Full textThe lex petrolea is the set of rules established over time by actors involved in the exploration, development and exploitation of hydrocarbons. Recorded and regularly updated by Anglo-Saxon doctrine, it constitutes Archimedes' point from which academic work declines what should be considered hydrocarbon law. It is more likely to be interpreted as a set of norms of plural sources (arbitral, contractual, legislative), without any overall coherence and, above all, without distinguishing the role of actors who nevertheless have a different legal and economic status. On the one hand, States are certainly driven by legitimate patrimonial interests, but also by geo-economic and even political interests. Energy investors on the other hand are exclusively motivated by the gain of profit, and this relationship generates a significant hydrocarbon law. In order to renew the legal doctrine of this activity, a new approach is proposed based on the respective and complementary theories of legal monism on the one hand and legal relationalism on the other. Once legal norms are established, they are more or less applied, immersed in the special relationship between States and their contracting partners. The contractual relationship leads to a broader legal relationship structured around written standards, shareholder practices and simply around a relationship that generates a hydrocarbon law that goes beyond identifiable written standards. The systematic intervention of a third party, either the administration in several forms in the execution of the obligations of the parties, or the arbitrator in the event of litigation, allows the construction, upkeep and permanent maintenance of legal relations between the parties. They thus create a symbolic framework for their relations, under the influence and total control of the State, as the owner of the extractive resources. This is what we have called in conclusion to the study the relational monism of African hydrocarbon law

Full textWe suggest reading Georg Simmel's work as an endeavor to determine an idea of culture that is suitable to a modernity dominated by objectivation and functionalization processes, and where one can observe the "discrepancy" between the "subjective culture" and the "objective culture". Simmel is not only a Kulturkritiker, who would merely describe this problem, he is also a philosopher of culture, who seeks to determine the ontological and axiological structure of the problem and solve it. This effort appears as the fulfillment of a theoretical program known as "relativism", which we rename "philosophical relationism". This relationism, after having accounted for the specific validity of the cultural formations - within the form of a theory of value and objective spirit -, aims at promoting it to a second order validity, individual and alive, that is: to the form of individual culture. Thus, relationism constitutes itself as a "cosmic concept" of philosophy, which doesn't take the form of a system, but that of a functional metaphysics, while the static opposition between the subject and the object is outmatched towards an "objectivation of the subject" and a "desubjectivation of the individual"

Full textThe thesis evaluates the potential of Fine’s Semantic Relationism for a cognitivist approach to language and the mind. The main aim is to champion Semantic Relationism as the only adequate theory of content for the Language of Thought by bringing out the benefits of the theory over its main rivals, Referentialism and Fregeanism. It seeks to show that only Semantic Relationism can address all the variants of Frege’s Puzzle for the Language of Thought, and that it can do so in a way that avoids the substantial difficulties that beset other semantic theories. The main outcome is at the same time a vindication of the adopted semantic theory and a confirmation of the viability of the Language of Thought hypothesis. The thesis also offers a new theory of propositions on the basis of the Language of Thought and a Relationist semantics that differs significantly from all such presently available theories, including Fine’s. The final result is a theory of propositions as syntactically structured mental representations, which are sentences in the Language of Thought, that are content bearers individuated by their semantic content as specified by Semantic Relationism. A major objective of the thesis is to highlight the advantages of this view over both classical and current alternatives. The thesis develops its overall view by offering solutions in three closely related ongoing debates. First, the challenge posed by Frege’s Puzzle for thought and belief, Kripke’s Puzzle notably included, secondly, the problem about the proper type-individuation of Language of Thought symbol tokens, and thirdly, the debate about the ontological nature of concepts and propositions. By developing a promising Relationist response to these problems, the thesis also provides additional support to Fine’s semantic theory by considerably expanding its scope of application.

Full textThis research is questioning the relation that young adolescent have with otherness : inter-group relations and friendship relations. Concerning inter group relations , we have wished to question the existence of an "ethnical" discrimination among French children. Anderson's Functional Theory of Cognition enables us to find ethnical and socio cultural features that leads to acceptation or rejection of the other. Territorial origin, language, economic level, clothes and manner of eating appear to be judgement criterias that might lead to the rejection of the other. On the other hand, children do not take into account skin colour or religion to make a decision. The second part of this work deals with friendship between children and shows motivations for choosing a "different" friend. Investigation from Apter's Reversal Theory brings to light Alloïc and Sympathy motivations. Finally, this work leads to the creation of an evaluation device for children's relationships. This device will allow to analyze seven aspects of children's social relationships : xenophile norm's internalization ; friendship' sublimation ; the importance of time spent playing or talking with the friend ; the affection granted by friendship ; school life ; consideration of others' emotions and rules transgression

One of the fundamental issues in cognitive science is the problem of grounding concepts in the perceptual world. In this thesis, I present a computational theory for how spatial relations are grounded in the perceptual world. Three constraints are critical to this theory: abstractness, groundedness and flexibility all of which need to be satisfied in order to explain the structure of spatial concepts. I then show how a formal framework, based on the mathematical notions of category theory can be used to model the grounding problem. The key computational ideas are that of minimal mapping and derivations. A minimal mapping of two categories, A and B, is the "smallest' category, C, that contains A and B. A derivation is a sequence of categories that follow a minimal mapping rule. Derivations and minimal mappings are used to model three domains - the semantics of prepositions, the structure of a toy "Jigsaw World" and the semantics of generic terms and quantifiers. In each case, I show how the computational theory gives rise to insights that are not available upon a purely empirical analysis. In particular, the derivational account shows the importance of stable, non-accidental features and of multiple scales in spatial cognition.

Full textToday's organizations face significant challenges in being competitive with the outside world. Human resources are the organizations most important factor at all survive. For the business to be able to manage and utilize employee skills in the right way, it creates conditions and occasions where relationships can occur. This is something that is discussed in both research and literature as well as how organizations should be structured to encourage work on employees. This study is a contribution to be used in organizations to work to develop employees' collective learning about each other to strengthen relationics. Process method that has been used to create collective learning among employees is attractive work. Participants have been carrying out the method and observations have been made on how the participants have acted during the process. The result shows that to achieve a collective learning requires participants to show the commitment and willingness to learn about each other. Through dialogue creates the conditions to understand each other. That's when the understanding is on another as relations strengthened, and thus created relationic.

Full text@Up to now, it is mainly the romanization of Hispania through the aspect of urbanization and municipalization that has held the attention of searchers as is shown by recent historiography. Family and social relations in the provinces as a whole and in the Iberian peninsula particularly have merely aroused a polite interest with historians, perhaps because it was thought that they pertained essentially to the private filed often considered as the conservatory of the pre-Roman usages. Yet, the joint rising of the studies devoted to the anthropology of kinship, on one side, and regional onomastics. Celtic especially, on the other side, suggests that the history of the family is a field of investigation very near, indeed, to customs, but still nearer to the political. From that point of view, Hispania, whose legal and urban frame is better and better known, gathers every suitable condition to carry on an original investigation about the connection of family and social relationship with romanization : how did Hispano-roman communities adapt themselsves to the introduction of civitas and its corollary, Latin law. ? After successively studying the fitting of the Roman terminology about kinship to those new territories, noting the interpretation of Roman onomastic formulae according to the status of the individuals and its seniority, and closely examining the various attitudes in front of the neww territorial definition, we shall conclude that the acculturation, at once slow and quick, was not uniform and less one-sided

Background: Relation means the relationship between two parts. By creating a good relation between nurse and patient you can conduce a better caring. Aim: The aim of the study was to illustrate the relation within palliative care from nurse- patient perspective. Method: The study is a literature review where ten articles were analysed with qualitative content analysis. Results: The findings showed that knowledge, communication, continuity, silence and availability were the most important thing for the nurse in the relationship. Energy, regular contacts, having time and the nurse being able to listen was most important for the patient. In the encounter between the nurse and patient, communication is fundamental for understanding in the conversation where the patient tried to find information about treatment, medicament and the illness. The most valuable was being able to talk about feelings. You must get to know the patient as the person he is to be able to know his interests and what he considers important. Continuity is a prerequisite to make the patient feel safe and secure. Conclusion: Being able to pay attention to unspoken needs and understanding why the patient reacts the way he does is a proof that knowledge has appeared.
