Abstract:
We consider the problem of simplifying a planar triangle mesh using edge contractions, under the restriction that the resulting vertices must be a subset of the input set. That is, contraction of an edge must be made onto one of its adjacent vertices, which results in removing the other adjacent vertex. We show that if the perimeter of the mesh consists of at most five vertices, then we can always find a vertex not on the perimeter which can be removed in this way. If the perimeter consists of more than five vertices such a vertex may not exist. In order to maintain a higher number of removable vertices under the above restriction, we study edge flips which can be performed in a visually smooth way. A removal of a vertex which is preceded by one such smooth operation is called a 2-step removal. Moreover, we introduce the possibility that the user defines "important" vertices (or edges) which have to remain intact. Given m such important vertices, or edges, we show that a simplification hierarchy of size O(n) and depth O( log (n/m)) can be constructed by 2-step removals in O(n) time, such that the simplified graph contains the m important vertices and edges, and at most O(m) other vertices from the input graph. In some triangulations, many vertices may not even be 2-step removable. In order to provide the option to remove such vertices, we also define and examine k-step removals. This increases the lower bound on the number of removable vertices.

Abstract:
The biodegradation kinetics of BTE-oX and MTBE, mixed all together, in the presence of bioaugmented bacterial populations as high as 880 mg/L VSS was evaluated. The effect of soil in aqueous samples and the effect of Tergitol NP-10 on substrate biodegradation rates were also evaluated. Biodegradation kinetics was evaluated for 36 hours, every 6 hours. Benzene and o-xylene biodegradation followed a first-order one-phase kinetic model, whereas toluene and ethylbenzene biodegradation was well described by a first-order two-phase kinetic model in all samples. MTBE followed a zero-order removal kinetic model in all samples. The presence of soil in aqueous samples retarded BTE-oX removal rates, with the highest negative effect on o-xylene. The presence of soil enhanced MTBE removal rate. The addition of Tergitol NP-10 to aqueous samples containing soil had a positive effect on substrate removal rate in all samples. Substrate percent removals ranged from 95.4-99.7% for benzene, toluene and ethylbenzene. O-xylene and MTBE percent removals ranged from 55.9-90.1% and 15.6-30.1%, respectively.

AbstractDenoising of images corrupted by multiplicative noise is an important task in various applications, such as laser imaging, synthetic aperture radar and ultrasound imaging. We propose a combined first-order and second-order variational model for removal of multiplicative noise. Our model substantially reduces the staircase effects while preserving edges in the restored images, since it combines advantages of the first-order and second-order total variation. The issues of existence and uniqueness of a minimizer for this variational model are analysed. Moreover, a gradient descent method is employed to solve the associated Euler–Lagrange equation, and several numerical experiments are given to show the efficiency of our model. In particular, a comparison with an existing model in terms of peak signal-to-noise ratio and structural similarity index is provided.

The combined method takes the advantage of both filters since it can preserve edges and at the same time avoid the blocky effects in smooth regions. Substrate percent removals ranged between 64.8–98.9% for benzene, toluene and ethylbenzene. O-xylene and MTBE percent removals ranged between 18.7–40.8% and 7.2–10.3%, respectively.

PONTIFÍCIA UNIVERSIDADE CATÓLICA DO RIO DE JANEIRO
A presente tese é um estudo sobre a transexualidade no Direito brasileiro. A partir de questões centrais ligadas à dignidade da pessoa humana o estudo analisa a construção do conceito da transexualidade ao longo da História, especialmente da História da Medicina, em busca de uma explicação do tratamento discriminatório que os transexuais são constantemente submetidos no meio social. Busca-se a origem da visão da transexualidade como algo anormal, doente, que precise de conserto, para então desconstruir esse estereótipo que se firmou com o tempo e que predomina até hoje, inclusive no meio jurídico. Os princípios constitucionais de Igualdade, Dignidade, e Direito à Intimidade são usados como base na elaboração de uma proposta de tratamento respeitoso às pessoas que apresentam esse comportamento tido como desviante, mas que nada mais é que a expressão de sua identidade. A ausência de atuação do Poder Legislativo, a atuação discrepante do Poder Judiciário em situações fáticas idênticas, e a insuficiência das medidas do Poder Executivo servem para mostrar a urgência do enfrentamento do tema pelo Direito pátrio. O exame de outros ordenamentos jurídicos é feito para a elaboração de sugestões para a superação enfrentada pelos problemas acima, especialmente no que diz respeito à mudança do registro civil.
The current thesis is a study about the transsexuality in the Brazilian Law. Based on central issues related to the dignity of the human person, the study analyzes the construction of the concept of transsexuality throughout history, especially of the Medicine History, searching for answers about the discriminatory treatment that the transsexuals are constantly submitted in the social environment. The origin of the vision of transsexuality is sought as something abnormal, sick, in need of repair, to finally deconstruct this stereotype that was established over time and that prevails nowadays, including in the legal environment. The constitutional principles of Equality, Dignity and the Right to Intimacy are used as the basis in the elaboration of a respectful treatment proposal to the people who present this behavior as deviant, but which is nothing more than the expression of its identity. The lack of actions of the Legislative Power, the discrepant action of the Judiciary in identical factual situations and the insufficiency of the Executive Power measures serve to show the urgency of the confrontation of the subject by the Brazilian Law. The examination of other legal systems is done for the elaboration of suggestions aiming the overcoming of the above problems, especially regarding the change of civil registry.

L’objectif de ce travail est de traiter la problématique de l’éloignement des étrangers sous l’angle des droits de l’homme en Europe. En effet, la Convention européenne des droits de l’homme permet de limiter le droit des Etats d’expulser, d’extrader, ou de reconduire à la frontière les étrangers. La Cour européenne des droits de l’homme exige que toute mesure d’éloignement prise à l’encontre de l’étranger respecte les droits fondamentaux énumérés dans la Convention européenne des droits de l’homme. Ces exigences découlent de l’interprétation dynamique et évolutive des articles de ce texte, offrant une protection aux étrangers contre tout renvoi vers des destinations où ils risquent de subir des mauvais traitements. De même, l’expulsion des étrangers délinquants ayant des liens d’attachements dans l’Etat d’accueil peut constituer une violation de leur droit à une vie privée et familiale. Le juge européen octroie également des garanties procédurales aux mineurs étrangers et aux demandeurs d’asile en leur maintenant le droit à un recours effectif. Toutefois, le juge européen limite l’application de certains articles quand la mesure d’éloignement est nécessaire pour la sauvegarde de l’ordre public et la sécurité nationale. A ce titre, le juge refuse d’appliquer le droit à un procès équitable en cas d’extradition ou d’interdiction de territoires, en particulier à ceux suspectés de terrorisme. Afin de réconcilier l’intérêt des Etats et la protection les droits fondamentaux de l’étranger frappé par une mesure d’éloignement, les juges de la Cour européenne des droits de l’homme examinent ce contentieux au cas par cas. En somme, les solutions européennes permettent de modifier le statut interne de l’étranger en situation d’éloignement et de combler les défaillances du droit international en la matière
The objective of this study is to address the issue of removal of foreigners from the human rights perspective in Europe. Indeed, the European Convention on Human Rights limits the right of member States to expulse, extradite or deport foreigners. The European Court of Human Rights requires that any order of removal against a foreigner must respect the fundamental rights enshrined in the European Convention on Human Rights. This requirement stems from the dynamic and evolving interpretation of the articles of the Convention, which provide protection against the sending of foreigners towards destinations where they risk being subjected to ill- treatment. Likewise, the removal of unlawful non-citizens with strong bonding ties in the host Member State may constitute a violation of their right to a private and family life. There are also procedural protection such as the right to an effective remedy, granted by the European Court to foreign minors and asylum seekers. However, the European Court limits the application of certain articles of the Convention when removal is necessary in order to maintain public and national security. As such, the judge refuses to recognize the right to a fair trial for those extradited or banned from entering a member State if suspected terrorism. In order to strike balance between the interests of States and the protection of fundamental rights of foreigners affected by a removal order, the judges of the European Court of Human Rights examine the situation case by case. In summary, the European approach enables the transformation of the internal status of foreigners subject to removal, and thus corrects the deficiencies of international law in the matter

Lilburn W. Boggs and the Case for Jacksonian Democracy Robert John Walker Department of Religion, BYU Masters of Religious Education Lilburn W. Boggs was lieutenant governor of Missouri from 1832 to 1836. He was governor of Missouri from 1836 to 1840. Political upheaval was the order of the day as Jacksonian democrats overthrew, through the power of the ballot box, the establishment of the patrician leadership in the United States. Issues of equity, slavery, religion, settlement of the West, and divisive sectionalism threatened the Union of the states. President Andrew Jackson was the representation of the common man and the enemy of the monied oligarchy that assumed the right to rule the common people. Jackson's leadership enabled a powerful change in party politics as he became the charismatic figurehead of the Jacksonian Democratic Party. Boggs was a protégé of Thomas Hart Bennett, the powerful ally of Jackson and leading senator from Missouri. Boggs, beginning as a young man, rode the coattails of Benton right into the governor's mansion in Columbia, Missouri. This thesis examines Boggs' life and political career to ascertain whether or not he was truly a Jackson man as he represented himself to be to the electorate.

Avec la croissance des familles binationales, les divorces et séparations des époux donnent souvent lieu aux problèmes d’enlèvement parental d’enfant : l'un d’eux décide de déplacer l'enfant à l'étranger sans le consentement de l'autre afin de se faire accorder le droit de garde par un juge étranger plus clément. Des instruments juridiques internationaux tendent à résoudre ce problème d’enlèvement international d’enfants par le mécanisme de retour immédiat. La Convention de La Haye du 25 octobre 1980 sur les aspects civils de l'enlèvement international d'enfants est l'instrument principal qui est ratifié par un grand nombre d'États. Son effectivité dépend de la conformité de l'application par les États. Autrement dit, il est important d'interpréter des termes principaux et des exceptions de la Convention de manière conforme, voire similaire. Pour ce faire, le principe est l'interprétation autonome des notions de la Convention. Outre que la question d'interprétation de la Convention, l'attention est aussi portée sur l'exécution de l'ordonnance de retour. Cette exécution est en effet encadrée par l'obligation de célérité et elle requiert en même temps une forte coopération entre les autorités judiciaires et administratives entre les deux États concernés. Les États sont donc invités à donner effet aux ordonnances de retour à travers les différentes mesures, y compris les mesures coercitives. Cependant, la remise volontaire de l'enfant reste la meilleure solution qui doit être favorisée, notamment à travers le recours à une procédure amiable telle que la médiation familiale internationale
With the increase of binational families, the divorces and separations between the married couple always give rise to problems of parental child kidnapping: one of them decides to remove the couple's child abroad, without consent of the other, with a view to having the child custody awarded by more clement foreign judges. International legal instruments tend to solve this problem of international child abduction through the summary return mechanism. The Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction, as the main instrument, is now ratified by a great number of States. Its effectiveness depends on the compliance of the application of the Convention by member States. In other words, it is important for member States to interpret the Convention terms in the way to comply with the other. In doing so, the proposed principle must be the autonomous interpretation of the Convention terms. In addition to the issue of interpretation, attention must also be placed on the enforcement of return orders. This enforcement must be guided by the celerity obligation. At the same time, the enforcement of return orders requires a strong cooperation between judicial and administrative authorities of the States involved in each abduction case. The States are, thus, invited to give effect to return orders by taking different measures, including coercive ones. However, voluntary return of the abducted child is always the best solution that must be favored, especially through the use of amicable settlement between the parties, such as the international family mediation

Abstract During image transmission, digital images are frequently corrupted by noises. Among them, the impulse noise is frequently seen. Different kinds of linear and nonlinear filters have been proposed to remove impulse noises. In recent years, nonlinear filters gradually substituted linear filter in the application of removing impulsive noises. In this thesis, we combine one kind of the nonlinear filter, the median filter, and the fuzzy rules to develop a novel rank order filter mean based switching scheme (NROM-SS) to remove the impulse noises from the images. While realizing the fuzzy system, it is of most difficulty to find out the fuzzy characteristic. In this study, the fuzzy characteristic is derived based on the differences defined between the current pixel and the rank order value. Specifically, the Laplacian edge detection is also used to produce the fuzzy measurement. Moreover, in order to control the dynamic range of weights of defuzzifier, the weights are optimized using constrained LMS (least mean square) and genie algorithm. In the design of experiments, 10% to 30% of the low-amplitude uniform-valued and the mixed Gaussian impulsive noises are exploited to test the effectiveness of this method. The experimental results show that the proposed method outperforms the standard median filter by 1~2db in PSNR. The effect of the proposed method becomes better with the rise in noise level. In the experiments using constrained LMS optimization or genie algorithm to estimate the parameters of the filter, the proposed scheme attains 0.4~0.6db improvement in PSNR. In general, the genetic algorithm performs better than the constrained LMS by 0.1db in PSNR. Based on the experimental results, we conclude that the proposed NROM-SS filter can readily reduce the influence of the low amplitude noises. The drawback of over-correction situation, which is usually observed in the median filter, has been improved with the proposed scheme. Moreover, the two methods for optimal parameter estimation can further improve the effectiveness of the filter. Keywords- Constrained LMS;Rank order filter mean filter;

Section 71(3) of the Companies Act 71 of 2008 has introduced into South African company law a provision which for the first time permits the board of directors to remove another director from office in certain specific instances. A further significant innovation in the Companies Act 71 of 2008 is contained in section 162, which empowers a court to make an order declaring a director delinquent or placing him under probation in specific instances. The effect of section 162 is that a court is empowered to remove a director from the board of directors. The focus of this thesis is the removal of directors from office by the board of directors and by the judiciary. The thesis explores the underpinning philosophy of the statutory provisions relating to the removal of directors from office. It also examines the impact of the power given to the board of directors and to the courts to remove a director from office. The grounds and the procedures for the removal of directors by the board of directors and the judiciary are examined. The fiduciary duties applicable to directors in removing a director from the board of directors are also explored. In addition, this thesis examines the removal of directors holding multiple positions or capacities in relation to a company, such as an employee or a shareholder with loaded voting rights. The remedies which may be relied on by a director who has been removed from office by the board of directors are examined. Recommendations are made to strengthen and improve the provisions in the Companies Act 71 of 2008 relating to the removal of directors from office by the board of directors and the judiciary. Amendments to the Companies Act 71 of 2008 are suggested to remove ambiguities; to guard against the abuse of sections 71(3) and 162; to improve the grounds and procedures for the removal of directors by the board of directors and the judiciary, and to enhance the remedies that may be relied on by a director who has been removed from office by the board of directors.

abstract: Rates of domestic violence (DV) gun homicide in Arizona consistently exceed the national average (Everytown, 2015). For perpetrators, firearms continue to be their primary weapon of choice in DV homicides (Arizona Coalition to End Sexual and Domestic Violence, 2015). In Arizona, civil DV protection orders (POs) help reduce the growing rates of gun homicide through firearm removal provisions. Questioning how firearms shape judicial decision-making, this thesis contributes to existing literature on firearms and DV by exploring how judges come to interpret findings of credible threat and which factors are associated with judicial decisions to grant firearm removal pursuant to Ariz. Rev. Stat. § 13-3601. This thesis reveals how courts navigate competing concerns around victim safety and gun rights. Secondary qualitative and quantitative data collected as part of Dr. Alesha Durfee’s National Institute of Justice Researcher-Practitioner Partnerships Grant “Investigating the Impacts of Institutional and Contextual Factors on Protection Order Decision-Making” (Dr. Alesha Durfee, PI; Mesa Municipal Court and National Center for State Courts, co-PIs) (2015-IJ-CX-0013) are analyzed in this thesis.

L'affaire Baker, de la Cour suprême du Canada, est notre point de référence puisqu'elle prône, entre autres, le respect de l'intérêt supérieur de l'enfant en matière d'immigration. À partir de cette affirmation et de la pratique législative et jurisprudentielle qui s'en est suivie, arriverait-on un jour à reconnaître la protection du droit de l'étranger à mener une vie familiale normale comme il se fait en Europe ? Ce chemin lui serait-il accessible ? Ce projet vise à démontrer cette évolution juridique qui pourrait survenir au Canada dans le cadre d'un plus grand respect des droits fondamentaux de la personne.
This thesis relates to the right of immigration. It concems aliens who are aimed with a removal order in spite of the fact that they have family bonds in Canada. The Baker case, of the Supreme Court of Canada, is our point of reference since it preaches, inter alia, the respect of the best interest of the child as regards to immigration. Starting from this assertion and legislative & jurisprudential practices that followed from the case, would one arrive one day at recognizing to every migrant the right to a normal family life like it is done in Europe? Would this path be accessible? This project aims at showing this legal evolution that could occur in Canada within the framework of a larger respect of the fundamental human rights.

This rapid review synthesises the literature from academic, policy, and knowledge institution sources on how business environment reforms in middle-income countries impacts on poverty, gender and inclusion. Although, there is limited evidence on the direct impact of business environment reforms on poverty, gender, and inclusion, this review illustrates that there is evidence of indirect effects of such reforms. Business environment reform (BER) targets inadequate business regulations and institutions, in order to remove constraints to business investment and expansion, enabling growth and job creation, as well as new opportunities for international business to contribute to and benefit from this growth. However, there is a lack of detailed knowledge of the impact of BER on gender and inclusion (G&I) outcomes, in terms of the potential to remove institutional barriers which exclude formerly marginalised groups from business opportunities, in ways that promote equal access to resources, opportunities, benefits, and services. The literature shows how the business environment affects women in business, and how women’s experiences of a given business environment can be different from those of men. This is the result of disparities in how they are treated under the law, but also based on structural and sociocultural factors which influence how men and women behave in a given business environment and the barriers they face.

This deliverable focuses on the proling activities developed in the project with the partner's applications. To perform this proling activities, a couple of benchmarks were dened in collaboration with WP5. The rst benchmark is an embarrassingly parallel benchmark that performs a read and then multiple writes of the same object, with the objective of stressing the memory and storage systems and evaluate the overhead when these reads and writes are performed in parallel. A second benchmark is dened based on the Continuation Multi Level Monte Carlo (C-MLMC) algorithm. While this algorithm is normally executed using multiple levels, for the proling and performance analysis objectives, the execution of a single level was enough since the forthcoming levels have similar performance characteristics. Additionally, while the simulation tasks can be executed as parallel (multi-threaded tasks), in the benchmark, single threaded tasks were executed to increase the number of simulations to be scheduled and stress the scheduling engines. A set of experiments based on these two benchmarks have been executed in the MareNostrum 4 supercomputer and using PyCOMPSs as underlying programming model and dynamic scheduler of the tasks involved in the executions. While the rst benchmark was executed several times in a single iteration, the second benchmark was executed in an iterative manner, with cycles of 1) Execution and trace generation; 2) Performance analysis; 3) Improvements. This had enabled to perform several improvements in the benchmark and in the scheduler of PyCOMPSs. The initial iterations focused on the C-MLMC structure itself, performing re-factors of the code to remove ne grain and sequential tasks and merging them in larger granularity tasks. The next iterations focused on improving the PyCOMPSs scheduler, removing existent bottlenecks and increasing its performance by making the scheduler a multithreaded engine. While the results can still be improved, we are satised with the results since the granularity of the simulations run in this evaluation step are much ner than the one that will be used for the real scenarios. The deliverable nishes with some recommendations that should be followed along the project in order to obtain good performance in the execution of the project codes.
