The product of the snail1 gene (SNAIL1) is a transcriptional repressor required for triggering the epithelial-to-mesenchymal transition (EMT). SNAIL1 transcription is induced when epithelial cells are forced to acquire a mesenchymal phenotype. Furthermore, ectopic expression of snail1 in epithelial cells promotes resistance to apoptosis. An exclusion clause might operate in any of the following three ways: (a) as a limitation clause, imposing a financial cap on the compensation to be paid upon breach; or (b) it might provide for total exclusion of liability for breach; or (c) the clause might constitute a time restriction (an agreed time bar), which requires a claim to be made within a specified period of the alleged harm, that period being shorter than the ordinary limitation period prescribed by statute (ordinarily, six years for breach of contract, twelve years if the action is based on a deed). By a combination of judicial doctrine and (predominantly) statutory regulation, exclusion clauses have become more closely controlled since the Second World War. This chapter explains these responses to this problem.

Apparent raising (AR) constructions in Tongan resemble raising constructions in that the thematic subject of the embedded clause seems to occur in the matrix subject position. Unlike regular raising, however, Tongan AR shows characteristics of A-bar movement such as long-distance dependency, sensitivity to islands, and syntactic ergativity. This chapter argues that Tongan AR involves three operations: (a) topic movement of a DP to the embedded [Spec, C], (b) cancelation of the previous valuation of the case feature on the DP in [Spec, C], and (c) subsequent case valuation under Agree with the matrix v. The proposed analysis calls for a parametric adjustment to the activity condition to allow for multiple case valuation: in languages like Tongan, a DP located at the edge of a phase not only remains active, but the valuation of its case feature gets undone upon completion of the CP phase.

Over the past 35 years a great deal has been learned about the mechanisms of photosynthesis, ranging from the ultrafast reactions involved in the initial capture of photons to the slower processes of carbon metabolism. Today our knowledge of photosynthesis and its molecular mechanisms is enormous, so much so that it is difficult for one person to absorb all the information. This is not necessarily a bad thing, since what we have achieved is sufficient information to appreciate the complexity of the “photosynthetic engine” and to identify the main factors that ultimately regulate its efficiency. In this chapter I summarize those areas of photosynthesis research with which I am reasonably familiar and, in so doing, address the question posed by the chapter title. As Blackman (1895a,b) pointed out, the rate of photosynthesis initially rises as the light intensity is increased and then levels off to a plateau. This plot is often referred to as the rate v PFD curve, where PFD stands for Photon Flux Density. Over the years rigorous analyses of the slopes of the rate v PFD curve have been made to obtain a value of the quantum yield (usually expressed as the number of quanta or photons required to produce one molecule of oxygen or to fix one molecule of carbon dioxide). With a few exceptions, the value obtained for a wide range of “non stressed” organisms and plants supplied with excess CO2 is about 9 or a little more (Björkman and Demmig, 1987; Walker, 1992). Bearing in mind that one molecule of oxygen evolved or carbon dioxide fixed is a 4e/4H+ process, then a value of 8 would he consistent with the “Z-scheme” model proposed by Hill and Bendall (1960). In this scheme, each electron is excited twice, first by photosystem two (PSII) and then by photosystem one (PSI). In this way, 8 photons are used to drive 4e/4H+ from water, through PSII and PSI to NADP.

As new technologies continue to emerge, firms in diverse industries increasingly must respond. Future economic rents and competitive advantage rests on the organizational ability to assimilate new technologies in the right manner. Broadcasters, content and service providers, packaging providers, and many other firms have been affected by the advent of digital technologies in the digital television (DTV) industry. All these firms have considered the adoption of digital technologies. Digital television is a new television service representing the most significant development in television technology since the advent of color television in the 1950s (Kruger, 2005). DTV can provide several benefits: sharper pictures, a wider screen, CD-quality sound, better color rendition, integration with Web technologies, increased programming options, easy integration between broadcasting networks and broadband telecommunication networks (e.g., B-ISDN—Integrated Services Digital Network), and other new services currently being developed. The nationwide deployment of digital television is a complex and multifaceted enterprise though. It has a profound impact on the entire TV system: from the offer typologies to the consumption manners. Therefore, a successful deployment requires the development by content providers of compelling digital programming; the delivery of digital signals to consumers by broadcast television stations, as well as cable and satellite television systems; and the widespread purchase and adoption by consumers of digital television equipment (Kruger, 2005). In sum, the advent of the digital television has caused an actual breakthrough innovation on almost all levels of the value chain. Although the adoption of breakthrough innovations is highly risky to pursue, research has shown that firms always follow them (Charitou & Markides, 2003; Ketchen, Snow, & Hoover, 2004). In the case of the television industry, the adoption also happens because the government and the telecommunication regulatory agencies in many countries have foreseen deadlines for the complete transition from analog to digital technologies in this industry. Despite lingering standardization issues, digital transmission is replacing analog transmission in the three major delivery platforms (terrestrial, cable, and direct broadcast satellite [DBS]) (Galperin & Bar, 2002). Therefore, in the future we expect that all firms in this industry will have adopted these digital technologies. Furthermore, this adoption will vary according to both the firm’s activities and the type of breakthrough innovation. This research will present some theoretical arguments to describe the adoption of the digital technology by two different activities in the digital TV industry: TV channels and content providers. These two different types of firms were chosen because the emergence of the digital TV has meant the adoption of different types of breakthrough innovation for each one of them. The next section defines these different types of breakthrough innovation. The two following sections describe the two cases of the adoption of DTV: by TV channel and by content provider. Finally, the last section presents the conclusion and implications of this research.

In other words there is a significant subject-by-formulation interaction. To show that this is not the case T and R have to be shown to be IBE, i.e., individually bioequivalent. The measure of IBE that has been suggested by the regulators is an aggregate measure involving the means and variances of T and R and the subject-by-formulation inter-action. We will describe this measure in Section 7.4. In simple terms PBE can be considered as a measure that permits patients who have not yet been treated with T or R to be safely prescribed either. IBE, on the other hand, is a measure which permits a patient who is cur-rently being treated with R to be safely switched to T (FDA Guid-ance, 1997, 1999a,b, 2000, 2001). It is worth noting that if T is IBE to R it does not imply that R is IBE to T. The same can be said for PBE. An important practical implication of testing for IBE is that the 2×2 cross-over trial is no longer adequate. As will be seen, the volunteers in the study will have to receive at least one repeat dose of R or T. In other words, three-or four-period designs with sequences such as [RTR,TRT] and [RTRT,TRTR], respectively, must be used. The measures of ABE, PBE and IBE that will be described in Sec-tions 7.2, 7.5 and 7.4 are those suggested by the regulators. Dragalin and Fedorov (1999) and Dragalin et al. (2002) have pointed out some drawbacks of these measures and suggested alternatives which have more attractive properties. We will consider these alternatives in Section 7.7. All the analyzes considered in Sections 7.2 to 7.4 are based on sum-mary measures (AUC and Cmax) obtained from the concentration-time profiles. If testing for bioequivalence is all that is of interest, then these measures are adequate and have been extensively used in practice. How-ever, there is often a need to obtain an understanding of the absorb-tion and elimination processes to which the drug is exposed once it has entered the body, e.g., when bioequivalence is not demonstrated. This can be done by fitting compartmental models to the drug con-centrations obtained from each volunteer. These models not only pro-vide insight into the mechanisms of action of the drugs, but can also be used to calculate the AUC and Cmax values. In Section 7.8 we de-scribe how such models can be fitted using the methods proposed by Lindsey et al. (2000a). The history of bioequivalence testing dates back to the late 1960s and early 1970s. The issues of ‘significant imbalance’ and consumer ‘detriment’ seem largely matters of fact to be decided ‘case by case’, although, significantly, they seem suggestive of substantive unfairness compared to the largely, procedural unfairness perspective of ‘good faith’ discussed below. ‘Consumer’ is defined (reg 3) so as to include only ‘natural’ persons, thereby immediately ruling out the possibility of an R & B Customs Brokers type argument. The burden of proof (that is, to establish that a term ‘challenged’ is fair) lies on the seller/supplier (reg 5(4)). Three issues in the regulations seem of particular interest and uncertainty: (i) Core terms Regulation 6(2) reconfirms that the Regulations will not ‘bite’ on any term which either: (a) defines the main subject matter of the contract; or (b) relates to the adequacy of the contract price, so long as the term in question is in ‘plain intelligible’ language. The meaning of (a) is far from clear, as it seems to link back to the ‘Coote’ perspective on exemption clauses dismissed earlier (see fn 10) and, unless interpreted carefully could lead to a re-emergence of the argument that liability is not being excluded – merely not accepted in the first place. Of course, there must be something at the ‘core’ of a contract which cannot be challenged as ‘unfair’ (assuming the consumer entered into the contract freely in the first place) – but this should, surely, be construed narrowly. (ii) Good faith The remarks of Bingham LJ in Interfoto v Stiletto convey lucidly the broad sense of ‘good faith’, a concept which seems of the essence of the idea of procedural fairness. In many ways, good faith in the codes of countries like Germany seems to play a similar role to that of equity in relation to the common law – giving a ‘gloss’ of flexibility, humanity and justice to an otherwise rather schematic and technical system. The wording of reg 5(1) suggests that, even if a term shows some evidence of imbalance and detriment, it may be acceptable if the consumer received full and clear information about the implications of the clause and went into it with his/her eyes open."
