Full textMy dissertation, which lies within the framework of international linguistics, is about the interaction during meals among friends in invitations in France. Based on audio and video data recorded in naturally-occurring situations, this empirical study aims to show the modalities by which the participants co-construct the two main activities observed at table: eating and talking. Concerning eating, the study describes in detail the interactions since the eaters sit down at the table until they finish the meal. On the basis of verbal and multimodal analysis, this study brings out the linguistic and multimodal resources used by the hosts and the guests in order to make sure of the course of the meal. As for talking, this dissertation focuses on the assessment on the dishes served. The analysis shows that through the assessment on the dishes served, the speakers express their personal observation about the food, as well, they realize various actions such as complimenting, criticizing, self-complimenting and self-depreciating. The key issue of this study is to shed light on the principles seen but unnoticed by which the French speakers construct interaction at table

Full textThis study aims to propose a systematization of Private International Law from the European neoliberal context, based on the German ordoliberalism. This doctrine recommends a permanent legal interventionism to build a market and generalizes this logic to every social relation. Therefore, the means offered to individuals to satisfy their private interests are increased while, at the same time, the State actively defends a public interest in private relations. Thus, Private International Law is permeated by a phenomenon of primacy of interests. It leads to a rise of power-conferring norms, both for parties and the judge, to respectively satisfy private and public interests. Yet, this phenomenon increases the potential for conflict of interests and requires a method of coordination of interests based on two complementary principles: the ontological superiority of public interest, and the private conception of Private International Law. The analysis of positive law reveals some situations of dis-coordination of interests that could be overruled by the use of proportionality to restore the role properly assigned to each of them

Full textThe current Lebanese context of the education is characterized by a plurality of types of establishments and by a freedom of education. These establishments (public, private, subsidized) know, each at the level, of great difficulties which threaten them, and with real problems stressed by diverse social, economic and political phenomena. This reality has notable incidences on the current state of the school education generally, on the status of every type of school, on the professional level of the teachers and on the successes at school. Our study targets the subsidized schools, as constituting a Lebanese originality. It is a sector, situated in the crossing of the private and the public, offering a quality of education with an accessible schooling to a disadvantaged population. The study aims at seeing closely the stakes in terms of educational equity, and at spotting(locating), within a binding situation, the militant aspect of certain teachers of these schools, to limit(ease) the feelings of equity (on equity and sub-equity) and to reduce discard by the educational efficiency. The working conditions are at the origin of a professional exhaustion at certain teachers. They are besides an engine-challenge for other teachers who manage to develop professionally in spite of all the risk factors. This phenomenon is similar to the concept of “resiliency in education” introduced recently into the world of the education. The resiliency of the school staff appears then as an essential factor(mailman) valuing the professional evolution and the educational efficiency in modest school circles and having to regulate, in consequent, some in equities between learners and between school environment

Full textEducation represents a major challenge in Burkina Faso, in a context of poverty and high population growth. For this reason the Government of Burkina Faso signed, in 2000, an educational partnership with the civil society. This new partnership saw the reintroduction of a former partner, the Catholic Church. In 1969, the Catholic Church withdrew from primary schools and then became involved again in 2000. Is this come back innovative or just a repetition of the past? This research is devoted to an analysis and an evaluation of this educational partnership in a sociological, historical and pedagogical context. It explores the reasons behind past failings then assesses the involvement of catholic primary schools since 2000. From this point, it draws a comparative analysis between the past and present educational praxis of the Catholic Church. Finally, thanks to investigations, the research leads to concrete proposals for a more appropriate partnership
Eine der großen Herausforderungen Burkina Fasos ist die Bildung bedingt durch die Armut und der stark ansteigenden Bevölkerungszahl. Dies führte im Jahr 2000 zu einem Bildungspakt zwischen der Regierung Burkina Fasos und der Zivilbevölkerung. Aber dieser neue Bildungspakt ist im Grunde genommen der Wiedereinstieg eines früheren Partners, nämlich der der Katholischen Kirche. 1969 hat sie sich aus der Grundschulbildung zurückgezogen und brachte sich dann erneut im Jahr 2000 wieder ein, ausgehend von folgender Fragestellung: Handelt es sich um einen Wiedereinstieg mit einem neuen Konzept oder geht es einfach um eine Wiedereinführung des vergangenen Systems? Ziel der Doktorarbeit ist es, diesen Bildungspakt unter einem soziohistorischen und pädagogischen Blickwinkel zu analysieren und zu bewerten. Sie untersucht die tiefgründigen Auslöser des vergangenen Bruchs und bewertet in einem weiteren Schritt die Dynamik der katholischen Grundschulen seit dem Jahr 2000. Ausgehend davon erstellt sie eine vergleichende Studie zwischen der vergangenen und aktuellen Erziehungspraxis der Katholischen Kirche. Schließlich mündet die Untersuchung auf der Basis einer Grundlagenforschung in konkrete Vorschläge für einen beständigeren Bildungspakt

Full textThis study will aim at outlining those concepts, originating in German general contractual theory, which have been influential in French law. Education which provides us with a comparison of national rights in terms of contracts also enables us to discern substantial and effective notions which have been established in German national law which have subsequently exerted a real influence on French lawmakers, their doctrines and jurisprudence. The study may be seen as part of a substantial amount of research currently being undertaken into the possible reform of contractual law as regards French law of obligations within the 'Code civil', as well as possible future synchronisation or even standardisation of European or International contract law. It is necessary to analyse the concepts which have become established in German and French national law which recur in various scholastic texts, which are intended to contribute to the reform of the French law of obligations, along with the emergence of a genuine European or International Law of Contracts. The aim of this work is the general contractual theory, which is at the very heart of national laws of obligations. The study will not merely be a report on the circulation of legal concepts. Its relevance will also lie in emphasising certain proven notions which are likely to be a part of a judicial decree which could exceed the framework of national rights

The regulation set up in 1968 at the federal federal level can seem to be out of date, even if the U. S. Judges try to maintain a balance between the shareholders' protection and the requirements of the economic restructuring in the u. S. The potential target companies take some to defeat the attempts of tender offers and adopt a wide range of defensive measures which intend to deter potential raiders. Such defensive tactics have led the states of the u. S. To be more involved and to offer a protective framework for companies which try to fight against tender offers. The state laws are varied and a standard-law according to the general principles of the last decisions taken by the U. S. Supreme court would be useful in order to specify the scope of the states power to regulate tender offers. Such a new regulation should come from the federal authorities

Full textThe research refers to the discipline of the didactic language sector and particularly in the domain of teaching French as a foreign language in Greece. The language teaching involves a great number of people who are seeking a variety of answers concerning structural and organizational problems in teaching methods, the future and the expectations of the foreign languages, the status of the language tutors as well as the position of our country in the European status quo. Considering the new reality defined by the Common European Language Framework, our study aims at observing and analyzing the ways of teaching French as a foreign language in Private and State schools in Greece. Throughout the field of research, our objective is to define to what degree the teaching of French has been influenced by the official directives, what the profile of the tasks preferred is, what the competences targeted by the language tutors – in the Private and State schools – during their teaching are and what the level of the certification and assessment is, in the family of schools. Given that the Greek teaching system for foreign languages presents a lot of diversions in Private and State schools, we are forced to demonstrate and explain the differences in the teaching method selections, in the modalities of their working as well as in the sensibility and information sector concerning the European directives. After a qualified analysis of interview data, we proceed to develop the comparative conclusions of our research

Full textThis work investigates the impact of social power and private or public context on normative influence. We defend the thesis according to which the context (private vs. public) regulates the effects of power on normative influence. In a first series of research, we tested the hypothesis that the possession of power, by generating disinhibition, would make individuals less sensitive to social norms. Two studies are presented and show that the possession of power causes less normative behaviors as well as less socially desirable self-presentations. In a second series of research, we argue that high power primed individuals would exhibit greater disinhibition in private and greater inhibition in public than low power primed individuals. Two studies were conducted and tend to support this idea. A last study examined social responsibility as a potential moderator of the effects of social power and context on normative influence. However, it seems that social responsibility does not mediates the inhibition and disinhibition patterns we observe. Overall, these studies help to clarify the paradoxical effects of power underlined in the literature, by proposing a model which allows to understand how the context generates different processes depending on social power, when disinhibition and inhibition are likely to occur, and what are the consequences for individual behavior

Full textThis dissertation addresses the legal issues that must face a party seeking to recognize and enforce in Quebec, in the context of bankruptcy, a security linked to more than one canadian jurisdiction. In that regard, this paper deals with the issues of jurisdiction arising under those circumstances, more specifical1y the determination of the Court before which legal proceedings must be introduced and the jurisdiction where those proceedings must take place. Also, the questions surrounding the interaction between the Bankruptcy and insolvency Act and the provincial legislation pertaining to the enforcement and order of payment of securities is developped in the context of a bankruptcy affecting goods located in more than one canadian jurisdiction. Moreover, the extent ofthe recognition in Quebec of securities created in another canadian jurisdiction is assessed. In doing so, a comparative study of the schemes put in place in Quebec and the other Canadian jurisdictions is completed. Final1y, the last part of this paper focuses on the rules applicable to the recognition in Quebec of judgments originating from other Canadian jurisdictions dealing with the recognition and enforcement of securities.

Full textContext: Since 1985, the main objective of the Association des services de garde en milieu scolaire du Québec (ASGEMSQ) has been to improve the quality of child care services in schools so that each child could develop in an environment that contributes to its well-being and growth. In partnership with Québec en forme, ASGEMSQ joined a national movement searching to promote healthy lifestyles and initiated actions leading to the development of environment conductive to healthy eating and physical activities in school child care services. To this end, child care providers definitively play a decisive role. Objective: The main objectives of this research are to study the perceptions of school-age child care providers in Quebec with regards to the meal period and the factors that may impair its development, as well as to identify their training needs in nutrition. Methodology: During fall 2014, an electronic survey was sent to 1655 child care providers from Quebec schools. Descriptive statistics and chi-square tests were conducted (SPSS, version 17.01). Results: In total, 624 responses were obtained, a 38% response rate. The meal context appears to be a relatively pleasant moment for the majority of children and educators. Different obstacles had statistically significant relationship with the perception of the meal context as being enjoyable for the majority of children, namely failure from parents to comply with instructions regarding lunch box content, children personal eating pace, the need to appropriately support children with special needs, non-compliance to the school code of conduct and the general attitude of the school's staff. The results show considerable interest from child care providers in various nutrition training activities. Moreover, specific training themes have a statistically significant relationship with obstacles related to a favorable meal context and to certain characteristics of the environment likely to impact them. Conclusion: The data confirm training needs and the importance to support partnerships with school and parents so that the meal context represents enjoyable moments. Elementary school day care is an environment to be documented. It constitutes a living environment that a majority of children experiment on a daily base. In collaboration with child-care center managers, school principals and parents, actions can be planned to create environments that support the adoption of healthy lifestyles. This transversal study conducted in Quebec's elementary schools contributed to the study on the importance of the environments on overall healthy lifestyles.

Full textJesus of Nazareth used to place much importance on commensality, so much that he wished the common meal to be the particular environment for both actions on bread and wine Jesus did during the Last Supper. For several generations, the memorial of Jesus Last Supper kept on being celebrated in its original context by Christians. But it was later separated from the communal meal. Does the word koinwnia in Acts 2:42 denote those communal meals during which Christian gatherings were held? The importance of common meals in the early community will be highlighted here through a funnel-type structural analysis of Acts 2-5. But it will be shown also that the meaning of koinwnia is more extended than the common meal alone, and just as concrete and active as the three other elements listed in verse 2:42.
