Abstract:
In response to an enormous growth of trusts in the late nineteenth century, demands for reform among a wide spectrum of interest groups culminated in the Federal Trade Commission Act of 1915. Playing an influential, though little-recognized role in framing this legislation was Wisconsin progressive Democrat Joseph E. Davies. As Commissioner of Corporations, Davies served in a unique, dual capacity as both politician and regulator, giving him access to President Woodrow Wilson and influence on the antitrust legislation. Davies used his position to promote a vision of administrative regulation b

Decontrol of natural gas prices created more competition at the wellhead and the need for greater flexibility in the transportation rules to allow sales directly to end users and distribution without middlemen. In 1987, the Commission issued Order No. 500 which would end the disputes that had arisen by addressing three concerns: take-or-pay, contract demand adjustments, and ‘grand fathering’. The first and the most important was dealt with by a flexible crediting mechanism, the second eliminated and the third of insufficient importance to change the rules. China began to establish markets a quarter century ago, but only in the last decade has its government made a concerted effort to design new institutions to govern them. Hence, a “regulatory state” is emerging. The prevailing literature focuses on a seeming convergence of Chinas institutions with the dominant global model of the “independent regulator,” including the establishment of new regulatory commissions. Yet research on China's strategic industries—those in the infrastructure and financial services sectors—suggests that assumptions of convergence obscure key elements of a regulatory des

The proposition of the thesis is, in its role as the lead offshore petroleum regulator in Ghana, the Petroleum Commission is not competent enough to oversee robust offshore health and safety regulation. Two accounts are developed to support this claim. First, the conferment of dual licensing and health and safety regulatory functions on the Petroleum Commission gives rise to a potential conflict. Secondly, even recognising a distinction between formal and de facto independence, neither is present in the Petroleum Commission. A number of factors justify these assertions: not least the fact that

AbstractThis chapter tells the story of how the Election Commission of India (ECI) became one of the most awe-inspiring electoral regulatory bodies in the world. One of the most widely celebrated and trusted public institutions in India, it has ensured the integrity—free and fair—of 17 national and more than 370 state elections since 1947, in what is not only the most populous but also one of the most potentially fractious democracies in the world. Ever under pressure from the executive branch and governing parties to bow to demands fed by their desire for electoral windfalls, the ECI managed to strengthen its autonomy through assertive leadership by a series of Chief Electoral Commissioners following the decline of the Congress Party’s political dominance. The rise of the Hindu Nationalist BJP as the new dominant force in Indian politics provides a crucial test for the endurance of the ECI’s role as India’s guardian of electoral integrity.

The ACCC has conserved its enforcement mission by adapting to challenges in the political and business environments; through expanding and re-directing its repertoire for regulatory action and broadening its consumer and small business constituencies. This chapter describes the origins of the ACCC and the ways in which its leaders have capitalized on and adapted its organizational capacities to address today’s threats to the organization’s existence and institutional status.
