Antidumping law to the commercial relations with china includes certain particularities resulting from the special rules applicable to the countries who are considered by the community to be a non-market economy. According to these rules, in nonmarket economies, normal value is not based on domestic price but on the price of a like product in a market economy third country - known as an "analogue country". This affects the whole basis of the comparison of prices which is at the heart of an anti-dumping investigation and puts the chinese exporters into a difficult position during a procedure. The present study demonstrates that the community anti-dumping rules applicable to the non-market economy countries call for the reexamination in order to be conforme to the realities. Full textThis study focuses on community relations policies followed by public bodies in Northern Ireland during the Troubles [1969-1998]. The author compares the first plan, which lasted from 1969 to 1974, with the second series of measures taken from 1987. She also examines policies set up during the intervening thirteen years [1974-1987] when the issue of CR remained dormant. This examination shows that the consistency of government policies in the field of community relations is questionable. Community relations programmes have been looked at alongside peacebuilding initiatives involving public bodies as well as community activists. Despite an initial assumption that there has been no continuity in community relations policies between 1969 and 1998, it appears from the research that, throughout the Troubles, such policies have emanated from modes of thinking and acting which are well established among decision makers

Full textMeant to stop the loss of competivity of the european information technology industry in the early 80's, the ESPRIT programme consists in an heavy financial support to transeuropean industrial cooperations in the field of research and development. With a 4. 5 billions ecus budget, it is the most ambitious programme of research ever launched by the community. Besides the necessity of its inclusion in an appropriate legal support, esprit has become a model for most of the " second generation " community programmes. It has served as an experimentation of specific legal methods. In particular, the solution of indirect research actions led to the elaboration of a careful contractors selection procedure and to the conclusion of different types of contracts : eec standard contracts, consortium agreements and subcontracts. Apart form arising of an emergency, the right performance of esprit requires the carrying out of obligations related to the contractual work and to the informations diffusion, as well as the conformity of the programme with the community competition law, which is applicable in spite of the community institutions participation

Full textThis dissertation looks into the factors that have caused the Belfast community arts sector to grow over a period of time that was marked by major political changes. Indeed, in the 80s community arts, which developed primarily in Catholic working-class areas against a backdrop of communal violence and community activism, were marginalised, undervalued and underfunded. In the 90s, this situation gradually changed as the British government and Europe came to realise the contribution community arts could make to peace building, social cohesion, community relations and economic development by enhancing community confidence. The impact this shift in approach has had, has been particularly impressive in the field of arts and culture where cultural trends promoting greater participation and wider access to the arts have gained momentum. In practice, the gradual move from arts policy to cultural policy has meant that community arts have been placed! at the heart of Belfast’s regeneration process and increasingly used as a tool to further public policies

Full textThis thesis presents some empirical results of an intervention in a health program of the federal government of Brazil. It analyzes the development of the power to act in professional practices of two health agent groups.Analyzing excerpts of dialogues collected during the intervention, we conclude that the development of the power to act has to be understood in a deep way that concerns: the extension of power to act (on themselves, on the professional genre or on the organization); different types of instruments that are created (to act on themselves and to act on other; ways of acting and value rules).The analysis of the motivation of the development has enabled us to reaffirm the need for alternating functional movement between sense and efficiency to ensure the effectiveness of the activity.Differentiation and limits of the development of the power to act of professionals has allowed us to conclude that the absence of a steering committee involved in the intervention does not support the development of power to act in an organization. It put at risk the effectiveness of the organization and the health of the professionals

Full textRadio has been a really important communication medium for African countries. The democratization experienced by the African countries helped to liberalize the media landscape. Furthermore, this liberalization helped the development of a specific kind of radio, community radios, that have ability of giving a voice to the voiceless. Beside the insufficient integration of women in the community radios, this study shows that this new communication tool has a relative importance on women’s economic and civil rights. The study shows what these impacts are, as well as their limits, and the place of governmental and non-governmental institutions in the development of this medium.

The analysis on the aspects concerning the technique of the adaptation process of romanian legislation to the acquis communautaire raises the main difficulties of organisation and functioning as well as the modalities to gradually surmount them. Full textThis thesis attempts to clarify the jurisprudence of the Court of Justice and the Court of First instance of the European Communities concerning public international law treaties involving contracting parties other than the Communities and their Member States. In particular, it focuses on the analysis of the legal status and of the application of the external agreements, with the exception of the question of the existence of EC competence for their conclusion. One of the contributions is to propose a coherent explanation of the relevant jurisprudence, which is structured depending on the nature of the norm that is examined by reference to a treaty norm. We argue that the logic of the judge, vis-a-vis the interpretation and the application of a treaty provision in a particular case, is usually servile to the norm, either Community or national, which interacts with the treaty provision concerned

Full textThis thesis deals with trade relations between the European economic community and Japan through some non-tariff obstacles and through the community law. The dialogue is set out on the multilateral and bilateral level within economic and political fields. In the absence of an arbitration agreement, the exchange discipline is guaranteed by the general agreement on tariffs and trade organization. Unilateral and conventional restrictive measures, legalized or controlled on both sides by legal texts or guaranteed by the current practice, are hindering exchanges. The rules of the market economy are hence thwarted because of the Japanese dumping. This latter may be linked to new speculative goods which are not only bringing about destabilizing these countries as far as the technological investment is concerned. The community institutions are curbing the poor functioning engendered by the dumping, through a regulation targeted to the Japanese dumping. The institutions are striving towards the setting up of an almost tariff system. The reason may be the marked preference for law rather than for agreements. The surveys conclusions are made up by fundamental economic data obscured by the regulation. In Japan and within the European economic community, the opening up of the public market to the international competition may be seen through legal texts. These latter are setting out the resulting public markets. This opening up is invalidated

Initially elaborated by a consequent jurisprudence of the European Communities Court of Justice, this control led to the adoption in 1989, of a specific regulation on concentrations.
Considered as an essential tool towards the realisation of the Community objectives, its implementing must nevertheless be combined with the imperatives of a common industrial policy and take into account the globalisation trend that is attached to this activity.

Full textThe impact of communitarian law of competition goes beyond the legislation in the associated countries. This is the case of Tunisia, whose competition law has been changed according to certain communitarian regulations, since the country has signed an Association Agreement with the European Union. This Agreement prohibits nearly the same anticompetitive practices, as are forbidden by Tunisian competition law. However, it also introduces new measures concerning state aides, liberalization of the public sector and adjustment of state monopolies. The Tunisian law on competition and prices of 1991 has created an autonomous body of control: the Council of competition, which will play an ever more important role concerning the regulation of the market. The interventions of this institution have increased over the last years, certainly under the influence of communitarian regulations imposed by the Association agreement and WTO regulations; but also under the pressure of growing complexity and diversity of juridical problems caused by the accelerated development of new modes and techniques of the functioning of markets and commerce

Full textFrom the mid 90’s, changes in both internal and international scenarios led to a development of strategic Euro-Latino-American partnerships paving the way for new contractual tools. Mexico and Chile were the first emerging countries to benefit from this contractual renovation herewith the subject of this thesis which will seek to determine the juridical nature from the European Community Law point of view of the euro-Mexican and euro-Chilean agreements, signed respectively in 1997 and 2002 seeing as these broke the euro-Latino-American tradition of only signing non-preferential agreements, thus opening the way for a new and ambitious future for the relations between the parties. The content analysis of these agreements which are based on mutual values and interests demonstrates the associative nature as well as the essence and the scope of these relations which became the base of a new model of strategic alliances on the international level

Full textIn 1939, as war had just broken out, the Council for the Encouragement of Music and the Arts (CEMA) was created in Great Britain to finance the arts. Four years later, the same organisation was established in Northern Irelad because of the pressure coming from the London government. As it was not born out of regional political conviction, CEMA (NI) struggled for years to get the principle of public support for the arts accepted.The present work studies this organisation, which was renamed Arts Council of Northern Ireland (ACNI) in 1963, under various angles: political, economic, social, cultural and, of course, artistic. It will also question the arm’s length principle and the separation between the realm of politics and that of the arts that the Council was supposed to guarantee. Indeed, even though the role and the budget of CEMA were extremely limited in 1943, the Council progressively acquired numerous responsibilities. This did not go unnoticed by the unionist government, which sought to control CEMA/ACNI and how it distributed grants. With the outbreak of the Troubles in the late 1960s, the Council increasingly isolated itself in order to be recognised as neutral in the conflict. However, this also pushed it to put in place a policy that was perceived as elitist and cut out from the population. In the 1990s, the Peace Process gave ACNI a new role in the promotion of reconciliation between the communities. With the creation of the Department of Culture, Arts and Leisure in 1998, the Council was further integrated into the cultural policy framework of the regional and power-sharing government. Nevertheless, culture remained a sore point and a divisive issue in Northern Ireland, with academics going as far as to say that the conflict has now become a cultural war

Full textThe idea of "regionalization" is currently very successfull in most of the European countries, including the countries with a long centralizing tradition. It has an influence upon the europan community too. The classic European system, based on the relationship betweeen the community and its member states, don't be a reality any more and a new development appears in this relationship: the region. This notion has many differents meanings in each member state, but the situation of the federal republic of Germany is quite particular. It's the only federal state in the European Community , its "regions", the Länder, are federate states and have important powers. It's therefore interesting to analyse how a federal state with two levels of decesion, bund and Länder, could become integrated into a system already based on two levels, community and member states, without his federal characteristic disappears. The German Länder are direct and indirect in contact with the community and have some influence upon the decisions of the community. This relationship could be a model which could guide the relationship between the community and the European regions

Full textThe Community regulations on the agricultural support of the French Overseas Departments has its legal origins from ex-article 227 (2) of the E(E)C Treaty, as set down by the Hansen decision of the European Court of Justice of October 10th 1978 and which became following the revision of 2nd October 1997 of the Treaty of Rome, article 299 (2) of the EC Treaty. Guadeloupe, Guyane, Martinique and Reunion are integrated within the Community in a realistic manner, where the Community legislator takes into account the handicaps which are characteristic of these regions called the outermost regions. The agricultural producers from these regions not only benefit from the common support measures of the Common Agricultural Policy but also from the differentiating measures. These measures concern a CAP more adapted to the DOM, and which added on to the former enable a real continuity of the objective of providing an equitable standard of living for the agricultural population of these departments. Nevertheless, the support regulations subject to or are susceptible to be subject to modifications, which could go against the interest of the overseas producers. This is due to the international engagements of the Community on the one hand and to purely Community decisions on the other hand which question or could question the exercise of the objective of Article 33 (1) b) of the Treaty

Full textWith the rise of a worldwide free market and the development of new means of transport and communications, economic agents are now able to perform their activities on a global scale. Multinational enterprises are of course the first one to benefit from such situation. In this framework, more than 50% of the international business is made within interrelated companies, i. E. Companies belonging to a same group. This raises the issue to find a transfer price that suits both the interests of the MNE and the tax administration. In order to prevent any transfer of profit by way of transfer pricing, countries all around the world including France issued new regulations aiming at reintegrating the profit that has been transferred into their tax base. By doing so, tax administrations multiplied the frictions between them all at an international scale, as each administration bases its approach on its own interpretation of facts and circumstances surrounding the MNE. Therefore, MNE are facing a certain tax and legal uncertainty, which threatens their own transfer pricing policy, i. E. Their way to perform their activity. Fortunately, some solutions exist in order to prevent and solve tee double taxation likely to arise. Moreover, some other solutions should be implemented in a near future
