Abstract:
According to retributivism, what justifies punishment is a wrongdoer's desert. Critics argue that retributivists fail to provide sufficient justification for punishment. Herbert Morris offers the type of justification critics demand, providing an account of punishment that: 1) values autonomy, and 2) appeals to the principle of fairness. Punishment, in this account, restores equilibrium of benefits and burdens with respect to autonomy. Since punishment largely ignores the autonomy of the victim, however, punishment alone seems unable to ensure justice. In order to provide a more complete accou

This thesis explores the strength of the two major theories of punishment, consequentialism and retributivism. It also explores the two most critiqued systems of punishment in the world: The U.S and Norway. By presenting the idea that retributivism is the only plausible theory that can morally justify the U.S. penal practises, I argue against the theory by incorporating various objections delivered by Antony Duff, Michael Zimmerman, and Jeffrie Murphy. I then explore the question of what could possibly ground the Norwegian justice system, for the answer to this is crucial, if we hope to demand

This thesis explores the merits and limits of John Hawthorne’s contextualist analysis of free will. First, I argue that contextualism does better at capturing the ordinary understanding of ‘free will’ than competing views because it best accounts for the way in which our willingness to attribute free will ordinarily varies with context. Then I consider whether this is enough to conclude that the contextualist has won the free will debate. I argue that this would be hasty, because the contextualist, unlike her competitors, cannot tell us whether any particular agent is definitively free, and th

Abstract:
This thesis focuses on contemporary institutional and societal responses to the rising profile of inner-city youth gang violence to provide a recognition centred account of the retributive turn apparent in contemporary youth penal justice. The discussion is informed by the institutional determination that the inner-city gang youth belongs to a violent minority of serious offenders for whom penal administrators reserve their most punitive sanctions. Surveillance has become normalised as part of institutional aims to curtail this violent minority. In this pursuit, policing authorities are guided
