Full textDespite some authors’ scepticism, the international environmental law can find certain solutions in the law of state responsibility. However, the success of finding such solutions depends on the introduction of a number of environmental considerations to as conditions of state responsibility, its invocation and reparation. Regarding the first, although the state responsibility, which is based on breach of obligations, may lack normative environmental aspect, its preventive role vis-a-vis the environmental harm should not be underestimated. As to the invocation, the positive law has to acknowledge the right of an injured state acting for the collective interest in order to include spaces and species beyond the state’s sovereignty to the law of state responsibility. Regarding the forms of reparation, restitution and compensation must be adapted taking into consideration the importance of environmental restoration towards baseline conditions. However, satisfaction needs to transform into a multiform and flexible form of reparation. For this purpose the present study suggests the biodiversity offset mechanism as a form of satisfaction

But The States or the officials behave like the private persons, they contract The State Contracts, etc.., and, Those States breach the attributes or the feature, or the characteristics, of the rule of law of Universal Nature. they fail to perform the universal law or the universal principles. To seek personal profit do not surbordinate the protection of the Human Rights. Thus, the weak people have their universal law violate, those who are not strong, children and unarmed civilians are the victims of the internationally wrongful act or the internationally wrongful act of the state, and the real authors are never accused. The interference has its meaning in the rule of law, but the peaceful settlement of conflicts seems to be better characterize the judicial principles and international law, when weak people with an universal character becomes victim of internationally wrongful acts or victims of the irregular colonial or neocolonial systems, so the mimicry of French legal institutions by the French-speaking States of Africa, or the mimicry of American legal institutions by the English-speaking States of Africa, is the mimicry that loses its universally real meaning. Full textThe current situation of the rules governing the liability of the entrepreneur for environmental damage caused by offshore oil exploration and by the transportation of this product by oil tankers, shows that the legislator is more concerned with environmental health issues. However, there are many gaps in national legislations that can lead to considerable legal uncertainty for the responsible parties. While, at the same time it does not provide adequate protection for the environment and to human beings. The comparative study of legals systems shows the importance that countries that are exposed to the dangers of oil spills, especially those exploiting oil in the sea, to have a special indemnisation fund to guarantee and facilitate environmental restoration and payment of compensation to victims. Besides protecting the environment and citizens' rights, the fund also offers the possibility of applying the defenses of liability and limitation of liability. The funds would be used to cover the losses beyond the limit of liability of the responsible partie or when the responsibility for the accident is ruled out by a liability defense cause

Full textThe protection of the rights of indigenous peoples, who are displaced by environmental degradation, is a theme that has received little attention in most of the work on environmental displacement that tends to conceptualize displacement in an abstract way. The particularities of indigenous peoples' environmental displacement require analysis in the legal, political and social contexts in which they occur: this framework makes it possible not to isolate the environmental factor but to specify its importance in view of the particular relationship that indigenous peoples have with the land and their environment and their claims to be able to freely decide their future. Taking the indigenous communities in Alaska as an example, the analysis of the legal and institutional obstacles to the recognition of indigenous particularities in displacement then makes it possible to consider the role of the law in maintaining the status of indigenousness and the perpetuation of the status of the indigenous land in the territory of destination. The mobilization of the various corpuses of recognition of the rights of indigenous peoples under international, regional and domestic law (American law) allows for a re-reading of the obligations of States in the implementation of indigenous rights in the light of the unprecedented context of their environmental displacement, while demonstrating the importance of not locking indigenous peoples into a “legal straitjacket” that would lead communities to no longer being recognized as indigenous when being displaced

Full textThe function of the recourse against breach is to operate the execution and the respect of treaties -creating the european communities - by the members states. Besides this function meant to regularize the behaviours of the states towards the communities, the recourse against breach is endowed with another function which is to secure damaged people with a breach of the community law committed by the members states, with an effective protection. This function has been made effective thanks to the power of the commission and of the court of justice, since they use their given powers as part of recourse against the breach. Nevertheless, the authority of making law concerning the damaged people pertains to the national judge. Contrary to what happens regarding the community institutions (namely the commission and the court of justice), the national judge is not always endowed with all the necessary means to sanction in the right way the members states within the frame of the recourse against breach. In the eventuality when it becomes impossible for the judge to sanction the breach in the right way, this becomes unbearable, and in such a case, a solution will have compulsorily to be found at the level of the community
