This study investigates the impact of the right to lease renewal and rent cap, introduced through the “Two Lease Acts” in July 2020, on apartment rent in Seoul, South Korea. By comparing rent price changes based on the exercise of the right to lease renewal, we find that exercising the right led to a 12.29 percentage point lower rent increase rate compared to non-exercise. While this suggests that the Two Lease Acts enhanced tenants’ housing stability, the 5% rent cap raises concerns about potential long-term market distortions and structural problems. A tenure type comparison shows that the p

If a landlord wants to forfeit as a result of a breach (and they have the right to forfeit as is provided for in their lease) and there is rent due, they should not demand or accept rent accruing beyond the date they become aware of the breach, as this would likely amount to a waiver. In the United Kingdom the most important embedded option is the upward-only rent review. This becomes more valuable to the landlord in an era of low demand and low inflation, as nominal market rents are more likely to fall. Lease contracts are freely negotiated between landlord and tenant, and alternative forms of rent review clause would fundamentally change the investment characteristics of property. Abstract The facility of an interim rent was created in 1969, by the insertion of section 24A 6.01 into the Landlord and Tenant Act 1954, to offer the landlord much needed protection from financial disadvantage during the continuation period between the end of the contractual tenancy and the commencement of a new lease. It is a bridging device which caters for a variation of the former contractual rent until the time when, on renewal, a market rent becomes payable. The interim rent, therefore, constitutes a counterweight to the tenant’s right to prolong the continuation tenancy under section 2
