A despeito de todo esforço em desenvolver um sistema comum de asilo para os Estados-Membros, a aplicação dos critérios nem sempre é algo fácil de ser alcançando. Portanto, o escopo do presente trabalho é analisar o Regulamento Dublin III que define qual será o Estado-Membro responsável pela análise do pedido de asilo. Ademais, serão analisadas as medidas adotadas nos últimos anos pela União Europeia a fim ajudar determinados Estados-Membros a superarem a grande demanda de análise dos pedidos. O objetivo geral é permitir ao leitor a compreensão, ainda que de forma não exaustiva, do acolhimento estampado no Regulamento Dublin III. O objetivo específico é entender a importância de uma política comum de asilo no âmbito da União Europeia. Por fim, o trabalho utiliza métodos bibliográficos como Convenções Internacionais e instrumentos jurídicos comunitários europeus que permitem melhor percepção sobre a realidade do asilo na União Europeia.

Abstract:
The Dublin regime – in short – determines which EU Member State is responsible to examine an application for asylum. The former Dublin Convention was signed in 1990 and first came into force in 1997. Today, 22 years and several legislative generations later, the Dublin regime is determined by the Dublin-III Regulation. After the 2015 so called ‘migration crisis’ and the collapse of legal principles in the Regulation, European legislators called for a reform of the Dublin system. Beside the will to reform the whole Common European Asylum System (CEAS), special focus lies on the reform of the Dublin-III Regulation. Therefore, the Commission issued its proposal for a new Dublin-IV Regulation. The proposal led to enormous controversies not only in the academic world but also in the European Institutions themselves. The aim of this article is first to analyse the Dublin-IV proposal against the background of fundamental and human rights with the incorporation of relevant case law of the ECJ and the ECtHR. The analysis will show several such violations and contradictions to the relevant jurisdiction. Furthermore, it will be demonstrated that the European Institutions are far from consent with regards to the Commission’s proposal. By showing the different approaches of the Institutions and of the academic world, finally, this article will provide guidelines on how to reform the Dublin regime adequately and in accordance with fundamental and human rights.

Abstract:
As práticas alimentares da população brasileira vêm se alterando nas últimas décadas e a publicidade é um dos fatores que contribuem para esta situação. O objetivo deste trabalho foi avaliar o conteúdo das propagandas de alimentos veiculadas na televisão e dirigidas a crianças, sob a ótica da regulação. As propagandas foram gravadas em fitas VHS de duas grandes emissoras de televisão, no período de férias escolares. Foram utilizadas técnicas de análise de conteúdo e definidas oito categorias de análise a partir do referencial teórico sobre as práticas alimentares e seus determinantes. Para subsidiar a análise utilizou-se a proposta de Regulamento Técnico da Anvisa. Foram contabilizadas 1018 propagandas, das quais foram selecionadas as 132 (12,9%) que anunciavam alimentos dirigidos para as crianças, sendo identificados somente 12 produtos diferentes. De acordo com o Regulamento proposto, todas as propagandas analisadas infringiam pelo menos três artigos, entre os quais se destaca o 4º, Incisos III e VIb. É nítida a urgência do setor público de regular o conteúdo das propagandas de alimentos infantis, cujo consumo pode ser prejudicial à saúde devido à influência que exercem na decisão pela compra, tanto por parte das próprias crianças, quanto dos pais.

A rotulagem ambiental tipo III tem sido adotada por diversos países no mundo, especialmente após as exigências dos países europeus. Tem-se observado o crescimento da rotulagem tipo III e da elaboração das regras de categoria de produtos em diferentes setores produtivos. O Brasil recentemente publicou seu Programa de Rotulagem tipo III-DAP (Declaração Ambiental de Produto), por meio de regulamento do Instituto Nacional de Metrologia, Qualidade e Tecnologia (Inmetro), que já era o órgão responsável pelo Programa Brasileiro de Avaliação do Ciclo de Vida. Este trabalho teve por objetivo identificar e analisar os instrumentos, desafios, limites e possibilidade para a implementação do programa proposto pelo Inmetro para rotulagem tipo III, a partir da avaliação de experiências internacionais, da análise SWOT e de entrevista realizada com o setor privado. O que se concluiu é que o programa do Inmetro ainda é muito recente, mas segue alinhado com os programas dos demais países, e isso lhe permitirá um reconhecimento mútuo no futuro. Além disso, o programa brasileiro é capaz de ser integrado a outras políticas públicas brasileiras, impulsionando sua implementação.

ABSTRACTAmong the holdings of Hamburg’s Staats- und Universitätsbibliothek Carl von Ossietzky is an anonymous fifty-two-page score headed ‘Serenata à 4’, described in the corresponding catalogue entry by its former owner, German musicologist Friedrich Chrysander (1826–1901), as a ‘cantata for the funeral of the English king William III of Orange, 1702’. But both the work’s text and the recent identification of the manuscript as being in the hand of Johann Sigismund Cousser (1660–1727) call for a reassessment of this serenata’s provenance, situating it in either England or Ireland between Cousser’s arrival in London on Christmas Day 1704 and the end of Queen Anne’s reign in 1714. Over the course of the two decades he resided in Ireland, from 4 July 1707 until his death, Cousser was responsible for the composition and musical direction of one ode and more than twenty serenatas, the majority of which were commissioned by the viceregal court at Dublin Castle for state celebrations of the reigning monarch’s birthday. Taking printed librettos, contemporary newspaper reports, Cousser’s own commonplace book and two further surviving manuscript scores as its primary evidence, this study seeks to establish a likely location and occasion for the performance of the ‘William III’ serenata within Dublin’s musical life during the early eighteenth century. In their choice of terminology, compositional style and performance practices, Cousser’s serenatas, which may have incorporated elements of theatrical staging and dancing, reveal his extensive Continental experience, and they can be seen to have functioned in part as an operatic substitute, presumably reflecting the limited financial resources of Dublin high society.

Além disso, foi realizada, via formulário Google, uma pesquisa eletrônica com os professores do curso e campus em questão. Ao final do estudo foi possível constatar que o ato de examinar predomina nas práticas avaliativas dos professores do referido curso do IFCE-Campus Paracuru e que ainda há uma preferência por avaliações somativas que tem como propósito atribuir notas e conceitos para os estudantes.

ABSTRACTSalmonella entericais an important diarrheal pathogen, and infections may involve severe systemic sequelae depending on serovar- and host-specific factors. The molecular mechanisms underlying translocation of host-restricted and -specific serovars ofS. entericafrom the intestines to distal organs are ill defined. By surgical cannulation of lymph and blood vessels draining the distal ileum in cattle,S. entericaserovar Dublin was observed to translocate predominantly via mesenteric lymph nodes to efferent lymphatics in a manner that correlates with systemic virulence, since the fowl typhoid-associated serovar Gallinarum translocated at a significantly lower level. While bothS. entericaserovars Dublin and Gallinarum were intracellular while in the intestinal mucosa and associated with major histocompatibility complex class II-positive cells, the bacteria were predominantly extracellular within efferent lymph. Screening of a library of signature-tagged serovar Dublin mutants following oral inoculation of calves defined the role of 36 virulence-associated loci in enteric and systemic phases of infection. The number and proportion of tagged clones reaching the liver and spleen early after oral infection were identical to the values in efferent lymph, implying that this may be a relevant mode of dissemination. Coinfection studies confirmed that lymphatic translocation requires the function of type III secretion system 1 (T3SS-1) but, remarkably, not T3SS-2. This is the first description of the mode and genetics of systemic translocation of serovar Dublin in its natural host.

While the Dublin System was meant to create a clear and fair division of responsibilities for the examination of applications for international protection, the recent refugee crisis highlighted the extent to which normative aspirations and political realities can diverge. That said, the Dublin System does allow for a certain degree of flexibility: By exercising the discretionary right to assume responsibility under the so-called “sovereignty clause” of Article 17, paragraph 1 of the Dublin III Regulation, Member States can examine asylum applications even when they would not formally have jurisdiction for doing so according to the criteria established by the Dublin System. Germany has relied upon this right extensively during the refugee crisis. Against this backdrop, the following contribution analyzes the reasons for, and limits of, multilevel administrative discretion in the Common European Asylum System. It argues that when a Member State exercises the right to assume responsibility in a sweeping manner, i.e. in hundreds of thousands of cases, it runs the risk of overstretching the legal limits of its discretionary powers. National administrative bodies can only invoke the right to assume responsibility insofar as this does not amount to game-changing decisions by the executive or unilateral decision-making without transnational coordination – particularly when such decisions have severe transnational consequences.

As many cities increase in size across multiple dimensions such as population, economic output and physical size, new methods for understanding and managing cities are required. Data produced by and about urban environments offer insight into what is happening in cities. Real-time data from sensors within the city record current transport and environmental conditions such as noise levels, water levels, journey times and public transport delays. Similarly administrative data such as demographics, employment statistics, property prices and crime rates all provide insight into how a city is evolving. Traditionally, these data were maintained separately and managed by individual city departments. Advances in technology and a move to open-government have placed many of these data in the public domain. Urban dashboards have emerged as a technique to visualise these data in an accessible way. This paper describes the implementation of one such dashboard, the Dublin Dashboard, an interactive website which collects, analyses and visualises data from a variety of sources about Dublin in Ireland through a series of interactive maps, graphs and applications. This paper describes the approach, the data and the technology used to develop the Dublin Dashboard and acts as a guideline for developing urban dashboards in other cities.

AbstractIn most EU policy areas, procedural cooperation between national administrations takes place through the shared implementation of “composite” decision-making procedures, facilitated by the operation of multijurisdictional networks or horizontal or vertical information exchange. In the context of asylum policy, such administrative cooperation has been necessary in the distribution of asylum seekers—in accordance with the Dublin III Regulation, which allocates responsibility among Member States to examine an asylum application. In addition to rules in the Regulation itself—Article 34—information sharing also takes place through Eurodac, an EU-wide centralized information system. This Article examines whether the Dublin system ensures effective judicial and administrative remedies in the operationalization of multijurisdictional information networks. It analyzes the relevant Eurodac and Dublin-related legislation, national implementation, and national case law through the lens of administrative cooperation. The assumption that the data exchanged has been acquired and processed lawfully, due to interstate trust, and the extent to which that assumption is rebuttable, are central themes throughout this Article. It is argued that administrative cooperation through information sharing takes precedence over the right to an effective remedy, and that, in practice, judicial and extrajudicial remedies are insufficient to protect asylum seekers.

Safety is at the heart of the aviation system, accident rates are on a steady downward trend with 2.1 accidents per million departures in 2016, representing the lowest annual aviation accident rate. It is predicted that globally the airline industry will grow, expecting 7.2 billion passengers to travel in 2035 (IATA, 2016). The airport domain is a complex socio technical environment where an airline receives a range of services and is the focal point for the convergence of ground activities, part of its role is creating the ‘safety picture’ and a ‘safety space’ for its industry customers to provide these services to aircraft operators. All operators (excluding ground-handling service providers) at European Union (EU) airports are regulated by European Aviation Safety Agency (EASA) regulations and now all have Safety Management Systems in place. Using Dublin Airport as a case study, the paper explores safety culture and safety challenges amongst operators in the multi stakeholder context of Dublin airport’s airside operations. In particular, the paper argues that (i) the attitudes of airport stakeholders on the effectiveness of Safety Management Systems were positive with good indicators of an engaged safety culture, (ii) operators strive for safe airport operations as well as achieving compliance operations and (iii) attitudes towards multi stakeholder safety management depend on the primary relationship held by each party. Finally, the paper recommends strategies to be adopted to enhance and improve multi stakeholder safety culture at Dublin Airport.

SUMMARYAn analysis of genotype was made for representative strains of Salmonella dublin. The collection consisted primarily of strains isolated from humans in England and Wales, and were of both intestinal and extra-intestinal origin. Three genetic elements were characterized by DNA hybridization. They were the sprBC genes, extrachromosomal virulence determinants. the salmonella-specific insertion sequence IS200, and the 16S ribosomal RNA genes, a phylogenetic marker. Two clones of S. dublin (SdRI and SdRII) which shared an identical IS200 profile, were identified on the basis of restriction fragment length polymorphism at the 16S rRNA locus. With one exception, all strains harboured a 52 MDa plasmid which contained a conserved 3·7 kbp Hind III fragment homologous to the sprBC mouse-virulence genes of S. typhimurium. However, a single plasmid-free strain of SdRI, isolated from a patient with septicaemia exhibited no spc homology. In SdRI there was no observable genotype distinction between strains causing gastroenteritis or bacteraemia. In contrast, none of the strains of SdRII were from cases of bacteraemia, and all human isolates of this clone were from cases of gastroenteritis.

Interactions between the pathogen and intestinal epithelial cells result in a variety of cellular responses mediating inflammation and fluid secretion. It is becoming apparent that proteins secreted by the Inv-Spa type III secretion system of Salmonella spp. play a key role in the induction of these responses. We have recently demonstrated that the SopB effector protein is translocated into eukaryotic cells via a Sip-dependent pathway and mediates inflammation and fluid secretion in infected ileal mucosa. However, SopB did not appear to be the only effector involved, as inactivation of thesopB gene only partially impaired enteropathogenicity. We suggested that at least some of such protein effectors are likely to be proteins of the same class as SopB, i.e., secreted effector proteins translocated into eukaroyotic cells via a Sip-dependent pathway. In this work, we identify SopD, another secreted protein belonging to the family of Sop effectors of Salmonella dublin. Using thecya reporter system we showed that SopD is translocated into eukaroyotic cells. We assessed the potential involvement of SopD in enteropathogenicity and found that inactivation of sopDhas an additive effect in relation to the sopB mutation.

Ultimamente nos cursos de engenharia vem se buscando métodos de aprendizagem mais significativos que promovam a autonomia dos alunos, despertando o interesse dos mesmos em aprender e aplicar os conceitos teóricos aprendidos em sala de aula, dessa forma objetivou-se por meio desse trabalho realizar uma competição com os alunos de engenharia civil da FAT, durante a III Semana Acadêmica de Engenharia da instituição, os carneiros hidráulicos foram confeccionados de forma artesanal pelas equipes do 6° período, utilizando apenas materiais previstos no regulamento, foi levado em consideração como critério de avaliação a funcionalidade correta do equipamento, vazão, relação volume inicial de água, volume bombeado e estética, as equipes tiveram 20 minutos para demonstrar o funcionamento do equipamento. Os melhores resultados foram obtidos para um caudal de elevação igual a 2,2 L/min, com aproximadamente 60 batidas por minuto. Foi possível verificar com essa competição os alunos ficaram motivados e promoveram sua autonomia, sendo aplicado os conceitos teóricos passados em sala de aula para uma aplicação prática.</p>

Purpose In total, 90,000 of the 1.26 million people applying for asylum in the EU in 2015 were unaccompanied children. The Dublin III Regulations provided a unique legal situation where unaccompanied young people in the Calais Jungle potentially had the right to be reunited with family in the UK. The purpose of this paper is to explore the substantial challenges presented by carrying out medico-legal assessment of this group in the Calais Jungle. Design/methodology/approach The authors consider the refugee crisis from a mental health and legal perspective. The authors provide two case examples to contextualise and describe the work. The authors draw from the observations and the literature to discuss the impact of living in the Calais Jungle on young people, the challenges the authors overcame to carry out the assessments and the needs of refugees following settling in the UK. Findings The authors conclude that the Calais Jungle was a toxic environment not suitable for young refugees’ continued emotional development or recovery from trauma. The current legal process to relocate a young person to the UK is time consuming and labour intensive. The authors note that these concerns are not unique to the Jungle, nor have they ended with its demolition. The difficulties young refugees face with mental illness continues following their arrival to the UK. Originality/value This was the first successful attempt since the Dublin III Regulations to seek a legal route to bring unaccompanied refugee minors from France to the UK. This paper was co-written by both the legal and mental health professionals involved in the cases providing a broad opinion across both disciplines.

The Court of Justice of the European Union (CJEU) has examined the limitation of the principle of mutual trust in European arrest warrant (EAW) cases in a number of recent decisions. The court has found that when the executing judicial authority possesses information demonstrating that the requested person is at a real risk of violation of the right to be free from inhuman or degrading treatment guaranteed in art 4 of the Charter of Fundamental Rights of the European Union, then the individual should not be automatically surrendered. Instead, the proceedings should be postponed to obtain supplementary information or discontinued if the risk cannot be discounted. The ‘real risk’ test has also been extended to non-absolute rights, such as the right to a fair trial. However, the CJEU’s reasoning about the limitation of mutual trust is not yet fully formed in relation to certain aspects concerning the nature of fundamental rights and the EAW procedure. This article explores these gaps of understanding about the scope of the limitation on mutual trust in surrender cases and, in doing so, assesses the consistency of similar developments in the area of transfers of asylum seekers under the Dublin Regulation III.

AbstractObjective: To describe the clinical characteristics and demographic details of a sample of patients with a principal diagnosis of obsessive compulsive disorder (OCD). Method: A retrospective review of fifty patients with DSM-III-R OCD referred to the Department of Behaviour Therapy at St. Patrick's Hospital, Dublin, Ireland between 1990 and 1991. Standard clinical ratings were made before and after treatment. Ratings used included the Maudsley Obsessive Compulsive Inventory (MOCI), the Fear Questionnaire (FQ), and the Yale-Brown obsessive compulsive score (YBOCS). Results: The male to female ratio was almost equal and the mean duration of illness was 6.1 (SD 11 years). OCD presented in isolation in a minority of cases (14%). A life time history of at least one other DSM-III-R axis I diagnosis, especially depression, was found in 72% of patients. Co-morbid Gilles de la Tourettes syndrome or epilepsy was rare. The majority of patients were on medication prior to presentation (78%). Levels of symptomatology were reduced in 91% of patients who completed treatment. Conclusions: Epidemiological research into the mass aspects of this disorder is required.

During the period January 1990 to January 1992 260 patients known to be infected with human immunodeficiency virus type 1 (HIV-1) attended the Accident & Emergency (A & E) Department of St James's Hospital, Dublin. There was a total of 709 visits with a mean annual attendance rate of 2.7, twice that for the general A & E population. Eighty-nine per cent of patients were intravenous drug users (IVDUs), 9% homosexual/bisexual and 2% heterosexual. Known HIV-1 seropositive patients accounted for 0.7% and 0.8% of the total number of patients who attended A & E in 1990 and 1991 respectively. The majority of patients disclosed their HIV status. Bacterial respiratory tract infection was the single most common reason for attending A & E and for admission to hospital. Seventy-two per cent of IVDUs fulfilled Centers of Disease Control (CDC) criteria for stage II and III disease; the majority of these used A & E for primary medical care, although listed with a general practitioner (GP) and attending during the daytime. Sixty-eight per cent of homosexuals/bisexuals were CDC stage IV with AIDS defining illnesses accounting for 52.6% of clinical presentations. Of this risk category, 79% required medical admission. Homosexuals/bisexuals represent more advanced disease, thus the full impact of HIV-1 infection in IVDUs in this A & E setting has yet to be realized.

Para estas interações, um rastro de dados é imperceptivelmente obtido por um meio ambiente embebido em tecnologia, sendo depois minerado e armazenado no contexto de Destinos Turísticos Inteligentes para criar experiências valiosas, designadamente relacionadas com a eco-responsabilidade, assim como facultando vantagens competitivas a tais destinos. Ao mesmo tempo, estas tecnologias permitem aos destinos turísticos uma otimização do uso de recursos naturais e da energia, assim como a preservação dos espaços naturais, em síntese, reduzindo a “pegada ecológica” do turismo. Porém, isto ocorre com um custo, o de uma “pegada de dados” acrescida. Consequentemente, a fruição apercebida de experiências tem de ser considerada no contexto normativo da Privacidade e da Proteção de Dados proteção de dados expondo os riscos potencias relacionados que lhe são inerentes, analisando as respostas das pelo RGPD - Regulamento Geral sobre Proteção de Dados da União Europeia. Assim, os objetivos do artigo são os seguintes: i. identificar as especificidades dos Destinos Turísticos Inteligentes; ii. mostrar como os princípios da proteção de dados, tal como constam do RGPD, são relevantes para os DTI; iii, finalmente, avaliar as consequências jurídicas potenciais deste ecossistema. A nossa perspectiva assenta numa análise jurídica de natureza académica. Sobretudo, procuramos mostrar como as implicações jurídicas das experiências turísticas reforçadas pelas tecnologias têm sido subestimadas, tal como o envolvimento informado e consciente das pessoas nestes processos. Group B streptococcal isolates (n=159) from the three Dublin maternity hospitals, were serotyped and analysed for the bac, bca, hylB, pepB, and rib genes. The serotype distribution of the isolates was Ia, 19·5%; Ib, 18·9%; II, 10·7%; III, 29·5%; IV, 1·9%; V, 15·1%; non-typeable, 4·4%. There was a statistically significant association between the serotype and invasive status (carriage or infection) of isolates (P<0·005), but no significant association between serotype and degree of invasiveness was demonstrated. The presence or absence of each analysed gene was not associated with the invasive status of isolates. Statistically significant associations were revealed between bca and hylB (IS1548) (P=0·0004) and between bac and bca (P=0·0l4). The bac, bca, hylB (IS1548) and rib genes and the numbers of tandem repeats in the bca gene showed significant associations with serotype. Almost 50% of serotype III isolates possessed at least one of the bac and bca genes and 55–65% of strains of serotypes Ia, Ib and II possessed the rib gene. Most serotype III isolates had IS1548 in their hylB genes. Serotype Ib was the only serotype in which more than half of the strains contained more tandem repeats in the bca gene than the overall mean for the GBS population studied of 7·4 repeats. These findings indicate that some previously reported associations between putative virulence factors and GBS disease require further study and clarification.

ABSTRACT Infection of human macrophages with Salmonella enterica serovar Typhimurium or Salmonella enterica serovar Dublin produces delayed cytotoxicity characterized by cell detachment and associated apoptosis. Using a site-specific mutant in the SpvB active site, we verify that the ADP-ribosylation activity of SpvB is required for delayed cytotoxicity in human macrophages infected with Salmonella. SipB and the type III protein secretion system (TTSS) encoded by Salmonella pathogenicity island 1 (SPI1) are not involved, whereas the SPI2 TTSS is absolutely required for SpvB-dependent cytotoxicity. Furthermore, we show that infection of macrophage cultures with wild-type or sipB mutant bacteria led to a complete loss of polymerized actin in over half of the cells after 24 h. In contrast, macrophages infected with the spvB or SPI2 (ssaV or ssaJ) mutant strain retained normal F-actin filaments, despite similar numbers of intracellular bacteria. We conclude that SpvB and a functional SPI2 TTSS are essential for Salmonella-induced delayed cytotoxicity of human macrophages.

S. typhimurium induced greater secretory and inflammatory responses than S. dublin in bovine ileal loops, despite the fact that these serotypes were recovered from bovine ileal mucosa in comparable numbers (P. R. Watson, S. M. Paulin, A. P. Bland, P. W. Jones, and T. S. Wallis, Infect. Immun. 63:2743–2754, 1995). These results implicate serotype-specific factors other than, or in addition to, intestinal invasion in the induction of enteritis. The secretory and inflammatory responses induced by S. typhimurium and S. dublin in bovine ligated ileal loops were not significantly altered by mutation of stn, which suggests that stn does not have a major role inSalmonella-induced enteritis. The invH mutation significantly reduced the secretory and inflammatory responses induced in bovine ileal loops, and this correlated with a reduction in the severity of enteritis following oral inoculation of calves. The attenuation associated with the invH mutation did not appear to be due to an increased susceptibility to the innate host defense mechanisms, because the resistance of S. typhimurium to the bactericidal action of either bovine polymorphonuclear leukocytes or bovine serum was not significantly altered. However, lysis of macrophages following infection withS. typhimurium was significantly reduced by theinvH mutation. The invH mutation prevented the normal secretion of several proteins, including SipC, by S. typhimurium, indicating that the function of theinv-spa-encoded type III protein secretion system was disrupted. Taken together, these observations implicateinv-spa-dependent effectors in mediation ofSalmonella-induced enteritis in cattle. Clearly, however, other undefined serotype-specific virulence factors are also involved in Salmonella-induced enteritis.

Invasion and survival in mammalian cells by Salmonella enterica is mediated by bacterial proteins that are delivered to the host cell cytoplasm by type III secretion systems. One of these proteins, SopB/SigD, is a phosphoinositide phosphatase that can hydrolyse a number of substrates in vitro including PtdIns(3,5)P2. These substrates are, however, likely to be restricted in vivo by the localization of SopB, as different phosphoinositides have distinct spatial distributions in mammalian cells. In the present study, we show that heterologously expressed SopB localizes almost exclusively to endosomes containing the lipid PtdIns(3)P, and on which ESCRT (endosomal sorting complexes required for transport) proteins assemble. Furthermore, we present evidence that SopB can inhibit trafficking of activated epidermal growth factor receptor to the lysosome. These results provide further evidence that PtdIns(3,5)P2, a lipid involved in endosomal maturation, may be a relevant in vivo substrate of SopB. We hypothesize that reduction of PtdIns(3,5)P2 levels in cells by the action of SopB may perturb the function of a subset of ESCRT proteins that have previously been shown to bind to this lipid.

Zawiera analizę dokonywanych na przestrzeni lat zmian regulacji w tej materii. Wprowadzone jak dotychczas, a także planowane na przyszłość modyfikacje wiążą się ze stale utrzymującym się problemem znacznych wątpliwości interpretacyjnych w obszarze omawianych dyskrecjonalnych uprawnień państw. Opracowanie zawiera przegląd danych statystycznych dotyczących wykorzystywania klauzul w poszczególnych państwach członkowskich i odnosi się również do orzeczeń Trybunału Sprawiedliwości wydawanych w ramach poruszanej problematyki. Dąży do wyjaśnienia, w jaki sposób klauzule dyskrecjonalne mają wpływ na system dubliński i w tym świetle prezentuje kierunki przyszłych, proponowanych przez prawodawcę udoskonaleń prawnych. Przeprowadzone badania dowodzą, że klauzule dyskrecjonalne są stosowane tylko wyjątkowo przez państwa członkowskie, jednak nieprecyzyjność przepisów powoduje, że występowanie tych nielicznych nawet przypadków może prowadzić do obniżenia skuteczności procedury dublińskiej. Z kolei prawodawca unijny dąży do wyjaśnienia zasad i ograniczenia przypadków, w których klauzule dyskrecjonalne zastępują kryteria wynikające z rozporządzenia Dublin III. Podczas tworzenia artykułu zastosowano następujące metody: analizę opisową, historyczną, prawną i statystyczną.

AbstractThe Common European Asylum System constitutes one of the principal areas in which the fundamental rights of individuals are essentially placed in competition with the core principle of mutual confidence and the need to preserve the effectiveness of EU law. That competitive relationship becomes particularly evident when applicants for international protection rely on alleged violations of their fundamental rights in order to contest their transfer to the Member State that is normally responsible for examining their asylum request according to the criteria of the Dublin III Regulation. The balancing process that needs to be carried out in this respect and the measure of the monitoring obligation that EU law imposes on the receiving Member State regarding the protection of the fundamental rights of asylum seekers are well exemplified by the preliminary ruling in Jawo. That case provides additional clarification regarding the circumstances in which the protection of fundamental rights may introduce exceptions to the principle of mutual trust. At the same time, it illustrates the inherent tensions that exist between the protection of fundamental rights and the application of the principle of mutual confidence.

Barriers to climate change adaptation have received increased attention in recent years as researchers and policymakers attempt to understand their complex and interdependent nature and identify strategies for overcoming them. To date however, there is a paucity of research on barriers to transformative adaptation. Using two case studies of flood risk management from Ireland we identify and characterize barriers to transformative adaptation. Qualitative semi-structured interviews were conducted with key stakeholders connected to proposed transformative strategies in Skibbereen, County Cork and Clontarf, County Dublin. Across both case studies, where transformative strategies failed to materialize, we highlight three significant barriers that impede transformation including: (i) social and cultural values, particularly place attachment and identity; (ii) institutional reliance on technical expertise which fails to look beyond traditional technocratic approaches and; (iii) institutional regulatory practices. Findings illustrate that where social or institutional barriers emerge, transformation may more likely succeed through a series of incremental changes. This research has practical implications for future adaptation planning as facilitating transformation through incrementalism requires flexible adaptation strategies that are responsive to changing social values over time. While focused on flood risk management, our findings have applicability for other sectors adapting to climate change.

AbstractObjectives: The aims of the study were to examine: i) whether sex offending in elderly people is a serious problem, ii) whether mental disorder or alcohol abuse occur in association with such behaviour, iii) how such behaviour is managed by the psychiatric service and iv) the outcome of such management.Method: Referrals of people with sexually offensive behaviour to the North Dublin Psychiatry of Old Age Service from its inception in 1989 to date (1997) were examined. Information collected included: i) mode and reason for referral, ii) demographic, social and medical information, iii) psychiatric diagnosis, iv) management and v) outcome.Results: Thirteen cases were identified in the eight year period. The sexually offensive behaviours included indecent assault, masturbation in public and lewd remarks. Diagnoses included vascular dementia, frontal lobe dysfunction, Alzheimer's disease, chronic schizophrenia, depression with alcohol abuse and ‘no psychiatric diagnosis’. Two patients had positive syphilis serology detected on dementia screening. Alcohol abuse featured in almost half of the cases. Regarding treatment, five were treated with oral cyproterone acetate and one with benperidol, and all of these had a good response. Three were treated with neuroleptics and also settled. Specific treatment was not indicated in three cases and forensic services were involved in a further three cases.Conclusions: It is noted that most subjects had an underlying psychiatric diagnosis particularly organic brain damage. Management alleviated the problem in all cases with psychiatric disorder. Cyproterone acetate is clearly useful in management. This review highlights the importance of thorough assessment, diagnosis and management of sexually offensive behaviour in old age.

&lt;div&gt;The 13th International Symposium on Solubility Phenomena and Related Equilibrium Processes (ISSP-13) was held at Trinity College, Dublin, Ireland, 27-31 July 2008. The symposium was sponsored by IUPAC, and arrangements were carried out by Trinity College, Dublin and University College, Dublin.&lt;br /&gt;&lt;br /&gt;About 80 delegates attended the symposium from 27 different countries. The meeting comprised 8 invited speakers, 30 oral presentations, and 21 poster presentations.&lt;br /&gt;&lt;br /&gt;The ISSP was first organized in 1984, is held in even-numbered years, and was an outcrop of the solubility data project where a team of experts provides critical compilations of solubility data of importance in various technologies.&lt;/a&gt; &lt;br /&gt;&lt;br /&gt;Each symposium has a well-defined focus which incorporates experimental methods, data analysis, modeling, and predictive methods and general applications of solubility phenomena.&lt;br /&gt;&lt;br /&gt;Previous symposia have focused on several themes related to solubility. ABSTRACT The genus Salmonella has more than 2,600 serovars, and this trait is important when considering interventions for Salmonella control. Bacteriophages that are used for biocontrol must have an exclusively lytic cycle and the ability to lyse several Salmonella serovars under a wide range of environmental conditions. Salmonella phages were isolated and characterized from 34 backyard production systems (BPSs) with a history of Salmonella infections. BPSs were visited once, and cloacal or fecal samples were processed for phage isolation. Four hosts, Salmonella serovars Enteritidis, Heidelberg, Infantis, and Typhimurium, were used for phage isolation. The host range of the phages was later characterized with a panel of 23 Salmonella serovars (serovar diversity set) and 31 isolates obtained from the same farms (native set). Genetic relatedness for 10 phages with a wide host range was characterized by restriction fragment length polymorphism, and phages clustered based on the host range. We purified 63 phages, and 36 phage isolates were obtained on Salmonella Enteritidis, 16 on Salmonella Heidelberg, and 11 on Salmonella Infantis. Phages were classified in three clusters: (i) phages with a wide host range (cluster I), (ii) phages that lysed the most susceptible Salmonella serovars (serogroup D) and other isolates (cluster II), and (iii) phages that lysed only isolates of serogroup D (cluster III). The most susceptible Salmonella serovars were Enteritidis, Javiana, and Dublin. Seven of 34 farms yielded phages with a wide host range, and these phages had low levels of genetic relatedness. Our study showed an adaptation of the phages in the sampled BPSs to serogroup D Salmonella isolates and indicated that isolation of Salmonella phages with wide host range differs by farm. A better understanding of the factors driving the Salmonella phage host range could be useful when designing risk-based sampling strategies to obtain phages with a wide lytic host range for biocontrol purposes.
