Abstract:
The status of the refugee in international law, and of everyone entitled to protection, has always been precarious, not least in times of heightened and heated debate. People have always moved in search of safety, and they always will. This completely revised and updated edition casts new light on the refugee definition, the meaning of persecution, the role of gender and sexual orientation, the types of harm, and the protection due to refugees. The book reviews the fundamental principle of non-refoulement as a restraint on the conduct of States, even as States themselves seek new ways to prevent refugees and asylum seekers arriving. The book analyses related principles of protection—non-discrimination, due process, rescue at sea, and solutions—in light of what States, UNHCR, and treaty-monitoring bodies actually do, rather than merely deductively. It closely examines relevant treaty standards, and the role of UNHCR in providing protection, contributing to the development of international refugee law, and promoting solutions. New chapters bring into focus evolving protection demands in relation to nationality, statelessness, and displacement in the context of disasters and climate change. The book factors in the challenges posed by the movement of people across land and sea in search of refuge, and their interception, reception, and later treatment. The overall aim remains the same as in previous editions: to provide a sound basis for protection in international law, taking full account of State and community interests and recognizing the need to bridge gaps in the regime which now has 100 years of law and practice behind it.

Sharpe, Marina. The Relationship Between the 1951 and 1969 Conventions. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198826224.003.0004.

Abstract:
Chapter 4 begins with an articulation of the various approaches to refugee status determination in states party to both the regional and international refugee Conventions. This elucidates how and why a refugee might be recognized only under the 1969 Convention, the implications of which are then analysed. It is argued that in states party to both refugee Conventions, refugees recognized only under the 1969 Convention are entitled to the same standards of treatment as refugees recognized under the 1951 Convention. Finally, other aspects of the relationship between the 1951 and 1969 Conventions are considered. These are analysed within two categories: relationships of interpretation and relationships of conflict. The relationship addressed in the first category relates to the 1951 Convention’s article 1C(5) ‘compelling reasons’ proviso. The second category addresses the freedoms of movement and association, and the provision of travel documents.

Abstract:
Chapter 6 covers OAU and AU engagement with refugee issues from 1963 to 2018. Section B relates to the OAU, beginning with its refugee-related bodies. Select special refugee initiatives, in the form of conferences and summits, are then addressed. Section C relates to the AU, beginning with an overview of its constituent organs. AU refugee-related bodies are then discussed. The final sub-section relates to AU initiatives that are not refugee specific but may nevertheless impact upon refugees, including a discussion of the AU’s ongoing initiative for the free movement of persons on the continent. Section D concludes and includes a discussion of Rwandan President Paul Kagame’s initiative to reform the AU.

Abstract:
Chapter 8 concludes with a summary of the book’s main findings, which relate to the initial impetus for a regional refugee instrument, the meaning of key terms of the 1969 Convention, its relationships with the international refugee convention and with regional human rights law, and the institutional architecture supportive of this treaty framework. It also addresses several overarching issues: the lack of formal supervision of the 1969 Convention, the challenge of effective implementation, and both negative and constructive forms of international responsibility sharing. Finally, it suggests a protection priority the AU and states should focus on going forward: fostering the local integration of refugees in protracted situations, including by respecting refugees’ work rights and their freedom of movement.

Abstract:
A contextual chapter which presents the prevailing analysis of climate change and people movement from an international law standpoint. International law scholarship has played a part in framing, and drawing attention to, the topic of climate change and people movement. In particular, it has made some strides in exploring and uncovering the relevance (or lack thereof) of many of public international law’s sub-branches (refugee law, human rights law, humanitarian law, etc.) to addressing such movement. The chapter synthesizes the field’s findings and highlights why further infusing it with justice dimensions is both vital and credible.

Abstract:
Asylum-seekers are those who have applied for international protection. Asylum status is still governed by the 1951 United Nations Convention relating to the Status of Refugees. ‘Refugees and asylum-seekers’ explains the changing geography of refugees and the causes and consequences of refugee movements. Refugees tend not to travel very far, putting strain on the poorest countries, and mostly settle in camps, which suffer from aid misappropriation. There are three durable solutions for refugees: voluntary repatriation, local integration, and third-country settlement. Each can be problematic and none is working well at the moment, as demonstrated by rising numbers of refugees, the increasing proportion of protracted refugee situations, and fewer returns.
