AbstractTo the extent that the USPTO issues a proliferation of broad and potentially overlapping nanotechnology patents, the development of a nanotechnology patent thicket could impede the licensing process required for further innovation. If the contractor refuses the federal agency’s request, the agency can grant a license to the applicant itself if “the contractor or assignee has not taken, or is not expected to take within a reasonable time, effective steps to achieve practical application of the subject invention in such field of use” or if “action is necessary to meet requirements for pu

Abstract:
AbstractThe phenomenon of irregular migration is very complex in the EU, including Finland. Definitions and practices regarding asylum seekers, refugees, and undocumented migrants are blurred. The laws and immigration policies also attempt to define and enact fixed categories by which to classify undocumented migrants, but these people always escape such legal boundaries through their actions, decisions, and migratory behaviours. In this chapter, we study the asylum-related legislation and processes from the viewpoints of both the authorities who decide whether to grant international protection, and the undocumented migrants who request asylum. The chapter describes the Finnish asylum process in detail, and explains how the undocumented migrants (mostly former asylum seekers) we studied experienced it. Some countries tolerate undocumented migrants, allowing them to work and have access to many public services. In other countries, such as Finland, they are denied the right to work and barely have access to healthcare. Being an undocumented migrant is simultaneously about becoming an undocumented migrant, and failing the asylum process is the most common path to becoming an undocumented migrant. We also indicate how, during the COVID-19 pandemic, the number of new asylum applications in Finland decreased by more than half.

This chapter explains the processes involved in granting patents as well as the factors that applicants must take into account when deciding whether to patent an invention in the UK. The role of patent agents and the choice of route to take to secure grant of the patent are considered. The chapter then documents the procedures in the application for a patent, paying particular attention to some of the key features of the UK and European Patent Office patent application processes together with the Patent Cooperation Treaty. It also describes situations in which applicants and patentees are able to amend their applications and the restrictions under which such amendments operate. Finally, it looks at a number of proposals to reform the patent procedure.

Abstract:
This chapter considers some problems that may arise when objections of lack of unity, lack of novelty, or lack of inventive step are raised against a patent application. Objections of lack of unity are more of a nuisance than a real threat. One can avoid the problem by filing one or more divisional applications on time. Apart from questions of whether or not a citation really is prior art and whether or not it has been interpreted correctly, objections of lack of novelty are a relatively straightforward matter: either the claim is anticipated or it is not, and if it is, it must be limited accordingly. Obviousness or lack of inventive step, however, is a subjective matter and for this reason by far the greatest part of the work involved in patent prosecution is in arguing that the invention is not obvious over the citations that have been made.
