O presente trabalho visa contextualizar as inovações trazidas pela Lei n. 13.718/18, com escopo principal a prática conhecida como Pornografia de Vingança (Revenge Porn ou Revanche Pornográfico), também abordar sua caracterização à luz do Direito Penal. O fenômeno da Pornografia de Vingança é caracterizado pela divulgação sem consentimento de fotos, vídeos, áudios e demais tipos de mídia que possuam conteúdo íntimo da vítima, no ambiente virtual (redes sociais, aplicativos de mensagens instantâneas, hospedagem em websites, entre outros). Por conseguinte, está pesquisa também estudou os crimes oriundos da Lei 13.718/18, e sua conformação. Após a análise dos conceitos iniciais sobre o fato, será discutida a aplicabilidade do crime do art. 218-C, § 1º ao caso Neymar Jr. Vs. Najila Trindade, vez que o autor após ser denunciado por estupro, divulgou imagens e conversas com a vítima, sem identificação e com rosto borrado. Por fim, será examinada a conduta do jogador em conjunto com os mecanismos de enquadramento do tipo penal incriminador e a possibilidade de responsabilização criminal.

Abstract:
Currently, a range of criminal offences are perpetrated online. In addition to the commission of traditional offences, such as fraud, stalking, and domestic violence, new phenomena have emerged to warrant attention from the media, government, and communities. The phenomenon colloquially referred to as ‘revenge porn' stands as one of the greater threats to public morality. To date, legislative responses to circumscribe revenge porn, both internationally and in Australia, have been sporadic and disjunctive. This article critically examines the impact and prevalence of revenge porn and provides a critical analysis of the civil and criminal responses to its commission. It concludes by arguing that addressing the challenges associated with investigating such offences, and educating about the dangers of revenge porn have to some extent been overlooked in the rush to legislate and create new offences. The article highlights that existing legislation may provide adequate protection.

This paper presents a novel study, exploring a form of technology facilitated sexual violence (TFSV) known as revenge porn. Despite its emerging prevalence, little is known about the characteristics of revenge porn perpetrators. In the current study, a revenge porn proclivity scale was devised to examine participants' behavioural propensity to engage in revenge porn. One hundred adults, aged 18-54, were recruited online from a community sample. The correlational relationship between revenge porn proclivity and the self-reported endorsement of the Dark Triad, sadism, and ambivalent sexism was examined. Additional proclivity subscales of revenge porn enjoyment and revenge porn approval were also created. The study's main findings revealed a positive correlation between a greater behavioural propensity to engage in revenge porn and higher levels of the Dark Triad and ambivalent sexism. Moreover, endorsement of psychopathy was found to be the only Dark Triad trait that independently predicted revenge porn proclivity. The results suggest that perpetrators of revenge porn may have distinct personality profiles. Limitations and directions for future research are discussed.

Revenge porn is a new growing modus operandi of crime in society. Law enforcement still considers porn revenge as a pornographic crime in general as it is an activity of disseminating information that violates decency. Approach used by law enforcement in assessing revenge porn is still limited to formal juridical approach without considering the characteristics of porn revenge that substantive justice is not fulfilled. As part of a full understanding of porn revenge, a Criminological understanding of the Sobural approach is made. Two issues to be studied are (1) what is the significance of using the Sobural approach? And (2) Is revenge porn a decency crime based on the Sobural approach? Empirical juridical research method is used in this study by basing on a primer in the form of legislation supported by criminal law theory related to revenge porn. Exposure from primary data is associated with secondary data in the form of Judge Judgment to see understanding of defeating of revenge porn by a judge. The results of the study show that criminological understanding of porn revenge provides a very significant different approach in criminal law. Revenge porn is judged by the context of the community in which the perpetrators and acts of revenge porn are performed. Sobural (Social, Cultural and Structural) approach affirms contextual assessment of porn revenge based on social values, cultural values and structural factors of society. The approach of these three elements has a close correlation with the moral norms as the measure of defamation of crime of pornography as a decency crime. The integration of the Sobural approach to the understanding of moral norms in assessing porn revenge will provide an opportunity for the enforcement of living laws in society.

This study examines the emotional and mental health effects revenge porn has on female survivors. To date, no other academic studies have exclusively focused on mental health effects in revenge porn cases. In-depth qualitative interviews were conducted between February 2014 and January 2015 with 18 female revenge porn survivors, and inductive analysis revealed participants’ experiences of trust issues, posttraumatic stress disorder (PTSD), anxiety, depression, suicidal thoughts, and several other mental health effects. These findings reveal the seriousness of revenge porn, the devastating impacts it has on survivors’ mental health, and similarities between revenge porn and sexual assault.

Abstract: Revenge porn is the act of distributing pornographic material without the consent of the victim. Based on this, this paper aims to examine victims of revenge porn or revenge pornography by reviewing from the perspective of victimology. This paper is a normative legal research, using statutory, case, and conceptual approaches. The study concluded that victims of pornography often resort to revenge. The occurrence of this victimization process begins with the victim himself. Many lovers initially love each other, but when they break up they hate each other and end up taking revenge by spreading pornographic things when they are still dating. These cases are dominated by women, but some also occur in men. Revenge porn is categorized as sexual violence. Revenge porn is an act that can degrade or insult someone non-physically by showing or spreading something sexually related to the victim in cyberspace or digital world without the consent of the victim. Revenge porn is a criminal offense because it injures the privacy of the victim. In the Criminal Code (KUHP) the protection of victims of revenge pornography is regulated in Article 411, Article 14 of the Sexual Violence Crime Law (TPKS Law). Revenge porn can result in deep trauma for the victim. Therefore, victims must be protected, among others, through restitution, namely the provision of compensation by the perpetrator to the victim concerned. Keywords: Revenge porn, sexual violence, victimization, victimology, law. Abstrak: Revenge porn merupakan tindakan menyebarkan materi pornografi tanpa adanya persetujuan dari pihak korban. Berdasarkan hal tersebut maka tulisan ini bertujuan menelaah korban revenge porn atau pornografi balas dendam dengan meninjau dari perspektif viktimologi. Tulisan ini merupakan penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan, kasus, dan konseptual. Penelitian ini menyimpulkan bahwa korban pornografi sering melakukan balas dendam. Terjadinya proses viktimisasi ini berawal dari korban sendiri. Banyak pasangan kekasih yang awalnya saling mencintai, namun ketika putus keduanya saling membenci dan berakhir balas dendam dengan menyebarkan hal-hal yang berbau pornografi saat mereka masih berpacaran. Kasus ini didominasi oleh perempuan, namun beberapa juga terjadi pada laki-laki. Revenge porn dikategorikan sebagai kekerasan seksual. Revenge porn merupakan suatu perbuatan yang dapat merendahkan ataupun menghina seseorang secara non fisik dengan mempertontonkan atau menyebarkan sesuatu yang bermuatan seksual terkait diri korban di dunia maya atau dunia digital tanpa adanya persetujuan dari si korban. Revenge porn merupakan tindak pidana karena mencederai privasi korban. Dalam Kitab Undang-Undang Hukum Pidana (KUHP) perlindungan terhadap korban pornografi balas dendam diatur pada Pasal 411, Pasal 14 Undang-Undang Tindak Pidana Kekerasan Seksual (UU TPKS). Revenge porn dapat mengakibatkan trauma yang mendalam bagi korban. Karena itu korban harus dilindungi diantaranya melalui restitusi, yakni pemberian ganti rugi oleh pelaku kepada pihak korban yang bersangkutan. The delicate and depressed condition. The impacts also vary, namely psychological, physical, social, and economic impacts. These conditions require individuals to have resilience. This research aimed to discover the conception and resilience’s factors in survivor of revenge porn. Methods The method used is qualitative phenomenology. Determination of research informants was done by using purposive sampling technique. The characteristics of the informants in this research were domiciled in Jambi Province, female, aged 18-32 years, had been a victim of revenge porn, the time interval of the incident and the interview was a maximum of 1 year, and filed a report to the police. Data collection methods used are interview, observation, and documentation techniques. The data analysis used is Interpretative Phenomenological Analysis (IPA). Results The picture of resilience in revenge porn survivors includes emotion regulation, impulse control, cause analysis, empathy, self-efficacy, optimism, reaching out, and avoidance. While the influencing factors include i have, i am, i can, and spirituality. Conclusions All informants in this research showed the characteristics of resilience in revenge porn survivor with various factors. Penelitian ini bertujuan untuk mengetahui gambaran dan faktor-faktor resiliensi pada penyintas revenge porn. Metode Metode yang digunakan adalah kualitatif fenomenologi. Peneliti menggunakan purposive sampling dengan karakteristik berdomisili di Provinsi Jambi, berjenis kelamin perempuan, berusia 18-32 tahun, penyintas revenge porn, kejadian maksimal 1 tahun lalu, serta melapor ke pihak kepolisian. Metode pengumpulan data yang digunakan adalah teknik wawancara, observasi, dan dokumentasi. Analisis data yang digunakan adalah Interpretative Phenomenological Analysis (IPA). Hasil Gambaran resiliensi penyintas revenge porn meliputi regulasi emosi, kontrol impuls, analisis penyebab, empati, efikasi diri, optimis, reaching out, dan penghindaran. Le ricerche hanno messo in evidenza il ruolo giocato in questo contesto dalla Dark Triad, tuttavia, vista la compatibilità dei tratti psicopatici, machiavellici e narcisistici con gli atteggiamenti di deumanizzazione nelle relazioni romantiche abbiamo ritenuto che tali tratti giochino un ruolo importante nella propensione al revenge porn. Obiettivo: abbiamo ipotizzato che la deumanizzazione nelle relazioni romantiche possa essere correlata con i tratti della Dark Triad e con la propensione al revenge porn, e che la deumanizzazione possa essere un fattore di mediazione tra i tratti di personalità della Triade Oscura e la propensione al revenge porn. Metodo: è stato reclutato un campione sessualmente attivo di 213 soggetti, dai 18 ai 66 anni di età (M = 33.08, SD = 9.87). Risultati: I risultati evidenziano una correlazione tra il fattore deumanizzazione con i tratti di personalità della Dark Triad e con la scala del revenge porn proclivity. Il revenge porn proclivity mostra correlazioni con tutte le variabili precedenti tranne che con il tratto di personalità narcisistico. La deumanizzazione si conferma come mediatore tra i tratti della Dark Triad e la propensione al revenge porn.

<p>Artikel ini bertujuan untuk menganalisis faktor-faktor apakah yang menjadi penyebab terjadinya <em>revenge porn</em> dan bagaimanakah upaya perlindungan hukum terhadap perempuan korban <em>renvenge porn</em> dalam perspektif hak asasi manusia. Perkembangan kejahatan dengan pemanfaatan teknologi informasi salah satunya adalah perkembangan <em>cyberporn</em>. Jenis penelitian ini yuridis normatif, dengan data sekunder yang diperoleh dari studi kepustakaan dan studi dokumen yang dikuatkan dengan wawancara dan dianalisis secara kualitatif. Hasilnya bahwa muncul dinamika perkembangan kejahatan berupa <em>revenge porn.</em> <em>Revenge porn</em> atau balas dendam porno adalah “bentuk pemaksaan, ancaman terhadap seseorang, umumnya perempuan, untuk menyebarkan konten porno berupa foto atau video yang pernah dikirimkan kepada pelaku”. Perilaku ini bertujuan untuk mempermalukan, mengucilkan dan menghancurkan hidup korban. Pelaku bisa pacarnya, mantan pacar yang ingin kembali, atau orang yang tidak bisa diidentifikasi. <em>Victim impact statemens</em> dapat menjadi pertimbangan dalam <em>criminal juctice system</em> sebagai upaya untuk memberikan perlindungan terhadap korban <em>revenge porn</em>. Pelaku tidak cukup hanya dipidana penjara tetapi bagaimana upaya pelaku untuk memulihkan kembali korban karena masa depannya sudah hancur akibat penyebaran foto atau video korban yang melanggar nilai kesusilaan dan penyebabkan trauma bagi korban dan berdampak pada depresi yang dialami oleh korban. Korban juga perlu mendapatkan rehabilitasi berupa layanan psikologis, dan rehabilitasi psikososial untuk menghilangkan trauma bagi korban <em>revenge porn</em>.</p><p> </p>

Kekerasan berbasis gender online (KBGO) menjadi perhatian publik terkait jasa barter jual beli foto-foto porno yang viral di Twitter. Layanan ini didistribusikan melalui Google Forms dan group chat, di mana konten yang dibuat adalah revenge porn dan deep fake porn. Fenomena ini menunjukkan bagaimana penggunaan teknologi bisa dijadikan senjata untuk merugikan perempuan secara online. Sepanjang 2012-2021, Komnas Perempuan mencatat 2.247.594 kasus kekerasan terhadap perempuan, termasuk kekerasan seksual di ranah elektronik/online. Kasus kekerasan online berbasis gender meningkat hampir tiga kali lipat selama pandemi COVID-19. Mayoritas korban berusia 15-19 tahun. Film Like and Share yang disutradarai oleh Gina S. Noer ini bercerita tentang kehidupan dua remaja yaitu Lisa dan Sarah. Salah satu tokoh utamanya, yakni Sarah, dihadapkan pada kasus revenge porn. Selain Sarah, ada juga tokoh lain bernama Fita yang mengalami kasus serupa. Dengan menggunakan metode analisis konten secara kualitatif, artikel ini mendeskripsikan bagaimana perempuan sangat rentan menjadi korban kekerasan berbasis gender online dan bagaimana cara memberikan dukungan kepada para korban melalui tindakan, seperti dengan tidak membagikan atau mencari setiap konten dari revenge porn, memblokir dan melaporkan akun yang memposting video/gambar revenge porn, dan bersikap bijaksana terhadap setiap korban yang menghadapi kasus serupa berdasarkan pesan-pesan yang disampaikan dalam film.

Penelitian ini bertujuan untuk menggambarkan salah satu Kasus Kekerasan Berbasis Gender Online (KBGO) yaitu revenge porn dengan melihat 3 aspek. Antara lain bagaimana peranan perempuan sebagai korban dalam terjadinya revenge porn, penyebab kriminalisasi korban dan upaya perlindungan terhadap korban. Pandemi Covid-19 memaksa orang-orang untuk tinggal di dunia maya. Peningkatan jumlah penggunaan teknologi internet tersebut selaras dengan peningkatan kasus Kekerasan Berbasis Gender Online (KBGO). Komnas Perempuan mencatat terdapat 97 kasus kekerasan di dunia maya dimana 33% diantata kategori revenge porn. Metode yang digunakan adalah deskriptif kualitatif dengan teknik pengumpulan data studi dokumentasi. Peneleti menggunakan teori viktimologi dan konstruksi sosial guna mengkaji permasalan yang ada. Ditinjau dari prespektif viktimologi perempuan dalam kasus revenge porn termasuk dalam latent victim. Selain itu tak jarang perempuan dalam kasus revenge porn kerap terkriminalisasi yang disebabkan oleh budaya patriarki yang mengakar kuat dalam masyarakat. Payung hukum yang ada pun juga tak jarang menyebabkan korban terkriminalisasi sehingga dibutuhkan payung hukum baru yang mampu melindungi korban. ===== This study aims to describe one of the cases of online gender based violence (KBGO), namely revenge porn by looking at 3 aspects. Among other things, how is the role of women as victims in the occurrence of revenge porn, the causes of criminalization of victims and efforts to protect victims. The Covid-19 pandemic is forcing people to live in cyberspace. The increase in the use of internet technology is in line with the increase in cases of Online Gender Based Violence (KBGO). Komnas Perempuan noted that there were 97 cases of violence in cyberspace, of which 33% belonged to the revenge porn category. The method used is descriptive qualitative with data collection techniques of documentation studies. The researcher uses the theory of victimology and social construction to examine the existing problems. From the perspective of victimization, women in the case of revenge porn are included in the latent victim. In addition, it is not uncommon for women in revenge porn cases to be criminalized due to the patriarchal culture that is deeply rooted in society. The existing legal regulation also often causes victims to be criminalized so that a new legal regulation is needed that is able to protect victims.

In today's digital era, problems related to cybercrime are increasing, one of which is "Revenge Porn". Revenge porn refers to deliberately distributing pornographic content without the consent of the person seen in the content, often done by ex-spouses as a form of revenge. Due to the easy access and dissemination of information through the internet, revenge porn has become a threat to many individuals, especially women. Victims of this act often face social stigmatization, isolation, and depression. The stigma attached to victims affects their social and work lives, hampering their opportunities in many aspects of life. This research utilizes normative legal methods by adopting statutory, conceptual, comparative, and futuristic approaches. The nature of this research is descriptive-prescriptive. The data that has been collected is analyzed using the content analysis method. This research results in that apart from psychological and social impacts, and revenge porn also has legal implications. Some countries have responded by implementing specific laws to address this issue, but the challenge is distinguishing between the right to freedom of expression and invasion of privacy. Understanding this issue is essential for victims and society to build awareness and prevent the spread of this kind of digital crime. People can protect themselves and others from the dangers of revenge porn with proper understanding and preventive measures.Keywords: Revenge Porn, Digital Crime, Psychological Impact, Social Stigmatization.

Penelitian ini membahas mengenai Tinjauan Yuridis Terhadap Korban Revenge Porn selanjutnya dijabarkan kedalam beberapa sub masalah atau pertanyaan penelitian, yaitu pertama bahwa bagaimana upaya perlindungan hukum terhadap korban revenge porn (pornografi balas dendam) di kota Makassar. Serta apakah faktor yang menyebabkan terjadinya tindak pidana revenge porn (pornografi balas dendam) di kota Makassar. Jenis penelitian yang digunakan yaitu penelitian hukum normatif empiris. Pendekatan yang di gunakan pendekatan perundang-undangan dan pendekatan kasus. Sumber data yang di gunakan data primer dan data sekunder. Metode dalam pengumpulan data yaitu observasi wawancara dan dokumentasi. Metode pengolahan dan analisis data yang di gunakan adalah klasifikasi, processing, editing dan cleaning serta analisis secara pendekatan kualitatif terhadap data sekunder dan data primer. Hasil dari penelitian ini bahwa terdapat upaya-upaya perlindungan hukum terhadap korban revenge porn yaitu upaya preventif (non penal) dan upaya represif (penal). Serta faktor yang yang menyebabkan terjadinya tindak pidana revenge porn yaitu munculnya rasa kecewa ataupun sakit hati dari pelaku mengakibatkan tindakan balas denda. Implikasi penelitian yaitu kekosongan norma hukum atas tindak pidana balas dendam pornografi harus segera dibentuk untuk mengurangi perbuatan di masyarakat, dengan pemilihan dasar hukum yang menjadi dasar hukum perbuatan tindak pidana balas dendam pornografi harus sesuai sehingga pelaku mendapatkan hukuman setimpal.

Revenge porn is a growing problem in current U.S. media culture. According to the Data & Society Institute, one in 10 women under the age of 30 have been victims of or threatened with having their private sexually explicit images shared with the public without their consent. Most of the current research on revenge porn is from a legal perspective, dealing with issues of privacy and copyright. This article uses feminist phenomenology to explore the cultural influences of revenge porn, specifically the prevalence of the male gaze and male voyeurism in mainstream media. Understanding how revenge porn is situated in culture will allow for a better understanding of potential sites of resistance. This article argues for critical pedagogy and media literacy as possible solutions.

Employing both normative and empirical juridical methods, the study draws upon literature review to uncover the psychological and sociological ramifications endured by victims, which often manifest in detrimental physical effects. Despite the absence of comprehensive legal safeguards specifically addressing online-based sexual violence and revenge porn in Indonesia, existing legal provisions, such as those outlined in Law Number 44 of 2008 concerning Pornography and Law Number 19 of 2016 concerning Electronic Information and Transactions, offer a semblance of protection for victims. Abstract‘Revenge porn’ is conceptualised as a modern phenomenon which the law is not equipped to deal with. The advent of smartphone technology has allowed sexually explicit material to be created easily and disseminated quickly. An increasing number of individuals have fallen victim to this phenomenon in recent years. This paper submits that victims of revenge porn ought to be held due monetary redress in the civil law, while acknowledging that the damage done by revenge porn need not necessarily involve a loss. Victims of revenge porn are likely to suffer from severe emotional distress and upset, but these injuries are non-patrimonial. This can consequently make it difficult to frame an action for damages. This paper asks if the delict iniuria might offer appropriate remedy in instances of revenge porn. The actio iniuriarum was, in Roman law, a delict which served to protect the non-patrimonial aspects of a person's existence – ‘who a person is rather than what a person has’. As the propagation of sexually explicit images of an individual without their consent is clearly an affront to the esteem of that individual, it is argued that instances of revenge porn ought to be considered actionable as iniuria in modern Scottish law.

Revenge porn is widespread and experienced by women. As victims, women often receive negative treatment from society or their families. The shame of the victim's family in reporting and the lack of understanding of law enforcement also make it difficult for victims to defend themselves before the law, especially in revenge porn based on consent. The formulation of this research problem is: How does positive law in Indonesia provide legal protection for women as victims of revenge porn? Is revenge porn carried out based on an agreement (based on consent) included in the type of crime of sexual violence? The normative judicial method was carried out based on the findings of secondary and primary data from the team on victims, perpetrators, witnesses, officials of the Women's and/or Children's Protection Service of Malang City/Regency, and experts. Analyzed using qualitative descriptive methods. The purpose of this paper is to explore polarization in the discourse of social media commentators over crimes of Revenge Porn. Revenge porn refers to “the nonconsensual sharing of intimate images” (Bond and Tyrrell 2021, 2166), videos, or other intimate material, which are weaponized against its victims. As with other crimes, revenge porn cases are highly discussed on social media, where users might (a) reproduce prejudice and stigma against victims or, contrarily, (b) resist victim-blaming and shaming ideologies as a form of activism and call for empathy (Garcés-Conejos Blitvich and Bou-Franch 2019; Palomino-Manjón 2022). In light of this, this paper examines the discursive construction of the phenomenon of revenge porn and the evaluations proposed of victims and perpetrators on the social network YouTube with the aim of unveiling conflicting ideologies online. To this end, the present study analyzes a corpus of 14,000 comments (ca. 411,000 words) from four different YouTube videos tackling revenge porn cases. The paper adopts a Corpus-Assisted Discourse Studies (CADS) approach (Partington et al. 2013) and uses Sketch Engine to analyze the corpus. Additionally, a more detailed analysis of evaluative resources and linguistic patterns is carried out. Results show that polarized understandings of revenge porn abound in the corpus. Specifically, victim-blaming ideologies are discursively concealed, whereas traditional ideologies regarding sex are overtly encoded. Moreover, male users affiliate with newer constructions of masculinity and dissociate from the illegal actions attributed to perpetrators. Women/victims are generally derogated for not conforming to societal views of common-sensical sexual behavior or praised for their strength in standing social judgment.

Though revenge porn is a relatively new phenomenon in popular culture, the first instance can be dated back as early as the 1950s. Despite its nearly 70-year existence, very little is known about this crime or how it is expressed in criminal justice legislation. To further examine the former, the present study analyzes the legislation surrounding revenge porn and reflects upon the scant social science research through a content analysis of the nation’s state statutes. Though innovative revenge porn laws were observed, much of this legislation appeared inconsistent with how this crime is perpetrated and is best described as vague and medley. In light of these observations, policy implications and areas of future research are discussed.

Articles 281, 282, 283, 532, and 533 of the Criminal Code prohibit pornography and pornographic acts and provide punishment. The Law Number 19 of 2016 specifically regulates decency in the electronic field, amending the Law Number 11 of 2008 concerning Electronic Information and Transactions. Komnas Perempuan reported an increase in gender-based violence on the internet, specifically revenge porn, with cases increasing from 126 in 2019 to 510 in 2020. Law enforcement efforts against perpetrators of revenge pornographic content on social media include preventive and repressive measures.

Hasil penelitian menunjukan bahwa pada kondisi saat ini, masih belum terdapat payung hukum yang dapat memberikan perlindungan secara khusus terhadap korban <em>r</em><em>evenge porn. </em>Korban kejahatan seksual, termasuk tindakan penyebaran konten pornografi atas dasar balas dendam dalam kasus ini memerlukan perhatian khusus. The results of the study indicate that under current conditions, there is still no legal regulation that can provide special protection for victims of revenge porn. Victims of sexual crimes, including acts of distributing pornographic content on the basis of revenge in this case require special attention.The lack of legal protection for victims and there are several provisions of articles in the Pornography Law and the Information and Electronic Transactions Law which are considered prone to criminalization for victims, resulting in many victims of revenge porn who are reluctant to report their cases. Nonconsensual pornography, commonly known as “revenge porn,” is the dissemination of another’s sexually explicit images or videos without their consent. This article explores this phenomenon in gay and bisexual male online communities. The first part reviews the current sociological and legal literature on online dating, gay culture on the Internet, and revenge porn. Then, based on a survey of gay and bisexual male dating app users, ethnographic interviews, and an analysis of platform content moderation policies, the next part makes three related points. First, it shows that gay and bisexual men who use geosocial dating apps are more frequently victims of revenge porn than both the general population and the broader lesbian, gay, and bisexual community. Second, it shows that geosocial dating apps create powerful norms of disclosure that make sharing personal information all but required. And third, it describes how gay and bisexual male users engage in privacy navigation techniques with the goal of building trust and enhancing safety. The final substantive section then shows how inadequate protections for online privacy and inadequate legal incentives for safe platform design contribute to the problem of revenge porn. The article concludes with a summary and avenues for future research.

Revenge porn is included in cases of sexual violence, where the victims are not only women but also men, can also become victims of the revenge porn act. These actions have been widely carried out to make victims famous by dropping victims psychologically and physically. This phenomenon has finally caused polemics both internally and externally on campus in responding to the challenges of the high number of online gender-based sexual violence cases. The purpose of this study is to examine the social, cultural, legal, and political aspects of the high number of revenge porn cases in universities in Indonesia.

Many states have criminalized “revenge porn,” an increasingly common form of online sexual abuse. Yet, we know little regarding attitudes toward these laws. Through an original survey of nearly 500 U.S. residents, we find widespread public support for criminalization, but support varies by respondent’s self-identified gender and revenge porn type. Women favor criminalization more than men, but support falls among women and men when the subject created the media, colloquially known as “selfies” or “noodz.” Results suggest that women expressing their sexuality are deemed less deserving of protection, reinforcing feminist legal critiques of criminal law as insufficient to prevent sexual abuse.

Revenge porn comes in many forms but most commonly refers to the online posting of sexually explicit photos or videos of past lovers, without their consent, after the relationship has ended. The author explains how the current legal framework has left many victims without legal recourse to punish those who have posted their intimate photos or videos without consent, and few options to have their images removed from the internet once they have been posted. The note argues that in order to protect victims, states should make laws to criminalize the posting of revenge porn and the Communications Decency Act should be amended to give victims the power to have their images removed from websites.

En esta investigación se lleva a cabo un análisis crítico del discurso con perspectiva feminista del caso de la difusión de imágenes manipuladas de la artista española Rosalía. En mayo de 2023 el cantante JC Reyes publicó unas imágenes falsas en su cuenta de Instagram y los medios de comunicación se hicieron eco de ello. El objetivo principal es descubrir si la prensa sitúa el caso estudiado como un acto dentro de la práctica del porno de venganza o si lo clasifican como un hecho aislado. En primer lugar, en el artículo se revisan los deep fakes (imágenes falsificadas), los cuales permiten profundizar en el concepto del revenge porn y su implicación con la inteligencia artificial. En segundo lugar, se presenta el caso analizado y la metodología de análisis del discurso; y en tercer lugar la discusión y principales conclusiones de este trabajo. En el análisis discursivo se puede apreciar que no se relaciona prácticamente el caso analizado con el revenge porn ni con las formas de violencia simbólica, la víctima es presentada como un sujeto activo y se afianza la utilización del cuerpo femenino como una estrategia de marketing al generarse contenidos que sitúan al autor de los hechos en el panorama musical.

This paper describes the suffering experienced by a woman as a double victim of revenge porn. Indeed, revenge porn is a crime in the Pornography Law which has criminal sanctions in accordance with Article 4 paragraph (1) jo. Article 29, with the threat of imprisonment for a minimum of 6 months and a maximum of 12 years and a fine of between 250 million and/or 1 billion. By using an exploratory qualitative approach to the main subject, Bunga (21 years old) is not her real name, as a student at one of the universities in Pekanbaru, this study also uses the Feminism and Victim theory approach as the analytical knife. From the research findings, it can be concluded that the victim experiences multiple and varied sufferings from the revenge porn she experienced. Personally, the victim experienced sexual violence and extortion. In other cases, the legal process as a victim's right which can actually be taken to ensnare the perpetrator is not supported by the family with the aim that the perpetrator and victim can be united in the marriage bond. Meanwhile, socially, the victim gets a negative image and stigma in the form of reproach (cheap and immoral women) from the circle of friends and the environment where the victim lives, regardless of the perpetrator as the main actor in the revenge porn case.

Assim, adota-se como problema de pesquisa como e de que maneira são atingidos os direitos humanos de crianças e adolescentes por meio do revenge porn, bem como de que modo se dá a resposta judicial a tais demandas. Esse questionamento busca ser respondido com auxílio do método indutivo de abordagem, juntamente ao método de procedimento monográfico e da técnica de pesquisa da documentação indireta. Desse modo, conclui-se que direitos humanos de crianças e adolescentes encontram-se atingidos pela conduta do revenge porn, tais como dignidade humana, direitos de personalidade e liberdade. Ademais, por vezes, o revenge porn é auxiliado por outros crimes digitais (sexting e ciberbullying), gerando danos sociais, físicos e psicológicos aos infantes, além de atualmente contar com respostas simplificadas e insuficientes tanto na via jurisdicional quanto política, já que não existe um planejamento para atuações em relação ao tema, tampouco se observa a compreensão de ações que superem as respostas punitivas ou demagógicas.

Among many forms of abuse of privacy in the cyberspace and social media networks, particular attention is given to the so-called cyber misogyny. It refers to the existence of deeply rooted prejudices against women and encompasses various forms of gender- based hatred, harassment and violence against women that occur in a virtual (cyber) space. The subject of this paper is an analysis of emerging forms of cyber misogyny, particularly focusing on one of its most widespread forms: revenge porn. Through revenge porn in the cyberspace, misogyny can be manifested through publishing someone?s intimate photos, that is, photos of their intimate private life or sexually explicit photos and videos. In all these cases, publications in cyberspace or social media occur without the knowledge, willingness or consent of the photographed person. The purpose behind such activity is to shame and/or humiliate the victim by causing her pain and moral suffering for reasons of revenge. The anonymity of the victim is not preserved; on the contrary, her identity and other relevant data are listed in order to identify and make the victim more visible. Therefore, the aim of the paper is to point out to the seriousness of this phenomenon that occurs in the cyberspace, which presents violation of privacy and causes difficult consequences for the victim. Furthermore, the aim is to investigate the possibilities of criminalization and protection of the (mostly female) victims of this criminal act. The main topics analysed in this paper include: a definition of cyber misogyny and revenge porn, an explanation of the most common forms of its manifestation, existing forms of protection, and criminalization of revenge porn worldwide and in the Republic of Serbia.

Peningkatan ini menunjukkan pentingnyadalam menyebarkan informasi yang baik guna meningkatkan kesadaran dan pemahamanmasyarakat, terutama perempuan berusia tahun 18-30. Motion graphic menjadi salah satumedia alternatif yang efektif dalam penyampaian informasi, sehingga penyampaiantentang KGBO dan revenge porn dapat menggunakan motion graphic. Pengembanganmotion graphic menggunakan metode design thinking yang terdiri dari pemahamanmasalah (empathize), pendefinisian masalah (define), ideasi (ideate), pembuatan prototipe(prototype), dan pengujian (test). Motion graphic yang dihasilkan menggunakanpenggayaan sederhana dan feminim, disesuaikan dengan target pengguna utama, yakniperempuan berusia 18-30 tahun. Hasil uji coba menghasilkan 95% responden dapatmemahami isi dan pesan yang disampaikan melalui motion graphic. Hal inimenunjukkan bahwa metode design thinking yang digunakan pada media motion graphicini dapat meningkatkan keterbacaan dan pemahaman target pengguna. Motion graphicyang dihasilkan memiliki daya tarik visual sehingga mampu menarik perhatian targetpengguna dalam penyampaian pesan yang jelas dan efektif. In this article, we discursively analyse a selected range of electronic written texts accompanying explicit images posted by self-identified straight/gay/lesbian (male-to-female, female-to-male, male-to-male, female-to-female postings) on a popular revenge pornography website ‘MyEx.com’. Situating our analysis in debates on gender and sexuality, we examine commonalities and differences in the complex and sometimes contradictory ways in which gender and sexuality are invoked in posters’ accounts of their motivations for revenge pornography.

The analysis was carried out from a victimological perspective by using thelifestyle exposure theory to see if the victim's involvement from the role and lifestyle in supportingthem to be indicated being victims. The conclusion of this research is someone can potentiallybecome a victim of revenge porn in toxic practices because they take advantage of the victim'sweaknesses when the two of them are still in a dating relationship through an indication process. Inaddition, someone has the potential to become a victim of revenge porn practices due to anvariables in terms of the victim's lifestyle such as excessive dating style, lack of self-control, wronguse of social media, inability to refuse in toxic relationship conditions, and the existence of familyrelationships that weak.

The state responded to the issue of violence against women by establishing an independent state agency, namely National Commission on Violence against Women. However, National Commission on Violence against Women faced numerous obstacles in its handling of cases, particularly regarding gender-based violence online, which had become the most discussed topic, and the largest case was revenge porn type in Indonesia. The purpose of this study was to analyze the authority of National Commission on Violence against Women in handling victims of revenge porn in Indonesia from 2020-2021. This study utilized theories of authority, state auxiliary organs, government administration, and revenge porn. The method used in this study was qualitative with a descriptive qualitative approach because the researcher wanted to describe the phenomenon found regarding National Commission on Violence against Women handling of the surge in revenge porn cases. Data collection techniques included observation, interviews, documentation, and a literature review conducted at National Commission on Violence against Women. The results of this study, viewed from the theory of authority, could be reviewed in terms of regulation, management, and supervision, it indicating that National Commission on Violence against Women had implemented its mandate in accordance with applicable Presidential Decrees. However, the process still faced many challenges, such as regulations, budget allocation, and access. National Commission on Violence against Women implemented various programs to address these challenges, including annual reports, publication and documentation, learning forums, monitoring, campaigns, and advocacy, and these programs were carried out by enhancing cooperation among government institutions, NGOs, and the public.

Rozvoj moderních technologií je neodlučitelně spojen s novými způsoby zásahů do práva na soukromí. V uplynulých letech se mnoho lidí osobně setkalo s jedním z nich, fenoménem přezdívaným revenge porn (anebo obecněji nekonsenzuální pornografie). Po internetu byly totiž šířeny jejich intimní anebo sexuální fotografie či videa, která buďto někdo nedovoleně rozšířil, anebo dokonce i pořídil bez jejich vědomí. Od roku 2017 je hrozba v tomto směru ještě o poznání větší, a to z důvodu rozvoje technologie deepfake, která umožňuje takové záznamy dokonce uměle vytvářet. A přestože představuje i jiná rizika, prozatím se rozšířila převážně v oblasti nedovoleně vytvářených sexuálních záznamů. Téměř kdokoliv tak na internetu může v budoucnu najít pornografické video, v němž účinkuje, aniž by jej kdy natočil. Taková skutečnost pochopitelně zaklá- dá znatelný zásah do práva na soukromí. Otázkami ohledně rozvoje porno- grafických deepfakes a souvisejícími právními aspekty se tento článek zabývá.

Abstract Based on US and British regulations in force, this article offers an overview of legislation of two Common Law countries in the area of modern forms of law infringements focusing on the notions of revenge porn and fake porn. The first part contains definitions and descriptions of the terms ‘revenge porn’ and ‘fake porn’, pointing out to the context of the relationship between the dynamic technological development and use of artificial intelligence on the one hand and the regulatory framework failing to meet the current needs on the other. Further, examination is conducted of US and British legislation in force divided into civil and criminal law, indicating legislative gaps as well as the inefficiency of the existing legal solutions and presenting a range of proposals of legislative changes. The considerations have been supplemented with the results of the author’s assessment of sociological and statistical research available in source literature carried thus far in the field in question. The following section is dedicated to a comparative assessment of American and British legal solutions based on selected, critical issues. The final parts of the article serve to postulate systemic changes in legislation and is a proposal to introduce out-of-court dispute settlement methods in legal disputes pertaining to the matters discussed herein, and to frame future research directions.

In addition, information and communication technology which is developing very rapidly also has a negative impact. Among them is the misuse of internet media as a means of revenge porn, which often occurs within the scope of society. The purpose of this research is to find out how the legal efforts taken by a country in providing legal protection to women who are victims of revenge pornography. The approach method used in this study is a descriptive normative juridical approach, using a statutory approach (State Approach). The data collection method used by the author is to use library research collection methods (library research). The data in this paper are sourced from revelation data and secondary data using qualitative analysis. Based on the results of the study, it is known that actions related to revenge porn can be seen from the production of intimate content which is carried out by recording without permission, hacking intimate content, manipulating content regarding resemblance to someone. So it can be concluded that efforts to provide protection to women victims of revenge porn have been regulated in Law no. 19 of 2016 concerning Information and Electronic Transactions, Law no. 44 of 2008 concerning Pornography, but this protection is still considered ineffective and there is not full protection regarding the losses received by the victim.

UGotPosted.com, SnapSext.com, SnapGFs.com, snapchatleaked.com, Huntermoore.tv, etc., are websites where you do not want to find your picture. These websites are nonconsensual pornography websites. If you do unexpectedly find an intimate image of yourself on one of these websites—or any other porn website for that matter— your best legal recourse is through your state’s revenge porn law. However, if your state has yet to enact one, you might have to fight a legal battle in a notoriously grey area of the law. Pennsylvania recently enacted a revenge porn statute in 2014. But, prior to the adoption of 18 Pa. Cons. Stat. § 3131, entitled “Unlawful Dissemination of Intimate Image,” Pennsylvania residents had to navigate through the grey area of legal recourse, such as arguing one’s case under Pennsylvania’s Invasion of Privacy statute. This new area of sexual harassment through high-tech means proved to be growing and could no longer be ignored by state legislatures.

The paper discusses the problem of forensic analysis of pornographic information in revenge porn situation (non-consensual public placement of materials of sexual explicit content). The paper presents a list of social practices related to revenge porn, specifies the participants of the communicative act (actor, addressee- person caught on camara, addressee-reference group, addressee-third-party participant), determines the intentional component of the actor's communicative activity, gives a list of the actor's communicative goals in conditions of multiple addressee-targeting . The features of the recontextualization of pornographic material are revealed. A weak dependence of pornographic discourse on extralinguistic background is established. It is noted that in the situation of revenge porn sexual explicit information is subjected to recontextualization, which makes it difficult to establish linguistic (semiotic) signs of pornographic information in forensic analysis. It is established that under the conditions of the transfer of a sexual explicit text into a conflict-triggering context, pornographic meanings are preserved. At the same time, the actualization of the taboo aspect of sexual interaction underlies the transformation of the emotive potential and determines the nature of the relationship between the participants in the communicative situation. The authors conclude that in order to establish the linguistic features of sexual explicit information, it is necessary to decontextualize the text submitted for forensic research. Analysis of the distribution context is necessary to establish the extralinguistic background of the actor's communication activity.
