Full textAs part of this study, we identify certain principles that are fundamental in the theory of contract: notably, commutative justice, contract commutability, subjective rights and legitimate interests. We establish the relationship between each of these basic concepts to conclude that to be consistent with the principles of commutative justice, contract commutability shall not be based on a monetary equivalent of benefits but on the respect of a standard based on peaceful coexistence of rights and interests. It consists therefore of a normalization of contractual relations which ceases to be purely subjective. This finding leads to several inferences: the addition of the circumstances of the execution and termination of the contract, rather than simply its creation, to the possibilities of judicial review, a better legitimization of such review and the recognition of the principle of good faith as a privileged instrument for a fairer contractual commutability. Moreover, the last part of our thesis is devoted to examining judicial practice interventions based on good faith in order to illustrate the principles expressed in the study.

Full textThree major forms of inequality are interrelated in contemporary modalities of sharing responsibility for caring for people with disabilities: 1) the persistence of a gendered division of caregiving responsibilities and its consequences on the professional and economic trajectory of women; 2) the transfer of some of these tasks to female workers with precarious status; 3) lack of access to care for people with disabilities, especially for low-income older women, in the context of reduced availability of family members and limited services offered by the state. Based on the idea that the implementation of public policies is never the simple consequence of identifying a social problem, but that it implies a political reading of the challenge it faces (Jenson, 2008) or otherwise stated that it involves a particular way of representing the problem (diagnosis) and the solutions (prognosis) to be implemented (Bacchi, 2009, 2012; Verloo, 2007), this thesis aims to explore how certain discursive events that shape public policy have helped define the modalities of the share responsibility for caring for seniors with disabilities. The formulated hypothesis is that discourses carry elements that contribute to challenge or reinforce social relations creating inequalities between women and men. The speeches produced by different groups of actors during the Rochon Commission (1985–1988), the Clair Commission (2000) and the Consultations on the Autonomy Insurance Project (2013) were analyzed and compared according to a synchronic then diachronic perspective. This thesis suggests that the three discursive events under study led to different problematizations of the issue of shared responsibility for caring for older people with disabilities and that, within these discussions, there are spaces of reproduction and contestation of social relations of caring generating inequalities. The speeches heard thus helped to define the identity of the social groups involved in the care relationship. Older people have essentially been defined on the basis of their vulnerability, their loss of autonomy and according to a user-consumer figure. Caregivers have gradually emerged as a category and as a collective actor likely to raise public awareness on suffering and inequality (Cefaï, 2007) and to mobilize a political voice (Verloo, 2007). Female workers paid for caring have been the subject of discussion, but almost exclusively from the issue of their qualification/non-qualification to provide personal assistance services to elderly people living with a disability. Four narratives of shared responsibility for caring between the state, the market, the third sector, and the family emerge from discourse analysis: 1) Mixed Competitive Regulation; 2) Competitive Market Regulation; 3) Social-Statist Regulation; 4) Mixed State/Third Sector Regulation. Each of these narratives is carried by different alliances of actors and mobilizes different configurations of the problem definition, the solution to be adopted, the cares and identities as well as discursive postures regarding the sexual division of care work. Full textLa présente thèse propose une étude complète de l'obligation in solidum en droit privé québécois. Elle en embrasse donc tous les aspects : origines, nature, justification, portée et effets. Elle cherche principalement à comprendre et à cerner cette notion (Partie 1) et à en préciser le régime ainsi que le champ d'application (Partie II). Pour éclairer notre analyse, nous retraçons les origines historiques de l'obligation in solidum en droit romain, en Ancien droit français et en droit français moderne. L'obligation in solidum telle qu'elle existe aujourd 'hui est formellement née en doctrine et en jurisprudence françaises au tournant du 20e siècle. Au Québec, avant le début du 21 e siècle, sa présence s'est avérée discrète et incertaine. Nous examinons également, quoique de manière moins systématique, la présence de l'obligation in solidum dans d'autres juridictions de tradition civiliste et en droit de tradition anglaise. Cet exercice nous a permis de construire notre vision de l'obligation in solidum, tout en exposant et critiquant celles des principaux auteurs français et québécois qui se sont intéressés au sujet, et ce de la fin des années 1800 jusqu'à aujourd'hui. À partir de la vision de l'obligation in solidum qui fut ainsi construite, nous avons dégagé le régime juridique de l'institution ainsi que son champ d'application en droit québécois. Par une étude et une comparaison systématique avec le régime de la solidarité, régime qui est prévu de façon détaillée par les législateurs québécois et français, nous proposons un régime juridique pour l'obligation in solidum. Après avoir ainsi posé ces assises générales, notre thèse est complétée avec des assises vraiment particulières au droit québécois. Le champ d'application de l'obligation in solidum est intimement lié dans tout système juridique à l'espace octroyé par le législateur et la jurisprudence à l'obligation solidaire. Le droit québécois diffère à cet égard de façon notable du droit français. Pourtant, le droit québécois a formellement reconnu l'obligation in solidum et la jurisprudence en fait maintenant un usage constant. En s'appuyant sur leur structure, leurs fondements théoriques et leurs effets pratiques, nous dégageons le champ d'application souhaitable de l'obligation solidaire et de l'obligation in solidum en droit privé québécois.

Full textMedication reconciliation (MedRec) is a formal process. While doctors’ and pharmacists’ contribution is clearly spelled out, nurses’ involvement remains to be clarified. Goal: Describe nurses’ involvement in implementing MedRec among cardiorespiratory patients admitted to a hospital centre’s cardiology department. Framework: Meleis theory, Reason model. Method: Single case study. Three data sources: interviews (N = 6) (nurses, doctors and pharmacists); a qualitative review of patient files (N = 22), and documentation (N =15). Results: While nurses are indeed expected to manage forms in the various phases of transition of care, their involvement extends well beyond this task and falls into four main categories: distinct involvement; nuanced mobilization; safety net, and; contributive activities. Results show that the accompaniment of patients and their loved ones is learned through teaching, screening high-risk patients and collaborating in a way that supports the mobilization of the other professionals involved to ensure patient safety during transitions.

Full textSince the end of 1980s, Sustainable Development (SD) has been made the object of much attention, driving the different actors of society to change their behaviors. Various institutional and private initiatives were introduced favoring the implementation of the concept. It was the case for example in Quebec, where the government introduced in 2004 a Plan de développement durable, followed by a the Sustainable Development Act in 2006. Various studies focused on the manner in which companies react to different pressures to widen their spheres of responsibility, but some key issues remain little studied in the literature. This is particularly the case for companies that display passive and negative behavior in the field of the integration of the integration of SD, and Small and Medium-Sized Entreprises (SMEs) in particular. SMEs offer a fertile ground for exploration because of their importance and economic weight, and their historically commitment to the environmental aspects of the SD. The objective of this qualitative study is to produce a portrait of the practices and the discourses of companies, in particular SMEs, in the field of the SD. More specifically, this research aims to analyze the stance of Quebec companies towards SD and of the public policies on this matter, as well as the perceptions of the SMEs which are less committed in this area and the justifications provided. To this end, a content analysis To this end, a content analysis of 69 submissions presented by the business community during the public consultation on the Plan de développement durable du Québec in 2005 was conducted, followed by a case study in nine manufacturing SMEs based on 33 interviews. The results allow to highlight the fact that enterprises adopt and justify passives positions to towards the implementation of SD are assumed and justified by the enterprises. In addition, the inactive behaviors in the field of SD seem just as legitimate as the increasing pressures and the prevailing views favoring the adoption of the SD. This calls into question the findings of recent studies, which adopt an optimistic view on the business engagement in SD, particularly among SMEs. Full textLike it use to be with most of the right to statements, legal practitioner are generally skeptical regarding the right to health care ability to produce juridical effects. However, this specific right shows, through judges constructions, that he can influence positive law, once it's stated. Such an influence can clearly be noticed in Quebecker law. It can also be in French law, less clearly. Right to health care statement modified the nature and the schema of the duty inherent to the horizontal relation between care giver and patient. The influence can be noticed regarding the juridical qualifying of the relation, as long as the scheme of the main duty incumbent on the care giver. The prerogatives conferred by this right have subsidiary and complementary functions in relation to those general and specific duties. The right to health care also has a vertical effectiveness, creating prerogatives for all citizens that can be opposed to the State. The degree of protection so given fluctuates according the fact that the care needed is or not due to guaranty the respect of a fundamental right

Full textIn 2019, across the province of Quebec, 35,000 people were injured in road accidents. The effect ofthese accidents on the mental health of survivors are poorly documented statistically. The prevalence of posttraumatic stress disorder (PTSD) and its comorbidity with insomnia, depression and transportation phobia hasbeen noted in some victims. Victims of accidents involving a heavy vehicle are over-represented and, in mostcases, the truck driver is not at fault. In these situations, it is possible that a person may have used the heavyvehicle to take their own life (suicide-by-truck). The impact of suicides-by-truck on mental health is decried bytrucker associations, but the nature and magnitude of these consequences are not well known. The aim of thisstudy is to define a portrait of a sample of Quebec truck drivers’ mental health, who have or have not experienceda road accident, whether involving a suicide attempt or not, to clarify the situation. Eighty-five truck drivers (64.7%male, average age = 42.8 years) completed a battery of validated and homemade questionnaires measuring theseverity of PTSD symptoms, insomnia, depression, daily functioning, and substance use. A significant differencewas observed between those who had not experienced an accident and those who had experienced an accidentthat was not a suicide attempt on the severity of intrusive symptoms related to PTSD (F (2.82) = 4.017, p =0.022). No significant difference was observed between those reporting accidents involving a suicide attemptand those in other groups. The sample of this study did not reveal any specific impact on the mental health oftruck drivers who had experienced road accidents involving a suicide attempt. Therefore, the results obtainedindicate that, for this sample of truck drivers, the context of the accident is not what seems to have the greatestinfluence on mental health. In future research, considering some factors such as the time passed since theaccident or the number of accidents experienced by each truck driver would provide a more accurate picture ofthis population.

Full textPhysical education teachers’ formation in Quebec as in France is oriented to develop professional competencies. Cooperative teachers supervise student-teachers and are considered key-players. In this comparative study, we analyzed the cooperative teacher’s supervision practices during a 7 week practicum in Quebec and a 7 month practicum in France. We use a double theoretical framework to study student-teacher’s supervision. The first one is the classroom ecology paradigm in physical education from North America and allows to understand all the events of the life in the gym. The second one is a didactic approach from francophone Europe and looks at the events in the gym in relation with the content knowledge. This double framework is used to understand what happens during post-lesson interviews between cooperative teachers and student teachers. It also allows to quantify and qualify the content of the supervision in both countries. In order to understand the singularity of each context, we use data from phone interviews and semi-directed interviews with cooperative teachers and student teachers. Results show that in both cases, supervision intensity is low during the practicum (less than 20 minutes each week). 48 % of the post-lesson discussions are related to the content knowledge, 25 % to the organization and 16 % to the social interactions between students. Our second level, based on didactic approach, demonstrates that discussions about content knowledge are associated to “contrat didactique” and “milieu didactique”. We also show that cooperative teachers do not look at student-teachers’ lesson plan and they do not know the professional competencies that student teachers must develop during the internship. Our research on conditions and contents of supervision in two cases shows difficulties on several aspects. First, the supervision conditions seem to be insufficient in the Quebec case and in the French case to allow cooperative teachers to look professionally and with a formative intervention on student-teachers practices. The lack of cooperative teacher’s formation on professional competencies may explain this tendency. Content knowledge is the main subject during the post-lesson discussions. Task system from ecology paradigm combined with didactic descriptors is a new approach in physical education research and it is the focal point of this research. The present thesis contributes to the advancement of research on student-teachers’ supervision from the diversity of data collection and allows to understand what happens during the last practicum of the physical education teacher’s formation

Full textThe protection of the environment through penal law is a real challenge for the future. However, it is enough to look at the substance of the protection regime to see that it contains a number of specific features that still make it insufficiently effective. It will therefore be necessary to study the penal law's understanding of the notion of the environment, both in Canada and in France, from a comparative law perspective, through the common core of penal offenses. However, to understand how we protect, we must clearly identify what we are protecting. It will therefore also be a question of studying the very definition of the environment as protected by penal law. All this will make it possible to more effectively identify what constitutes the notion of the environment in French-Canadian penal law.

Current issues raised by sustainability need to deconstruct the concept of CSR to reveal the underlying structure of the Business & Society academic field. Through historical and comparative approaches, this research follows the trail that socio-Environmental issues leave in the controversies they deploy, in the relationships they forge and in compromises they establish with human and non-Humans through the construction of four energy facilities in France (Tignes’ hydroelectric dam and La Rance’ tidal power plant) and Quebec (Bersimis’ hydroelectric dam and Gentilly’ nuclear plant) during the 1945th until the 1970th. In the line of work that develop non dichotomous understanding of the nature and culture by taking the refusal of Modern ontology (Latour; Descola; Gladwin, Kennely and Krause, and Banerjee etc.) as a base, it sheds light on associations/dissociations performed within heterogeneous group of allies and revisits "environmental turn" thanks to the precise analysis of the work of the founding father of CSR, Howard R. Bowen Social Responsibilities of the Businessman (1953), illuminating its theoretical legacies. This research aims at making three contributions. First, it refines the "naturalistic" approach or "Modern" in two empirical and cognitive perspectives and two modes of relating to collective: realism and nominalism. Then it entered the literature of CSR into the Modern ontology by showing theoretical legacies in wilderness conservation. Finally, it mobilizes the Amodern approach to analyze the socio-Environmental issues, and proposes an alternative understanding of CSR based on a dynamic and relational view of responsibility where the traditional boundaries of the business environment are broken in favor of socio-Environmental networks

In a perspective to innovate the legislation, it would be therefore a matter of modelling coherent legal structures for a real European Union of the construction. The participation of the builders in the debates is required, to facilitate the integration and the application of the future common standards with the support of a new European institution devoted for this mission.But how respect the national diversities, while seeking to set up a "unionist" principle keeping in mind the goal of full harmonization of the legal warranty periods settled down by the Member states of the European Union ? The very wide diversity of legal warranty periods in the construction's sector is an issue of real concern within the European Union to give rise to the new European model, a future source of stability and prosperity
