During the 2018 revision of the Criminal Procedure Law, China introduced the trial in absentia procedure into its criminal justice system. Concurrently, the concept of the “right to dissent”, outlined in Article 295 of the revised Criminal Procedure Law, was enshrined. This right stands as a pivotal component of defendants’ recourse within Chinese criminal trial in absentia scenarios, serving as an indispensable safeguard for defendants’ litigation rights. However, the current legal stipulations concerning the right to dissent are notably concise. The exercise of this right by defendants neith

This article argues that the American judiciary should recognize a constitutional right of access to government information, or more forcefully a “right to know”, for purposes of achieving the self-government that was envisioned by the Founding Fathers. This in turn will subject political leaders to the “consent of the governed” that was also envisioned by the nation’s early theorists. While no such right is stated explicitly in the Constitution, a right to know is implied by Congressional investigative responsibilities that are delineated in the Constitution, particularly in Article II; the i

The paper observed that that African leaders practice autocracy in the guise of democracy and when faced with organized dissent which is the pillar upon which democracy is built, they routinely employ various kinds of coercive force in the hopes of subduing these challenges rather dialoguin

This thesis develops the literature on the role of human rights in the Cold War by highlighting the impact of British human rights organisations in the response to Soviet dissent. It argues that human rights groups played an essential role in compiling and distributing information on Soviet dissenters to all levels of British society. These groups all held empiricism at the centre of their campaigns, utilising an array of information to support their activism. This approach entailed the development of relationships between groups, which led to a network of activists, all working towards suppor

Committing to human rights treaties is considered in this environment, where treaty commitments are conceptualized as a policy concession that leaders can grant dissenters. Why do women protest? Why do women protest “as women”? Why do some women participate in protests but not others? In the wake of the Women’s March of 2017, perhaps the largest single day protest event in history, these questions are particularly timely and deserve scholarly attention. One important but understudied and undertheorized motivation for women’s protests is state sanctioned violence, particularly repression.
