Abstract:
Serbian law from the early 13th century developed under the direct influence of Byzantine law. Serbian jurists adopted Byzantine law through translations of Byzantine legal compilations. The first such translation was the Nomokanon of St. Sabba of 1219. St. Sabba’s Nomokanon contained ecclesiastical rules together with the canonist’s glosses, a translation of part of Justinian’s Novels, and the whole of the Procheiron of Basil I. Between 1349 and 1354, Serbian lawyers created a special Codex Tripartitus, codifying both Serbian and Byzantine law. The Russian scholar T. Florinsky noticed this as

In this paper the author is exposing definitions of marriage that were accepted in Byzantium and mediaeval Serbia, although it was not insisted in them on wedding as a religious rite. Leo VI, at the end of the 9th century, was the first to prescribe Church benediction as an obligatory form of entering into marriage. In antiquity, Roman law was a case-law system built up gradually through the creation and elaboration of specific remedies for particular fact-situations. The 6th century Byzantine emperor Justinian converted it into a collection of authoritative texts. They were rediscovered in the 12th century at Bologna and, since they provided arguments relevant to most problems of law and government, were studied in all European universities. Adapted by commentators, Roman law became a ius commune, which was ‘received’ to a greater or lesser degree into the national laws of modern European states.

The term consumpta pecunia, money used, in D. 12,1 is interpreted differently in the legal tradition of East and West, when it came to explain why a condictio was granted to recover money, lent by an unauthorised person. In Roman and Byzantine legal literature there has been much debate about the payment (merces/μισθός) claimed by the mandatory in D. 17,1,26,8 (B. 14,1,26,8). The reason was the requirement of gratuitousness of mandatum, which made that this case should in principle be classified as a locatio conductio/μίσθωσις. To explain the presence of merces in Roman law literature several suggestions were made: interpolation, remuneration, the existence of two contracts or a pactum adiectum. Although the textbooks of Stoic philosophers did not survive from the period of independence of the Serbian mediaeval State (from the 12th to the 15th century), some Stoic ideas emerged in Serbia through the texts of Roman lawyers, who in the period of the Principate wrote under the great influence of Stoic philosophy.
