Il lavoro passa brevemente in rassegna i cambiamenti relativi all’attuale comprensione della coscienza e analizza la probabilità che l’obiezione di coscienza sia accettata nel contesto delle nuove percezioni del ruolo della coscienza e del relativismo individualistico o culturale supportato dall’individualismo espressivo contemporaneo. Le critiche e le conclusioni di Husserl sullo scetticismo vengono utilizzate come riferimento per la discussione di tali prospettive. Le incoerenze logiche individuate in entrambe le teorie relativiste mostrano i principali problemi insiti nella loro formulazione e applicazione. Se ne conclude che in una società basata sul relativismo morale sarebbe possibile respingere le ragioni dei singoli per l’obiezione di coscienza, invalidando i loro sforzi per salvaguardare la loro coscienza. Le revisioni della nozione di coscienza spesso invocano il rispetto per l’autonomia personale come salvaguardia dell’autogoverno da parte degli individui. Esaminando l’interpretazione prevalente del concetto di autonomia ne emergono la vaghezza e i limiti, ma ciononostante tale concetto è impiegato per mettere in discussione l’obiezione di coscienza. Dal momento che la possibilità di considerare molti punti di vista diversi è ciò che caratterizza la proposta dei relativisti contemporanei a sostegno delle loro opinioni, lo studio che presentiamo affronta anche il problema di come sia veramente relativo il relativismo contemporaneo. Il risultato di questa analisi intende fornire un approfondimento sui problemi incontrati dal rifiuto della coscienza in un contesto sociale relativistico. ---------- This work reviewed briefly changes in the current understanding of conscience and analysed the likelihood of conscientious objections being accepted in the context of these new perceptions of the role of conscience and of the individual or cultural relativism supported by contemporary expressive individualism. Husserl’s critiques and conclusions about skepticism were used as models to discuss these prospects. Logical inconsistencies identified in both relativistic theories exposed fundamental problems in their formulation and application. It was concluded that in a society based on moral relativism, it would be possible to rebut the reasons of individuals to object in conscience, rendering void their efforts to safeguard their conscience. Revisions of the notion of conscience often invoke respect for personal autonomy as a safeguard of self-government by individuals. An examination of a prevailing concept of autonomy showed it riddled with imprecisions and limitations, but nonetheless employed to question the validity of objections in conscience. Since the ability to accommodate many different perspectives is a characteristic proposed by contemporary relativists in support of their views, the study addressed also the question of how truly relative is, in fact, contemporary relativism. The result of these analyses provided added insights into the problems faced by conscientious refusals in a relativistic social context.

Esta pesquisa analisa os fundamentos dos Direitos Humanos sob o viés da clássica discussão entre o universalismo e relativismo, apresentando um contrassenso a partir do conceito de anti anti-relativismo, proposto por Clifford Geertz. Neste sentido, investiga-se o anti anti-relativismo como forma de resgatar valores antropológicos na discussão relativista, superando os paradoxos do relativismo e universalismo e buscando compreender de que modo o anti anti-relativismo pode ampliar o horizonte interpretativo sobre o relativismo cultural dos Direitos Humanos. Trata-se de um estudo de natureza bibliográfica, valendo-se do método dedutivo para alcançar o resultado.

English Given globalization and increasing multiculturalism, growing numbers of social workers face the challenges of respecting culture while upholding professional ethics. This article examines the perspectives of universalism and cultural relativism as applied to ethical decision-making in social work. A moderately universalist stance is recommended for social work, as valuing both diversity and human rights. French Face à la mondialisation et à l'augmentation du multiculturalisme, un nombre croissant de travailleurs sociaux font face à des défis dans un contexte qui demande de tenir compte à la fois du respect culturel et de l'éthique professionnelle. Cet article examine l'application de prises de décisions éthiques dans des perspectives universalistes et de relativisme culturel en travail social. Une position universaliste modérée est recommandée pour le travail social, valorisant à la fois la diversité culturelle et les droits humains. Spanish Dada la globalización y el multiculturalismo creciente, los trabajadores sociales se encuentran con el reto de respetar tanto la cultura como la ética profesional. Se examina la aplicación de las perspectivas universalistas y del relativismo cultural al proceso de decisión ética en trabajo social. Se recomienda una postura universalista moderada que respete tanto la diversidad como los derechos humanos.

La postmodernidad ha sido caracterizada por el uso constante del relativismo para poder reinterpretar y resignificar todo concepto concreto y objetivo relacionado con la especie humana. La crisis de identidad derivada de la adopción de ideologías, el materialismo, la pérdida de sentido deontológico y de la dignidad humana están simbióticamente relacionadas con el problema cultural, filosófico, social y tecnocientífico que trae consigo la relativización de conceptos, los cuales se analizan en la investigación social de hoy y repercuten en la comprensión bioética del ser humano. Entender al sujeto postmoderno y el relativismo que lo permea permite que el filósofo, el antropólogo, el bioeticista, el politólogo, el sociólogo, el psicólogo, entre otros, puedan considerar como factor el problema que suscita una perspectiva relativista en un contexto materialista, individualista y de cosificación de la especie humana en los diferentes ámbitos de investigación social. No todo relativismo es nocivo, pero hay uno en particular que atrae a las masas de sujetos postmodernos y que atañe a una mayor crisis ideológica, deontológica y social actualmente: el Relativismo de Segundo Orden como problema bioético.

A antropologia pode contribuir para que os juristas visualizem o fenômeno jurídico como produto da cultura e, por isso, marcado por grande diversidade. A proposta do trabalho é analisar como o relativismo e o anti anti-relativismo de Clifford Geertz podem lançar luzes sobre o direito. Apresenta-se o etnocentrismo e o evolucionismo cultural para depois explorar sua presença no direito e a contribuição da antropologia, com o relativismo, para se questionar essas visões. Em seguida, faz-se uma análise do anti anti-relativismo de Clifford Geertz para compreender as críticas que recebeu o relativismo e como Geertz as rebate, para se discutir, no segundo momento, como os juristas podem aprender a lançar um olhar através do espelho que possibilite criticar também os próprios pressupostos.

Abstract:
O objetivo deste artigo é analisar o espaço ocupado pelos "direitos do homem" no sistema filosófico de Alfred Rosenberg. No Pós-Guerra, muitos autores - como Hannah Arendt, Hans Kelsen e Karl Popper - argumentaram que o totalitarismo político seria uma consequência do "totalitarismo filosófico", isto é, da tentativa de criar um modelo teórico capaz de abarcar todas as esferas da existência humana. O culto ocidental à razão teria conduzido a Europa ao fascismo, rejeitando o pluralismo e a diversidade cultural. Contudo, nenhum dos autores que desenvolveram essa abordagem se ocuparam de uma análise aprofundada da filosofia produzida por intelectuais nazistas, durante o Terceiro Reich. É preciso questionar como filósofos nazistas compreendiam o humanismo, o racionalismo, e a tensão entre universalismo e relativismo cultural. A leitura dos escritos de Rosenberg — o mais influente filósofo da Alemanha nazista — refuta a tese segundo a qual o totalitarismo derivaria da pretensão universalizante do pensamento ocidental. Rosenberg é relativista e antiintelectualista, e sua defesa teórica do nazismo se desenvolve a partir de uma crítica aos "direitos humanos" e, de forma geral, à busca filosófica por categorias metaempíricas que poderiam funcionar como referência para toda a humanidade.

Con esta tesis quiero contribuir a los estudios existentes sobre la filosofía de Richard Rorty, y en este sentido propongo un tipo de hermenéutica de su pensamiento a través de la clave transversal de su reacción crítica al universalismo moral. Lo que pretendo precisar es cómo entiende Rorty que puede problematizarse el alcance universal en el ámbito de la moralidad, cuál es la noción de universalidad que implica y rechaza en su propia comprensión de este problema, y de qué forma argumenta su rechazo. Para ello sigo la hipótesis de que Rorty sugiere una comprensión ambivalente del problema del alcance universal, de acuerdo con la cual también propone dos perspectivas críticas sobre el mismo que deberían abarcarse pero a la vez distinguirse en toda tentativa de estudio de su pensamiento moral. Asimismo y en continuidad con esto último, trato de mostrar que ambas perspectivas sobre todo asumen como posición antagónica, y por ende como blanco de su crítica, una noción de alcance universal en la acepción de exigencia o presunción de incondicionalidad; por lo cual discuto finalmente que los argumentos críticos de Rorty afecten a cualquier otra posible comprensión de la noción de universalidad. En el desarrollo que responde al problema y a la hipótesis anterior, comienzo por proponer una lectura sistemática de la filosofía moral de Rorty como una reacción crítica frente a la manera en que las doctrinas morales universalistas pretenden o presumen subsanar las consecuencias –relativas a las relaciones sociales- derivadas de la actitud moral etnocentrista. Según lo da a entender el propio filosofo estadounidense, el universalismo moral habría venido asumiendo como principal estrategia de respuesta al “etnocentrismo moral” la tarea de descubrir y constatar contenidos morales vinculantes, y esto bajo el no menos importante supuesto de que tales descubrimientos o constataciones resultan suficientes para propiciar disposiciones morales igualmente vinculantes. Una vez establecido lo anterior, demuestro que el filósofo estadounidense elabora su réplica antiuniversalista bajo esas dos perspectivas distintas, lo que explica que en algunas ocasiones parezca que aconseja una ética de la conversación y de la justificación intersubjetiva, y en otras que más bien sugiere una ética sentimentalista, basada en la capacidad de simpatía o de compasión, con efectiva incidencia sobre las motivaciones morales. Considero, pues, que en cada uno de los registros y perspectivas anteriores la exigencia o presunción de alcance moral universal, es enfocada de diferente manera por Rorty, y también críticamente discutida con argumentos específicos. Con esto me refiero a que el filósofo estadounidense remite a diferentes usos semánticos de la noción de universalidad, y a que, por referencia a ellos, es que elabora también su propia contestación crítica. Distingo en este sentido dos enfoques y usos bajo las rúbricas “perspectiva de la validez” y “perspectiva de los destinatarios”. En la primera entiendo que lo que se privilegia es el problema del conocimiento moral; en la segunda que lo destacado es la pregunta por la motivación de la acción moral o solidaria. Para mostrar lo propio de la primera perspectiva, reservo un lugar especial al debate que Rorty mantuvo con Jürgen Habermas; para distinguir la segunda, otorgo al pensamiento moral de David Hume un papel protagónico. Una vez que a través de este desarrollo he decantado la demostración de la hipótesis original, en la conclusión finalmente la enfatizo, intento precisarla aún más y sobre todo la discuto con distancia crítica en algunos de sus aspectos. Como lo adelanté al principio, tal hipótesis es doble: que pueden y han de distinguirse esas dos perspectivas en el tipo de reacción crítica a la noción de alcance moral universal diseminada por los diversos escritos de Rorty, y que ambas perspectivas coinciden en traslucir un rechazo a cierta noción de alcance universal equiparada con una exigencia o presunción de incondicionalidad.<br>In this thesis I propose a specific hermeneutics of Richard Rorty’s ethics, approaching the topic from his critical reaction to moral universalism. What I attempt to point out is how Rorty thinks that universal scope can be problematized in the sphere of morality, what notion of universality he implies and rejects in this own understanding of this issue, and what arguments he uses to justify his rejection. I put forward the hypothesis that Rorty is suggesting an ambivalent understanding of the problem of universal scope, which leads him to propose two critical perspectives on the issue; these two perspectives must be considered in any attempt to study Rorty’s moral thinking, but at the same time it is important to distinguish between them. Consequently I try to show that both perspectives assume above all a counterposition consisting of a notion of universal scope in the sense of a demand or assumption of inconditionality. On this basis I finally question whether Rorty’s critical arguments affect any other possible understanding of the notion of universality. In developing a response to this problem and this hypothesis, I start out by proposing a reading of Rorty’s moral philosophy as a critical reaction to the way universalist moral doctrines set out to correct the consequences that the ethnocentric moral attitude has had in terms of social relations. Once this is established, I demonstrate that the US philosopher puts together his anti-universalist reply with two distinct perspectives, which explains why sometimes he seems to be promoting an ethics of conversation and inter-subjective justification, and other times he tends toward a sentimentalist ethics based on the capacity for empathy or compassion, with an effective impact on moral motivation. In the thesis I distinguish between these two approaches by using the headings “validity perspective” and “recipient perspective”. The former highlights the issue of moral knowledge; the latter, on the other hand, places the issue of motivation for moral action or solidarity in the foreground. In examining the key features of the former perspective I focus on Rorty’s debate with Jürgen Habermas; for the latter I assign the leading role to David Hume’s moral thinking. Once the demonstration of the original hypothesis is sufficiently developed, I use the conclusion to emphasize it, to clarify it further, and above all to discuss some of its aspects with greater critical distance.

It presents a synthesis of the evolution of the modern thought as for the establishment of the concepts of individual, society and State, basic for the definition of the contours and limits of the human rights seen as universal. After that, exposes the debate concerning the tension produced for the positions that defend the universalism and the cultural relativism, in face of a paradox that demonstrates the affirmation of fundamental rights and, at the same time, its constant disrespect. As alternative for the overcoming of the tension and the paradox, it presents the contributions of Boaventura de Sousa Santos sociologist, who suggests the adoption of a new paradigm supported for the possibility of construction of an intercultural dialogue and for the concepts of emancipation politics and diatopic hermeneusm.<br>O presente trabalho visa abordar os conceitos de direitos humanos e dignidade humana a partir da concepção política moderna. Apresenta uma síntese da evolução do pensamento moderno no que se refere ao estabelecimento dos conceitos de indivíduo, de sociedade e de Estado, fundamentais para a definição dos contornos e limites dos direitos humanos vistos como universais. Em seguida, expõe o debate acerca da tensão produzida pelas posições que defendem o universalismo e o relativismo cultural, em face de um paradoxo que explicita a afirmação dos direitos fundamentais e, ao mesmo tempo, o seu constante desrespeito. Como alternativa para a superação da tensão e do paradoxo, apresenta as contribuições do sociólogo Boaventura de Sousa Santos, que sugere a adoção de um novo paradigma sustentado pela possibilidade de construção de um diálogo intercultural e pelos conceitos de política emancipatória e hermenêutica diatópica.

According to Martha Nussbaums’s Capability Approach thispractice undermines the woman and violates her rights as a human being, on the other handMelville Herskovits’ Cultural Relativist theory encourages acceptance and respect of the variouscultures and their beliefs; thus making female genital mutilation a cultural tradition that shouldbe respected like any other tradition around the world.

The purpose of this descriptive study was to determine how the concept of "cultural relativism" is used in the current literature pertaining to intercultural communication. This concept is central to much of the work being done on face-to-face intercultural communication, but a preliminary review of that literature indicated ambiguity and lack of concurrence among authors' views regarding the concept. This research was designed to describe the range of authors' views on cultural relativism as well as to provide some historical and critical perspective regarding "cultural relativism."

It sees its main sources in the following trends: the growth of income and property inequality, the concentration of political power in the hands of the professional elite, differentiated access to justice, the hypertrophy of the security apparatus, the growth of the number of hard-to-assimilate immigrants, the influence of the ideology of cultural and moral relativism, the decline in the birth rate, radical pacifism, devaluation of the institution of citizenship, demilitarization of society, uncontrolled growth of the influence of alternative media, spread of disinformation and hybrid war against Western democracies, virtual political parties, growth of political populism, population aging, power challengers from the former periphery. In the past few decades a new approach to ethical principles known as ‘particularism’ has become fashionable among moral philosophers. According to the particularist the progress in the field of ethics, is from monism (the view that there is only one moral principle), through pluralism (the view that there are many), to particularism (the view that there are none). Jonathan Dancy advocates a radical particularist theory: arguing against a variety of univer- salist–pluralist doctrines, he maintains that there are no moral principles; and, even if there are, our ethical decisions are highly context-dependent, made case by case, without the sup- port of such principles. In this paper, drawing on a number of theoretical concepts used in science as well as the philosophy of science, and making use of Fethullah Gülen’s insights, I try to develop a mod- erate universalist–pluralist model in defence of universal ethical values and principles. This model, I argue, is less vulnerable to Dancy’s criticisms and better equipped, in comparison to Dancy’s own model, to deal with particular moral cases. While particularism in ethics leads to relativism and leaves moral agents with no clear guidelines, the model developed here could serve all moral agents, regardless of credal or cultural association and socio-political outlook, in making sound and commendable moral judgements.

The Slovak Romantic Messianism is perceived by us as a phenomenon growing from a specific current epochal situation relating to a relatively rich tradition, which existed in the Slovak cultural context already in previous historical periods. By considering the characteristic features of production, its existence was often relativised. Nevertheless, it represents an important testimony of a concrete epoch. Its artistic implementation (perhaps today more than in the past) is being well appreciated, thanks to its interesting form and to its expressive and narrative strength or value. By focusing our attention on its expressive and thematic means, it is possible to prove that the authors tried to mediate a mystical experience to the readers. As mystagogues, they introduced and initiated the readers to the mysteries of God’s plans aiming at transformation of this world. In this sense, through their literary production, they invoked and prayed God to give them a chance to live a direct mystic experience in the reality. By pursuing this purpose, they filled their poetry with curious archaisms and neologisms (the so-called self-creation of language). They gave way to a speculative etymologism and poetical forms. Generally, they were syncretically stylying poetical shapes. And they often exploited experiments or complex strophic structures.

This paper aims to explore to what extent “property”, as an ECtHR autonomous concept, includes the collective dimensions of property rights, as well as to systematize different collective dimensions of the right to property as addressed in the ECtHR case law. The underlying hypothesis of the paper, which was confirmed by research, is that the ECtHR failed to sufficiently elaborate on the collective dimensions of the right to property due to the causes that are not linked to cultural relativist arguments but to the ECtHR general approach of giving deference in examining domestic law pertaining to all the aspects of the right of property under Article 1 of Protocol No. 1 to the ECHR. Firstly, the key standards for protecting the right to property as developed through the ECtHR caselaw will be briefly presented. After that, selected ECtHR case-law on the collective dimension of the propriety rights of indigenous peoples and the caselaw on the restitution afforded in cases of denationalization will be examined to assess whether they diverge from the general protection of the right to property afforded by the ECtHR. The normative-legal method to analyze the case law of the ECtHR in terms of the protection it afforded to collective dimensions of the property right will be predominantly utilized.

Abstract:
Students of history and philosophy of science courses at my University are either naive robust realists or naive relativists in relation to science and technology. The first group absorbs from culture stereotypical conceptions, such as the value-free character of the scientific method, that science and technology are impervious to history or ideology, and that science and religion are always at odds. The second believes science and technology were selected arbitrarily by ideologues to have privileged world views of reality to the detriment of other interpretations. These deterministic outlooks must be challenged to make students aware of the social importance of their future roles, be they as scientists and engineers or as science and technology policy decision makers. The University as Decision Center (DC) not only reproduces the social by teaching standard solutions to well-defined problems but also provides information regarding conflict resolution and the epistemological, individual, historical, social, and political mechanisms that help create new science and technology. Interdisciplinary research prepares students for roles that require science and technology literacy, but raises methodological issues in the context of the classroom as it increases uncertainty with respect to apparently self- evident beliefs about scientific and technological practices.
