Abstract:
In 1852 King Victor Emmanuel’s ministers proposed legislation to recognize civil marriages in the Kingdom of Sardinia (Piedmont). This proposal was opposed by Pope Pius IX and other Catholic apologists who argued that it would result in undermining the official status of the Catholic Church and one of the church’s sacraments. Even worse it would mean that Jewish and Protestant marriages would be recognized. This legislation coincided with Mormon missionaries proselytizing in Torino and the public announcement that the church practiced polygamy. Catholic opponents of this legislation argued that even Mormon polygamous marriages would be recognized if the legislation passed. During fierce debates that took place Catholic apologists also claimed that Mormons formed alliances with other Protestant “sects” to push through the civil marriage litigation. The specter of Mormon plural marriages in a civil marriage system continued to be mentioned until civil marriages were finally recognized in 1865.

AbstractClaimed rights to sexual expression unlinked to the creation of children are among the strongest challenges facing the free exercise of religion in the United States today. Such rights gained importance by means of a series of Supreme Court opinions associating consensual sexual expression unlinked to children with human dignity and even personal identity. These were accompanied by legal and cultural movements, led by more privileged Americans, diminishing children's rights in favor of adults', in the context of sex, marriage, and parenting. Laws and regulations protecting and promoting sexual expression detached from children are powerfully affecting religious institutions that operate health care, educational, and social services available to all Americans; the Catholic Church is a particularly prominent supplier of all of these services. Respecting the Catholic Church, it is possible but quite difficult to maintain respect for its free exercise of religion in the current environment, potentially by highlighting its measurable contributions to the common good. It might also be useful to show the close link between Catholic teachings on sex and marriage and the entire Catholic cosmology, such that coercing Catholics to behave otherwise is tantamount to coercing them to practice a different faith.

Abstract:
This study explores the complexity of marriage for people in Manggarai. Since they are citizens of the cultural community of Manggarai, Indonesian citizens, and members of a Catholic community, their marriage is required to follow the provisions of customary law, religious law, and state law. Using a library and ethnographic approaches, the study compares these laws on the legality of marriage and analyzes their differences and the impacts on the rights and obligations of married couples and children born to the couple. The study discovered that the differences in the provisions regarding the validity of a marriage between the three laws have provided space for the emergence of legal uncertainty and discriminatory treatment of customary marriages which are not legalized by religious law and state law as well as marriages that are divorced civilly but are still valid according to Catholic rules. Such a phenomenon is certainly a portrait of failure or incompetence in the attempt to unify marriage law in Indonesia through Law No. 1 of 1974 concerning Marriage. So it is urgent to have a more comprehensive new law that accommodates the wisdom of local customary law and provides protection for every citizen

Religious rituals, while comforting for believers, may be uncomfortable for those who do not share their manifold meanings. Catholic Filipinas who marry Muslim Iranian men face mandatory conversion to Islam, necessitating ongoing negotiations between Christianity and Islam. My research suggests that these Filipinas held their first religion dear while participating in – for them – unpleasant Shi’a Muslims rituals. Their Filipino/Iranian children, familiar from birth with Shi’a Islam, felt at home with both religions, no matter which one they chose for themselves. The discussion of converts’ perceptions of Shi’a rituals contributes to the literature on transnational marriages and marriage migration.

Shattered Faith is the story of Sheila Rauch Kennedy's marriage and divorce from Congressman Joe Kennedy, a member of one of the best known families in the United States of America. Married in 1979 in a Catholic Church, Mr Kennedy was a Catholic while Mrs Kennedy remained an Episcopalian. Twin sons were born in 1980 and baptised as Catholics, with godparents from both Christian churches. The marriage began to unravel when Mr Kennedy was elected to Congress. Separation in 1989 was followed by divorce because of ‘irreconcilable differences’. In 1993, Mrs Kennedy received notification from the Metropolitan Tribunal of the Archdiocese of Boston, informing her of the petition lodged by her former husband to have the marriage declared null on the grounds of lack of due discretion of judgement (though whose lack of due discretion is not made clear). Shocked, and while willing to acknowledge that the marriage had failed (evidenced in a divorce), she could not accept that it had never existed as a sacrament.

The results of this study are the first Isbat Marriage Marriage or different religious marriages according to the law that has been regulated in regulations Number 1 of 1974 Regarding marriage and ratified on the basis of the Law of Mixed Marriage Ordination Stb. 1898 Number 158. Second According to Islamic law interfaith marriages are permissible if certain conditions are adjusted to the existing provisions and adhere to the shari'ah that has been believed. Third, according to the view of pluralism of different marriages. Religion shows the attitude of tolerance in this plural society.

In the teaching of the Catholic Church, the institution of marriage derives directly from God, for common good and for the good of spouses and children. Human authorities are called upon not to transform its characteristics and to avoid any attempts to distort them. However, the Church is today confronted with a changing understanding of the notion of ‘gender’ and with new considerations about the meaning of ‘marriage’ on behalf of parts of society and of political institutions. Based on an overview of the recent legislative and political proposals concerning family issues at the European level, this article aims to assess what model of family the Member States of the European Union are developing, and how the traditional concept of marriage could be influenced by this evolution.

In my work in a diocesan marriage tribunal I have observed that many couples who are planning their weddings are influenced greatly by the superficial focus of our culture. In fact, there is statistical and sociological evidence that culture is highly influential in much Catholic wedding planning. Presented in this paper is evidence of how little Catholics know about the sacramental nature of marriage and how their married life affects themselves and others around them. This paper presents a theological reflection on the sacrament of marriage; an analysis of how the Rite of Marriage is usually perceived and carried out; a study of how the attitude of brides and grooms at the time of their wedding effects their life thereafter and, by association, the greater family and community; and it offers an explanation of how instructing couples on the theology behind the Rite of Marriage as prima theologia can better prepare them to live their marriage sacramentally. The pre-marital classes in the Diocese of Orange are currently comprised of mostly practical information on how to live successfully as a married couple, but they neglect to also consider the most important issue for them as Catholics: how to live out a sacramental marriage. It is proposed in this document that a diocesan-wide premarital handbook be designed and employed which provides greater emphasis on the ecclesial aspect of marriage as well as the practical advice of seasoned mentors.

Marriage is an institution found in every society, culture or religion in the world. The Catholic Church has maintained most of her seven Sacraments including that of marriage. The Church of Sweden, an established Evangelical Lutheran faith, born out of the 16th century Reformation has two Sacraments excluding marriage. This field study was carried out in Gävle, Sweden in spring 2009. A comparative study of marriage in the Catholic Church and the Church of Sweden and the reason each church alludes to based on scripture and tradition was to help me, an African Catholic, understand differences between the respective churches and also understand why the Church of Sweden accepts same sex marriages. This was my motivation for writing this paper. I hope this paper will serve as a study guide to new people who come to Sweden from other cultures to enable them understand why the “Modus Operandi” regarding church marriage in Sweden is different from the church marriage in their native countries.

Civil unions are currently a divisive issues in the United States. Religion has historically influenced these debates. The French version of civil union, the Pacte Civil de Solidarité (Pacs,) was created in 1999 after seven years of debate. Many have written about the Pacs in the last decade. However, few have explored the direct correlations with France's relationship with Catholicism, her dominant religion that is doctrinally opposed to any sexual relationships outside of marriage. Laïcité has influenced a steady decrease in religiosity among French Catholics. This thesis explores the impact of this religious decline on the creation and surprising popularity of the Pacs, especially among heterosexual couples seeking an alternative to traditional marriage. The author believes that French society's tendency to modify institutions to meet the needs of the times assures a permanent place in society for both marriage and the Catholic Church, though both will probably continue to change forms.

This dissertation deals with an ethical analysis of marriage relationships among Tswana speaking Catholics in the light of the understandings of marriage of both the African and Christian traditions. These traditions have certain practices and perspectives that, if they are put together, can enrich marriage in all its aspects. The first two chapters analyse the practices and perspectives of marriage within the African and Christian traditions, while the third compares and contrasts them. The aspects dealt with are a) compatible values from African and Christian marriage and b) incompatible values from African and Christian marriages. In chapter four, the role of the Church in restoring the purpose and the meaning of marriage and what it can do to improve Catholic marriage relationships among Tswana speaking people are discussed and some practical suggestions are proposed.

Abstract:
Vatican II provided the Catholic Church with an opportunity for deep reflection and to align its theological teachings with modern times. This reflection resulted in a resurgence of the importance of Christian marriage and family living. Beyond Vatican II, the Christian family has been described as a ‘domestic’ church. This description defines the family founded on marriage as a cornerstone for the church and society. The Church has realised that if she has to succeed in her mission of evangelisation, she needs to strengthen the families founded on the sacrament of marriage and also to take care of broken families. The theme of a ‘domestic church’ was further explored and discussed in the 1994 Special Synod for the Bishops of Africa. This synod strongly used the image of the family as an effective tool for evangelisation in Africa. The rationale for this emphasis was that the institution of the family founded on marriage is held in high esteem in Africa and it is one of the most important custodians of cultural values. This institution, the bishops argued, can now be used as a custodian for Christian values. Hence, the family founded on marriage will become a school where these values are cherished and taught to offspring. The family founded on marriage is celebrated across the global cultural spectrum. It is through the family that the age old wisdom of ancestors is propagated. This ensures the survival and the development of the different communities. Communities develop because they are built upon strong ethical, religious and cultural values which are safeguarded by the institution of the family founded on marriage. The Catholic Church teaches that marriage is the custodian of life. Marriage is about life. Hence, the respect of human life is safeguarded by the family. The collapse of such a pivotal institution has serious implications for the community. The institution of the family founded on marriage is presented in this thesis as a turn around strategy to the challenge of moral permissiveness in our country. It is a commonly accepted theory that development can only take place where there is stability. The lack of infrastructural development in most African countries is due to lack of political stability. Instability often results in chaos and anarchy. Marriage promises stability which is rooted in the self giving of the couples. Such an environment becomes conducive for human life to be propagated, nurtured and developed. It further creates a sense of being loved and belonging to the child. These qualities are essential for proper and integral human development. Furthermore, marriage ties together the goals of parenting, namely, procreation and parenthood and they are inseparable. They prepare children for social integration.The purpose of this research is to demonstrate how the institution of the family founded on marriage can help us develop a coherent moral vision in South Africa. This turn around strategy is proposed by systematically analysing the causes and consequences of family breakdown. The thesis establishes that the institution of the family founded on marriage is undergoing a crisis. This crisis manifests itself through single-parenthood, high rate of divorce, fatherlessness, etc. The consequences of this crisis are not favourable for individuals and the society.

Abstract:
In the first essay, I demonstrate that during the 1970s, the marital behavior of US Catholics changed dramatically relative to that of the total population. The Catholic marriage rate, that is, the number of Catholic marriages per 1000 Catholics, decreased nearly 20 percent relative to the civil marriage rate. Before and after this time period, the two rates moved in unison. Empirically, I find that the Catholic reforms and encyclicals of the 1960s, that is, Vatican II and Humanae Vitae, led to a decrease in the Catholic marriage rate relative to the civil marriage rate and that the reform of civil divorce law had no effect on this relative rate. In the second essay, I expand the analysis of the previous essay and test whether a negative response among US Catholics to the reforms of Vatican II and to Humanae Vitae is able to explain the increase in the civil marriage rate, the decrease in the Catholic marriage rate, and the increase in the interfaith marriage rate seen in the data. To do this, I construct an original model that treats marriage as a set of two contracts, one civil and one religious, with the benefit and cost of the religious contract depending upon a social complementarity. The theory and the data match if the primary effect of 1960s Catholic reform was to decrease the benefit of a Catholic marriage. In the third essay, I examine the link between religiosity and the incidence of domestic abuse and model sanctification as the pathway connecting the two. Sanctification is "a psychological process through which aspects of life are perceived by people as having spiritual character or significance"[25]. In the model, the abuser must his choose level of abuse, and both abuser and abused must allocate a scarce amount of time between the production of a marital good and a personal consumption good. Sanctification is modeled as an increase in the return to time invested in the marital good. Theoretically, abuse increases in both spouses' level of sanctification and the wife's productivity and decreases in the husband's productivity. This partially agrees with the data.

Drawing on archival research on two important Catholic family movements from the postwar era and ethnographic observation of marriage preparation in several contemporary parishes in Western Washington, this chapter highlights parish efforts to collectively engage in meaning-making by transmitting a Catholic vision of marriage to individual parishioners. While the vision of a “good” family has changed little from the postwar era to today, therapeutic cultural discourses about self-development and changing marital norms have entered into marriage preparation. Moreover, shifts in the structure of religious authority mean that who does the speaking has changed drastically. Lay persons are increasingly empowered to produce local Catholic culture and make sense of Catholic teachings through the marriage preparation process.

Abstract:
This chapter’s discussion of American Jewish marriage shows that how religion and sexuality have shaped one another, often very profoundly. Jewish investment in marriage in the twentieth century shaped the ways in which Jewish Americans practiced and valued their faith. In turn, the religious investment in marriage, by Jews and other people of faith, contributed to national conversations about the sanctity and value of marital stability. Religious individuals and institutions therefore played central roles in the promotion of the modern categories of heterosexuality and homosexuality through their efforts to promote and sustain marriage. The history of religious investment in heterosexuality has featured Protestant and Catholic actors most prominently, and it was this dominant Christian context within which American Jews articulated and acted upon their ideas about marital sexuality. American Jewish religious leaders put concerns about marriage and the family at the center of their communal and spiritual work throughout the twentieth century. Jewish efforts to promote cultural continuity through marriage became agents of significant shifts in Jewish attitudes toward sexuality.

Abstract:
This chapter assesses the issuance of the encyclical Humanæ vitæ in July of 1968, which imposed on Catholics a stringent code of sexual morality in line with Pius XI's 1930 encyclical Casti connubii, or ‘chastity in marriage’. In particular, Humanæ vitæ rejected all forms of artificial contraception. Many Christians were expecting the Church to adapt to the tide of sexual liberation, but instead, just when birth control pills appeared on the European market, hence proposing an alternative to abortion, the pope issued an encyclical taking a stance against the changing mores. Sexual morality came to be the newest battlefront between religion and Europe's dominant culture, and became central to the way of life promoted by the Church. What once bridged the gap between believers and nonbelievers, namely a shared base of secularized Christian values, had faded or disappeared. This raises some serious questions: If the Church no longer recognizes the dominant culture in Europe today as Christian, who would take the liberty of claiming that Europe's identity is Christian? And how could this Christian identity be reclaimed without a battle for Europe's morals, which would be directed less against Islam than against European society itself? Not only does this change the position of the Catholic Church but it also alters the very meaning of what it is to be a believer in Europe.

Additionally, attention is given to the challenge of addressing clergy sexual abuse. Second, we examine their hopes for the future: young adults, laity, spirituality, vocations to Church ministry, Pope Francis, priests, Hispanics, and evangelization. Third, we look at how the bishops are encouraging vocations to priesthood and religious life. How are they promoting a new generation of priests, sisters and brothers to serve the Church? These three issues provide a broad understanding of where the bishops of the United States may be leading the Church.
