Full textThe effects of temporal factors on worker's behavior are analyzed for three classes of temporal conditions : temporal requirements of the task (machine-paced work, time sharing), variability of human functionning (circadian rythmicity), interactions between time of work and off-the-job life (especially concerning shiftwork). Worker's responses to time requirements implies coordination of analyses at three levels : precise identification of situation's parameters for temporal aspects but also for psychological functions ; evaluation of importance of performance as regard time criteria and cost associated to success ; strategies of regulation used by the subject according to the balance between risks of failure and workload. Furthermore analysis of the activity under time pressure must be conducted in the frame work of the global system including work and out-of-work activities. Also social meaning of work needs effective coordination between analysis of worker behaviorin the line of man-machine system-and analysis of worker motivation concerning the activity under temporal constraints. Systematic articulation of the frameworks of ergonomics and social psychology is necessary for the progress of research on workers' response to temporal factors in work situation

Full textThe corporate social responsibility (CSR) of major companies, defined as the voluntary integration of social and environmental concerns in both business itself and in the relationships with stakeholders, has become the site of a series of acts and standards of diverse nature and effects. Encouraged to develop social initiatives, firms have experimented with several initiatives to promote the image of social responsibility. However, with any endeavour, these are likely to demand legal assessment, especially as the subjects to which they relate are subject to state regulation. Voluntary acts of CSR can, by their recommandatory, proclamatory or declaratory formulation, refer to hard law and thus constitute an educational or informational basis of the rule of law, offering a framework for monitoring fair and rational conduct. Other standards can also prescribe behaviours and act as a form of control. Moreover, the intensification of the normative force of those voluntary measures involves legal implications, both binding and inspiring CSR development. The national framework helps to shape the initiatives in this area. This legal mesh makes the CSR a space of varying regulation, including self-regulation as a result of unilateral will in light of legal obligations. In this new dynamic, one must not overshadow the legal freedom granted by the law, which, over judgment and analysis facilitates the conception of CSR as a standard of conduct, generating regulation forms and responsibilities within the employment report

Full textThis work (study) questions the participation of individuals in collective bargaining following the Aubry laws, during the reduction of work time and its articulation with the organisation of a work democracy for the management of work relations. The participation, taken in the context of the social division of work, leads to understand that which these devices create in the shape of wage regulation of the RATP. The study carried out in the company shows that individuals integrate as much these devices (mechanisms) as they oppose them. They allow new relations to activate by opening spaces of expression that individuals invest in and question the creation of social categories, their form of action and their capacity to invest in spaces of democracy. The reconfiguration of conflict relies on the processes, allowing the emergence of the possibility to form social relations to constitute new objectives, mobilisations and to intervene in the practical evolution processes

Full textThe thesis intends to discover and criticize, according to the epistemological method, the fundamental characteristics of macro-analytical concept of "employment" in actual legal theories. The dominant discipline is french science of labour law, but the research is grounded on a comparison with sociological and, especially, economica conceptualizations. It shows how legal theories (and industrial sociology) generally embrace the concept of employment thinked out in term of market by the neo-classical economics, what ruins their pertinence and logic relating to founding effective public or private full-employment policies. The thesis suggests to the jurists to have a share in late socio-conomical flows of thought, inspired by "neo-institutionalism" wich conceive employment rather as a system of rules, what comes within legal studies'sphere. The fruitfulness of that proceeding is proved, in the thesis, by a work about the legal dimension of the -untranslatable- concept of "rapport salarial" elaborated by the recent french economical "theory of the regulation" (the concept designates, abstractedly and totally, the whole instituionalized aspects of the relation of work's submission to capital). Particulary, by means of refurbishing the theory of case law, the research demonstrates the driving part of that leading source of law in the process of work-and-employment relations'institutionalization. So, employment is no longer conceived as a market, wihch the law has to avoid disturbing, but, on the contrary, as a product of rules, the most important of which being juridical (judiciary) ones

Full textThis thesis addresses the difficulties of cooperation and the elaboration of common rules between multiple firms that work on a same construction yard.This work focuses on an important topic, considering both the economic approach brought by of the empirical research subject and the contemporary issues with network firms, outsourcing organizations and posted workers.This thesis proposes an original approach of workplace safety, by shifting the focus from the dual concept of regulated and managed security to a process of safety control actions.The main contribution of this study concerns the process of "acting safe": which is not only about applying and creating procedures or rules but also about control between a set of normative bodies. This thesis relies on the theory of social regulation and control. This theory was originally built to analyze Taylorist-type organizations, and it has proved its effectiveness in studyingnetworked outsourcing organizations. These conceptual tools have proved to be relevant for studying network firms and outsourcing organizations.Thus, we have described the work coordination and cooperation, between firms that are related with subcontracting and co-contracting commitment. The target is to evaluate safety.The purpose is to propose a system thinking approach of safety control at work within a set outsourcing company.In other words, this study aims to describe forms of social links that contribute to safety at a workplace

Full textIn medieval Normandy, from the end of the XIIIth century, the word métier (craft) could refer to a category of profession-based institutions that were clearly identified by the contemporary society. Dating from that period, the documentation also sheds a new light on the modes of enforcement of the economic rules which are particular to these craft institutions. Among their main characteristics was the role of craft officers (gardes du métier) who were appointed in agreement with the craft group. This evolution goes with the second "writing revolution" which developed the use of written norms. In this study, craft rules are therefore defined as a type of source which sets the structures of craft organisations. The development of this type of source was only part of the expansion of more detailed professional rules, whose geographic diffusion reflects the urban hierarchy. Judicial sources and accounts completed those normative sources and broadened the spectrum of craft institutions by including small towns like Elbeuf or Neufchâtel-en-Bray, as well as rural activities like pottery or metallurgy. The quantitative analysis of sources covering over 60 jurisdictions shows their representativity and a growth that does not entirely come from documentary biases. The diversity of places and activities ruled by craft institutions grew at the end of the Middle Ages. Better sources make case studies possible not only in Rouen but also in the jurisdictions of Louviers, of Elbeuf, of Roncheville and of the mine of Beaumont at Saint-Rémy-sur-Orne. The comparisons reveal how limited the autonomy of craft organisations concerning the enforcement of rules could be, despite a few exceptions like the master of the ironworkers of Normandy or the provost of the tanners of Rouen who had jurisdiction over their peers. However, until the end of the 14th century, the authorities seemed to lack control over the expertise on the quality of goods and on qualification, as well as over the formalities required for becoming an apprentice or a master. Even in the 15th century, the superior courts did not always intervene in such cases. The identity of craft organisations revolved more around their officers, who were sworn before higher authorities, than it depended on the shifting boundaries of the working communities. As a consequence, the collective action of workers very slowly took a formal aspect and often took place outside the craft institutions. Nevertheless, craft communities were consulted as a group about their rules. The development of formal craft institutions at the end of the Middle Ages can be linked to the growing use of written laws that were claimed by professional associations or by the authorities according to the context

Full textThe thesis studies the construction of a French competitiveness cluster ("pôle de compétitivité"). We question the appropriation by the players of the public policy regardingcompetitiveness clusters, by proposing a new interpretation built on the theory of social regulation (Reynaud,1989), enriched by the theory of organizational work (de Terssac, 2003) in order to clarify the emergence of a collective player from a problematic situation. This framework considers the public policy as a control regulation, and the effort from the players to seize this policy as an autonomous regulation. Therefore, the "regulation work" is at the centre of the analysis. It is defined as the operationalization of the regulation, as it will bring the rules to life, amend and modify them, in the encounter with the problematic situations and the players involved. The case study of the French cluster iDforCAR highlights the regulation work implemented by the operational team. This approach enriches the theory of social regulation, by confirming its relevance, by openly addressing the issue of the emergence and sustainability of a collective player around a project, and by specifying the definition of the regulation work. It also contributes to the knowledge of French competitiveness clusters by proposing, thanks to the theoretical framework adopted, a detailed description of the actions of the operational team of a cluster. This description helps to clarify the construction of a French competitiveness cluster by showing the appropriation of the public policy by the recipients of the clusters. The uniqueness of clusters is then illustrated, each cluster being built from singular problematic situations that give rise to a singular project

This Phd thesis deals with these complex dynamics. Based on a review of the scientist literature and a clinical research-action, it contributes to the knowledge of the interrelations between activity, health and psychotropic products. The thesis shows the existence of different functional uses irreducible to the idea of disease or dangerousness. It observes that official prevention masks reality and organizes ignorance about the role of work organization in the use of psychotropics. The figures on the health problems of the active population and on their consumption of psychotropic products require the renewal of management and prevention. We propose to shift the prevention of addictions towards labor analysis and psychotropics' use study as a system of preservation and self-recognition activities

Full textThis thesis studies the design and evolution of the risk regulation regime of nuclear safety in France between 1945 and 2017. Based on the concept of “risk regulation regimes” (Hood et al, 2001), we propose a model that identifies three periods, corresponding to three types of "philosophies". During the first period (1945-1969), an embryonic regulatory regime developed within CEA is characterized by "experimentation and autocontrol". The second period of "reasonable flexibility" (1969-1986) is marked by an institutional reorganization but leaves many room for maneuver to experts and operators, in a context of intensive industrial development. Finally, during the third period (1986-2017), a regime "in search of auditability" is the product of hybridization between the regime of "reasonable flexibility" and a standardized regime responding to international good practice (openness, transparency, and regulator’s and expert’s independence). To explain the evolution of the regime, we focus on one of its components, the rules, which we analyze as regulatory instruments, and we describe as "regulatory work" all activities and interactions of a group of agents who act to design, transform and implement these instruments (for our case, flooding rules and guides). We argue that regulatory work is at the same time cognitive, political, social and organizational, and, beyond producing an instrument, it results in exploring evolutions of the regulation regime, while building both the knowledge mobilized in regulatory instruments and interorganizational collective that shares them. This process would explain the relative slowness of the ongoing hybridization process

Full textThe objective of this study is to assess mental representations of a dynamic environment in order to anticipate and reduce complexity of control tasks. The effect of a presentation of the schematized environment on anticipatory behavior is then examined by manipulating the types of interfaces used in bus traffic control tasks. However, former studies show that this type of task has many requirements and a wide variety of interfaces exist in work situations. Indeed, the choice of interfaces is often empirical. In order to study anticipatory behavior in several coding conditions, we developed a bus traffic simulator. It allows generation of different scenarios which vary depending on the parametered disturbances. This simulator also allows the use of different interfaces. Moreover, different experimental conditions are possible such as the nature of tasks. The use of different interfaces in the simulator allows the experimenter to manipulate the way information is coded. The results reveal significant differences between the types of interfaces and tasks

Full textThis PhD in sociology renews the approach to advertising, by taking interest not in its role in the meeting between products and consumers, but in its producers, and particularly in art directors and copywriters. On the basis that advertising executives are confronted with the major problem of uncertainty with regards to the added value of their services, the author studies, on the one hand, how a specialised services market, and correlatively a professional group, is established at the end of the XIXth century in France. On the other hand, how advertising campaigns are made today and sold to advertisers. The analysis of the rationalisation of activities by specialisation shows that the importance taken by the creative function in the work system has contributed to justify the expertise of the professional group. The contribution of creativity to the added value of advertising executives’ practical knowledge is based on the belief in its esoteric value, acquired via the transformation of social representations of art and the artist. The study of activities of work within advertising agencies reveals that the structural opposition between market and aesthetic values emerges via conflicts of interest between the actors. The author stresses that these tensions are dissolved in a social role play between creatives, creative directors and account managers, who enable to maintain the common myth of the creator, essential to the enhanced value of advertising services. The adjustment between agencies and advertisers is effectively based on the mutual capacity to bet on creative talent

Full textPrevention and compensation for work hazards is regulated by two acts dated 1898 and 1946. The build up of the notion of work hazards has limited health issues at work to the work environment. Today, changes to the system imply a review of the of the regulations around the notion of "public sanitary order". The integration of social, health and environmental policies, imposed by EEC regulations, impacts on risk perception and therefore on the way to approach prevention and compensation. As damages are increasing and becoming of an international nature, questions around health at work need to be rethought and evolutions will have to include the notions of' "public sanitary order" and sustainable development. If sanitary safety is to become an overall target in the work place, two elements need to be present. Firstly, the right to health has to take precedent on contractual relationships and statuses. Secondly, the rising crisis in the work place contributes to widen public health's field to the concept of work hazards. That evolution imposes to clarify and define the links between health and environmental regulations. Work hazards allow for a positive cross over between social and environmental laws, both on fondamental and legal means, through the sanitary dimension. That cross over should not be seen as weakening the different law fields, but rather contributes to a more global and responsible approach on risks, including work hazards

Full textA longitudinal teaching experiment was conducted with forth and fifth graders. The researcher was the teacher of the experimental class. The students participated in two specially designed activities, in: the production of fractions problems, by using a specific typology, and by producing and observing a set of criterias. The aim of such an activity was the improvement of the students conceptual and epistemological reflexion, and their change from a waiting position, passive, to a devolution position. So, they have to accept the responsability for sharing the teaching intention. A special work in the "journal of fractions", devoted to link the students activity to the progress of the institutional time. So, the students had to be able to become chronogenetic, i. E to propose to the class useful contributions to tackle new topics of curriculum, in an emblematisation process, which contributed to build the didactic memory of the class. These two activities constituted phenomenotechnic instruments, intendent to produce empiric facts, and to favorise the understanding of learning-teaching practices. On an other hand, they were considered as institutions, where teacher's and students's work allowed them to elaborate together new relations to the mathematical objects. So, classroom interactions were organised in order to built a mutual meaning system, grounded on appropriate semiotic tools. Such interactions necessitated a negotiation of new social norms, and the inculcation of new "dispositions" which demanded accurate gestures by the teacher. Full textThrough the ethnographic observation of several call-centres sharing the same feature – i. E. They all operated as subcontractors – the purpose of this work is to lay bare, the specificities of professional regulation implemented by the various parties involved (entrepreneurs, employees, governmental authorities and unions). Our study will tackle the development of telemarketing activities in France and Tunisia as well as health and social care helplines; it will show the necessity of going beyond the classic approaches that summon up the indignation mode by denouncing labour precariousness and the penibility at work in these companies before getting back to the field of labour relations and collective bargaining. Indeed, although there are no collective regulation authorities per se dealing with call centre activities, as they exist, for instance, in other professional fields, the close and systematic observation of discourses, strategies and of power relationships reveal however something else than individual actors who would be the passive onlookers of their personal histories and the victims of economic factors. Thus, even if the actors are not clearly identifiable, their actions are nonetheless collective. They go far beyond the mere management of internal labour division within the companies. They not only deal with the setting up of labour management mechanisms, with professionnalisation, or with the organization of the competition between companies, but also with the regulation of the power struggle between the companies and the contractors In the end, after questioning the capacity of the framework of classical analysis – generally founded on the homo oeconomicus model and its application in social sciences – to really explain the structuration processes of professionnalisation, the author relies on the observation of concrete practices to objectively explain the emerging problems linked the transformation of an occupation into a profession in call centre activities

Full textIn French Police the number of suicides among policemen (50 in 2017, probably more than 55 in 2019) is one of the most enlightening revealers of the actual policeman social unrest. Based on the activity analysis, the research conveys on process behind suicide acting out of some policemen. In Police institution, with a strong historical culture, it could be noticed a double regulation : control regulation and autonomous regulation, with a lack of dialogue between both. While that the job transmission is realized in the field activity and that an old hand role is essential for well-done work. Today it could be observe a deficiency of job rules development and debate. The norm production would be a condition of social integration, which is, itself, a condition of acting power and of suicide risk prevention. A crisis linked with the discovery by policemen of powerlessness and vulnerability feelings, is arousing a strong collective anxiety for the majority, and anguish until mental distress for some. The majority fight this unrest, by strategies of disengagement like operational retreat, tactics accommodation or deviancy. Process by collective narration and practical rules formulation are encountered in rare teams, where is visible a well-being status at work. Occupational psychology will contribute to fund a primary prevention by developing necessary conditions to a regulation activity in work debate spaces, social integration will be maintained for all

Full textWhen the European social dialogue is celebrating the twentieth anniversary of its institutional recognition in the Maastricht Treaty, analysing the role of the European social partners in the employment regulation which now facing significant changes within the EU is of peculiar relevance. Our study establishes that the making of the European labour market differs from an addition of national scales. We demonstrate that this construction is not mechanically induced by the goods market integration but partly results from the European social partners’ involvement in the Community employment regulation and from their interactions with the other stakeholders, mainly the European commission. Experimenting new forms of regulation reinforces the European social partners’ legitimacy. It widens their scope of intervention and maintains them in the Community regulation process whereas other players (civil society, groups of experts) could have drawn them aside. In However, because of the evolution of the employment paradigm on behalf of the “modernization of the labour market”, the European social partners now deliberate on more general terms (“more and better jobs”, “inclusive labour markets”) at the expense of operability. This limited operability is all the more problematic as the lack of deepening in the regulation of the employment relationship opens the door to cases of social dumping. Therefore, the impact of European social dialogue is more tested by the evolutions of the subject of regulation than by the new forms of regulation

Full textEnterprise collective bargaining produces social regulation and controls day to day industrial relations. This work tries therefore to measure the ability of enterprise collective agreements to control decisions taken in their application and the actors rationality. It analyses in which measure an enterprise collective agreement furthers worker's acceptance of management decisions that the agreement have produced. It gives the actors power sources which can be resources or constraints. Part time in insurances sector case shows the ability of enterprise collective agreement to control actor's game. Indeed, as a source of rule creation, enterprise collective bargaining can be considered as "control regulation" with regard to "autonomous regulation" created by interactions between actors in the firm. We have tested the hypothesis by confronting some enterprise collective agreements and internal social figures (134 years). The results of this research allow us to come to the conclusion that the way decisions are taken have an impact on conflictuality. In the same way, the existence of an actor controlling the agreement helps to reach its objectives

Full textThe main goal of rapid tooling method is to allow the fabrication of "actual material shaped by actual process" prototype parts. The produced batches tend increasingly towards the pre-series ones and even towards the small or medium series ones. One major advantage of rapid prototyping processes is their capabilities to produce parts with hollow and complex shapes. These processes can also include cooling channels with sections and form which can be much more complex in comparison with conventional machined moulds. The design of these channels is critical due to their direct influence on the injection cycle time and also on the geometrical accuracy and the mechanical properties of injected parts. These processes enable to validate a prototype part design. Moreover, if these rapid tools present good thermal and mechanical properties, it enables to validate the mould design and particularly its thermal regulation design (integrated product-process approach). The Stratoconception process comes up to these expectations. With this process, the large size rapid tools are manufactured by machining and piling of aluminium or steel sheets. To improve the thermal regulation, the cooling channels must constitute a “cooling sheet” in geometrical conformity with the part external surface at a given distance from this surface. The “cooling sheet” thus defined plays the role of a thermal shield removing the heat brought by the polymer material and eliminating the thermal influence of the external on the cooling part of the tool walls

Full textThe striking ecological success of social insects results from an extreme cooperation notably based on a division of labour. This labour division is achieved either by morphological specialization or by behavioural task specialization of colony members. The preimaginal and imaginal mechanisms leading to these (sub)caste differentiations have been investigated in the ant Cerapachys biroi. In this species, there are neither queens nor males. Within a colony, reproduction is evenly distributed among all workers and intercastes through thelytokous parthenogenesis. Workers reproduce in their youth, before ceasing as they become foragers, while intercastes display higher and lasting laying capacities. The study of caste differentiation showed that, faced with colonial sterility, societies of C. Biroi alter caste ratios by considerably increasing the production of intercastes. In fertile conditions, larval development is constrained to worker fate by a contact pheromone probably applied during brood care. In this species in which reproduction mainly relies on young workers with finite fertility, an adaptive self-regulated mechanism of caste regulation thus allows to restore colonial fertility or to enhance colony growth. Furthermore, the singular traits exhibited by C. Biroi ants have allowed to show that individual experience alone can generate a lasting labour division among similar workers. Moreover, the cuticular profile analyses revealed that C. Biroi colonies present different chemical signature. This also turned to be true for the different (sub)castes of this species. Finally, according to the superorganism paradigm, the differentiation mechanisms in T cells and in social insects are compared. This unprecedented analysis gives rise to a new model for T cell differentiation and thus points out the heuristic significance for such a cross-disciplinary approach in biology

Full textThis dissertation explores the work of waste management by the use sociological mixed methods: computer-assisted discourse analysis and participant observation in waste industries. This research aims at showing the scope of work in waste industry as well as the content of the professional household waste sorting activity. The research focuses on interaction, social regulation and organizational work. This PhD dissertation shows the tensions between environment (green jobs) and the conditions of industrial work. The first part emphasizes on the elements that define this type of opposition. We observed a strong division of labor, particularly because the conception appears very far from the actual manual activities occurring in factories. Then the coexistence of public and private showcase other socio-economic issues related to the type of management. Finally, work in the waste sector, it is also considering the issue of risks at work and environmental hazards, which meanings are subject to the work context. The second part of the dissertation research aims at understanding how the workers live these contradictions and how they manage to move in this constraining industrial world. The research shows the importance and the difficulties for a novice to "become" a worker through the integration of a work collective and the appropriation of work. This will highlight the importance of social relationships and language activity in a workplace “a priori” hostile to interactions. Finally, the weight of waste sorter job’s representations, the risk of soiling and the apprehension of line work bring the worker to negotiate this “very dirty work” in order to change the working conditions and representations to be more viable and decent

This deals with perceptions of fairness in the regulatory postures operated by four French organizations.Design/Methodology – For this purpose, we drive a qualitative research by semi-structured interviews, observation periods and a documentary analysis in four organizations. That it is an emboided multiple-case study.Findings – Sharing and clarity on postures is an essential issue, as is internal and external coherence of regulation actions, décision-maker neutrality and the compliance with the law. Externalization signs (cross, veil, etc.) provide perceptions of injustice when they are regulated on basis of non work-based criteria. Religion do not provide discrimination nor a special privilege in matter of ressource allocation (time, work etc.).Practical implications – A neutral posture, work-focused, that respects human rights and law without value based judgment, nurtures au justice climate.Originality/value – This work concern understudied fields , ask to a pairs calling for dealing with the issue in term of justice, and reconcile individual perceptions with the organizationnal good fonctionning imperative

Indeed, IT development and risk increase led to increase control complexity. It is now shared between human actors (inspectors, industrialist, OHS department, etc.) and non-human (IT, software, management systems, etc.) including a collaborative working dimension. In order to propose a model of the system of actors and different exchanges allowed by the collaborative approach, three sociological objects are mobilized: the Social Regulation Theory (SRT), introducing the concept of regulation, the actor- Network Theory (ANT), authorizing an asymmetric study of actors, and collaborative working, combining collaboration and software engineering. To verify IT contributions as part of a collaborative approach a field trial and a survey on collaborative work practices were conducted. Full textThis doctoral research deals with the social regulation of emotional risk in the work. It is based on a comparative study of three professional backgrounds: the funeral, hospital and police. Data collection was conducted through qualitative methods, or 350 hours of observations for each trade and sixty interviews in total. These occupations are facing a public affected by their situation; be it bereaved families in the funeral, the sick children and their families in the hospital or to the victims and questioned in the police. But that public is also demanding for professionals, insofar as the emotional state of the user may have an impact that of the professional. These emotions can then impact the performance of work and emotional well-being of workers; this is what we propose to call an emotional risk. Emotion is constitutive of relational work which is at the heart of the relationship of service. However, this aspect of the work is ambivalent from the start because the emotional factor may be both a lever for a good workflow as well as a risk to the fulfillment of the service. How does the work collective work with the emotional risk? We offer an analysis about setting collective rule of the emotional risk. From a definition of our purpose, we analyze situations, actions and actors who put under control emotional risk. Our perspective focuses on the process of social regulation, the phases of the implementation rule of risk and its result. This leads to routinization of activity that professionals develop to frame the emotional risk

Full textWe consider, first, a positive relationship between workers’ skills and product quality, in a model of partial equilibrium with vertical preferences. We prove that the standard result of vertical differentiation no longer applies by the introduction of the labor market. We also test the robustness of our results under globalization. Then, we consider a general equilibrium model where individuals are potentially consumers, workers and shareholders. We study the majority preference between duopoly and monopoly, and we prove that the democratic choice doesn’t always generate less poverty, collectively and individually. Second, we introduce universities upstream the labor market. We prove that partial privatization of the university appears at equilibrium for a low level of public inefficiency, where the State has a broad majority. Then, we study the question of financing education. We determine the level of public tuition fees via a majority voting model, in a mixed education system. We prove that the extremes or the middle class hold the majority depending on the marginal cost structure of the private quality. And finally, we study firms’ sponsoring universities. Using a common agency approach, we prove that there is a negative relationship between the proportion of skilled workers and the share of firms in financing education

Full textSince the 90s in Europe, the measures and public schemes on behalf of employment have been largely covered by the debate on flexicurity. Thus, at the national level, some policies aiming at framing the career transitions, in a context of labour market flexibility and ever-increasing precarity, have emerged. If, at the European level we can observe a rather transverse trend, the underlying orientations for employment policy schemes relative to career transitions, specifically depend on societal contexts. This thesis will highlight the Italian situation, for which the work contract maintained by the Cassa Integrazione Guadagni into the short-time working has been for a long time preferred to the unemployment compensation. The work will be particularly focused on the stakes of the employment, wage and labour regulation, supported by the industrial action which is opposed to mobility on the labour market. It will be based on the diachronic and synchronic analysis of the industrial action led by the main union actors in order to maintain the work contract. On the one hand the diachronic analysis (1941-2013) allowed us to consider a project of union action concerning the regulation of work-related mobility, and on the other hand the synchronic analysis showed, from the actors’ justifications, the appropriation of an employment security scheme

Full textThe company’s interest is an important concept sparking lively doctrinal debate. What is the company’s interest ? Plenty of lessons, doctrinal approach do not lead to a consensus of un unified definition. Pure creation from the case law, the concept is used to control the decisions and behavior of the parties concerning to the employment relationship. Though the reference to the interest of the company is explicit regarding to the foundation or the conditions of exercise of the employer’s power, it helps neverthelessly to regulate behavior and decisions made by the employee. All actors contributing to the operation of the company must act in consistency with the "company’s interest". In this regard, the apprehension of this concept goes to be plural and functional. Membership of employees, as well as staff representatives entrepreneurial project implemented in the interest of the business require their participation in decision making. Despite of the successive reforms in this direction, we must recognize that the participation of employees in the management of the company remains very limited. This should probably change with the emergence of the concept of social corporate responsibility which is a new way of regulating of labor relations, tending to promote stakeholder accountability through enhanced participation. The evolution of social relations, induced by the world trade globalization having an impact on the structure of the company, requires necessary adjustments in the labor law. The aim is to achieve a balance between the protection of employees and their jobs and the sustainability of the company’s development

La première partie du mémoire contextualise la situation étudiée. Elle définit la notion de flexibilité en la situant dans l'histoire du temps de travail ainsi que par rapport aux différentes formes d'organisation et à certaines transformations culturelles de notre société. Elle présente la littérature internationale et détaille la situation du temps de travail en Suisse, ce qui permet de situer la monographie présentée dans la deuxième partie. Celle-ci porte sur une entreprise suisse de vente par correspondance ayant introduit une gestion individualisée et annualisée du temps de travail. La combinaison entre une approche quantitative et
qualitative permet d'analyser les déterminants internes à l'entreprise et ceux propres aux salariés susceptibles d'orienter les pratiques en matière de temps de travail, ainsi que la manière dont les salariés articulent ces deux ordres de contraintes.
Les résultats indiquent que l'application des temps de travail flexibles ne passe pas tant par une négociation quotidienne des pratiques que par la fixation de règles informelles. L'autonomie des salariés s'exprime avant tout dans leur capacité à produire, à négocier et à légitimer ces règles. Le niveau intraindividuel s'est révélé être crucial dans la régulation sociale du temps de travail flexible. Elle ne renvoie pas à un simple processus de légitimation mais bien à un mouvement d'institutionnalisation qui tire sa force de l'énergie investie par les salariés dans la recherche personnelle de compromis entre leurs différents rôles, identités et aspirations. C'est cette régulation passant par l'individu qui assure le succès du système étudié.
