On assiste aujourd'hui à la prolifération de l'expertise et le recours aux experts est devenu un phénomène de mode qui n'épargne pas la politique artistique. La compétence du professionnel culmine dans l'expertise et, si tous les experts ne sont pas des professionnels au sens que le mot revêt dans la sociologie anglo-saxonne, ils aspirent généralement à le devenir. Les responsables politiques et administratifs, de leur côté, ont pris l'habitude de faire appel à la capacité d'objectivation des experts. La commission d'experts apparaît ainsi comme la version actualisée du processus de consultation très général et très ancien de l'administration républicaine, à la fois protection et alibi. L'art étant devenu, au terme de la rationalisation, une activité spécialisée, on ne saurait s'étonner que le modèle de recours aux experts se soit généralisé au point de dominer les institutions culturelles et le marché.

Dès son instauration en 2002 et jusqu’à sa réforme en 2021, le congé de paternité de onze jours a fait l’objet d’un succès immédiat. Court, bien indemnisé et répondant aux normes contemporaines de « bonne » paternité, toutes les conditions semblaient réunies pour favoriser son utilisation. Dans ce contexte, ce sont moins les pères qui utilisent ces deux semaines que ceux qui renoncent à leur droit qui interrogent. Qui sont les pères qui n’utilisent pas le congé de paternité en France ? Comment expliquer ce non-recours ? Peut-on y lire la revendication d’une paternité « traditionnelle », particulièrement attachée au modèle de « l’homme gagne-pain » ? À partir de méthodes mixtes, cet article identifie les caractéristiques des pères qui n’ont pas pris leur congé et retrace les mécanismes sous-jacents à ce phénomène. Si la priorisation de la sphère professionnelle est un frein essentiel à l’utilisation du dispositif, cette focale d’analyse ne permet pas de rendre compte d’une large partie des cas de non-recours, en particulier chez les pères non insérés dans un emploi salarié stable. L’étude revient sur la pluralité des formes prises par le non-recours, qui peut aussi tenir à des obstacles informationnels et administratifs.

À l'instar de chercheurs d'autres disciplines, les démographes s'interrogent sur les usages et les effets sociaux du savoir qu'ils produisent. Cependant, si l'on s'inquiète de l'utilisation que font les milieux politico-administratifs des connaissances démographiques — et des effets pervers qui peuvent en découler —, les différents « objets » auxquels font eux-mêmes appel les démographes dans leur travail ne semblent pas avoir suscité le même intérêt. À travers une analyse de travaux de recherche qui ont défendu la thèse de l'existence d'un « système africain » régissant les comportements procréateurs et sexuels, cet article cherche à attirer l'attention sur le caractère hybride du savoir démographique et sur les différents enjeux qui entourent la construction d'une « Afrique distincte ».

Abstract:
Le Comité de règlement des différends (CRD) de l’Autorité de régulation des marchés publics (ARMP) constitue une nouvelle institution devant contribuer à la mise en œuvre de la législation sur la commande publique en République Démocratique du Congo (RDC). Cette étude vise à examiner sa nature juridique et sa distinction, du point de vue organique et fonctionnel, des cours et tribunaux. Elle tente également d’identifier quelques leçons que l’on peut déjà tirer de la pratique qui forme sa « jurisprudence » depuis qu’il est à pied d’œuvre en 2013. Il est démontré que le CRD dispose d’importants pouvoirs administratifs qui le singularisent et le démarquent des cours et tribunaux avec lesquels il n’est en position ni de dualité ni de complémentarité de compétences. Il s’agit plutôt d’une institution administrative dont la création en tant qu’organe technique de l’ARMP procède de la volonté de moderniser l’administration publique et de déconcentrer le système de traitement des recours administratifs en matière de contentieux des marchés publics pour plus de transparence et d’efficacité aussi bien que pour une meilleure protection des droits garantis aux citoyens. En dernière analyse, l’étude démontre que la « jurisprudence » du CRD est riche en ce qui concerne notamment la délimitation de la portée de sa propre compétence et le droit qu’il applique aux litiges qui sont soumis à son appréciation. A cet égard, sa contribution à la protection de l’Etat de droit en RDC mérite d’être particulièrement saluée.

Abstract L’internement politique a joué un rôle important dans le processus par lequel l’administration coloniale française a essayé d’amener les Kanak, le peuple indigène de Nouvelle-Calédonie, sous domination française. Dans le cadre d’une étude examinant la fonction et l’héritage de l’indigénat dans la régularisation des relations entre Kanak et colons, cet article développe une étude de cas de l’internement des Kanak jusqu’en 1928. Contrairement à penser les représentations coloniales et populaires, la majorité des internés kanak n’étaient ni des « chefs » ni des « rebelles ». Les autorités avaient recours à l’internement pour réprimer les actes de la résistance quotidienne, imposer la discipline dans les réserves et renforcer l’autorité des chefs administratifs. En examinant la façon dont les mesures d’internement se sont traduites localement, négociées et mises en place, nous contribuons à la compréhension de l’évolution locale de l’indigénat et de sa place au sein du système colonial.

Cet article traite de la mise en récit des situations de vulnérabilité comme mode d’accès aux prestations sociales. Il montre que les droits sociaux sont conditionnés par des critères d’accès et de maintien dans la prestation qui sont traversés de normes, notamment celle d’apporter la preuve d’être un ou une bon·ne pauvre. L’article pose l’hypothèse que la mise en récit des situations spécifiques dans le cadre de recours administratifs ou juridiques pour accéder à des prestations s’apparente à une forme de résistance face au pouvoir symbolique et institutionnel de l’État.

L’objectif de cette étude est d’identifier à partir d’un échantillon de 102 ordonnances de mains levées d’hospitalisation sans consentement par la Justice les principaux motifs en cause et de déterminer des pistes d’amélioration. L’étude a porté sur 102 ordonnances soit 149 motifs soulevés. Les motifs ont été classés en 9 groupes :– les irrégularités médicales observées 29 fois, dont l’incompétence médicale, la non nécessité médicale ;– les irrégularités administratives observées 22 fois dont les délégations de signatures irrégulières ;– l’identification du signataire impossible, et l’absence de motivation des actes administratifs ;– le défaut du contradictoire observé 48 fois qui inclut le défaut d’information du patient sur sa situation juridique, ses droits et les voies recours et le défaut de recueil des observations du patient ;– le non-respect des délais pour les certificats médicaux, des décisions administratives, et de saisine du juge des libertés et de la détention et le délai de réponse de l’ordonnance du juge des libertés et de la détention observés 20 fois ;– l’absence de documents observée 18 fois qui concerne l’absence de certificats médicaux et l’absence de documents transmis au greffe du juge des libertés et de la détention ;– les défauts de procédure portant sur le tiers observés à 6 reprises ;– l’absence d’information du mandataire judiciaire observée à 3 reprises ;– l’absence d’examen somatique réalisé dans les 24 h observée à 2 reprises et la non-conformité du programme de soins observée à 1 fois.La diminution des mains levées pour ces motifs apparaît indispensable dans l’intérêt de nos patients qui se retrouvent privés de soins en milieu hospitalier, et doit passer par une bonne connaissance de la loi par les différents protagonistes intervenants dans le processus de soins psychiatriques sans consentement.

L’indicateur souvent utilisé pour mesurer la fécondité des immigrantes et pour comparer son niveau à celui des femmes natives est l’indice synthétique de fécondité. Cependant, des recherches ont montré que cet indice tend à surestimer les écarts entre les immigrantes et les natives, car il attribue un niveau de fécondité qui reste marqué par l’âge des femmes au moment de l’arrivée. Pour contourner ce problème, il est nécessaire d’avoir recours à des approches longitudinales qui considèrent la partie de la vie féconde qui précède la migration. Au Québec, il est possible d’estimer la fécondité des immigrantes à l’aide de données de registres administratifs qui suivent des cohortes au fil du temps. Dans cet article, nous présentons la méthodologie employée pour estimer le nombre d’enfants mis au monde avant et après la migration et nous comparons la fécondité des immigrantes selon la descendance des générations. Les résultats montrent que la fécondité des femmes immigrantes au Québec est influencée par le calendrier de la migration. Quant aux estimations de la descendance à divers âges, le nombre moyen d’enfants varie selon la région de provenance, mais il ne dépasse pas les deux enfants par femme vers la fin de leur vie féconde.

Abstract:
Introduction. L’internat est une source de stress et de travail des internes en médecine. Elle pose la question de leur recours aux substances psychoactives comme un reflet de leur difficulté au travail. Objectif. Évaluer la prévalence de la consommation de substances psychoactives par les internes en médecine. Méthodes. Une enquête épidémiologique descriptive transversale par questionnaire anonyme a été menée auprès de l’ensemble des internes en médecine, toutes spécialités confondues en région Auvergne-Rhône-Alpes. Les différentes associations, syndicats et services administratifs des scolarités de chaque faculté ont permis de diffuser l’enquête. Le recueil de données s’est déroulé durant 2 mois par un logiciel sécurisé. Le critère de jugement principal était l’évaluation de la prévalence de consommation des différentes substances psychoactives débutées avant et pendant l’internat chez les internes en médecine. Résultats. Parmi les 540 questionnaires (78,7 %) analysés, 453 internes avaient consommé au moins une substance psychoactive durant leur internat dont 422 (93,2 %) l’avaient débutée avant ce dernier. La plupart des consommations était à usage festif, à l’exception des médicaments psychoactifs, de la morphine et ses dérivés. Le principal moyen d’obtention de ces substances (hors tabac et alcool) était par le biais de connaissances (60,5 %). 19,4 % des internes avaient déjà travaillé sous l’effet de substances psychoactives (hors tabac et substances à visée thérapeutique) et 37,1 % d’entre eux pensaient que leur consommation pouvait nuire à leurs capacités au travail. Pour les non-consommateurs, la raison principale était la peur des effets néfastes. Conclusion. Cette étude a montré une forte prévalence de consommation des différentes substances psychoactives chez les internes en médecine de la région Auvergne-Rhône-Alpes, majoritairement à but festif. Celle-ci était plus importante chez les internes de médecine générale et des autres spécialités médicales.

Abstract:
In the light of historical tensions, this article considers some classical administrative law responses to changing techniques of public administration. Rejecting the customary reproach that law is unresponsive to the needs of public administrators, the article nonetheless identifies a widespread conviction that control and accountability are the primary objectives of administrative law. The response of administrators overwhelmed by procedural requirements is to fall back on ‘soft law’ techniques. The article notes the growing use of ‘soft law’ and recourse to ‘soft’ techniques of governance in the European Union, together with a possible convergence of legal and administrative values, as standards of ‘good governance’ and ‘principles of good administration’ acceptable to both sides are promulgated and enforced by courts. As ‘good governance’ standards are disseminated by international and transnational institutions, the article predicts a similar pattern of tension and evasion, as procedurally oriented administrative law systems enforced by transnational adjudicative organs develop to occupy the global administrative space.

Abstract:
This article describes the issue of governance in higher education, of which administration is key, is saddled with numerous challenges, as such, new approaches are being sought out to enhance the process. It is obvious that Information and Communication Technology (ICT) is a tool that enhances administrative activities of higher education institution. This article is based on descriptive survey design which investigates the impact of ICT on the administrative services/management of students' records in Nigerian universities. A questionnaire was the research instrument employed, and questionnaire items were developed through a review of related literature. A total of 200 respondents participated, comprising students, lecturers and administrators were randomly selected from ten universities in Nigeria. Data collected was analyzed using ANOVA. The major impacts of ICT in administrative services/management of students' records in Nigerian universities were identified and discussed. Suggestions are made on the need for Nigerian universities to widen the scope of ICT application in administrative services to fully reap the benefits of ICT.

Abstract: The general report highlights the replies given to nine questions, by scholars from different legal systems. The problem of the fragmentation of international sources of law has been widely considered in the literature. It affects also the private law field. Judges and practitioners dealing with cross-border cases have to districate themselves between local rules on conflict of laws, international treaties on the law applicable to transnational relationships, conventions providing uniform material rules, and collections of principles by non-governmental organizations. The enquiry showed that the concern about the difficulty of districating this complex network of rules is mainly shown by academics. The supporting role of the executive (providing information about international obligations) is not everywhere reliable. Judges sometimes receive special training to tackle the increasing complexity of transnational law, but mostly in connection with EU law. The benefit that might be attached to a courts' specialization (in international commercial matters) is not as higly valued as to be implemented everywhere; the attitude of administrative, commercial, criminal courts is not perceived as highly diversified. In some countries the courts do adopt strategies to elude the difficulty (by a presumption of identity of the foreign sources with the local ones, by attaching a waiver of their rights to the parties' omission to plead the foreign law immediately, etc.). No definite suggestions on how to increase the awareness about the problem and how to face it seem easily available. Résumé: Le rapport général commente les réponses données par les rapporteurs nationaux à neuf questions concernant la complexité des sources transnationales. Le problème de la fragmentation des sources internationales du droit est discutée depuis de nombreuses années dans la littérature juridique: elle concerne aussi le droit privé. Les juges, les avocats, les praticiens du droit confrontés à des questions qui dépassent les frontières nationales doivent se débattre parmi les règles nationales de droit international privé, les traités internationaux concernant les conflits de lois, les conventions qui règlent de façon uniforme les rapports transnationaux, les innombrables principes issus d'organisations non gouvernementales. Les études entreprises dans ce secteur indiquent que le souci concernant la difficulté à s'orienter parmi cet ensemble inextricable de règles est exprimé principalement par le monde académique, tandis que le pouvoir exécutif (chargé d'informer les juristes sur les obligations internationals de l'Etat) ne joue pas toujours efficacement son rôle de support; une formation spéciale est offerte aux juges, mais surtout pour le droit de l'Union Européenne; l'avantage qui pourrait dériver d'une spécialisation des cours (en droit du commerce international) n'est pas considéré partout comme une nécessité; le comportement des tribunaux administratifs, criminels, commerciaux n'est pas perçu comme très différencié selon le sujet des sources transnationales. Les juges de certains pays mettent en oeuvre des stratégies pour contourner ces difficultés (en faisant recours à une presumption d'identité entre le droit étranger et le droit national, en présumant une renonciation à l'application du droit extra-national si les parties n'ont pas soulevé la question dès le début du procès, etc.). The subject of the article is an analysis of the realisation of the right to access to administrative records in public administration authorities. This right is the most important manifestation of the right of access to the records, which a party to administrative proceedings is entitled to. The right to access the administrative records is limited by the fact that the party has access to incomplete, unstructured, unnumbered records or unavailable records without issuing a refusal of access to the records, as well as access to the records in places not adapted for that purpose. The right of access is also limited by the following restrictions which do not exist in the Code of Administrative Procedure but are applied by the authorities: the hours of visitors and the queuing system. A party should be able to review his or her personal records during the office’s working hours in a room adapted for that purpose. I propose that the party should be able to access the records in the body’s information and communication system at on-line remote.

The collected data will undergo descriptive analysis. Based on the research findings, numerous advantages can be gained from installing electronic administration information systems at hospitals, notwithstanding any challenges or difficulties. Because they can improve the effectiveness and efficiency of hospital services in registering and storing patient data, registering, recording inpatient medical records, recording doctor data, recording room data, and producing administrative reports that management is required for decision-making and patient medical record information for insurance claims, electronic administrative information systems in hospitals are practical to implement. Electronic health records (EHRs) pose unique concerns for administrators and information technology professionals with regard to cybersecurity. Due to the sensitive nature and increasing value of personal health information, cyber risks and information protection should be a high priority. A literature review was conducted to identify potential threat categories and best practices in protecting EHR information. Potential threats were identified and categorized into five areas; physical, portable devices, insider use, technical, and administrative. Government policies have created administrative, physical, and technical safeguards to keep EHR information safe. Despite these efforts, EHRs are being targeted by cyber-criminals due to flaws in personal and organizational management of protected healthcare information. This paper aims to educate, inform, and advocate for the proper handling of EHRs to alleviate the burden caused by compromised electronic documents.

Abstract By looking at list-making and comparative assessments of trade, this article on central administrative practices of record management aims at discussing the mobilization of archives in French colonial supervision in the eighteenth century. A Bureau des Colonies was created in the French Secretariat of the Marine in 1710: from the very outset, its main mission was to deal with the colonial records, mostly correspondence, through which the colonies were administered. Archives had been collected and classified in the Bureau des archives from 1699 onwards. But this implied an effort in the organization of papers: throughout the eighteenth century, the imperial administration created several other documentary tools that produced a simplified and ideal vision of the empire and of its place in the global order. Looking at the kinds of papers produced by the colonial administration and where these records were kept provides insight into how the central authorities understood the colonial empire. The paperwork shaped the way administrators understood empire, through operations carried out by the clerks on the records. Records were collected from all the colonies and actors, with a growing sense of being a unique agency possessing relevant records that were reduced to similar storage units by agents without field experience. In fact, archives became crucial in strengthening the empire as a political unity, under a centralized metropolitan direction, mainly after the Seven Years’ War.

Administrative effectiveness in secondary schools is germane to making education relevant to the growth of the society.The operational processes and functions in school administration depend on the good management of the documented activities of the school programs, infrastructures, staff and students found in school records for successful executions. Previous studies found that school records were basically created in paper formats which ran into many volumes with the problems of inadequate storage and in-effective preservation methods among others, although the studies did not use the records life cycle in the appraisal of the records management practices. These reported poor records management practices made the retrieval of school records difficult and sometimes impossible resulting in in-effective school administration. This paper examines the influence of records management practices on administrative effectiveness in public secondary schools in Lagos State, Nigeria. Survey research design was adopted for this study and the instrument for data collection was a questionnaire administered on a sample size of360 administrative team members in public senior secondary schools in Lagos State, Nigeria. Data analysis was done using frequency counts and simple percentages to answer the research questions while regression analysis technique was employed to test he hypotheses. Research findings revealed that the schools have all the statutory and non- statutory records for proper and adequate administrative duties, the records management policy manual was available and the records management practices were based on the records life cycle in the public senior secondary schools in Lagos State. Additionally, the study found that the records creation stage was well managed while the maintenance and use stage were fairly managed and the disposition stage was poorly managed. Based on the findings, the study recommends the provision of equipment that would ensure that school records are properly stored, preserved and disposed to achieve best practices in records management for effective school administration.

AbstractArchaeologists working with complex societies are concerned with the administration of political economies. Beginning with the premise that there are differing forms of administration and that bureaucracy, in the classic formulation of Max Weber, is one of these, I develop a heuristic dichotomy between two types of administrators: stewards (who closely supervise goods and people) and bureaucrats (who process and control information). Bureaucracy is often linked to written records, but in the Central Andes alternative methods of record keeping were developed, such as the quipu or knotted string record. I argue that one alternative record-keeping device was an architectural form, the U-shaped structure. U-shaped structures are closely identified with the administrative architecture of the Chimu kingdom (ca. A.D. 850–1470) on the north coast of Peru. Four independent lines of argument demonstrate the development of bureaucracy from stewardship at Chan Chan, the capital of the Chimu kingdom. Brief comparisons are made between the Chimu administrative pattern and commodity and information flow in the earlier Huari and Tiwanku civilizations, and with the later Inka pattern. These comparisons show how record-keeping technology affects political economy and the strategy of expansion.

In order to realize effective records management, educational institutions actively utilize digital technology through electronic archive management to improve the quality of services provided to customers. This study aims to determine the management of electronic records, the quality of administrative services, and the relationship between electronic archive management and the quality of administrative services at Madrasah Aliyah Negeri in Bandung Regency. The approach used is quantitative with the type of correlation. The data collection technique was carried out using a questionnaire. Then after the data is collected, it is processed with the help of the SPSS program using instrument test data analysis techniques (validity and reliability), partial indicator analysis test, prerequisite test (normality and linearity test), and correlation test using Pearson correlation and determination test. The results of the study stated that electronic records management had a positive relationship with the quality of administrative administration services, with a significance level of 0.000 <0.05. There is a type of variable relationship that leads to a positive nature due to the Pearson correlation number of 0.566 which does not have a (-) sign in the number, the relationship between the two variables is unidirectional and means that the better the management of electronic records, the better the quality of administrative services. administration. Then the coefficient of determination (R square) obtained is 0.321, which means that the contribution of electronic records management variables to the quality of administrative administration services is 32.1%.

Purpose The purpose of this paper is to critically examine the reasons behind the relatively poor level of implementation of e-services. To this end, records management procedures in a particular Belgian federal administration – the Belgian Federal Public Service (FPS) Employment, Labor and Social Dialogue – will be studied. Based on this concrete and relevant case study, the authors examine how cross-organizational differences in terms of the implementation speed of digital workflows can hinder the development of innovative e-services. By doing so, the authors raise relevant questions about the efficacy of digital workflows and work processes. The impact on the consultation and exchange of government records among public services and toward citizens will be examined as well. Design/methodology/approach In the context of an on-going four-year research project named HECTOR (Hybrid Electronic Curation, Transformation and Organization of Records), the study is conducted from an interdisciplinary approach, closely combining information sciences and law. Moreover, this approach also has implications on information sciences through the integration of archival principles at an early stage of conception of hybrid (paper-based and digital-based) records management strategies, instead of confining archivists to a depository and preservation role. This “integrated archival” approach is highly encouraged to anticipate best practices for the long-term preservation of records (Rousseau and Couture, 1994). Furthermore, the project adopts a bottom-up approach based on an exploratory analysis of the particularities of hybrid records management within a project called “e-PV” led by the FPS Employment, Labor and Social Dialogue to draw general conclusions that could eventually be applied to other public services. In this case study, standardized surveys were used to collect information from a manager perspective, followed by in-depth interviews with field workers. Findings The miscellaneous reasons for the aforementioned poor level of implementation are a continuously decreasing public budget, a strongly rooted resistance to change, the difficult but inevitable cross-organizational relations between public administrations, the legal uncertainties arising from a fast-changing digital environment and the political autonomy in the decision-making process of the different public entities. As a consequence, the substantial differences between the many public administrations lead to a lack of interoperability not only at a technical level but also at an organizational level. The many local and other non-connected initiatives that this situation has generated do not help fostering collaboration either. The absence of well-established records management policies is interpreted both as a cause and a consequence of some of the factors mentioned before. Research limitations/implications Research is carried out within Belgium’s particularly complex administrative context, where competences are not only spread but also shared at multiple levels (national and regional) and in multiple domains (legislative and executive). Consequently, the political decision-making process is also highly complex. Nevertheless, the observations and the findings of the study are deemed to be applicable to any administrative structure (both national and international ones). Originality/value This paper outlines the constraints of an almost completely implemented eGovernment initiative which may guide other public administrations in the development of their own e-services, as well as showing them the importance of taking into account records management and archiving principles. The multidisciplinary approach represents a significant added value.

It finds that the concept of the ‘administrative record’ is far more significant in United States administrative law than in either English or Australian administrative law, and suggests why this might be so. The research work ascertains the availability and accessibility of digital records keeping among university administrators in Nigeria. To accomplish the survey's goal, two research inquiries were put forward, and two corresponding alternative hypotheses were developed to direct the investigation. A survey research approach was employed. The respondents consisted of 498 university administrators. The instrument used for the study was the Availability and Accessibility of Digital Record Keeping among University Administrators Questionnaire (AADRKUAQ). A trial test was carried out on 50 administrative staff at Ebonyi State University that yielded an overall reliability coefficient of 0.85. Mean and standard deviation were used to answer research questions, and the t-test was equally used to test the research hypotheses at the 0.05 level of significance. According to the findings, digital record keeping is widely available and accessible. Whereas the alternate hypothesis revealed no significant difference in the extents of availability and accessibility of digital record keeping among gender, it was strongly recommended, along with many other things, that the school administration should embrace international standards for accessibility and availability of digital record keeping. The level of mastery of computer operations 0% of all managers. The problem that occurs in this farmer group is that there are no administrators who can operate the computer, so the administration has not been well organized. All documents are written manually using separate books and note papers. Especially in making reports of Lembaga Keuangan Mikro(LKM) that must be reported every month to farmer groups, they must collect from many records and not infrequently there are records that are scattered or lost which cause reports especially financial statements to be invalid. The objectives of this partnership program are: (a) Giving skills to operate computers, especially office application programs for farmer group administrators. (b) Giving skills in making invitations automatically using a mail merge facility. (c). Improve ability in recording and making financial reports. The methods used: (a) the preparation stage, (b) the implementation stage, (c) the evaluation phase and (d) preparing the report. The results of this activity, the average level of mastery of computer utilization for administrative activities are as follows: Mastering (0.78%) and Self-mastering (0.22%), Output of PKU is increasing the ability of partners to use computer applications for administration to 70% of the original target of 50%. In his discussion of the nature of law St Thomas Aquinas cites St Augustine's principle that an unjust law ceases by that very fact to be a truly binding one, and this remark provides us with a useful springboard for a discussion of how different institutions have dealt with the occurrence of such a problem within their own systems. There are two principal factispecies envisaged when we deal with such a scenario within the Christian community; when a law has been interpreted erroneously by its officers and when the law is applied by the administration with a rigidity that exceeds the intention of the legislator. In these circumstances, it is arguable that we are dealing not with true law as such but with the corruption of law, non lex seil corruptio legis. The expression corruptio legis is here understood not in a subjective but in an objective sense, i.e. it is not to be understood to refer to the administration or the officials that apply the law but to the legal norm itself. The issues raised by the principle, non lex sed corruptio legis, are not simply ethical but also legal, and the important resolution in Augustine and Aquinas offers a useful window into one of the central problems of comparative administrative law.

This causes health services that should be handled quickly cannot be carried out. Therefore, the researcher is interested and aims to design a website-based medical record administration management system at the Dian Rapha Medika Clinic Toraja. This study uses the waterfall model design method, which consists of 1) Needs Analysis, 2) System Design, 3) Implementation, and 4) Testing. The data collection techniques in this design are 1) Interview and 2) Observation. The results of this study indicate several advantages when using digitization of administrative services for medical colleagues at Dian Rapha Medika Toraja clinic, namely: 1) assisting in digitally documenting patient medical record data; 2) input of patient medical record data is easier and faster; 3) facilitate doctors in analyzing the patient's medical records; 4) searching for patient medical record data is easier and faster; 5) storage of medical record data is more concise and well-structured due to the integration of patient data and medical records so that it can accelerate administrative management at the clinic.

Dès leur origine et par leur évolution, les instances décisionnelles en matière de prestations d’assurance-chômage ont constitué une contribution notable au renouvellement des institutions administratives au Canada. Le cheminement historique de cet aspect de la protection sociale illustre le lien étroit entre l’édification de l’état providence et le développement de la justice administrative. Positif à plusieurs égards, le bilan de cette évolution dans la procédure administrative de l’assurance-chômage jusqu’en 2012 appelait néanmoins un double constat d’inaboutissement, quant à l’aménagement des recours, et de renoncement, quant à l’aménagement de la phase initiale du processus décisionnel. La comparaison avec l’évolution des institutions britanniques, devancières et inspiratrices du modèle canadien, confirme cette évaluation en demi-teintes. Introduction: In achieving the goals of government or private organizations, it is very necessary to manage administrative activities in an orderly and orderly manner, one of the activities in the Administrative Section is archival activities. The role of archives is very important in organizational activities as a center of memory and a source of information. Similar to records stored and managed by hospitals, hospital records are created along with the many activities carried out. Methods: The purpose of this study was to find out the description of archive management in the BLUD Administration Sub-Division of Banjar City General Hospital in 2021. This study used descriptive research methods and used a qualitative approach, using research instruments in the form of interviews, observations, and documentation. Results: Results of the study show that there are 3 human resources in the Administration Sub-Section, each of which has a role as the Head of the Sub-Division, Administration, and Archives. The archival facilities used are quite complete and adequate, and the archive management process has mostly been carried out in accordance with the regulations and procedures in the hospital. Discussion: It can be concluded that the management of archives in the Administrative Sub-section of General Hospital Banjar City is quite good, seen from all components supporting the needs of the Banjar City General Hospital Administration Sub Division. The Administrative Sub-Section needs to maximize the use of storage racks, and use electronic archive storage as a whole, it is necessary to create or create an archive borrowing control card, and archive management employees need to review the destruction of archives in accordance with applicable guidelines so that archive destruction can be carried out.

211 Background: The Palo Alto Medical Foundation (PAMF), an integrated multispecialty physician group and one of five regions of Sutter Health in Northern California, is converting from an electronic chemotherapy ordering and administration system, Intellidose, to Epic Beacon to achieve full EHR integration. As chemotherapy workflows are complex with multiple interactions between providers and high potential for patient harm, we adopted a novel approach of incorporating Lean process improvement principles in advance of our Beacon deployment to improve the design of our software build and increase operational safety and efficiency. Methods: Two multi-disciplinary teams including oncologists, pharmacists, nurses, administrative and technical support staff were deployed; a Sutter Beacon team responsible for technical design and build of the Sutter Beacon standard and a second PAMF team to evaluate workflow variation among PAMF chemotherapy infusion centers, identify best practices, engage the Sutter Beacon Build team around system design and institute rapid cycle process improvement in partnership with the PAMF Lean Promotion Office. Results: Visio maps of current state workflows were constructed to reflect oncologist, pharmacy and nursing workflows from medication ordering to chemotherapy administration and billing submission. Two Rapid Process Improvement Workshops designed future state workflows and identified key areas requiring re-engineering. Lean rapid cycle improvement strategies will be leveraged to improve clinical workflows prior to Beacon implementation. To support the 40% of infusion treatments that are for non-oncology patients, a second process was designed as an important patient safety initiative to avoid discordant nursing administration workflows. Conclusions: Successful design, build and implementation of EHR require achieving consensus-driven work processes that maximize patient safety, eliminate workflow redundancies and maximizes the value-added component. It requires coordination between the EHR technical build team who design the system and the implementation team who integrate it with re-engineered workflows. Lean methodology provides the conceptual framework to achieve a successful EHR deployment.

This research was about the initial survey of Malay Civil Servants in Johor during British colonial administration in year 1914 to year 1941. The role of Malay civil servants has started since the restructuring of the Johor state administration. This study article uses a qualitative method. This analysis was focus on documents and primary sources from files of colonial records such as the Annual Report of Johor files, Johor state government files related to salaries and pension laws. Findings show that the ability of Malay civil servants to help manage the administration of the state of Johor led to the formation of the Johor Civil Service by Sultan Ibrahim in 1895 by appointing young civil servants to work with older figures to enable the younger generation of civil servants to deepen knowledge and knowledge from staff. experienced in Johor state administrative management. Overall, this article will show the ability of the Malays to work in administrative management enabling them to continue to serve as civil servants in the administrative system after the British colonial rule in Johor.

Abstract Purpose An analysis to determine the frequency of medication administration timing variances for specific therapeutic classes of high-risk medications using data extracted from a health-system clinical data warehouse (CDW) is presented. Methods This multicenter retrospective, observational analysis of medication administration data from 14 hospitals over 1 year was conducted using a large enterprise health-system CDW. The primary objective was to assess medication administration timing variance for focused therapeutic classes using medication orders and electronic medication administration records data extracted from the electronic health record (EHR). Administration timing variance patterns between standard hospital staffing shifts, within therapeutic drug classes, and for as-needed (PRN) medications were also studied. To assess medication administration timing variance, calculated variables were created for time intervals of 30-59, 60-120, and greater than 120 minutes. Scheduled medications were assessed for delayed administration and PRN medications for early administration. Results A total of 5,690,770 medication administrations (3,418,275 scheduled and 2,272,495 PRN) were included in the normalized data set. Scheduled medications were frequently subject to delays of ≥60 minutes (15% of administrations, n = 275,257) when scheduled for administration between 9-10 AM and between 9-10 PM. By therapeutic drug class, scheduled administrations of insulins, heparin products, and platelet aggregation inhibitors were the most commonly delayed. For PRN medications, medications in the anticoagulant and antiplatelet agent class (most commonly heparin flushes and line-management preparations) were most likely to be administered early, defined as more than 60 minutes from the scheduled time of first administration. Conclusion The findings of this study assist in understanding patterns of delayed medication administration. Medication class, time of day of scheduled administration, and frequency were factors that influenced medication administration timing variance.

Abstract The article reports on the workshop »born digitals und die historische Wissenschaft – Annäherungen an eine Quellenkunde für genuin elektronisches Archivmaterial«, which was organized by the State Archives of North Rhine-Westphalia in Duisburg on August 30th and 31st, 2022. The workshop established a dialogue between archivists and historians to address the epistemological, methodological, and technological challenges and opportunities of archiving and analyzing digital administrative records. The article situates these debates in a longer history of efforts to document administrative practices. Thus, the article highlights that the established archival order of written records was the contingent outcome of three interlinked transformation processes that occurred around 1900 in administrations and archives: 1) loose paper files started to replace records bound together in books transforming the file as the primary medium for documenting administrative practice, 2) the chronological organization of records in the registry gave way to an order based on subject categories, 3) archivists started to establish the principle of provenance as a principle of structuring archival collections. Thus, rather than treating digitalization as a crisis, it is seen as a transformative period of documentation practices, which brings its specific opportunities and challenges.
