Full textThe objet of the study is related to the research on a coviability between humans and ecosystems within a sahelian context whose environmental, socioeconomical and political data have deeply evolued since at least twenty years. An approach based on the anthropo-juridical study of the various exploitation systems and their interactions infers the fundamental imbrication of the land (defined as the substrate support of the biotic elements and the ecological process) and of the environment (composed in particular of the renewed resources as stakes of power relations). This approach in environmental law is made from a methodological attitude taking into account three observation scales : the village territory, the province and the region. Constituing the binomial spaceresource as unit of observation and as operative concept in every scales, it explores the relation man-natural environment by decorticating the land tenure frame of each of the exploitation systems taken individually and in interaction with the others. The aim is to think the principles of a right considering the interactions which weigh on the behaviour of individuals, on their decision and their action in terms of management of natural resources and which integrate the necessity of the longterme coviability of the biodiversity and of the cultural diversity. This right should constitute a change lever and allow to move from the conflicting and disorganized situation that the analysis of the social structures shows to a juridical situation where the liberty margin of the social actors and their respective responsability shares are clarified in accordance with the rights they have on the space-resources and in which they must be, in other respects, secured

Full textSince the early 1980s, French-speaking African countries, producers of raw materials, have largely opened their extractive sector to foreign investments. This openness has adopted several strategies among which taxation and customs have occupied a special place. Our work focused on the latter. Indeed, the stakes of these states have always been the reconciliation of the attractiveness of the sector and its profitability. Initially, our reflection focused on the strategies for setting up favorable tax and customs systems and, secondly, on the good governance of these systems. Our research shows that, first, while tax and customs strategies have been successful in attracting foreign investments, the question of profitability is still mixed, for many reasons that we have analyzed. This is where we made suggestions for improvement. In the second, it appears that the conditions of good governance tax and customs arrangements put in place are not sufficiently met by Francophone African, hence the need reunite past and improve prevention and resolution techniques disputes

Full textThe normative position of this dissertation is that there is a constraint of the law with regards to the mining regime of resource rich countries in Africa. This has resulted in the creation of a pluralist system of law will continue to thrive in developing countries as a result of the historical context which most of these countries derive. However, having a mixed system comprising of a formal and informal legal regime does not necessarily equate a disadvantage. The problem arises when there is a reluctance in accepting one of these systems. This is the case currently with the informal regime which exists mostly as an unrecognized and therefore illegitimate system of law. Yet, evidence from this dissertation shows the advantages which informal rules and norms can offer to a country’s legal regime. In this regard, it is therefore reasonable to suggest that something ought to be done with this system as opposed to its continued marginalization in the shadows of the formal regime. This dissertation therefore proposes the formalization of selected attributes of the informal system which govern the natural resources sector of resouce rich countries in Africa. Moreover, the formalization envisioned in the mining sector, makes no attempt to codify laws and is in alignment with a local to international approach to law making. In this regard, the aim for formalization, as proposed by this dissertation, is in finding possible solutions for bridging the hiatus between the formal and informal regime which currently work in parallel with each other within the mining space. This is in hopes that the synchronizing of these two sets of laws would facilitate the flourishing of economic and human/social development based on the mining sector

Full textContending that tenure insecurity under informal customary institutions dampens incentives for investment and contributes to low agricultural productivity in much of Sub-Saharan Africa, policymakers have tried to formalize customary land use through the provision of de jure rights to users. Two examples of such initiatives are the land registration programmes in Benin and Ethiopia. Both programmes embed the resolution of land disputes, the demarcation of plots and the recognition of individual land rights within customary practices and provide documentary evidence of those rights. In this doctoral thesis we explore the early effects of such programmes on household welfare. Following the land demarcation activities and the resolution of land disputes, the resources previously used to safeguard land claims from risk of encroachment are freed and can increase household welfare. There is also evidence that households anticipate the registration of their landholding(s) and take preventive measures to safeguard their land rights. This anticipation has an impact on the distribution of land rights between female and male landholders and could bias the impact evaluation of land registration programmes

Full textNatural resources are taken in the nature for, in the most of cases to improve the conditions of existence of the population. In Sub-Saharan Africa, economics are often dominated by the exploitation of these natural resources which contribute to the formation of the national wealth. This exploitation of natural resources should thus allow the improvement of the welfare of the present generations without compromising the possibility for the future generations to improve theirs. So natural resources should be exploited so that the heritage represented by the environment is not altered and so that the populations living thanks to these naturalresources see theirs conditions of existence improving today and in the future.The sustainable development is thus the way which must to guide the strategies ofdevelopment in Sub-Saharan economics which are generously endowed in natural resources. This one dresses a triple dimension, namely economic, social and ecological. It is thus important to examine the relation between natural resources and sustainable development because, indeed natural resources have to allow the populations to know a sustainable development. If certain countries indeed, although provided in natural resources did not bring, on examination of the indicators of development which are at the lowest, elements of sustainable development in the past and today, it is important to reverse the trend. It is as such that the strategies must be mobilized in Sub-Saharan Africa. The examination of the case of certain countries generously endowed in natural resources shows that these should be a source of endogenous growth to envisage a sustainabledevelopment. From then on the good governance, the best distribution of receipts stemming from natural resources and the contribution of the foreign partners are important. The European Union as partner and financer has a role so that the economics of Africa in the south of Sahara put themselves on the path of the sustainable development from their asset which lies in possession of natural resources. As such the financial cooperation among other has to give better results so that we can establish a relation between financing and sustainable development in Sub-Sahara Africa
