Abstract:

Storme, Matthias E. "The Foundations of Private Law in a Multilevel Structure: Balancing, Distribution of Lawmaking Power, and Other Constitutional Issues." European Review of Private Law 20, Issue 1 (February 1, 2012): 237–53. http://dx.doi.org/10.54648/erpl2012013.

Abstract:
Abstract: This contribution is, first of all, a reflection on the distribution of power in relation to private law in the context of multilevel government, on the one hand, and relativization of this power by a so-called law market, on the other hand. It is also a reflection on the notion that law is a balancing activity (balancing values or interests). The author argues in favour of maintaining a normative perspective instead of recognizing as law everything that pretends to be law. He also argues in favour of the classical separation of powers and discusses the legitimacy of lawmaking by the different branches of power. Notions like pluralism and diversity tend to hide political choices that undermine classical values as equality before the law and the application of the law of the land. After an analysis of the arguments in favour of or against a centralization of lawmaking power on the European level, the author argues in favour of a reversal of the actual principles of division of power between the European Union and the Member States and thus in favour of a European Civil Code (ECC) that may be amended by the Member States.

Abstract:

Abstract:
The selective conversion of biomass-derived substrates is one of the major challenges facing the chemical industry. Recently, stannosilicates have been employed as highly active and selective Lewis acid catalysts for a number of industrially relevant reactions. In the present work, four different stannosilicates have been investigated: Sn-BEA, Sn-MFI, Sn-MCM-41 and Sn-SBA-15. When comparing the properties of tin sites in the structures, substantial differences are observed. Sn-beta displays the highest Lewis acid strength, as measured by probe molecule studies using infrared spectroscopy, which gives it a significantly higher activity at low temperatures than the other structures investigated. Furthermore, the increased acid strength translates into large differences in selectivity between the catalysts, thus demonstrating the influence of the structure on the active site, and pointing the way forward for tailoring the active site to the desired reaction.

Abstract:
Context. Feedback processes play a fundamental role in the regulation of the star formation (SF) activity in galaxies and, in particular, in the quenching of early-type galaxies (ETGs) as has been inferred by observational and numerical studies of Λ-CDM models. At z = 0, ETGs exhibit well-known fundamental scaling relations, but the connection between scaling relations and the physical processes shaping ETG evolution remains unknown. Aims. This work aims to study the impact of the energetic feedback due to active galactic nuclei (AGN) on the formation and evolution of ETGs. We focus on assessing the impact of AGN feedback on the evolution of the mass–plane and the fundamental plane (FP; defined using mass surface density) as well as on morphology, kinematics, and stellar age across the FP. Methods. The Horizon-AGN and Horizon-noAGN cosmological hydrodynamical simulations were performed with identical initial conditions, including the same physical processes except for the activation of the AGN feedback in the former. We selected a sample of central ETGs from both simulations using the same criteria and exhaustively studied their SF activity, kinematics, and scaling relations for z ≤ 3. Results. We find that Horizon-AGN ETGs identified at z = 0 follow the observed fundamental scaling relations (mass–plane, FP, and mass–size relation) and qualitatively reproduce kinematic features albeit conserving a rotational inner component with a mass fraction regulated by the AGN feedback. We discover that AGN feedback seems to be required to reproduce the bimodality in the spin parameter distribution reported by observational works and the mass–size relation; more massive galaxies have older stellar populations, larger sizes, and are slower rotators. We study the evolution of the fundamental relations with redshift, finding a mild evolution of the mass–plane of Horizon-AGN ETGs for z < 1, whereas a stronger change is detected for z > 1. The ETGs in Horizon-noAGN show a strong systematic redshift evolution of the mass–plane. The FP of Horizon-AGN ETGs agrees with observations at z = 0. When AGN feedback is switched off, a fraction of galaxies depart from the expected FP at all analysed redshifts owing to the presence of a few extended galaxies with an excess of stellar surface density. We find that AGN feedback regulates the SF activity as a function of stellar mass and redshift being able to reproduce the observed relations. Our results show the impact of AGN feedback on the mass-to-light ratio (M/L) and its relation with the tilt of the luminosity FP (L-FP; defined using the averaged surface brightness). Overall, AGN feedback has an impact on the regulation of the SF activity, size, stellar surface density, stellar ages, rotation, and masses of ETGs that is reflected on the fundamental relations, particularly on the FP. We detect a dependence of the FP on stellar age and galaxy morphology that evolves with redshfit. The characteristics of the galaxy distribution on the FP according to these properties change drastically by z ∼ 1 in Horizon-AGN and hence this feature could provide further insight into the action of AGN feedback.

Abstract:
Introduction. High efficiency of functioning of network business structures, in comparison to traditional forms of entrepreneurship organization, their adaptability and mutual interest of all participants of relations in achieving the goal, led to a great interest in the network form of entrepreneurship organization by scientists and their practical implementation. The purpose of the article is to clarify the essence of the term «network structure» based on the definition of its essential features and associative concepts from the standpoint of institutional, collaborative and coordination approaches. Results. The semantic network was constructed as the analysis result of the concept of «network structure» using the content analysis method implemented in the software product TextAnalyst that characterizes the key categories that are related to the essence of the concept of network business structure. It is determined that associative concepts of network structure are: organization, interaction, association, management structure, a form of management, coordination, cooperation, alliance, structured population, integration, corporate structure, relations, coalition. Using the content analysis three approaches to explaining the essence of the concept «network business structure» were distinguished: institutional (according to which the network structure is considered as the organizational structure of the company), collaborative approach (network structure as a system of interconnections between structural elements) and coordination approach (network structure as a form of managing peer-to-peer entities to achieve common business goals). Conclusions. Based on the integration of selected approaches to explaining the essence of the concept under the network business structure, it is proposed to understand the hybrid form of interaction of business structures that operate on the basis of quasi-integration forms of control in order to achieve a synergistic effect in the realization of common economic interests. The proposed concept, unlike the existing ones, is based on a comprehensive consideration of the stages’ peculiarities of network forms development of business activity and reflects the essential features of an institutional, collaborative, coordination approach in the functioning of business structures. Keywords: network structure, hybrid structure, management, coordination, cooperation, quasi-integration.

Taking into account the importance of protecting metal structures of livestock objects from corrosion during disinfection work, the corrosion properties of the new Penox-1 disinfectant have been studied. Studies have shown that the tested drug «Penox-1» has a low corrosion activity in relation to metal products made of aluminum, galvanized iron and stainless steel, compared with the reference drug. Thus, the solution of the Penox-1 preparation reduced the initial weight of metal plates during 24 hours of exposure from aluminum by 0.196 g, which is 7.4%, and the standard preparation by 0.836 g or 32.1%, which is 4.3 times more . Similar data were obtained in a comparative aspect with galvanized iron and stainless steel plates. When examining metal plates after testing in a Penox-1 solution, the color and structure did not change visually and under a microscope. At that time, the plates immersed in a 2% sodium hydroxide solution changed strongly in color and structure, and a yellow-gray corrosive coating appeared.

Abstract:
At the present stage of transformational change, the problems of activating the economic partnership and cooperation based on the creation of network structures are extremely important. These issues are actualized especially in the context of the rapid development of the digital economy and smart specialization. Given this, the purpose of this study is the theoretical generalization and systematization of existing scientific approaches to the interpretation of the concept of «network structure»; substantiation of the authors’ own approach to defining the content of this economic category. As a result of the carried out study, it is determined that the concept of «network structure» be identified with such definitions as: organization, interaction, association, management structure, form of management, coordination, cooperation, alliance, structured set, integration, corporate structure, relations, coalition. Using a systematic approach and the classification method, the interpretation of the term of «network structure», proposed by various scientific schools, is conventionally systematized as to the following groups: entrepreneurial network; business structure; open structures; new organizational form of joint activity; collective interaction; organizational type; model of economic relations; complex of business units (network partners); element of the network economy, et cetera. The article provides the authors’ own approach to defining the category of «network structure» as a specific form of organization of collective efforts, which is based on the voluntary interaction of its participants on the basis of combining their interests, resources, competencies, and capabilities. It is proposed to consider the network structure as an economic category from three positions, such as: a network form of partnership; an effective model of stakeholder interaction in the context of global transformations; a model of partnerships between market participants in the organization of logistics processes.

Abstract:
Abstract. The experience of successful aviation structures has shown that the effectiveness of their activities is largely determined by organizational support. There are four main approaches to the definition of "organizational support": structural, regulatory, process and system. It is proposed to define "organizational support" as a system of processes and procedures for sustainable operation of the enterprise in accordance with the developed strategy and objectives, which ensures orderliness of elements and relations by organizing the relationship between departments, providing them with necessary resources and establishing effective external communications. The following definition of organizational support of aviation activity is offered. establishing effective external communications. The definition contains elements of structural, regulatory, process and system approaches. Among the structural elements of "organizational support of aviation activities" are: organizational structure, which determines the composition and location of units of aviation entities, the internal order of elements and relations; creation of a rational production structure and organization of the main production processes, which are aimed at the implementation of the necessary production functions and performance of production tasks by the subjects of aviation activities and their units; resource support for the functioning of aviation entities - logistical, financial, personnel, information, methodological, etc .; organization of internal relations between the divisions of aviation entities and effective external communications. The aim of further research should be to study the specifics of organizational support of various aviation entities in the main production chain in the field of aviation and related support services, from basic and applied research in aircraft construction to the provision of aviation services. Key words: organizational support, aviation activity, aircraft, aviation, air traffic organization, air traffic service, use of airspace, use of aircraft, organizational structure, resource provision.

Abstract:
Fucoidan is a natural derived compound found in different species of brown algae and in some animals, that has gained attention for its anticancer properties. However, the exact mechanism of action is currently unknown. Therefore, this review will address fucoidans structure, the bioavailability, and all known different pathways affected by fucoidan, in order to formulate fucoidans structure and activity in relation to its anti-cancer mechanisms. The general bioactivity of fucoidan is difficult to establish due to factors like species-related structural diversity, growth conditions, and the extraction method. The main pathways influenced by fucoidan are the PI3K/AKT, the MAPK pathway, and the caspase pathway. PTEN seems to be important in the fucoidan-mediated effect on the AKT pathway. Furthermore, the interaction with VEGF, BMP, TGF-β, and estrogen receptors are discussed. Also, fucoidan as an adjunct seems to have beneficial effects, for both the enhanced effectiveness of chemotherapy and reduced toxicity in healthy cells. In conclusion, the multipotent character of fucoidan is promising in future anti-cancer treatment. However, there is a need for more specified studies of the structure–activity relationship of fucoidan from the most promising seaweed species.

Abstract:
In this paper, we proved that the solid-state structure of vitamin D analog is well represented by the structures of its structural fragments. This is important in predicting the biological activity of vitamin D analogs that are not available in the solid form. The previously published crystal structure of advanced vitamin D intermediate provided additional insights into vitamin D properties. A similar analysis based on simple vitamin D intermediate analogues showed that precursors crystallized in the space groups typical for vitamins D; geometrical parameters were related to the corresponding parameters in the vitamin D analogues; and crystal structures of the basic intermediates and their final products contained similar intermolecular interactions, essential for the infinite hydrogen bond motif observed in the vitamin D analogues. The energy of these interactions is related as shown by theoretical calculations, that is, energy frameworks analysis. Moreover, analysis of the hydrogen bonds motifs revealed a relation between these motifs and the absolute configuration of basic intermediates as well as the space orientation of the exocyclic methylene group in the final structures.

Abstract:
PurposeThree-dimensional computer-aided design (CAD) assembly model has become important resource for design reuse in enterprises, which implicates plenty of design intent, assembly intent, design experience knowledge and functional structures. To acquire quickly CAD assembly models associated with specific functions by using product function requirement information in the product conceptual design phase for model reuse, this paper aims to find an approach for structure-function correlations analysis and functional semantic annotation of mechanical CAD assembly model before functional semantic-based assembly retrieval.Design/methodology/approachAn approach for structure-function correlations analysis and functional semantic annotation of CAD assembly model is proposed. First, the product knowledge model is constructed based on ontology including design knowledge and function knowledge. Then, CAD assembly model is represented by part attributed adjacency graph and partitioned into multiple functional regions. Assembly region and flow-activity region are defined for structure-function correlations analysis of CAD assembly model. Meanwhile, the extraction process of assembly region and flow-activity region is given in detail. Furthermore, structure-function correlations analysis and functional semantic annotation are achieved by considering comprehensively assembly structure and assembled part shape structure in CAD assembly model. After that, a structure-function relation model is established based on polychromatic sets for expressing explicitly and formally relationships between functional structures, assembled parts and functional semantics.FindingsThe correlation between structure and function is analyzed effectively, and functional semantics corresponding to structures in CAD assembly model are labeled. Additionally, the relationships between functional structures, assembled parts and functional semantics can be described explicitly and formally.Practical implicationsThe approach can be used to help designers accomplish functional semantic annotation of CAD assembly models in model repository, which provides support for functional semantic-based CAD assembly retrieval in the product conceptual design phase. These assembly models can be reused for product structure design and assembly process design.Originality/valueThe paper proposes a novel approach for structure-function correlations analysis and functional semantic annotation of mechanical CAD assembly model. Functional structures in assembly model are extracted and analyzed from the point of view of assembly structure and function part structure. Furthermore, the correlation relation between structures, assembled parts and functional semantics is expressed explicitly and formally based on polychromatic sets.
