Abstract:
In March 2020 the Covid-19 pandemic changed life circumstances drastically for everyone. Exactly one year ago the university had to shift from campus to the internet. This led to huge alterations in how professors lecture and how student university life takes place. After this year, it is time to evaluate the changes and put them into perspective. This means recognizing the benefits of technology to legal education instead of seeing the current situation as a replacement that disappears as soon as a return back to campus is possible.

Abstract:
Therefore this edition of CEJ is dedicated to pressing criminal and compliance-related questions in connection with the coronavirus-pandemic. Furthermore we will focus on another branch of digitization: Namely cryptocurrencies and financial technology. The key issue of last CEJ-edition, Corporate Criminal Liability, will be deepened, as there have been notable (and given the current situation, questionable) developments in the German legislative process. Fittingly, the topic of whistleblower protection in Switzerland will be addressed and two books, dealing with the modern legal advice market, will be reviewed.

Abstract:

Dossani, Khairunessa. "Virtue and veiling| Perspectives from ancient to Abbasid times." Thesis, San Jose State University, 2013. http://pqdtopen.proquest.com/#viewpdf?dispub=1547087.

Full text
Abstract:
<p> This thesis establishes a link between conceptions of female virtue and the practice of veiling by women from ancient to medieval times in the Mediterranean region. This is evidenced by the consistent advocacy and prescription of veiling in ancient and medieval theological texts, including Jewish, Christian, Zoroastrian, and Islamic texts. Veiling practices are shown to have a religious foundation, grounded in the ideas of honor and virtue. These notions were reflected in society over time with veiled aristocratic noblewomen and unveiled marginalized classes. While acknowledging class-based theories of female veiling, the thesis concentrates on the religious factors for veiling, particularly for medieval Muslim societies. The argument of this thesis is that while veiling did not originate in Islamic societies, Muslims validated the practice through their own literature and laws. The paper also includes evidence of female seclusion, which co-exists with the spread in the practice of veiling by women. </p>

Abstract:

Stanley, Mark. "Portrait of a southern Progressive: The political life and times of Governor Pat M. Neff of Texas, 1871-1952." Thesis, University of North Texas, 2011. https://digital.library.unt.edu/ark:/67531/metadc67950/.

Full text
Abstract:
Pat M. Neff was a product of his political place and time. Born in Texas in 1871, during Reconstruction, he matured and prospered while his native state did the same as it transitioned from Old South to New South. Neff spent most of his life in Waco, a town that combined New South Progressivism with religious conservatism. This duality was reflected in Neff's own personality. On moral or religious issues, he was conservative. On economic and social issues, he was Progressive. He thus was a typical Southern Progressive who de-emphasized social and political change in favor of economic development. For instance, as governor from 1921 to 1925, his work to develop and conserve Texas' water resources brought urbanization and industrialization that made the New South a reality in the state. Neff was a devout Baptist which influenced his politics and philosophy. He was president of Baylor University, a Baptist institution, for fifteen years after leaving the governor s office and he led the Southern Baptist Convention (SBC) in the 1940s. He combined Progressive and Christian values as he argued for the establishment of the United Nations and advocated forgiveness and brotherhood after World War II. The war's end marked the beginning of the American civil rights movement. Many within the SBC advocated an end to racism and discrimination, others did not. Neff's unwillingness to challenge racial traditions was typical of southern Progressives. The convergence of national politics and southern evangelical religion is evident in the final chapter of Neff's career. His selection of President Harry S. Truman as the recipient of an honorary doctorate from Baylor offended many religious conservatives. Neff overcame the opposition but it damaged his reputation and ultimately forced his resignation, ending his public career. By the time of his death in 1952, Texas had become everything the New South was supposed to be-urbanized and industrialized. Neff's activities were crucial to making that happen.

Abstract:

Abstract:
This study discusses the history of the Arabs of north Arabia in later pre-Islamic times. This study provides an in-depth discussion of Arab ethnicity, which contributes to the improvement of our knowledge regarding this controversial issue. This study argues that the Arab nation is, in fact, a very old one of great importance, but the Arabs themselves had no consciousness of their unity and did not leave inscriptions proclaiming their identity as Arabs or claim to be the rightful proprietors of specific territories. An examination is made of the reasons behind the emergence of kingship in different communities through the course of history, in order to determine the general features of kingship. This study demonstrates that kingship in north Arabia had almost every feature of kingship as it appeared in other places. Particular attention is paid in the study to delivering a full and coherent account of the history of Qedar. Although, some scholars have tried to write the history of Qedar, their works remain fragmentary or inconsistent. Basing the examination not merely on most of the previous works, we subject those works to a comparison with the Assyrian inscriptions. By so doing, it has proved possible to critique the previous works and clarify many ambiguous issues in Qedarite history. Moreover, this study contributes to the improvement of our knowledge regarding Nebaioth and Na-ba-a-a-ti and their relationship with the Nabataeans. This study finds that the Nebaioth and Nabataeans were different, contemporary groups living during the sixth century BCE, even though the first direct and uncontested evidence of the Nabataeans of Petra comes from the late fourth century BCE, when the Nabataeans made their first clear appearance in Diodorus Siculus in connection with the expansion of the Seleucid Empire (312 BCE). The main settlement centres in north Arabia are discussed in depth in Chapter Five. This study traces the history of Tayma, Adummatu and Dedan, establishing the importance of those oases and their relationship with Mesopotamia. The discussion of those oases produces useful results, which contribute to improving our knowledge and assist in our understanding of issues relating to the history of those sites.

Khalidi, Anbara Mariam. ""It was the worst of times; it was the worst of times" : popular prophecy, Rapture fiction, and the imminent apocalypse in contemporary American Evangelism." Thesis, University of Oxford, 2014. http://ora.ox.ac.uk/objects/uuid:e2e7da46-9462-448c-88ae-8a98a9482b8d.

Abstract:
This thesis explores how the Rapture fiction and popular prophecy of modern American premillennial dispensationalism shapes the eschatological beliefs of its readership. This will be accomplished through a text-based critical analysis of the anxiety narratives of the Bible study and exegetical guides of the Tim LaHaye Prophecy Library, and its counterpart, the Left Behind fiction series. This thesis represents the first scholarly analysis of the Tim LaHaye Prophecy Library, and the first situation of Left Behind fiction within its theological context. It will be proposed that these two sets of texts shape the eschatological beliefs of their readers through a discursive ‘streamlining’ that is performed in several ways. Firstly, the historical development of the movement will be examined, exploring the evolution of a specific premillennial dispensationalist hermeneutic and its ‘channelling’ through particular cultural institutions. Secondly, an analysis of the Tim LaHaye Prophecy Library and Left Behind fiction will demonstrate that this premillennial dispensationalist hermeneutic is almost exclusively communicated through anxiety narratives which focus on expressions of horror, isolation, powerlessness and paranoia. It will be argued that these narratives serve to explore ‘abjective’ elements of premillennial dispensationalist belief, re-integrating them into the fabric of the faith. Particular attention will be paid to these abjective elements, which include the role of the eschatological body, the nature of individual salvation, and the perpetual deferment of the Rapture. As such, the popular media of premillennial dispensationalism serves as a further channel for the discursive streamlining of the movement’s prophetic scheme. Finally, this thesis proposes that the ‘deprivation’ theory of millennial appeal does not adequately explain the appeal and success of premillennial dispensationalism. As such, the following analysis will suggest that an alternate critical analysis of the movement, concentrating on its tropes of anxiety, serves to better explain the continued appeal of this ideology.

Abstract:
La deuxième partie de cette thèse étudie les conditions sociales qui font que les différences d'origine peuvent devenir une barrière à la réussite économique aux États-Unis<br>Individual and social behaviors, such as voting patterns, the ability to trust others, participation in the community, health-seeking behaviors, or attitudes towards contraception, can persist over many years. Relying on new historical and contemporary data sources, the works compiled in this thesis aim at explaining and quantifying rigorously instances of persistence in behaviors and preferences. This work presents three contributions to the literature. Firstly, it compiles a new micro-level geocoded historical datasource on missionary activity in sub-Saharan Africa. Secondly, it has elucidated, in original ways, channels of persistence in development, which are not attributable to formal institutions. Thirdly, it has analyzed the intensive margin of diversity, providing a new way to address the endogeneity issue in the study of the role of diversity on income. The first part of the thesis is a work on the long-lasting influence of missionary activity in sub-Saharan Africa. I present there the research I have conducted with Julia Cagé. It relies a new database that we constructed and geocoded based on the Geography and Atlas of Protestant missions. This research is developed in the two first chapters of the thesis. The second part of this thesis studies the social conditions under which ancestry differences act as a persistent barrier for individual earnings in the United States. The United States is a natural choice to study the persistent effect of ancestry on income, as this is a country that was populated by subsequent waves of migration from different origins during a relatively short period of time. Moreover, the American Census Bureau has recorded data about ancestries since the 1850s

Abstract:
This study explores the Swedish portrayals of Russians as compared to Danes and Polesand how they changed over time during the Great Northern War and Russo-SwedishWar (1741–1743). Through the Swedish state-run Posttidningar, the information deliveredby the state indicates that the circumstances of war and the power of the enemy leaderswere more significant than specific attributes of the enemy other in forming collectiveSwedish identity. Creating these collective sentiments was an essential tool for the stateto affirm the cooperation of its population during times of war. The information aboutthe enemy affects the transformation of a semi-public sphere in Sweden by providing acommon knowledge base to discuss and understand a changing view of its place inEurope. By depicting the enemy in flexible terms, the Swedish state desires its populationto cooperate based on the threat of war, common knowledge, and Sweden’s place inEurope, rather than solidarity against a static religious or political other.

Abstract:
No region of the Greco-Roman world really stayed away from the distribution ofAsclepius’ cult, to the point that in IIth s p.C., we count not less than 320 Asclepieia. FromIVth s a.C. - or at least this is when we have it effective tracks - and during all the Hellenisticperiod, the cult propagates in the Aegean islands and in the coastal cities of Asia Minor. Inthis time, the complexes among the most famous of the antique world (Kos, Pergamon,Lebena) are built, as well as of numerous less important sanctuaries the influence of whichremained essentially local or regional. In our thesis, we study the Asclepius' cult and hissanctuaries in the Aegean islands and on the western coast of Asia Minor in the Hellenisticand Roman times, essentially from the epigraphic documentation. Several themes aredeveloped : the stages of the distribution and the origin of Asclepius' cult ; the economic, political and social role and the management of sanctuaries ; the god (epithets, functions, mythical family, relations with the Hellenistic sovereigns and the emperors) and his cult ; theclergy, the individuals and the social groups frequenting sanctuaries ; the motives for whichthese centers were famous places of "pilgrimage" and the interactions between profanemedical knowledges and divine power of healing

Abstract:
In 2020 the world was confronted with the outbreak of the corona crisis. The following case looks at the banking sector and analyses how a major German bank (Commerzbank AG) has dealt with the crisis. What was the main driver to release a new strategy? Which measures were taken because of the pandemic and which effects would have occurred independently? To answer these questions an analysis is conducted, using several strategic frameworks. This case study follows a pedagogical structure, which aims at providing a profound understanding of how banks may reorientate and adapt their strategies in times of crises. Therefore, a special focus is put on the external environment. Sine the case at hand reflects a real-life example, it is suitable for a wide range of people interested in the finance industry. The output revealed that the bank was already facing several difficulties due to its external environment. Digitalization and cost pressures were impacting Commerzbank AG. Covid-19 emphasized the need for change and not only enhanced the implementation of trends but also lead to a faster execution of the new strategy.<br>Em 2020, o mundo foi confrontado com a eclosão da crise do coronavírus.

Fischman, Dennis K. "Political discourse in exile: Karl Marx and the Jewish question of our times." 1988. https://scholarworks.umass.edu/dissertations/AAI8822656.

Full text
Abstract:
Karl Marx's philosophy of writing demands his readers help develop his theory by questioning its gaps and contradictions. A crucial question concerns Marx's relation to his Jewishness. In "On the Jewish Question," Judaism stands for civil society and the transformative power of practical need, Christianity for the "political state" and spiritual solutions to material problems. Human emancipation will spring not from politics but "the negation of Judaism": recognizing and overcoming barriers to fully human existence. Marx thus endorses a "Jewish" viewpoint which senses reality as the Hebrew bible does. The Torah conceives human beings in dialogue with God as indispensible partners in creating the world. We are called to act; our action matters. Marx criticizes the Greeks and most Western philosophers for their static, contemplative view of reality. Any ontology which imposes a truth beyond social relations privileges some people and needs, excluding others. By rejecting God, Marx discredits the God's-eye view that leads to false universals. He retains the structure of dialogue between the species and its evolving needs. Hegel had offered the young Marx a dialectical approach to reality, but Marx eventually found Hegel's ontology too Greek. Rather than simply reversing Hegel, though, Marx corrects him as though he were subject to a Jewish worldview. Marx's method resembles the traditional Jewish style of hermeneutics called midrash. It performs the same function: restoring sense to a chaotic world as glimpsed from a particular tradition. The breakdown of social meaning is central to Marx's theory of alienation. The Jewish theme of exile explains Marx's urgency. A group is exiled when society constructs reality to preclude it from expressing or acting upon the needs that constitute its identity. A society in exile frustrates the realization of human purposes. Both workers and capitalist society are exiled. To return, they must believe the world can become human--as their experience under capitalism shows it cannot. Marx's personal exile is that his audience lacks the Jewish context to recognize his theory of how we become free. Theorists continue his work by listening to people in exile and working out different roads to emancipation.

Phaswana, Dembe Reuben. "Communal pastoral counselling : culturally gifted care-giving in times of family pain - a vhavenda perspective." Thesis, 2008. http://hdl.handle.net/10500/2712.

Full text
Abstract:
The thesis argues that there is a need for Christian communal pastoral care and counselling practice beyond the individualistic Western pastoral care and counselling practices. The communal pastoral care model advocated by the author uses culturally gifted care-givers who follow spontaneous caring models. Several of the major books concerning communal pastoral care and counselling were reviewed. The author concludes that the church has been impoverished by ignoring the cultural gifts of the majority of members and the mutual communal care of the community. Pain and its healing in this thesis are understood in a culturally sensitive manner. Pastoral care must be done in context, in this case in the Vhavenda context. Hence the thesis looks systematically at the way in which the Vhavenda understand and heal pain from their cosmological perspective. The thesis engages in empirical research among the Vhavenda people using qualitative interview. The author selected five small communities to test for their understanding of pain and healing. He developed his own interview schedule. Themes encountered in interpreting the research results include pain as part of life. The thesis develops two sub-models of a Vhavenda-Christian culturally gifted model of communal care arguing the need of their incorporation into Christian communal care. They are “Kha ri vangulane” model which pictures pain as a thorn which people help to remove from a person; and the “khoro” or “dzulo” gathering which is family or community care-giving. A case study has illustrated how they are used. Finally, the author argues that the Bible is full of communal pictures which resonate well with the African people. Hence it is fairly easy to correlate the Vhavenda sense of community with the body of Christ model of Christian community as found in the Bible. The conclusion is that members of the Christian community need to reincorporate their culturally gifted care resources and integrate them with the biblical care.<br>Thesis (D. Th. Abstract:
Includes bibliographical references (leaves 231-239)<br>Chapter one begins by introducing and orientating the reader to the study and the purpose of the study, namely the revelation of God. It also opens up what is central to the study by a way of a problem statement concerning this revelation of God, the black church and the human condition. The aims of the study and the research methodology are set out. The chapter ends with a hypothesis concerning the future doctrine of revelation and the prospects of this revelation in the lives of black people. Chapter two entails discussion on God and the church, as it pertains to revelation, starting with a historical account of Christian theology on the subject of revelation. The subject of revelation is engaged on an existential level, particularly the main areas of Christian theology, namely; special and general revelation. This is a section that puts both concepts within black experience, to see the viability for a black ecclesiology and black theology. Chapter two moves on to contend that for black church, there is a serious theological insurgent that is necessary and it is part and parcel of God’s revelation to blacks and the oppressed. This outlook places a section of critical reasoning in South African context and society concerning God’s revelation. Chapter three engages a philosophical meditation, ascribing meditation as a state of self-reflection for the black church and black theology. This meditation is cognisant of black experience and is self-diagnosis concern God and humanity, particularly the dehumanising, (how it must affirm essence and substance). The meditation of the black church engages the concept of absurdity as Camus (1995) (also see Melancon 1983) has posited the absurd as a malaise in the world and silence of the word to that malaise. The absurd is also linked to theodicy, however, the black experience and the encounter with God transcends absurdity and theodicy. As part of the transcending aspect of the black experience, the research considers Western atheism, Christianity and death of God, whose burial is in the mind, souls and bodies of blacks. The chapter then moves on to discuss the black church as a receptor of God’s revelation, the new image of the crucified and the new metaphysics guaranteeing the upliftment of blacks. Chapter four focuses on the black invisibility and the hiddenness of God, it is seeing invisibility and hiddenness as linked together. The chapter also focuses on the need for black visibility rooted in the ontological and physiological expression and experience of being human; Imago Dei. The chapter links black visibility with the concept of whiteness, being a dehumanising political identity imposed on the people of colour. The chapter then translates into the context of visibility, invisibility and God’s revelation within the economic South African context. The final analysis of the chapter is a confession of God’s revelation rooted in God’s visibility and running parallel to that of black visibility. Chapter five proposes that the black experience and the use of the Bible Sola Sriptura, as it reveals the black church as part of church history. As such, it takes the early church’s reading of the New Testament and understanding of Christology through kenosis; the emptying of God to be human and using that paradigm to link Christ’s human experience and the experience of the dehumanising and humanising that of blacks. The chapter concludes with a Christology and black Messiah, who links the secular and divine, general and special revelation. Chapter six concerns the findings of the study, recommendations and conclusion.<br>Philosophy, Practical and Systematic Theology<br>D. Th. (Systematic Theology)

Abstract:
Through a critical-functional, rather than literal, reading of the text of Revelation, this dissertation hypothesises a move beyond the paralysing constant reduction of hermeneutic meaning to two conventional poles when discussing hope – the early Christian movement’s hope through reversal, and contemporary nihilism. In order to do so in a responsible manner, it is necessary to study other research done on the topics of eschatology and hope – especially as seen in the book of Revelation. For this reason, the most popular and representative scholars of the Book of Revelation are studied. This overall look at current scholarships' views regarding the Apocalypse will help detect any possible missing elements in our approach to Revelation. But no study of this topic can be considered near complete if other disciplines are not involved; in this case especially when moving on to a critical-functional reading of Revelation. This thesis thus features an exploratory study of the functioning of ritual and hope within the human psyche; from archaeological to psychological perspectives. This emphasises the importance of, and leads into, the possibilities of a functional reading of the Book of Revelation. All of the above work leads to a re-evaluation of the success of hope as metanarrative for today. The suggestion is that Christian hope is not imaginary, but is irreducibly imaginative. For “reality is never just the world as it exists; it is the world as it is experienced through the lenses of social perception” (Barr 2010:636).<br>New Testament<br>D. Th.
