Abstract:
The article analyzes authoritarian regimes within the post-Soviet territory in terms of informal practices (clannishness, clientelism and patronage) and their characteristics used by political leaders to form a power coalition. It has been argued that any of these informal practices determine a power coalition of a certain size, which is consequential for regime sustainability. Power coalitions formed on the basis of a clan-like nature is the least effective way to retain power and generally leads to regime destabilization. Clientelism, which allows for forming a power coalition on a wider basis, is a more effective strategy in terms of regime sustainability. Maximum regime sustainability is reached when patronage practices are used, which require more material resources and are only accessible to a limited number of wealthy states.

Abstract The matrimonial regime represents the entirety of the legal provisions concerning the property relations between spouses during marriage, as well as the legal documents they conclude with other people, governing a (measurable) patrimonial asset. In addition to the legal community regime, with the adoption of the new Civil Code two new matrimonial regimes were introduced, namely the regime of property separation and the regime of the conventional community. Where the two spouses opt for one of the other two regimes, instead of the legal community regime, it is necessary that they should sign a marital agreement.

O presente artigo tem como escopo discutir acerca da informalidade na escolha do regime legal de bens, em análise a autonomia de vontade e os seus reflexos na extinção do casamento civil pelo divórcio e na dissolução da união estável, com enfoque principal na questão patrimonial dos contraentes/conviventes e em eventual prejuízo econômico para uma das partes. Ainda, buscou-se com o presente artigo ponderar acerca da importância do conhecimento pelos contraentes/conviventes sobre os regimes de bens estabelecidos pela legislação civil. Outrossim, teve como finalidade apontar a necessidade de eventual assessoria advocatícia para escolha do regime de bens, uma vez que aquele escolhido pelo casal irá reger os direitos patrimoniais na constância do casamento e da união estável. Buscou-se, ainda, indagar acerca do tratamento jurídico para a dissolução da união estável e extinção do casamento civil e a diferenciação em relação ao momento da escolha do regime de bens, demonstrando que uma assessoria jurídica adequada prestada por um advogado ou pelo próprio Oficial do Registro Civil e Tabelião de Notas, uma vez que estes são os entes responsáveis pela formalização do ato solene e, de forma delegada, fazem as vias do Estado, poderia evitar eventual litígio futuro. Para análise das problemáticas, utilizou-se do método dedutivo de aporte bibliográfico e documental, assim como, do método qualitativo teórico, expondo posicionamentos doutrinários e jurisprudências acerca dos assuntos abordados.

Abstract: Two forthcoming EU Regulations are going to address, inter alia, the law applicable to the patrimonial consequences of marriages and registered partnerships. Under the Regulations, spouses and partners will not only be able to choose the applicable law but they are also granted the right to give their choice of law retroactive effect. Although the patrimonial consequences of marriages and partnerships are of relevance primarily to the spouses and registered partners, they may also directly affect the legal position of third parties. The aim of this paper is to identify and analyze the risks for third parties inherent in a retroactive change of the applicable law and the measures implemented in the Regulations to safeguard third party interests.Keywords: matrimonial property regime, partnership property regime, applicable law, choice of law, retroactivity, third parties.Resumen: Dos Reglamentos europeos regirán, entre otras cosas, la ley aplicable a los efectos patrimoniales de los matrimonios y de las uniones registradas. Según los Reglamentos, los cónyuges y los miembros de la unión además de poder elegir la ley aplicable tienen la posibilidad de dotar esta elección de efecto retroactivo. Five years after the downfall of Ferdinand E. Marcos, scholars of Philippine politics have yet to achieve even minimal consensus on the proper characterization of his authoritarian regime. More importantly, scholarship has failed to account for fundamental continuity, across regimes, in the way in which dominant economic interests interact with the Philippine state. The author argues that a focus on patrimonial aspects of the Philippine state will not only bring a greater sense of coherence to many disparate aspects of Marcos's rule, but will also lead to clearer understanding of enduring characteristics of the Philippine political economy. Throughout the postwar years, political administration is often treated as a personal affair, and the assignment of privileges granted by the state is largely determined by the personal discretion of those oligarchs currently holding official position. The article explores factors that help to explain why there has been no effective pressure from either domestic or external forces to undermine the patrimonial features of the state, and suggests that future research should analyze why patrimonial features have persisted in the Philippines despite enormous change, yet elsewhere seem to have subsided in the face of change.

This paper elaborates a new source of Chinese workplace consent based on participant observation of the Baigou bag industry. Different from other types of Chinese workplace consent that are based on state, gender or citizenship, Baigou’s worker consent comes from a particular factory regime—Familial Household Production—rooted in Chinese rural households. The principle of familialism manifests itself in the labour market, work organisation and reproduction of labour, and it maintains worker loyalty, which is deeper than normal worker consent. Three sub-types of the familial household production regime were distinguished: patriarchal factory regime, paternalistic factory regime and patrimonial factory regime.

Abstract:Current usages of the terms patrimonial and neopatrimonial in the context of Africa are conceptually problematical and amount to a serious misreading of Weber. His use of the term patrimonial delineated a legitimate type of authority, not a type of regime, and included notions of reciprocity and voluntary compliance between rulers and the ruled. Those reciprocities enabled subjects to check the actions of rulers, which most analyses of (neo) patrimonialism overlook. We apply these insights to a case study of Botswana and suggest that scholars reconsider the application of Weber's concepts to African states.

The concept of patrimonial domination was at first underutilized in western social science and then often used without proper clarification of its methodological basis. When the Soviet system was characterized as patrimonial, conceptual analysis was also generally lacking. In the article an attempt is made to fill in the gap between Weberian sociological theory and historical studies of Soviet society. It is argued that, although the concept of patrimonialism is applicable to the Stalinist system, this concept is not sufficient for the description of the Soviet state throughout its history. It is assumed in the article that Weber's concept of Beamtenmherrschaft might be more appropriate for the analysis of the post-Stalinist political regime in the USSR.

The paper intends to give an insight into the relations of the economic and political systems of the Central Asian republics using the theoretical framework of the “rentier economy” and “rentier state” approach. The main findings of the paper are that two (Kazakhstan and Turkmenistan) of the five states examined are commodity export dependent “full-scale” rentier states. The two political systems are of a stable neo-patrimonial regime character, while the Kyrgyz Republic and Tajikistan, poor in natural resources but dependent on external rents, may be described as “semi-rentier” states or “rentier economies”. They are politically more instable, but have an altogether authoritarian, oligarchical “clan-based” character. Uzbekistan with its closed economy, showing tendencies of economic autarchy, is also a potentially politically unstable clan-based regime. Thus, in the Central Asian context, the rentier state or rentier economy character affects the political stability of the actual regimes rather than having a direct impact on whether power is exercised in an autocratic or democratic way.

In the old French written law characteristic of the Middle Ages, the legal provisions on succession were not dictated exclusively by the rules of Roman law but were also influenced by local customs applicable in the south of France. The legal provisions ensured that the surviving spouse's patrimonial situation (especially in the case of the widow) did not suffer a sudden change of lifestyle after the death of the life partner. The substantial advantages enjoyed by the surviving spouse were mainly granted through seemingly voluntary legal manifestations, but which had well-founded beliefs and customs at the root. The rules of legal inheritance and those governing the dissolution of the matrimonial regime provided patrimonial aid but were far from sufficient.

Poland in the seventeenth and eighteenth centuries was more a mélange of patrimonially organized latifundia than a sovereign state. Literature on the organization of work and politics on these magnate estates has identified a layer of voluntaristic clientage ties astride a set of more lopsided, purely patrimonial relations. Boundaries separating the personnel of these various estates were firm; estates were mutually autonomous, competing economic and political organizations. National politics was characterized both by contests between a weak, elective monarchy and overwhelmingly powerful lords and by shifting factional alliances among these lords to achieve political ascendancy. While factional politics was unstable for much of the eighteenth century, shifts in the social network organization of elites in the last quarter of that century, combined with a retooling of traditional political cultural symbols, facilitated the “invention” of a constitutional regime in 1791—a remarkable accomplishment of political order out of disorder.

IN TERMS OF THE HISTORICAL CATEGORIES FORMULATED BY S. N. Eisentadt, the origins of the Ottoman-Turkish polity were imperial-bureaucratic rather than imperial-feudal or patrimonial. The regime was not patrimonial because the centre had its own distinctive normative system; the values of the centre were just a pale reflection of those of the periphery. The regime was not imperial-feudal for the centre did not have to face civil societal groups able to challenge it and impinge upon it. The members of the periphery could not develop horizontal loyalties; instead they competed among themselves for a limited number of privileges such as tax-farming rights or quotas for import or export which the centre granted. The Ottoman-Turkish peripheral elements did not develo into an aristocracy or a bourgeoisie with political influence. Consequently, the efforts towards modernization initiated during the nineteenth century took on a particular twist. Modernization meant Westernization, which in turn was perceived from the perspective of Enlightenment tradition. Informed by a ‘cast-iron theory’ of Islam ,the state's salvation was seen to lie in substituting reason for religion as the basis of public policy-making. The military and the bureaucratic elites came to see themselves primarily as the guardians of raison d'état.

Defende que um dos efeitos dessas políticas e práticas foi a culturalização das festas, isto é, a sua tematização em torno de ideias sobre cultura, raízes e tradição. Examinatambém os termos dessa culturalização. Esta deve ser vista não tanto como um processo de ressignificação radical das festas, mas como um processo de adição de um novo significado – cultural – aos significados – religiosos e sociais – que continuam a caracterizar as festas.

Renouncing the binding nature of the legal matrimonial regime[1], upon adoption of the new Civil Code, the Romanian lawmaker consecrated the patrimonial freedom of the spouses to decide as they deem appropriate and fit with regard to the property that is the object of their property relations. The New Civil Code establishes the principle of the freedom of choice of the matrimonial regime, the future spouses having the choice to enter, outside the regime of the legal community of property (the only possible matrimonial regime according to the previous regulation of the Family Code), into a matrimonial convention, on the basis of which they shall “join” either the separation of property regime or the conventional community of property regime.Regardless of the matrimonial regime chosen, whether legal or conventional, there is a common core of imperative, non-derogatory rules, which provide a minimal protection of the property relations between spouses.The imperative primary regime is enshrined in the Civil Code in force, in Book II, About Family, Title II – Marriage, Chapter VI – Property Rights and Obligations of Spouses, Section 1 – Common Provisions, Paragraph 1 – About the General Matrimonial Regime (Art. 312-320), Paragraph 2 – The Family Dwelling (Art.321-324), Paragraph 3 – Marriage Expenses (Art.325-328).In this article, the property obligations of the spouses present in the text of the law under the name of Marriage Expenses (Art. 325-328 Civil Code) are the subject of a legal review, highlighting a higher degree of concern on the part of the lawmaker, as compared to the current one, in drafting the Family Code, in terms of their regulation in relation to the accelerated dynamics of social relations.[1] Under the Family Code, which was abrogated with the entry into force of the current Romanian Civil Code, the matrimonial regime of the spouses was that of the community of goods, unique, mandatory and immutable. Cet article cherche à montrer que l’attitude masculine à l’égard des stéréotypes sur les femmes peut correspondre à deux manières de “gérer” l’énigme que représente pour l’homme la différence sexuelle: un régime doxique, celui de l’ “Homme Ordinaire”, et un régime esthétique, celui de “l’Artiste”. Le premier régime trouve à se manifester dans les proverbes, par exemple, dont la visée essentielle est de définir un ordre dans lequel le féminin se voit assigner “sa” place. Il est illustré ici par l’étude d’un corpus de proverbes espagnols. Le second régime suppose l’instauration d’une démarche créatrice, qui joue du stéréotype et de la position masculine même. Le dernier esthétique est étudié à travers des textes des XVII et XIX siècles: le théâtre de Molière, d’une part, la mythologie de la femme fatale et le drame symboliste, d’autre part. Mais la position masculine de l’Artiste apparaît ambiguë. Certes, il conteste la stéréotypie qui fonde l’univers patrimonial de l’Homme Ordinaire, mais, voulant faire œuvre, il demeure d’une certaine façon dans l’espace du patrimoine.MOTS-CLÉS: Stéréotypes. femme. homme.  RESUMOEsse artigo procura mostrar que a atitude masculina em relação aos estereótipos sobre as mulheres pode corresponder a duas maneiras de “gerir” o enigma que a diferença sexual representa para o homem: um regime dóxico, aquele do “Homem Ordinário”, e um regime estético, aquele do “Artista”. O primeiro regime pode encontrar sua manifestação nos provérbios, por exemplo, cuja visada essencial é definir uma ordem na qual o feminino vê assegurar “seu” lugar, que é aqui ilustrado por meio do estudo de um corpus de provérbios espanhóis. O segundo regime supõe a instauração de uma démarche criativa, que joga com o estereótipo e com a própria posição masculina. O último regime estético é estudado através dos textos dos séculos XVII e XIX: o teatro de Molière, de um lado, a mitologia da mulher fatal e, de outro, o drama simbolista. Mas a posição masculina do Artista se mostra ambígua. Certamente, contesta-se o estereótipo que funda o universo patrimonial do Homem Ordinário, mas, ao se envolver nesse trabalho, permanece de uma certa maneira no espaço do patrimônio.PALAVRAS-CHAVES: Estereótipos. Abstract: The following article aims at testing the interrelations between the rules on: jurisdiction in divorce and parental responsibility laid down in the Brussels IIa Regulation, maintenance laid down in the Maintenance Regulation, and property regime laid down in the Regulation on Matrimonial Property Regimes and on Property Consequences of Registered Partnerships, considering a number of potentially seised Member State courts and their interactions with domestic law. For the testing, the national legal system and case law of Slovakia and Czech Republic, which require hearing of a dispute in unique proceedings (with certain differences), has been selected in order to tackle problems connected with the simultaneous application of rules established by the EU regulations and domestic procedural rules.Keywords: Multiplicity of Regulations in Family Matters, Interplay between Jurisdictional Rules, Divorce, Parental Responsibility, Maintenance, Matrimonial Property Regimes, Czech and Slovak Legislation.Riassunto: Il presente contributo mira a verificare l’interazione tra le norme sulla competenza in materia di divorzio e responsabilità genitoriale stabilite dal Regolamento Bruxelles IIa, in materia di obbligazioni alimentari previste nel Regolamento sulle Obbligazioni Alimentari, e in materia di regimi patrimoniali previsti dai Regolamenti in Materia di Regimi Patrimoniali fra Coniugi e di Effetti Patrimoniali delle Unioni Registrate, prendendo in considerazione le Corti degli Stati Membri potenzialmente adite e la loro interazione con il diritto interno. This article argues that the effect of economic crises on democratic transition is contingent on economic structure. Specifically, a high level of state engagement in the economy makes social forces dependent on the ruling elites for patrimonial interests and, therefore, the authoritarian regime liable for economic failure. Moreover, when authoritarian elites own a high share of economic assets, this aggravates the economic loss of both the business class and the masses when economic crises occur, which in turn makes defection of the business class, the revolt of the masses and the alliance of the two social classes more likely. Cross-national analyses show that economic crises trigger democratic transition only when state engagement in the economy is above a certain level.

O artigo analisa a possibilidade de concessionária de serviço público (exemplificando-se por meio do setor elétrico) ter seu vínculo junto à Administração extinto por estar em processo de recuperação judicial. Para tanto, estudou-se distintas concepções relacionada a concessão, além de ter evidenciado que assim como qualquer sociedade empresária pode passar por crises econômica, financeira ou patrimonial. Dentre possíveis soluções mencionadas, estudou-se mais especificamente a recuperação judicial evidenciando, principalmente, que é permitido à Administração, nesses casos, assumir o controle das atividades de serviços essenciais (caso Celpa). Por fim, termina-se abordando a especificidade do setor elétrico que, por Medida Provisória, afastou o regime de recuperação judicial e extrajudicial das concessionárias e permissionárias de serviços públicos de energia elétrica.

La aparición del municipio como unidad territorial ocasionó la paulatina aparición de los actuales términos municipales, y la desaparición de las antigua unidades territoriales. Para el conocimiento de proceso seguido en la formación del actual termino municipal de Dos Torres es necesario conocer las peculiaridades históricas de las dos villas que a las que debe su origen: Torrefranca y Torremilano, y de las entidades históricas en las que estaban enclavadas: El condado de Santa Eufemia y las Siete Villas de Los Pedroches. Dichas peculiaridades quedaron reflejadas en la complejidad que presentaba la propiedad de gran parte de los bienes patrimoniales que integraban sus antiguos términos municipales de dichas villas. Sobre el conocimiento dichos bienes, sus peculiaridades, su administración y aprovechamiento durante la Edad Moderna y sobre las causas de su pérdida versa este articulo.AbstractThe 19th century supposed a radical change in the administrative organization of our country. The creation of the municipality as a territorial unit caused the gradual apparition of the present municipal boundaries, and the disappearance of the old administrative entities. In order to understand the process followed in the formation of the present municipal boundaries of Dos Torres it is necessary to know the historical peculiarities of the two towns to which it owes its origin: Torrefranca and Torremilano. Said peculiarities had their origin in the different jurisdictional regimes of each one of them: Torrefranca had a feudal regime and Torremilano was a royal property. These peculiarities were reflected in the complexity that a large part of the patrimonial goods that they owned reveal, mainly because they were shared with other towns in the region. This article is about the knowledge of such goods, their peculiarities, their administration during the Modern Age and the causes of their forfeiture.

Gamal Abdel Nasser established the praetorian regime in 1952. Nasser ruled Egypt with the ‘party-state’ system to maintain the ‘social contract’ between the state and the Egyptians. The government thrived on the patrimonial relationship and de-politicization of the population. The ‘Egyptian upheaval’ in 2011 sought the protection of individuals’ rights, equality, and freedom against the military-led praetorian regime. A short-democratic experiment led to the arrival of Islamist majority rule in Egypt under the leadership of President Mohammed Morsi. The liberal-secular oppositions and the military removed President Morsi because Islamists failed to achieve the protesters’ aspirations. Egyptians supported the military’s rule that led to the election of General Abdel Fatah al-Sisi as President of Egypt. Fatah al-Sisi shifted the dynamics of government from ‘party-state’ to ‘ruler-arbiter’ praetorian rule that centralized the authority and power under his leadership through military domination to counter the Islamists and revolutionary aspirations. The research explains the causality behind the Egyptian military's intervention in politics, structuring of the praetorian regime in Egypt; the return of military praetorianism after the removal of President Hosni Mubarak; the rise of the Sisi as ‘ruler-arbiter’ and its implications on the democratization process. The paper’s method is explanatory to study the ‘structural’ (military) and ‘agential’ (Sisi’s rule) factors to determine the causes of establishing the praetorian ‘ruler-arbiter’ type Sisi’s regime. The approach to examine the ruler-arbiter phenomenon is the ‘actor-centric’ instead of the ‘mechanistic’ to understand the praetorian rule in Egypt. The research finds that the rise of the ‘ruler-arbiter’ regime under the leadership of the Sisi, caused by the military-established praetorian authority and President Sisi's choices and decisions, led to the failure of the democratization in Egypt.

State capacity is arguably an essential factor that stabilizes electoral authoritarian rule. Yet, in the context of sub-Saharan Africa many measures of state capacity are generally weak. What therefore explains the persistence of electoral authoritarianism in Africa? This study provides a comparison of Tanzania and Cameroon to highlight two divergent reactions to the problem of power consolidation in Africa. In Cameroon, a centralized presidency and comparatively large coercive apparatus underpinned a strong patrimonial state. By contrast, in Tanzania the ruling party became an institution that integrated elites and appeared to subsume the state. These regime configurations stabilized electoral authoritarianism in unique ways, and led to different dependence on the state during elections. The study sheds new light on contemporary Africa, and the diverse sources of authoritarian resilience in the face of multiparty elections.

AbstractThe Big Man has attracted considerable attention from social scientists, both as an explanatory force as well as a phenomenon to be explained. But the concept has become unmoored from its original meaning. Once used to refer to an apex figure within a patrimonial regime, today Big Men are often described as dictators or thieves. I show this using an original dataset covering discussions of Big Men in leading African Studies journals since 1980. I find that authors, especially political scientists, overemphasise theft and underemphasise accountability of Big Men. Then, drawing on my research with Ghanaian local politicians, I show how Big Men are constantly under pressure from their supporters. The paper concludes with a modest call to put the Big Man back in his place as powerful but also empowered, and thus indebted, to those beneath him.

Devido à elevada carga tributária existente no Brasil, as empresas buscam soluções para reduzir o peso dos tributos sobre o custo de seus produtos e serviços, de maneira que possam manter-se atuantes de forma competitiva nomercado altamente concorrido. Uma dessas soluções é a análise tributária, quevisa identificar quais tributos deverão ser pagos e como podem ser minimizados,possibilitando reduzir os custos de produção, administração e comercializaçãoe, consequentemente, elevar os lucros da empresa. O trabalho utilizou-se do método exploratório-descritivo e natureza quanti-qualitativa, com base em pesquisa bibliográfica e documental. O presente estudo teve por objetivo analisar se a alteração do regime de tributação do Lucro Real Trimestral para o Lucro Presumido foi uma decisão acertada financeiramente para uma empresa do setor da construção civil, localizada em Monte Sião (MG). Para tal, foram analisados os anos de 2013 e 2014, em que a opção de regime tributário era o Lucro Real Trimestral, enquanto que no ano de 2015 os gestores decidiram alterar o regime, passando para o Lucro Presumido. Foram abordados os conceitos relativos à tributação conforme a legislação tributária nacional vigente. Os dados foram obtidos, sobretudo, das demonstrações contábeis e de documentos como balanço patrimonial e planilhas, disponibilizados pela contabilidade da empresa pesquisada. Este estudo possibilitou obter resultados que identificaram que o regime tributário que, comprovadamente, reduz custos relativos aos tributos é o Lucro Presumido, nos respectivos anos considerados, 2013 e 2014. Devido à política da empresa, os dados referentes ao ano-calendário de 2015 não foram concedidos, porém, se a empresa se mantiver nos mesmos padrões de receita, custos e despesas, provavelmente reduzirá a carga tributária, portanto, notou-se que foi uma decisão assertiva alcançando uma redução do ônus tributário.

This work wants to analyze, from the theoretical-conceptual architectural frame of the General Theory of Social Systems (TGSS), and problematize the relationships and the logical articulations between the system of politics, economics and law to observe what have been the hetero-descriptions of the democratic state in the periphery of modern society (1).The processes of functional differentiation characterizing the institutionalization of structures and expectations –normative, cognitive– in the evolutionary becoming of the State-nation, in Latin America, stabilized the logic of the patrimonial political centralism, so that the history of innumerable legal-political and economic reforms have been used rather to perpetuate the status quo than to change something (2). It's interesting to observe, for this reason, the developing of many forms of coordination and social development to achieve the desired modernity in the continent, from the presidential caudillism, Cepalian developmentalism (1950), military praetorianism (1970), till the forms of economical laissez faire (1990). These models have basically revolved around the valorization of the clientelistic political regime as a central space for the construction of democracy and the market (3). In this context, cognitive and normative expectations (law) have not managed to generate lasting political accommodations that facilitate sociopolitical evolution, where corporations, families and clientelistic caudillism continue to prevail, except the institutionalized expectations (4). The question then is not how ‘democracy should be’, but how is this possible in this periphery of modernity.

ABSTRACT: This work examines the innovative doctrine related to appeals delivered by the Supreme Court that interprets by tempering them some of the requirements established by the Act 40/2015 on the Legal Regime of the Public Sector, in order to determine the patrimonial liability of the legislator State for the damages resulting of unconstitutional legislative acts (and acts that infringe EU Law). Specifically, the Court admits the ex officio review as an adequate action to challenge the administrative action that executes an alledgelly unconstitutional legislative provision to the effects of meeting the conditions of art. 32.4 of the aforementioned legal act, and it defines the moment where damages are to be considered inflicted for the purpose of indemnization so as to estimate the onset moment of the five years limit term previous to the publication of the judgment that concludes its unconstitutionality, a time limitation to which art. 34.1, second paragraph, of the same provision refers. RESUMEN: El presente trabajo examina la novedosa doctrina casacional del Tribunal Supremo que interpreta, atemperándolas, algunas de las exigencias que impone la Ley 40/2015, de Régimen Jurídico del Sector Público, para apreciar la responsabilidad patrimonial del Estado Legislador por los perjuicios derivados de leyes inconstitucionales (y de leyes que vulneran el Derecho de la Unión Europea). euenergy policy objectives are directed at three highly interdependent areas: energy supply security, competitiveness and decarbonization to prevent climate change. In this paper, we focus on the issue of energy supply security. Security of energy supply for the immediate and medium-term future is a necessary condition in the current context of the global political economy for the survival of the Union and its component member states. Since the Lisbon Treaty entered into force, energy policy no longer comes onto the agenda of the European Commission through the backdoor of the common market, environment and competitiveness. The Treaty created a new legal basis for the internal energy market. However, securing external supplies as well as deciding the energy mix, remain matters of national prerogative, though within the constraints of other parts of eu’s legislation in force. Without a common defense policy, the highly import dependent Union and its members face external instability in the energy rich Arab Middle East and North Africa.Concern about energy security has been triggered by declining European energy production as well as the strain on global demand exerted by newly industrializing economies such as China and India and the Middle East, as well as the political instability in this reserve-rich part of the world. This paper explores the following two topics [1] the current situation and past trends in production, supply, demand and trade in energy in the eu, against the background of major changes in the last half decade and [2] threats to the security of the supply of oil and natural gas from import regions.Fossil fuel import dependence in the eu is expected to continue to increase in the coming two decades. As global trends show, and despite new fields in the Caspian region and the Eastern Mediterranean, conventional fossil oil and gas resources remain concentrated in fewer geopolitically unstable regions and countries (i.e. the Middle East and North Africa (mena) and the Caspian Region (cr) including Russia), while global demand for fossil energy is expected to substantially increase also within the energy rich Gulf countries. This combination directly impacts eu energy supply security. It should be noted that the trend towards higher levels of import dependence was not interrupted when the era of low energy prices, between 1980 and 2003, came to an end.Within the eu itself, domestic resistance to the development of unconventional resources is an obstacle to investment in unconventional sources in this part of the high-income world. This should therefore not put at risk investments in either renewables or alternative sources at home or conventional resources mainly in the Arab-Middle East.The situation is exacerbated by the spread of instability in the Arab-Middle Eastern countries. There are three domestic and geopolitical concerns to be taken into consideration:(1) In the Arab-Middle East, threats to eu energy supply security originate in the domestic regime of these countries. Almost all Arab resource-rich countries belong to a type ofpatrimonial, rentier-type of state-society relation. These regimes rely on rents from the exploitation of energy resources and the way in which rents are distributed.Regimes of this type are being challenged. Their economies show uneven economic development, centralized power structures, corruption and poverty at the bottom of the social hierarchy. The discrimination of females is a major obstacle to the development of the service sector. At present, even the monarchies fear the spread of violent conflict.Offshoots of these consequences have proven to cause civil unrest, exemplified by what optimists have called the ‘Arab Spring.’(2) The second concern is the domestic and global impact of Sovereign Wealth Funds (swfs) managed by Arab patrimonial rentier states. swfs have proven to be an asset in both developing and developed economies due to their ability to buffer the ‘Dutch Disease,’ and to encourage industrialization, economic diversification and eventually the development of civil society. In patrimonial states, however, swfs are affected by corruption and the diversion of funds away from long-term socioeconomic development to luxury consumption by political elites. In fact, Arab swfs underpin the persistence of the Arab patrimonial rentier state system.(3) Finally, the post-Cold War, me and cea geopolitical landscape is shifting. The emergence of China and other Asian economies has increased their presence in the Middle East due to a growing need for energy and the expansion of Asian markets. The recent discovery of energy resources in the us has led to speculation that there will be less us presence in the region. There would be a serious risk to eu energy security if emerging Asian economies were to increase their presence in the Middle East as us interests recede.

A questão da cultura do planejamento sucessório se demonstra pouco arraigada no agronegócio Sul-mato-grossense, o que já fez com que muitas famílias vissem patrimônios com dimensões significativas serem particionados ou vendidos em processos de inventário no momento da sucessão. Considerando o fato da urbanização das famílias rurais, de alguns herdeiros não terem aptidão para o agronegócio ou condições de administrá-lo, fica, naturalmente, a preocupação do patriarca com relação à perenidade do negócio e a segurança dos herdeiros. Como solução para essa situação, os produtores rurais podem contar com uma estratégia de gestão corporativa que permite uma administração profissional do negócio, uma sucessão familiar que garanta maior economia, e que dê condições plenas de continuidade da atividade rural, independentemente do falecimento do patriarca e dos interesses dos herdeiros. Trata-se da constituição de uma holding familiar, uma estratégia que permite a construção de estruturas societárias, que separem as áreas produtiva da patrimonial, protegendo, assim, o patrimônio comum dos negócios particulares dos herdeiros. Este artigo analisou as especificidades da implantação de uma holding familiar em uma empresa no segmento agropecuário em Mato Grosso do Sul. A metodologia utilizada passa pela revisão bibliográfica da caracterização da constituição dessas empresas, e os reflexos societários e econômicos para a empresa estudada. Concluiu-se que o projeto é absolutamente viável, tendo o lucro presumido se demonstrado a melhor opção de regime tributário.Palavras-chave: Planejamento Sucessório. Tributário. Holding Familiar. AbstractThe culture of succession planning is not very well established in Mato Grosso do Sul’s agribusiness, which has already caused many families to see assets with significant dimensions being partitioned or sold in inventory processes at the time of succession. Considering the lack of interest or lack of aptitude of heirs for agribusiness, the patriarchs may become concerned with the business perenniality and the safety of the heirs themselves. Nowadays, rural producers can rely on a corporate management strategy that allows for a business professional management, a family succession that guarantees greater economy, and that proposes full conditions to the continuity of rural activity, regardless of the patriarch’s death and the interests of the heirs. This is about the creation of a family holding company, a strategy that allows the constitution of a corporate structure that separates the productive area from the patrimonial one, thus protecting the common equity from the heirs’ private businesses. This article analyzes the specificities of the implementation of a family holding company in the agricultural sector of Mato Grosso do Sul, Brazil. The methodology used is qualitative because it is the most appropriate to evaluate the changes suggested for management in the corporate, tax and financial areas. The analysis of this management strategy proved to be a much more favorable option than an inventory one. Purpose Based on the authors’ study, the purpose of this paper is to ascertain the best approach to mitigate corruption in the Indonesian public sector. To do so, the paper uses three behavioral perspectives: the Schemata Theory, the Corruption Normalization Theory and the Moral Development Theory. Design/methodology/approach This paper is part of the authors’ study to examine corruption patterns in Indonesia in the past 10 years through examination of reports from various institutions as well as other relevant documents addresses corruption-related issues to explore various options for mitigating corruption through behavioral re-engineering. For the purpose of gaining various perspectives on anti-corruption measures, this study also uses expert interviews and focus group discussions with relevant experts in Indonesia and Australia on various corruption-related issues. Findings The authors establish that despite the fall of the New Order regime nearly two decades ago, corruption remains entrenched within the post-Suharto Governments. The normalized corruption in Indonesia is a legacy of the New Order regime that shaped societal, organizational and individual schemata in Indonesia. The patrimonial style of leadership in particular within the regional governments resulted in increasing rent-seeking activities within the decentralized system. The leadership style is also believed to have been supporting the normalization of corruption within the public sector since the New Order era. The three-decade-old systematic normalization of corruption in the Indonesian public sector can only be changed by means of long and systematic de-normalization initiatives. To design the best intervention measures, decision makers must first identify multiple factors that constitute the three normalization pillars: institutionalization, rationalization and normalization. Measures such as periodical reviews of operational procedures, appointment of leaders with sound morality, anti-corruption education programs, administering “cultural shocks”, just to name a few, can be part of multifaceted strategies to bring down the normalization pillars. Research limitations/implications The discussion on the options for de-normalization of corruption in Indonesia is focused on corruption within the Indonesian public institutions by interviewing anti-fraud professionals and scholars. A better formulation of strategic approaches can be developed by means of interviews with incarcerated corruption offenders from the Indonesian public institutions. Practical implications This paper contributes to the development of corruption eradication strategy by suggesting options for de-normalizing corruption in the Indonesian public sector so that resources can be allocated more effectively and efficiently to mitigate the problem. Originality/value This paper highlights the importance of behavior-oriented approaches in mitigating corruption in the Indonesian public sector.

Com isso, este estudo objetiva analisar as contribuições das alterações na contabilidade pública brasileira, com base no Regime de Competência no que se refere aos procedimentos contábeis patrimoniais. Adotando como metodologia a abordagem qualitativa, com pesquisa descritiva e documental, por meio da análise das Demonstrações Contábeis, Notas Explicativas e Relatórios de Controle Interno publicados no portal do Governo do Estado do ES. Buscou-se analisar as ações e procedimentos adotados no período de 2013 a 2015, no qual ocorreu a adoção dos novos procedimentos trazidos pelas Normas Brasileiras de Contabilidade Aplicadas ao Setor Público. Os resultados permitiram observar a evolução na implementação de procedimentos patrimoniais como depreciação, amortização, ajustes para perdas, provisões, apropriações por competência das despesas com pessoal e passivos contingentes. Porém, a adoção do regime de competência para procedimentos contábeis patrimoniais no setor público ainda não foram institucionalizados, já que os seus efeitos só poderão ser analisados no longo prazo.

Section 18(b) of the Matrimonial Property Act 88 of 1984 allows for non-patrimonial damages to be claimed by a spouse married in community of property against his/her spouse. In Van der Merwe v Road Accident Fund 2006 4 SA 230 (CC) the court extended this exception to the notional purity of community of property to include patrimonial damages on the basis that section 18(b) discriminated unfairly against spouses married in community of property vis-à-vis spouses married out of community. The implications of this decision on commercial intercourse are discussed in this contribution against the background of prior decisions relating to the insolvency of spouses married in community of property.

Abstract. Literature in the Assessment of Teachers of French in Communist Romania: School Canon, Disciplinary Knowledge, and Institutional Interactions. Drawing on a series of original sources (the tenure exam syllabi for the teachers in the Romanian system of secondary education), the article aims to analyze the ways in which literature was employed in the assessment and ranking of teachers who wanted to become tenured in this discipline. The development of the syllabi in question represents an instance of codifying and standardizing knowledge about literature (authors, works, and critical metadiscourses), a process whereby a literary canon made up of inclusions and exclusions becomes the mandatory reference point for the teachers working in this field. The first part describes the evolution of the canon of French literature by comparing the syllabi from 1960 and 1983, tracing a shift from an understanding of French literature through a Marxist lens (as illustrated by the choice of authors, bibliography, and critical commentary) to a discursive perspective on literature aiming to depart from the instrumentalization of the previous decade via references to French literary theory. The second part focuses on the “construction” of the 1989 syllabus, showing the various stages of its development and the institutions involved in it (the University of Bucharest, other Romanian universities, etc.). As such, it shows that what might have seemed, in the eyes of the teachers taking the tenure exam, a universally valid discourse on French literature (authors, works, concepts) was in fact the result of previous negotiations among various decision-making factors. The article thus captures the interactions among the producers of meta-discourse who try to assert their own perspectives in defining a canon of French literature in accordance with their respective positions in the national academic field. The University of Bucharest seems to have monopolized the legitimate discourse on literature, as it emerges from the process of accepting and especially refusing the suggestions made by the other universities. If, during the communist regime, French literature – as constructed in Bucharest – occupied an important place in the training and assessment of teachers of French, thus continuing an inter-war tradition, in the post-communist age, the teaching of French evolved towards a communicative approach, thus losing the patrimonial and normative dimension in which literature held an essential place.

Embora o poder cautelar administrativo do Estado seja um importante dever-poder da Administração Pública, que assegura a eficácia dos processos administrativo e atende ao interesse público, trata-se de temática ainda pouco estudada e traz dúvidas quanto ao seu regime jurídico. Ao final, em atenção ao seu conteúdo, verificar-se-á que as medidas cautelares administrativas se constituem como sacrifícios parciais do direito que, como regra, por ausência de previsão normativa, não geram indenização por parte do Estado, desde que aplicadas nos limites jurídicos determinados.

ABSTRACT: This present work explains some of the legal issues related to the submarine cultural heritage by the territorial sea. Specifically, the application to the goods that are part of it of the concept and legal regime of public domain, save the State ships with foreign flag; the State ownership of submarine cultural goods of public domain; and save very specific exceptions, the power to authorize the interventions over the cultural heritage by the territorial sea belongs to the autonomous communities, regardless of that space belongs to the state public domain and not to the autonomic territory.
