Keine großen Posen vor der Kamera, sondern die unmittelbare Nähe zwischen Fotograf und Porträtierten zeigend: Das ist die Faszination, die von den Porträts des renommierten Fotografen der Weimarer Republik, Hans Casparius, ausgeht. Der fotografische Nachlass von Casparius wird in der Deutschen Kinemathek verwahrt. Die Auswahl für dieses Buch konzentriert sich auf Aufnahmen von Prominenten und Unbekannten – Menschen des Alltags, Schauspieler, Intellektuelle. Als Fotograf war Hans Casparius Autodidakt. 1900 in Berlin geboren, aus wohlhabendem Elternhaus stammend, verdingte er sich aus Liebhaberei Ende der 1920er Jahre zunächst als Kleindarsteller beim Film. En passant begann er am Set zu fotografieren, spontan und ohne die professionelle Allüre der inszenierten Standfotografie. Der Regisseur G. W. Pabst förderte Casparius’ fotografische Ambition, die schließlich zu seinem Beruf wurde. Der Schriftsteller Arnold Höllriegel nahm ihn als Bildbegleiter auf seine Reisen in die Welt mit. So wuchs Hans Casparius’ Renommee. Er emigrierte 1933 aus dem nationalsozialistischen Deutschland, zunächst nach Wien, 1938 weiter nach London, wo er 1986 starb. Casparius vermied Posen vor der Kamera. Seine Porträts wirken wie nebenher fotografiert, bergen den Funken der unmittelbaren Begegnung zwischen Fotograf und Porträtierten und bewegen durch ihre menschliche Nähe und den wahrhaftigen Ausdruck, die in ihnen aufgehoben sind. Es treten uns entgegen Menschen des Alltags – Frauen, Männer, Kinder. Und Persönlichkeiten der Zeit – der Schriftsteller Arnold Höllriegel, der Komponist Kurt Weill, der Rabbiner Leo Baeck und Sigmund Freud mit seinen Hunden. Schließlich Menschen vom Film: Elisabeth Bergner, Sybille Schmitz und Louise Brooks, Reinhold Schünzel, Rudolf Forster und Theo Lingen, Lotte Lenya, Carola Neher und Valeska Gert. Auch Hans Casparius im Selbstporträt. Sie alle von dessen Kamera berührt.

The final decision on the interpretation of Union law rests with the European Court of Justice. Such a ruling oftentimes affects national legal systems. Within the framework of a preliminary ruling procedure, the ECJ often has to decide on the interpretation of directives that are relevant for national private law. Los desplazamientos de los centros urbanos son un importante problema de análisis para comprender la configuración y construcción espacial y jurídica del Nuevo Reino de Granada y Popayán en los siglos XVI y XVII, ya que la movilidad geográfica que sufrieron los centros urbanos ayuda a explicar los intereses de la población por asentarse en determinados lugares. De igual manera, no solo se identifican estos intereses sino los de la Corona y el impacto que estos tuvieron en las formas de asentamiento, ya que poblaciones que estaban dedicadas a la minería obedecían a formas e intereses de poblamiento divergentes a las poblaciones agrícolas. Los traslados y abandonos de centros urbanos, fundados entre los siglos XVI y XVII en el Nuevo Reino de Granada y Popayán, son un problema crucial para comprender las formas de asentamiento español en épocas tempranas de la ocupación ibérica en América. Esta es una característica transversal en la historia colonial de la cual hay escasos trabajos en la historiografía colombiana que desarrollen ampliamente esta temática, a pesar de la atención que los historiadores han prestado al tema sobre la fundación de ciudades y el poblamiento hispano, muchos de ellos se han enfocado en ciertas regiones como la provincia del Nuevo Reino, el Caribe o las ciudades fundadas por la hueste de Robledo y Belalcázar.

This introductory chapter provides an overview of the Anglo-Scottish Union in Scottish literature, and will set out the central objective of the volume, which is to effect a rapprochement between a new British-oriented Scottish historiography and an essentialist–nationalist tradition of Scottish literary criticism. The Union has rarely surfaced directly in Scottish literature, a consequence of the inarticulate ‘banal unionism’ which has until recently reigned in Scottish political culture. Nevertheless, the chapter examines the few cases where the Union has surfaced in imaginative literature, most obviously in Burns, in Scott and in MacDiarmid. It also assesses other phenomena—religious as well political—which have pushed the matter of Union into the literary background. James Hogg’s Memoirs and Confessions of a Justified Sinner, a novel set around the Union of 1707, but where the grand themes of Calvinism push the Union itself off-stage, is a classic example.

This chapter examines the accordion culture along the south shore of Lake Superior. From the late nineteenth century through the present, the accordion has reigned in the area as the most ubiquitous and emblematic folk-musical instrument. A downright working-class instrument, it fostered egalitarian social relations and interethnic alliances—a kind of alliance only possible in the New World, where the politics of ethnic identity has come to govern many social relations. The chapter focuses in the following: (1) how South Shore musicians acquired and learned to play assorted accordions; (2) the audiences for whom and contexts within which they performed; and (3) the sources and nature of their repertoires. The resulting cumulative historical and ethnographic portrait illuminates the accordion's significant role in establishing a common, creolized, regional, and enduring working-class culture that was substantially formed between the 1890s and the 1930s.

This book provides a conceptual and legal analysis of the core of investment protection guarantees that emerge from international treaties signed since 1959 for the promotion and protection of foreign investment. It focuses on both the origin and evolution of investment treaty standards. In terms of origin, the work considers the broader context at the time when the first modern investment treaty was concluded. In terms of evolution, the work examines (a) the many decisions of ad hoc arbitral tribunals that have been called upon to apply these treaties in order to resolve the several hundred investor–State disputes, as well as (b) some of the recent investment treaties that in the past ten to fifteen years have attempted to clarify and/or reform the content and scope of investment protection guarantees. This study posits that the key investment protection provisions in investment treaties (and thus much of the related controversy) revolve around three distinct concepts: legal stability, investment’s value and reasonableness. This book advances two main arguments. First, from the very beginning, the protection afforded to foreign investments by modern investment treaties has been an exceptionally broad one and as such restrictive of the host State’s ability to regulate. Second, while a growing number of investment treaty tribunals as well as new investment treaties have to some extent reined in such broad protections, the evolution of key investment protection standards has been (and in many ways still is) marred by inconsistency and uncertainty.

Abstract:
On 16 June 2011, three days before his sixtieth birthday, Ayman al-Zawahiri was declared the new leader of Al-Qaeda, replacing the fallen Osama bin Laden. The veteran Egyptian jihadist had little of his predecessor's charisma and enjoyed much less popularity, respect and celebrity. Yet, as scores of jihadi commanders from different organizations have succumbed to their enemies' missiles, bombs and bullets, Zawahiri has soldiered on. His tenure as Al-Qaeda's leader has been marked by some of its darkest and most challenging moments, which have threatened the viability and future of Al-Qaeda's central leadership. The gravest such development has been the emergence of Islamic State as a separate and rival jihadist entity. The best way to gauge Zawahiri's response to these threats is by studying the official statements and public communiqués that he has issued since taking the reins. This book provides the reader with professional translations of Zawahiri's key statements during his first five years as leader of Al-Qaeda. These official communications are introduced and contextualized to provide the reader with a comprehensive sourcebook, outlining the Al-Qaeda leadership's stance on the challenges to its existence since the death of bin Laden.

This study addresses the traditional characterization of Roman Cyprus’s history as a Roman province as uneventful, insignificant, and ‘weary’. It brings fresh insight to the study of its culture and society by taking an integrated approach and bringing together well-known, less familiar, and new evidence to reassess cultural change, local responses to Roman rule, and the articulation of local identity in the Cypriot context. While it focuses primarily on material from the annexation of the island in 58 BC until the mid fourth century AD, or more specifically the refoundation of Salamis by Constantius II between AD 332 and 342, where relevant space will be given to discussion of evidence from across all periods of the island’s ancient history to facilitate a meaningful investigation of the key themes of this work. Ultimately, this study aims to reinsert Roman Cyprus into academic narratives about culture and society of the Roman provinces. Furthermore, it has been put together with the undergraduate student in mind to encourage and promote the study of Roman Cyprus—and, of course, ancient Cyprus—by collating key studies, evidence, and material, and thus making them accessible to new audiences

Como signo de una insatisfacción o desasosiego más general con nuestra civilización, algunos autores señalan que en la actualidad existe un “malestar de la medicina” (parafraseando el conocido libro de Freud) que se expresa en síntomas más o menos evidentes: médicos desilusionados, soluciones agotadas, pacientes desengañados, popularidad rampante de las llamadas “medicinas alternativas”, y una espiral creciente de los costos (1). La aparición de la pandemia del COVID-19 ha desatado ancestrales temores y reanimado multitud de teorías conspirativas, ecos de profecías apocalípticas. Algunos teóricos arriesgan la hipótesis de que esta nueva dolencia, que se extendió por todo el planeta ocasionando la muerte de millones de personas e impactando la economía, la política y las ideas, es resultado del desajuste ocasionado por la industrialización generalizada en el modelo económico globalizado y la concepción según la cual la Naturaleza está allí como una especie de almacén de donde nuestra especie puede extraer infinitos productos, sin preocuparse por los desequilibrios que cause. Se han recordado otras pestes que han asolado anteriormente y otros casos de dolencias zoonóticas que pasan virus del Reino Animal a la Humanidad, pero la rapidez del contagio y la abundancia de mensajes apocalípticos que ha motivado, ha puesto de relieve de nuevo el obsesivo temor acerca de nuestra salud, como ausencia de enfermedades, pero más allá, y siguiendo las definiciones de la Organización Mundial de la Salud, el logro de un estado de bienestar deseado.

Rivers of the Sultan offers a history of the Ottoman Empire’s management of the Tigris and Euphrates rivers in the early modern period. During the early sixteenth century, a radical political realignment in West Asia placed the reins of the Tigris and Euphrates in the hands of Istanbul. The political unification of the longest rivers in West Asia allowed the Ottoman state to rebalance the natural resource disparity along its eastern frontier. It regularly organized the shipment of grain, metal, and timber from upstream areas of surplus in Anatolia and the Jazira to downstream areas of need in Iraq. This imperial system of waterborne communication, the book argues, created heavily militarized fortresses that anchored the Ottoman presence in Iraq, enabling Istanbul to hold in check foreign and domestic challenges to its authority and to exploit the organic wealth of the Tigris-Euphrates alluvium. From the end of the seventeenth century, the convergence of natural and human disasters transformed the Ottoman Empire’s relationship with its twin rivers. A trend toward provincial autonomy ensued that would localize the Ottoman management of the Tigris and Euphrates and shift its command post from Istanbul to the provinces. By placing a river system at the center of analysis, this book reveals intimate bonds between valley and mountain, water and power in the early modern world.

Psychiatry straddles a medical approach to the mentally ill, and a dynamic approach to the experiences of severely disturbed people. One consequence of this is that ethical principles apply in different ways. The understanding of processes known as introjection, projection, and splitting seriously disrupt the functioning of a person and his ability to make adequate, responsible decisions. Severe mental illness can be regarded as the disruption of a moral agent, and in a sense treatment has to focus on the resumption of those functions that enable the person to take responsibility again. This chapter explores the ethics of the person’s loss of his personal functioning. Paternalism does not have a free rein, and needs to be carefully used as it supplants autonomy. Over-extended paternalistic care leads to excessive depletion of the patient, and was apparent in the old mental hospital as it still is in contemporary community care as specific organizational dynamics.

La conciencia de la crisis ecológica presiona en la constitución de un nuevo paradigma científico, frente al de la modernidad y el industrialismo que han instaurado el reino del crecimiento y el desarrollo como objetivos irrenunciables. El escenario de la degradación ecológica, y en particular el de la crisis energética, ha impulsado la emergencia de la reflexión sobre los límites del planeta, y del modelo productivista. Es difícil pensar cómo puede producirse la transición desde un modelo que hace del crecimiento el núcleo central de su actuación, a otro basado en el reconocimiento y la auto-imposición de límites” (Gaja i Díaz, F. 2005: 37-38) Como puede observarse, Gaja Díaz aborda como pocos la problemática del cambio climático en la complejidad de las ciudades, y en particular, de la cuestión energética y las implicaciones que supone para los espacios urbanos la transición del modelo productivista basado en los combustibles fósiles, hacia la transición de opciones energéticas renovables, y por ende más sostenibles en las actividades del transporte, la manufactura, los servicios y el suministro energético a los hogares. El 23 de septiembre de 1604, llegó a Santafé la expedición fundadora de la Compañía de Jesús y el día 27 se hizo entrega de la real cédula a la Chancillería Real, mediante la que se autorizaba su fundación en la Nueva Granada. Pocos meses después, el primero de enero de 1605, se empezaron a impartir clases en el colegio de Santafé, que después se convertiría en el Colegio Máximo de la Provincia del Nuevo Reino de Granada y sería conocido como la Universidad Javeriana. A partir de ese momento, se dio inicio a una empresa intelectual, religiosa y social que persiste hasta hoy, cuyo recorrido ha estado marcado por los conflictos, la persecución y la diáspora. Antes de la publicación del decreto de expulsión de los jesuitas en 1767, ordenado por Carlos III, e incluso después de la dispersión de sus miembros por todo el mundo, la orden de Ignacio de Loyola estuvo conformada por una base heterogénea de individuos que educaron y formaron a toda una élite intelectual en el territorio neogranadino. Así, aportaron ideas del Viejo Continente y animaron las discusiones académica y religiosa en el Nuevo Mundo. En un esfuerzo de sistematización, el padre José del Rey Fajardo, S. J., ha reunido en este nomenclátor información precisa sobre los miembros de la Compañía de Jesús que trabajaron en la Nueva Granada desde 1604 hasta 1767, y posteriormente en tierras italianas hasta 1831. Desde esta perspectiva, se podrá ver cómo esta orden religiosa se insertó en los prolegómenos de una historia intelectual de los jesuitas del Renacimiento y en la génesis neogranadina, y también cómo y por qué sus miembros han concurrido a la obra común que ayudó a engendrar la modernidad.

Im Zuge der themen- und kompetenzorientierten Vermittlung Mittelhochdeutscher Sprache und Literatur des Lehrstuhls für Deutsche Philologie des Mittelalters wurde zusammen mit dem E.T.A-Hoffmann-Gymnasium Bamberg in der gymnasialen Oberstufe ein wissenschaftspropädeutisches Seminar zum Heldenbegriff durchgeführt, an dessen Ende erste wissenschaftliche Arbeiten verfasst und präsentiert wurden. In einer Einführung wird u.a. das mittelhochdeutsche Nibelungenlied als Ausgangstext für eine schulische Auseinandersetzung mit dem Heldenbegriff diskutiert. Darüber hinaus wird aus der Sicht der betreuenden Lehrkraft der Mehrwert einer Ko-operation zwischen Schule und Universität gerade im Hinblick der aktuellen Kompetenzorientierung dargelegt. Abschließend werden die Qualifikationsarbeiten der Schüler:innen gesammelt, die eindrucksvoll die Lernprozesse und erzielten Lernerfolge verdeutlichen. In this fifth volume of the MimaSch series, the development, realization and results of a collabo-ration between school and university that has been repeatedly called for are documented. In the course of the topic- and competence-oriented teaching of Middle High German language and literature of the Chair of German Philology of the Middle Ages, a scientific propaedeutic seminar on the concept of the hero was carried out together with the E.T.A Hoffmann Gymnasium Bam-berg in the grammar school upper level, at the end of which the first scientific papers were writ-ten and presented. In an introduction, the Middle High German Nibelungenlied is discussed as a starting text for an educational examination of the concept of the hero. Furthermore, from the perspective of the supervising teacher, the added value of a cooperation between school and uni-versity is demonstrated, especially with regard to the current competence orientation. Finally, the qualification works of the students are compiled, which impressively show the learning processes and achieved learning successes.

The origins of Santa Claus, or so I am told, is that the young Bishop Nicholas secretly delivered three bags of gold as dowries for three young girls to their indebted father to save them from a life of prostitution. Armed with immortality, a factory of elves and a fleet of reindeer, his has been a lasting legacy, inextricably linked to Christmas. Of course, this Christmas looks a little different. Amidst a global pandemic, shimmying down the chimneys of strangers certainly does not adhere to social distancing guidelines. Some borders remain closed, and in some instances, the quarantine period is far too long. After all, he only has 24 hours to spread cheer across the world. As with the rest of us, Santa Claus is likely to get the remote working treatment. The reindeers this year are likely to be self-driving, reminiscent of an Amazon swarm of technology, and the naughty and nice lists are likely to be based on algorithms derived from social media accounts. In the age of the fourth industrial revolution, it is difficult to imagine that letters suffice anymore. How many posts were verified as real before shared? Enough to get you a drone. Fake news? Here is a lump of coal. Will we see elves in personal protective equipment (PPE) and will Santa Claus, high risk because of age and his likely comorbidities from the copious amount of cookies, have to self-isolate in the North Pole? In fact, will there be any toys at all this year? Surely production has been stalled with the restrictions on imports and exports into the North Pole. Perhaps, there is a view to outsourcing, or perhaps, there is a shift towards local production and supply chains. More importantly, as we have done in many instances in this period, maybe we should pause to reflect on the current structures in place. The sanctification of a figure so clearly dismissive of the Global South and to be critical, quite classist must be called into question. From some of the keenest minds, the contributions in this book make a strong case against this holly jolly man. We traverse important topics such as, is the constitution too lenient with a clear intruder who has conveniently branded himself a Good Samaritan? Allegations of child labour under the guise of elves, blatant animal cruelty, constant surveillance in stark contrast to many democratic ideals and his possible threat to national security come to the fore. Nevertheless, as the song goes, he is aware when you are asleep, and he knows when you are awake. Is feminism a farce to this beloved man – what role does Mrs Claus play and why are there inherent gender norms in his toys? Then is the worry of closed borders and just how accurate his COVID-19 tests are. Of course, this brings his ethics into question. While there is an agreement that transparency, justice and fairness, nonmaleficence, responsibility, and privacy are the core ethical principles, the meaning of these principles differs, particularly across countries and cultures. Why are we subject to Santa Claus’ notions of good and evil when he is so far removed from our context? As Richard Thaler and Cass Sunstein would tell you, this is fundamentally a nudge from Santa Claus for children to fit into his ideals. A nudge, coined by Thaler, is a choice that predictably changes people’s behaviour without forbidding any options or substantially changing their economic incentives. Even with pinched cheeks and an air of holiday cheer, Santa Claus has to come under scrutiny. In the process of decolonising knowledge and looking at various epistemologies, does Santa still make the cut?

Abstract:
Desde los inicios de la actividad hospitalaria, en la Edad Media, ha sido necesario el establecimiento de cuidados particularizados para aquellos enfermos que enfrentan alguna enfermedad de la cual no tienenposibilidades con los medios existentes. Dicha necesidad llevó a la creación de los primeros hospicios, dirigidos generalmente por órdenes de religiosas católicas, quienes fueron las primeras enfermeras, antes de desarrollarse la profesión como tal en su sentido moderno. Esta tarea había sido relegada a un segundo plano hasta que resurgió a mediados del siglo XX en el Reino Unido en un movimiento vigente aún hoy y que lleva precisamente el nombre Hospice, este resurgir sentaría las bases de los Cuidados Paliativos modernos, y que vienen cobrando cada vez más importancia dado el cambio del patrón epidemiológico hacia enfermedades no trasmisibles, degenerativas y asociadas al envejecimiento poblacional. En América Latina la preocupación tardaría un poco más en aparecer, sin embargo ya para finales de siglo comenzó una serie de iniciativas por incorporar los cuidados paliativos en nuestra región, a pesar de que no existiera una cultura favorable al respecto, ni una legislación que facilitara tal adopción y mucho menos una infraestructura adecuada del sistema sanitario con profesionales acordes e idóneamente formados para tales fines. En el caso de Ecuador sería a mediados de la década de los noventa que se iniciaría el proceso de incorporación de los Cuidados Paliativos en el Sistema de Salud, los primeros intentos llevarían a la conformación de FACUPAL, y desde esa experiencia se iniciaría el establecimiento de las primeras instituciones dedicadas a los cuidados paliativos, como el Hospice San Camilo. El trayecto que los Cuidados Paliativos ha tenido que recorrer para su establecimiento definitivo como una especialidad y servicio específico dentro del ámbito sanitario nacional ecuatoriano cuenta ya con más de 30 años de experiencias y desarrollo, a lo largo de este período se han enfrentado dificultades, pero finalmente se ha venido instalando de manera que hoy en día no sólo forma parte del derecho a la salud, con el debido reconocimiento y garantías del Estado sino que existen una serie de directrices que le dan carácter sistémico, profesional y legítimo al ejercicio de los mismos. Todavía resta mucho por recorrer y avanzar, sin embargo para ello se hace necesario reforzar la formación de los profesionales ya existentes y contribuir por supuesto a la formación de una nueva generación de profesionales en estos cuidados, especialmente en el área de enfermería, para darle continuidad a un proceso que no ha hecho sino favorecer la salud de la población ecuatoriana. En tal sentido, obras como la que se presenta a continuación están revestidas de un valor y una importancia primordial para la continuidad del desarrollo de los Cuidados Paliativos y los profesionales que presten tal servicio en nuestro país. Estamos seguros de que no sólo será una herramienta práctica para los estudiantes universitarios sino para quienes ya ejerzan tan encomiable labor.
