come close to embracing identity fluidity, but cannot overcome the need to reach a coherent representation of the matriarch. The first chapter is devoted to Disappearing Moon Cafe, and argues that Lee's narrator sacrifices her female characters, albeit reluctantly, in order to privilege feminism over her Chinese heritage. The second chapter turns to The Jade Peony and discusses how Choy's child narrators give in to binary thinking by relegating Poh-Poh, the Old One, to the realm of memories to make room for the New Ways. The final chapter on The Concubine's Children explores Chong's desire to redeem a grandmother who wreaked havoc on the family when she defied traditional gender roles. The thesis concludes by determining that Lee, Choy, and Chong are reaching for a multi-voiced reading of the past, but cannot yet articulate a way out. The uncertainty of their representations of the matriarch signals their efforts to move beyond binaries to a state of coexisting identity categories.

It was an adventurous journey to reconcile with my own body. For more than a decade, I struggled with my body weight and suffered from the fear and anxiety of being fat. I have had enough! I am going to end this pursuit of becoming slender and in doing so, hope to relief myself of this frame of beauty that has left me in frustration and agony. Through self-narrative, I began looking at myself, face on, turning to the bountiful life wisdom as the source of my learning. I began by divulging my own story and the first step to facing me was to reveal how I, and my shapeless figure, managed to survive in a culture with dire pursuit of being thin. In order to get down to the core of my motivations of losing weight, I rummaged through the memories that my body and I had shared through the growing years. Those include memories of innocent childhoods past as well as the disappointment and feelings of inferiority as my family compared me with others. Moreover, there were stories of a fat girl’s journey through adolescence and school years. However, after reviewing my own story and some other literatures, there were some surprising findings. I found that my image of my body would change with my physical change and the environmental change. The obese body image not only interactively influences my self-esteem, it also affects how I present myself in different social context. Further, from looking at my non-stop, aggressive weight loss plans, I realized that I have done that in order to ease my anxiety and inferiority thinking that I would become a better person if only I am slimmer. Nonetheless, when I tried to understand the build-up of my body image and the experience of losing weight from the social cultural aspect, I found that I valued my body based on the outcome of my interaction with the society. How I value my own body was also changed by my interaction with mass media, which went from strongly agreeing to questioning, to being outrage and then to settling into forming independent opinions towards the information it provides. The continuous process of adventure, review, confrontation, and understanding helps me to think out of the box of being fat or thin. I have thus learned to appreciate my various appearances and values. Also, I start to think how I want my body and me to be in the future; how I can create a positive, nourishing environment for my body; and how I will be able to draw a positive interaction between myself and the artilleries of society and, at the same time, learn to display my independence and keep a steady mind. This is a precious journey of discovery and honing of the strength that lies within oneself. I thank God for the ingenious arrangement. In the past year, I learned to perceive my feelings towards my body, and listen to and response to the needs of my body. I realized that my everyday life would be happier and more hopeful if I stay healthy, happy, and satisfied. The whole experience of doing research, learning, and practicing also gives me the strength, attitude, and resources to keep moving on. Now, I have more courage to get to know more stories of my body, as well as other important memory in my life. Finally, I wish my sharing would inspire others to listen to different opinions, to be brave enough to share their experience, or even to do something to defend them.
