Abstract:
Esta tesis, enmarcada en los estudios de interdependencia desarrollados por el grupo CEIPAC, analiza los epígrafes anfóricos disponibles (éditos e inéditos) en el territorio de la antigua provincia romana de Raetia con una cronología de época altoimperial (I a. C.-III d. C.), en tanto que fuente primordial para el estudio de la economía antigua. Se hace especial hincapié en los sellos de proveniencia bética, pues son los que tienen mayor presencia. A partir de su análisis se llega a conclusiones de las rutas que se usaron para su transporte, se establece una comparación con los materiales de otros lugares y se teoriza sobre la estructura administrativa encargada del abastecimiento de la población, en especial la militar, que habita el limes rético.
This thesis, framed in the interdependence studies carried out by the CEIPAC group, analyses the amphoric epigraphs available (published and unpublished) in the territory of the ancient Roman province of Raetia with a chronology from the high imperial period (I B. C. -III A. D.), as a primordial source for the study of ancient economy. Special emphasis is placed on the seals of Betic origin, as they are the ones with the greatest presence. Based on its analysis, conclusions are drawn from the routes used for its transport, a comparison is made with materials from other places and theorised on the administrative structure in charge of supplying the population, especially the military, which inhabits the Rhaetic limes.

Iudicet iudicarive iubeat. Reflexões sobre os origens do processo civil romano e as causas da bipartição. Depois da introdução, o segundo capítulo analisa os aspectos da história constitucional da Monarquia e início da República, sobretudo as críticas à historiografia tradicional no tocante à passagem de um regime ao outro, além de estudar a religião romana arcaica. O terceiro capítulo busca elementos da administração da justiça no direito comparado (babilônico, gregos e germânicos), enquanto que o quarto analisa o início do processo criminal romano. O quinto capítulo, por sua vez, investiga as várias teorias acerca do início do processo civil, como da arbitragem, defesa privada, Volksjustiz etc. O sexto capítulo trata das várias teorias da bipartição, procurando estabelecer se teve caráter originário no processo civil romano e suas causas. O sétimo capítulo analisa as legis actiones mais antigas (legis actio sacramento, legis actio per manus iniectionem e legis actio per iudicis arbitrive postulationem). O oitavo capítulo tenta verificar o conteúdo da iurisdictio romana e suas relações com o imperium, enquanto que o capítulo nono trata das figuras do iudex e do arbiter. O décimo capítulo apresenta as críticas às teorias expostas, formulando hipótese acerca do surgimento do processo civil romano por meio de resolução das controvérsias no âmbito da comunidade anteriormente à formação da civitas com base em cultura e religião comuns, razão por que a presente tese propõe a adoção do termo justiça comunitária pré-cívica para qualificar esse sistema, propugnando pelo abandono das expressões autotutela/justiça privada e Volksjustiz por serem ambas portadoras de equívocos. No tocante à bipartição, a presente tese considera verossímil sua consolidação na época da Lei das XII Tábuas em razão sobretudo do fenômeno da dessacralização do processo
Iudicet iudicarive iubeat. Remarks on the origins of the Roman civil procedure and the causes of its dual mode. After the introduction, the second chapter analyses some aspects of constitucional history of Monarchy and the beginning of Republic, mainly the critics against the tradicional historiography concerning the transition from the first to the latter and it also studies the ancient Roman religion. The third chapter seeks elements from the administration of justice in comparative law (Babylonic, Greeks and Germanics), while the forth one analyses the beginning of the criminal persecution in Rome. The fifth chapter investigates the theories about the beginning of civil litigation, such as arbitration, self help, Volksjustiz etc. The sixth chapter deals with the dual mode procedure theories, trying to set if is had an original character and its causes. The seventh chapter analyses the most ancient legis actiones (legis actio sacramento, legis actio per manus iniectionem e legis actio per iudicis arbitrive postulationem). The eighth chapter tries to verify the content of the Roman iurisdictio and its relationships with imperium, while the nineth chapter deals with the figures of iudex and arbiter. The last chapter presents the critics to the analysed theories and formulates a hypothesis about the beginning ot the Roman civil procedure through the disputes settlement inside the community before the creation of civitas basing on common culture and religion. Thus, the thesis proposes the adoption of the term justiça comunitária pré-cívica (precivic community justice) in order to qualify this system, refusing the expressions self help, private justice and Volksjustiz, who are dubious. Regarding the dual mode, the thesis sustains it is plausible that it had already benn consolidated by the time of the Twelve Tables Law according mainly to the dessacralization of process.

Le règne de Manuel Ier, est décrit à partir du respect du principe de la pietas. Le terme a une teneur morale canoniste et juridique qui concerne la capacité du Basileus de légiférer de façon juste en faveur des intérêts de l’État, en respectant toujours le Droit sacré. L’œuvre législative de Manuel Ier que les commentaires des juristes byzantins de l’époque tendaient vers une interprétation moderne de dispositions fondamentales du droit romain.L’objectif principal du programme a été de raffermir l’image sacerdotale du Basileus, qui avait été sécularisée durant la crise politique du XIe siècle. Le rapprochement de l’État et de l’Église sous Manuel Ier a été le fruit d’un réalisme politique, étant donné que l’Église était reconnue, premièrement comme un réservoir idéologique pour l’Empereur, deuxièmement comme un facteur de légitimité et troisièmement comme un facteur de cohésion sociale. Sur le plan du Droit, l’attachement de Manuel Ier aux lois civiles et la nécessité de leur application rigoureuse étaient liés à sa conception selon laquelle la civilisation juridique était en accord avec la supériorité du système d’État byzantin qui, dans le fond, exprimait l’ordre divin et la volonté de Dieu lui-même. Par conséquent, la soumission de la Basileia à la loi impliquait la soumission aux commandements de Dieu.L’incorporation et la soumission du droit canonique au droit public signifiaient la nécessité de dépasser le dualisme étatique entre Imperium et Sacerdotium, au profit d’un ordre juridique aux caractéristiques intrinsèquement suprématistes. L’intégration organique de l’Église dans ce programme valorisait de façon décisive ses responsabilités spirituelles vis-à-vis d’un Empereur qui concevait la gouvernance comme une responsabilité avant tout spirituelle. De même, la distinction entre canons et lois et la systématisation de l’étude de droit canonique témoignent de la nécessité pratique de l’existence d’un code de Droit unitaire, où non seulement la loi de l’État serait présentée alignée sur les besoins modernes de l’État, mais où le droit canonique contribuerait aussi aux besoins spirituels de la société
Manuel’s I Comnenus reign is characterized from the respect to the principle of pietas. This notion has a moral and juridical content which determines the capacity of Basileus to act according to the State’s interests, respecting – in the same time – the Divine law. The legislative corpus of Manuel I is a manifestation of a tendency to a modern interpretation on fundamental principles of classic Roman law. This objective target of this program was to reconstruct the sacerdotal image of Basileus which has been secularized during the political crises of XI century. The rapprochement between the State and the Church was a fruit of political realism: i. The Church was recognized as an ideological tank for the Emperor, ii. as a factor of political legitimacy and iii. as a factor for the construction of the social cohesion. The attachment of Manuel I to the Civil Law and the necessity of his application was synonymous to his conception according to which the juridical civilization was the manifestation of the Byzantine State’s superiority, which fundamentally describe the divine order and the God’s will. This means that the submission of Basileia to the Civil Law was describing her submission to the God’s commandments. The incorporation and the submission of the Canon Law to the Civil Law describes the necessity for the overpassing the political dualism between Imperium and Sacerdotium in the horizon of a juridical order with supremacist characteristics. The integration of the Church in the Comneno’s political program was valuing decisively her spiritual responsibilities vis – a – vis an Emperor who understood his governance as a spiritual act. In the same way, the distinction between canons and laws and the systematization of the Canon Law studies saws the practical necessity of the existence of a unique code of Civil Law, which could express the modern needs of the State and in the same time could contribute to the spiritual needs of society

Abstract:
This thesis is a contribution towards legal history of Roman Asia Minor from the creation of the province of Asia to the enfranchisement of the free population of the Empire by the emperor Caracalla. Chapter I is concerned with the Hellenistic background and with the theoretical framework for explaining the relationship between the suzerain and the cities in the Hellenistic and Roman periods. The possibility of using Bickerman’s ‘surrender and grant’ model for introducing much needed nuance into usual dichotomy of ‘free’ and ‘subject’ cities is argued for. Chapter II deals with the court of the Roman governor. It is argued that there was no limit set on govenor’s jurisdiction from below and that the main way in which governor’s burden was relieved or legal autonomy of local communities guaranteed was through delegation of decision at the apud iudicem stage of the proceeedings. An in-depth study of the procedure is provided. Chapter III provides an analysis of the assize circuit system, above all in the province of Asia. Arguments for continuity with the pre-Roman administrative structure are advanced and a new hypothesis of significant structural changes in the second century A.D. advanced. Chapter IV explores the jurisdiction of other Roman officials: proconsular legates, quaestors, and above all procurators and other imperial officials. The division of responsibility with the governor’s court and their role in covering the areas not usually penetrated by the governor’s jurisdiction is discussed. Chapter V deals with judicial autonomy of the ‘free’ and ‘federate’ cities. It is argued that the extent of these privileges was widely variant and the possibility that some of them applied only to the apud iudicem stage explored. Chapter VI is concerned with courts of the ‘subject’ communities. It is suggested on the basis of recently published evidence that ‘subject’ communities could retain a high degree of judicial autonomy. Different models used by the Romans are explored and compared. Chapter VII explores a vexed question of internal jurisdiction of Jewish diaspora communities in Asia Minor. The validity of Flavius Josephus' evidence is upheld and the role of 'ancestral laws' ideology in Roman interventions in support of Jewish courts discussed. Two appendices discuss a recently published inscription from Chersonesus Taurica and offer an annotated list of passages in the Corpus iuris civilis dealing with Asia Minor in our period respectively.

Ao longo de seu texto, o Código Civil de 2002 não traz o vocábulo comissório ou quaisquer de suas possíveis flexões gramaticais. Na doutrina e jurisprudência pátrias, entretanto, ele é aplicado exaustivamente quanto à proibição prevista nos artigos 1.428 e 1.365 do mencionado diploma legal. Grosso modo, tem-se em tais dispositivos a impossibilidade de que, após verificado o inadimplemento da obrigação principal, possa o credor insatisfeito conservar para si, na condição de proprietário, a coisa entregue em garantia. Ainda que reproduzida em diversos códigos modernos, especialmente naqueles de tradição romano-germânica, essa vedação ao chamado pacto comissório é um tema pouquíssimo estudado. A necessidade de uma maior reflexão sobre seu conteúdo, no entanto, é cada vez mais evidente. Isso porque, como demonstram pesquisas recentes no âmbito da literatura comparística, há indícios de que a regra tem por base fundamentos que não mais se justificariam. A esse propósito, vale salientar, o estudo do direito romano é fundamental. Afinal, nele a lex commissoria foi criada e por séculos teve aplicação no âmbito dos direitos reais de garantia, até ter sido proibida pelo Imperador Constantino (C. Th. 3, 2, 1; C. 8, 34, 3), no século III. O presente trabalho, portanto, tem por objetivo central a reconstrução e análise do instituto antigo, para que então com mais segurança seja possível delimitar, em que medida, pôde a lex commissoria romana influenciar a proibição do pacto comissório nos atuais ordenamentos jurídicos, em especial, o brasileiro. Para tanto, deve-se notar, em um primeiro momento, que separar a lex commissoria objeto da mencionada decisão da mais consagrada lex comissória no âmbito da compra e venda, recepcionada no livro 18 do Digesto e ainda largamente aceita nos sistemas modernos, não é tarefa das mais fáceis. Tendo a proibição sido anterior à compilação do Corpus Iuris e, igualmente, tendo a própria fiducia cum creditore sido extinta por volta do século II, escassos são os testemunhos nas fontes que chegaram até os nossos dias.
Throughout its text, Brazilian Civil Code of 2002 does not have the word \"comissório\" or any of its possible grammatical inflections. In Brazilian doctrine and jurisprudence, however, it is applied thoroughly as the prohibition laid down in Articles 1,428 and 1,365 of that statute. Roughly speaking, we have in such provisions the impossibility that, upon inspection of the default of the principal obligation, unsatisfied creditors could keep for themselves the thing given as a real security (pledge), provided being the owner. Although reproduced in many modern codes, especially those of Roman-Germanic tradition, the prohibition of the so called pacto comissório is a topic rarely researched. The need for further reflection on its contents, however, is increasingly evident. This is because, as recent research into comparative literature shows, there is evidence that this rule is based on essentials that would no longer be justified. In that regard, it is worth mentioning, the study of Roman law is fundamental. After all, in it the lex commissoria was created and for centuries it had been applied under the provision of security until it was banned by Emperor Constantine (C. Th. 3, 2, 1; C. 8, 34, 3) in the 3rd century A.D. The present study, therefore, has as its central objective the reconstruction and the analysis of that ancient institute, so that more safely it will be possible to delimit to what extent could the Roman lex commissoria influence the pacto comissório in current legal systems, in particular the Brazilian one. Therefore, it should be noted at first that to separate the lex commissoria, object of the aforementioned ban, from the established lex commissoria under purchase and sale, as disposed in Book 18 of the Digesta and still widely accepted in modern systems, it is not an easy task. Since the prohibition was prior to the compiling of the Corpus Iuris and also having the fiducia cum creditore been extinct sometime around the 2nd Century, testimonies in sources that have come down to our day are scarce.

Abstract:
In times at which economic logic and a one-dimensional discourse of science silence alternative ways of thinking in our societies, this paper invites us to understand the law from a largely unexplored dimension: the dimension that institutes life, binding the social, the biological and the unconscious in a space that reproduces the logic of Interdiction. To achieve this goal, this paper begins by exploring the obstacles that make jurists unable to conceive a link between their discipline and psychoanalysis, as well as incapable of opening the law to its analysis. Among these, we encounter conceiving the legal system as the discourse of Reason in the West, construction which will remain an obstacle to the convergence between law and psychoanalysis unless we understand that the origin of this conception lies in the choice of Roman Canon law as its historical representation. Then, it reviews the notion of society, approaching it as a theatrical construction set by discursive practices, allowing the recovery of genealogical knowledge of the reference and to this end, builds on the knowledge of Roman law. Hand-in-hand with a psychoanalytic approach, it points out how a vast social system of interpretations places the law within the transmission of the Interdiction for the subject, transmission which introduces him to the institutional dimension of the limit. We also approach the unconscious aspects of the representation of the subject, by putting a transsexualism case law under the light of its notion of symbolic determinism. Finally, it reflects on the power of the State to divide words and things, that is, the Third separator, category necessary for the operation of law. Consequently, this paper allows law to be seen as refering to the order of life and also calls upon psychoanalysis to deepen the institutional dimension.
En tiempos en que la lógica económica y un discurso unidimensional de la ciencia silencian formas alternativas de pensamiento en nuestras sociedades, este trabajo nos invita a comprender el derecho desde una dimensión poco explorada: aquella dimensión que instituye la vida, que anuda lo social, lo biológico y lo inconsciente en un espacio que reproduce la lógica de la Interdicción. A este lugar se le llama el núcleo atómico del derecho. Para lograr este objetivo, el trabajo inicia explorando los obstáculos que hacen que los juristas sean incapaces de concebir un vínculo entre su disciplina y el psicoanálisis, y de abrir el derecho a su análisis. Entre estos encontramos concebir al sistema jurídico como el discurso de la Razón en Occidente, construcción que seguirá siendo un obstáculo para la convergencia entre el derecho y el psicoanálisis a no ser que entendamos que el origen de esta concepción yace en la elección del derecho romano-canónico como su representación histórica. Luego, revisa la noción misma de sociedad, planteándola como una construcción teatral establecida por prácticas discursivas, lo que permite recuperar el saber genealógico de la Referencia y, para ello, toma como base el conocimiento del derecho romano. De la mano con un enfoque psicoanalítico, señala cómo un vasto sistema social de interpretaciones ubica al derecho dentro de la transmisión de la Interdicción al sujeto, transmisión que lo introduce a la dimensión institucional del límite. Nos acerca también a los aspectos inconscientes de la representación del sujeto, poniendo un caso jurisprudencial sobre transexualismo a la luz de su noción de determinismo simbólico. Por último, reflexiona sobre el poder del Estado de dividir las palabras y las cosas, esto es, el Tercero separador, categoría necesaria para el funcionamiento del derecho. Con ello, el artículo permite ver el derecho como referido al orden de la vida y, además, exhorta al psicoanálisis a profundizar en la dimensión de la institucionalidad.

This thesis seeks to demonstrate how, in the Principate (High Roman Empire - the classic period from 27 BC to 284 AD), Stoic philosophy, absorbed by the sovereign of Rome, influenced the Roman law. As a guiding principle, we use the work of the jurist Ulpian in particular its Liber Singularis Regularum and the Title I of Book I from the Digesta of the Justinian I the Great, emperor of Easten Roman Empire. The history of the Principate is presented, preceded by the reasons that led to the end of the Republic, and gave rise this kind of Roman monarchy. After the presention of the history of the period, there is an explanation of Stoic thought, with emphasis on the last phase of this ancient school of philosophy, precisely the one that coincides with the Principate, and represents the pinnacle of Latin philosophical thought. Once the history of the period is presented together with the history of philosophy, then it is shown how classical Roman law absorbed these ideas that were found in legal texts of the jurist Ulpian. Completing the thesis, there is an explanation on how Ulpian s philosophy of justice was transmitted by means of the consolidation of Emperor Justinian "Corpus Juris Civilis" , thereby contributing to the formation of the Western civilization and, consequently, becoming the basis of Brazilian law
A presente tese busca demonstrar de que modo, durante o Principado (Alto- Império Romano - período clássico de 27 a.C. até 284 d.C), a filosofia estóica, absorvida pelos soberanos de Roma, influenciou o Direito Romano. Como fio condutor do trabalho usa-se a obra do jurisconsulto Ulpiano, em particular o título I do livro I do Digesto (do Imperador Justiniano I o Grande, Imperador Romano do Oriente) e seu livro de Regras . Faz-se um relato da história do Principado, antecedido dos motivos que culminaram com o fim da República e ensejaram esse gênero de monarquia romana. À história do período segue-se uma explanação do pensamento estóico com ênfase na última fase antiga de tal escola filosófica, justamente aquela que coincide com o Principado e representa o auge do pensamento filosófico latino. Posta a história do período, e, sobreposta a história da filosofia de então, procura-se demonstrar como o direito romano clássico absorveu tais ideais que são encontrados nos textos legais do jurisconsulto Ulpiano. Por fim, segue uma explanação de como a jus filosofia de Ulpiano foi transmitida graças à consolidação justinianeia do Corpus Juris Civilis e desse modo contribuindo com a formação da civilização ocidental e consequentemente tornando-se a base do Direito brasileiro

Les romans classiques lao sont, pour la plupart, des versifications de contes epiques. Ils sont principalement destines a etre lus devant un auditoire, lors des veillees. Il en existe plus d'une centaine de titres sous forme de manuscrits et beaucoup de ces manuscrits, consistant en feuilles de latanier gravees en caracteres lao anciens, ont ete edites sous forme de brochures imprimees en caracteres lao modernes, depuis 1957, surtout par le comite litteraire, l'academie royale et la bibliotheque nationale lao. L'etude des sources montre que ces romans s'inspirent de la litterature indienne, de la litterature yuan, de la litterature du vieux fonds indochinois, de la litterature siamoise et du pannasajataka, un recueil de jataka apocryphes d'origine mone. Les romans purement lao et ayant un caractere original sont des romans historiques. Bien qu'appartenant a la litterature laique, ou domine d'ailleurs le merveilleux, les romans lao sont fortement impregnes par les enseignements bouddhiques et les themes developpes tournent autour du dharma et du karma. Il s'agit, en fait, d'un bouddhisme populaire qui ne cherche qu'a inculquer les preceptes de base a la grande masse des habitants. Depuis 1975, date de l'instauration de la republique democratique et populaire lao, les romans les plus connus et les plus apprecies font l'objet de recuperation de la part des nouvelles autorites pour illustrer leurs themes politiques, comme ils le furent jadis par les moines pour repandre l'enseignement bouddhique
The most of lao classic tales are the epic poems. They are principally intended to be read in front of the public, in the evenings. There are more than one hundred stories in palmleaves manuscript forms which are engraved with the old lao characters. Some of these manuscripts have been printed in modern lao characters since1957, especially by the literary committee, the royal academy and the lao national library. The study of these origin tales shows that they were inspired by the indian literature, the yuan literature, the old indochinese fund literary, the siamese literature and the pannasajataka, the collection of apocryphal jataka coming from the mon civilization. The lao classic purely tales which have the original characters, are the historic stories. Although these tales belonged to the laic literature in which "the marvellous" dominated, they are impregnated by the buddhist teaching and the developped topics turned around the dharma and the karma. It concerns, in fact, that the popular buddhism finds to inculcate the basic precepts for the large population. Since 1975, date of the lao people's democratic republic instauration, the most well know tales are recuperated by new government to illustrate the political topics, as the classic tales were widespread for the buddhist teaching by the monks in the past

Thanks to Severan jurists’ testimonies collected in the Digest, we know that the appeal eligibility was conditioned by the «a quo» judge’s analysis of the respect of the prescribed terms and formalities and the nature of the contested measure. Against the possible refusal of the first instance judge, the parties were given the opportunity to take their case to the «ad quem» judge, who could confirm the decision and give way to the implementation of the judgment, or accept the part’s motion and proceed to the examination of the merits of the case. The Draft of the Model Civil Procedure Code for Ibero-America (texto del anteproyecto del Código Procesal Civil Modelo para Iberoamérica) follows, on the subject of appeal, Roman discipline faithfully, as regards both the «a quo» judge’s role and the possibility of contesting the latter’s decision before the «ad quem» judge through the complaint (recurso de queja). The strong Roman stamp also arises, similarly, in Peru’s Civil Procedure Code, where the right to a second court has a very incisive constitutional backing. The traditional problem to keep the justice process within reasonable time limits is closely connected with the appeal eligibility. The solution adopted by Roman Law —to take financial penalties to discourage daring appeals, filtering thus the merely delaying appeals— could represent an interesting indication for legislators, who are still grappling with the need to ensure the right, on the one hand, to appeal and to efficiency regarding the administration of justice on the other hand.
Gracias a los testimonios de los juristas de la época Severa, recogidos en el Digesto, sabemos que la admisibilidad de la apelación estaba condicionada a una revisión efectuada por el juez a quo, por lo que concernía al respeto de los plazos y de las formalidades prescritos y a la naturaleza de la resolución impugnada. Contra la eventual denegación del juez de primera instancia, las partes tenían la facultad de dirigirse al juez ad quem, quien podía confirmar la decisión y, por consiguiente, dar curso a la ejecución de la sentencia, o bien estimar el recurso de parte y proceder al examen de fondo de la cuestión. El texto del anteproyecto del Código Procesal Civil Modelo para Iberoamérica sigue la línea, en tema de apelación, de la disciplina romanística, tanto en lo que concierne al papel del juez a quo, como en lo que se refiere a la posibilidad de impugnar la decisión de este último ante el juez ad quem por medio del recurso de queja. Análogamente, la fuerte matriz romana emerge también en el Código Procesal Civil de Perú, país donde, por otra parte, el derecho al doble grado de jurisdicción hace alarde de una cobertura constitucional muy penetrante. Tradicionalmente, el problema de contener los tiempos de la justicia dentro de plazos aceptables se presenta estrictamente relacionado con el tema de la admisibilidad de la apelación. La solución adoptada por el derecho romano recurrir a medidas sancionatorias de naturaleza pecuniaria para desincentivar la interposición de apelaciones temerarias, de manera que se filtren las impugnaciones meramente dilatorias— podría representar un punto de partida interesante y una útil sugerencia para los legisladores, que también hoy en día se enfrentan a la necesidad de garantizar el derecho, por un lado a apelar y, por otro, a una administración eficiente de la justicia.

Determining the identity of the ‘I' who is speaking in Rom 7:7-25 and the nature of the problem being addressed has long been recognised to be one of the unsolved riddles in Paul's letters. This thesis articulates and defends the new view that the speaker in Rom 7 is a believer who has fallen prey to the deceptive teaching of Paul's opponents regarding the Law. In short, the problem of Rom 7:7-25 is the Law of Paul's opponents. The thesis principally establishes this identification of the Law and the speaker of Rom 7 through a close exegetical study of the event described in verses 8c to 10a, and then considers its consistent application to the argument throughout verses 7-25 and in Rom 8:2. Two central elements in the description of the event have been bypassed in the commentary tradition: the meaning of χωρίς νóμον in 7:8-9 and the referent and significance of áναζάωά in 7:9. Yet, taken together and interpreted in accordance with the lexica, they clearly identify the ‘I' of Rom 7 as a believer. Only of a believer can it be said that the one who used to live independently of the Law (χωρίς νóμον) is the one for whom sin should be reckoned as dead. In the same way, only of a believer can it be subsequently true that when the commandment came into his life, sin was resurrected (áναζάωά). Moreover, it will be argued that verses 10-11 establish a context of false teaching for the coming of the commandment, and therefore that the event is the arrival of deceptive false teaching regarding the Law as propagated by Paul's opponents. The thesis then considers the implications of this identification of the Law in the life of the believer in verses 8-10 for interpreting verses 7-11, where a state of sin-entwined Law is described; verses 21-25, where the two Laws are presented (Paul's and his opponents'); and Rom 8:2, where the believer is declared to be freed from ὀ νóμος τῆς άμαρτίας καί τοṽ θανάτον. As the solution to the problem of Rom 7, it is Paul's own hermeneutic of the Law that frees the believer form that of his opponents.

Abstract:
This thesis uses the language of adultery to examine the relationship between law and society in ancient Rome. In particular, questions will be asked about the ways in which this exchange functioned – do social norms determine law or vice versa? To begin, the lex Iulia de adulteriis coercendis will be contextualised within Augustus’ wider programme of moral reform, and definitions will be given for adulterium and stuprum, the terms which the law used to classify the actions it penalised. The thesis will use these two terms as a lens through which to investigate changes in attitudes to adultery following the introduction of the lex Iulia. A survey of the use of adulterium and stuprum, including their derivatives and the borrowed Greek form moechus, will be made within Latin literature from the 2nd century BC until the 2nd century AD. It will be argued that changes in the use and meaning of the terms following the introduction of the lex Iulia are indicative of changes in attitudes to adultery within the Roman male elite. This in turn will show that law can and does impact on society and it can be used as a positive force to change society’s conception of a given behaviour. Chapter two looks closely at the punishment of adultery in the republic in order to provide a framework through which to understand the lex Iulia as an innovative piece of legislation. The provisions of the law will then be recreated using the juristic texts of the sixth century legal compilations and the chapter will conclude by looking at the attempts to revive the lex Iulia by later emperors and the changes that were made to the law. The focus of chapters three and four is the use of the terms adulterium and stuprum in prose and verse literature. A selection of authors has been chosen to provide a sample that covers the chronological period in question and to include a wide range of genres. It will be shown that in the republic stuprum was the more frequent term as it could be used to refer to sexual transgression in general, including adultery. However, following the introduction of the adultery law, adulterium is found with much greater frequency and its use reflects the new legal definition of adultery and the need to qualify accusations in terms of the law. Moreover, whereas previously stuprum had been conceived of as the more damaging and disgraceful concept, adulterium became to be of greater concern. The legal significance which the lex Iulia gave to adultery and the terms used to describe it are also evident. Overall, it is the aim of this thesis to show how the introduction of the lex Iulia de adulteriis coercendis shaped and altered attitudes to adultery within Roman society. Nevertheless, the validity of using law to control morality continued to be questioned by some of the authors studied and there were negative effects on ideas of marital fidelity and sexual morality as a result of the law.

Néanmoins, le"vir bonus" n’est pas seulement un idéal éthique, mais il est un critère herméneutique qui permet d’interpréter et de compléter des actes juridiques. C’est dans ce sens technique que les jurisconsultes y ont recours, au moins dès le IIe siècle av. J.-C.Le vir bonus doit être encadré dans le phénomène plus large de l’arbitrage à Rome et il doit être distinct de l’"arbiter ex compromisso". Il est surtout employé dans le domaine du droit des obligations et du droit des successions. Il est donc utilisé pour les actes juridiques bilatéraux et unilatéraux. Parfois le renvoi à l’homme de bien implique la présence d’un tiers qui est appelé à décider comme le ferait un "vir bonus" ; il a toutefois souvent une valeur objective.Dans cette hypothèse, le jugement de l’homme de bien (arbitratus boni viri) a une valeur abstraite. Si un lien existe entre les concepts de "vir bonus" et de "bona fides", le critère herméneutique de l’homme de bien est utilisé aussi dans des actes juridiques qui sont sanctionnés par une action "stricti iuris". L’emploi de l’"arbitratus boni viri" permet de rendre plus flexible le jugement sans pour autant remettre en cause la nature de droit strict de l’action
The “vir bonus” is often mentioned in the sources. However, the “vir bonus” is not only an ethical ideal, but also a hermeneutic criterion that allows us to interpret and integrate the legal acts. This is the technical meaning given to it by the jurisconsults, at least starting from the II century a.C..The “vir bonus” should be replaced in the general context of Roman arbitration and distinguished from the “arbiter ex compromisso”. In particular, the “vir bonus” is used the field of obligation and inheritance rights. Therefore, it is used in bilateral as well as unilateral judiciary stores. At times, speaking of the “vir bonus” a third party is implied, called into question through the role and actions of a “vir bonus”; however, this third party often has an objective value. In this hypothesis, an honest man’s judgment (“arbitratus boni viri”) has an abstract value. Even though there is a link between the concepts of “vir bonus” and “bona fides”, the hermeneutic criterion of the “vir bonus” is also used in the actions that are “stricti iuris”. The use of the “arbitrates”“boni viri” allows judgment to be more flexible without questioning the “stricti iuris” nature of the action

The following work is the result of three years of research for my Ph.D. at the University of Trento, Faculty of Law. The aim of my research is to give an account of the Etruscan legal system by analysing both direct and indirect sources. For this, I have attempted to use historical, linguistic, and epigraphical methods and instruments, combining them to offer the most complete view of one of the most influential cultures in the Italian peninsula before the rise of Rome. The first chapter is an account of the historical evolution of the Etruscan ethnos from the Bronze age to the end of the I century b.C., focusing mainly on the socioeconomic drives that informed public affairs and the complex exchequer of international events. This part is based on indirect sources, such as literary ones. The second chapter is an attempt to offer a short linguistic vademecum, focused mainly on Etruscan alphabet and morphology, with some remarks regarding the origins of Etruscan language and alphabet. The third chapter is the analysis of the direct sources, mostly epigraphic ones. I have chosen the most relevant legal epigraphs that have yet been discovered and have proceeded to study them, attempting (where possible) some parallels with roman law. After the general conclusions, I deemed it appropriate to add two appendixes concerning Etruscan amgistratures and a short legal lexicon. The work is closed by some hand-drawn maps and the most important epigraphs.

The topic of this thesis is legal transplants in China since 1978. The first part is devoted to a presentation of contextual elements of Chinese Law, with a critical discussion of various theories of legal transplants, including the most recent Chinese scholarship on this topic. The second part contrasts the influence, on the Chinese legal reforms, of the continental (or civilian) legal tradition with that of the common law. To this end, the author uses a study of the reception of the bona fide principle and of the fairness principle in The Contract Law of the People's Republic of China, with a discussion of the future Chinese Civil Code. The common law's influence, in the same law, is then presented with a focus on the doctrines of anticipatory breach and indirect agency. In the end, the author explains why the civilian legal tradition will remain the dominant, but not exclusive, model on Chinese legal reforms.

A chamada regra do usus auctoritas, presente na Lei das XII tábuas, é apontada, desde Cujácio (séc. XVI), e daí em diante por muitos juristas, como sendo uma antiga norma sobre a garantia do vendedor por meio de negócio formal, mancipatio em caso de evicção; o próprio sentido do vocábulo auctoritas seria «garantia», ou mesmo «dever de prestar garantia», neste caso particular inseparável da mancipatio. Mas o fragmento que traz essa regra USUS AUCTORITAS FUNDI BIENNIUM EST[O] nos foi transmitido por Cícero e (embora de forma já interpretada) Gaio; e estes a consideram uma espécie de antiga norma a respeito do usucapião (inicialmente apenas de imóveis). Outros juristas antigos e contemporâneos seguiram, em parte, essa interpretação original. O trabalho pretende trazer novos argumentos em favor dessa exegese natural de Cícero e Gaio no sentido de que a dita regra versa sobre usucapião, mais especificamente sobre uma sua forma arcaica e bastante peculiar. Investiga-se o surgimento da propriedade imobiliária em Roma e suas peculiaridades: o sistema augural, quase religioso, de limitação do solo destinado, no início, a todo cidadão romano, conferido por meio de atos de adsignatio (concessão) pelo «estado» em formação, que detinha a auctoritas ou poder; a passagem da soberania das gentes pré-romanas aos Quirites; a gradual privatização a atribuição dessa auctoritas coletiva e diretamente quiritária ao proprietário dessas parcelas de terra e a fragmentação do solo pelo direito privado regulado pela Lei das XII tábuas, que confere autonomia (a auctoritas ou título) aos indíviduos e suas famílias. Acrescenta-se uma breve análise lógica da regra e uma tentativa de a inserir no esquema geral do usucapião moderno.
The usus auctoritas rule from the Twelve Tables was conceived by Jacques Cujas (16th century AD), and many authors thereafter, as an ancient norm that established a warranty against eviction granted by the seller when transferring the ownership of the thing to the buyer through the performance of mancipatio. According to this view, the very word auctoritas is taken to mean warranty, or else to imply an obligation to give warranty, and is intrinsically associated with mancipatio. But the fragment of the sources that state this rule USUS AUCTORITAS FUNDI BIENNIUM EST[O] were brough to us by Cicero and Gaius (the latter in the form of an interpretation of the norm), and both consider it to be an ancient Roman disposition that originally dealt with usucaption of immovable property only. To a certain extent, various ancient and modern jurists accept the latter interpretation. The object of this thesis is to provide new arguments to support the more natural interpretation adopted by Cicero and Gaius, i.e., that the rule in question deals specifically with an archaic and peculiar form of usucapio. The present work analyzes the emergence of private ownership of immovable property in Rome and its peculiarities: the quasi-religious augural system of land apportionment adopted by the fledging Roman state to assign a lot of land to every Roman citizen through the performance of acts of adsignatio (allotment); the sovereignty transferred by the pre-Roman gentes to the Quirites; the process by which land plots were gradually privatized and landowners acquired this once collective and quiritarian auctoritas, and the resulting land apportionment caused by the application of rules of private law based on the Twelve Tables conferring autonomy (auctoritas or title) to individuals and their families. In the final lines, an attempt is made to provide a logical analysis of the rule and to place it within the general conceptual framework of modern usucaption.

Abstract:
The starting point of the article is the idea that the original model of state of emergency government established to save the Constitution can be found in the Classical Roman Republic. It makes the characteristics of this institution to be analyzed. Institution that has founded an intellectual ‘tradition’ in the political and legal Western thought. The study also comments the characteristics that distinguish the “Roman dictatorship” as a concept that lightens the theoretical options of people who worry about the constitutional emergencies and the powers to set against.
El artículo toma como punto de partida la idea de que es en la República romana clásica donde ha de encontrarse el modelo original del gobierno de excepción instaurado para salvar la Constitución. A partir de ello, se analizan las características de esta institución, que ha fundado una«tradición» intelectual en el pensamiento político y jurídico de Occidente. El estudio también comenta los rasgos que distinguen a la «dictadura romana» como concepción que ilumina las opciones teóricas de quienes se preocupan por las emergencias constitucionales y los poderes para hacerles frente.

ENGLISH ABSTRACT: This study aims to interpret Romans 7 with special reference to the law. Both Romans 7 and the law in Paul are very difficult to understand. However, both are important for an understanding of Pauline theology and the gospel. In the past historical critical analyses were usually done in order to solve problematic passages like Romans 7 in Paul's letters. In this study a socio-rhetorical analysis is utilized. To start with, previous research is briefly dealt with in order obtain an overall picture of the understanding of the law in the past. From this overview more than ten problem areas are identified. Then, socio-rhetorical analysis is briefly explained. This is a multi-dimensional and multi-disciplinary method developed by Vernon Robbins, which sees the text as having various textures. In this research the method is utilized with some modifications. In chapter 4 the macrostructure of Romans is established by means of epistolary analysis and rhetorical analysis. Next, Rom. 7 is established as a rhetorical unit within Rom. 5-8 as the broader co-text of Rom. 7. After that the rhetorical situation of Romans is discussed, as well as some of Paul's rhetorical devices and styles. Finally, the rhetorical species of Romans is determined as deliberative rhetoric. From chapters 5 to 7, Rom. 7 is analyzed, using different textual analyses. In an analysis of inner texture repetitive-progressive texture, opening-middle-closing texture, and argumentative texture are discussed. Here an enthymemic analysis is used in order to chart Paul's argumentative flow of thought. From this it is concluded that Rom. 7: 1-6 is an analogy, which is an important tool for argumentation, and that the present tense in Rom. 7:14-25 functions as part of a combination of autobiographical-typical-rhetorical features for the purpose of argumentation. In the analysis of intertexture the scriptural intertexture is investigated: recitation with omission and thematic elaboration. In the cultural intertextual analysis some Jewish cultural intertextures are noted, namely, Rom. 7:8-10 as an allusion to both Gen. 3 and Exod. 3, Paul's usage of the "1," the law, slavery image, and the evil inclination. It is also interesting that Rom. 7: 15 & 19 and the "I" are allusions to Greek tragedy, sin as power, and slavery as Greco-Roman cultural intertexture. In analyzing the social intertexture it can be concluded that the marriage analogy is closer to Jewish marriage than to Greco-Roman marriage. The final analysis is an investigation of the theological texture. Here salvation history and the covenant of God are first dealt with in order to get to grips with Paul's theological world. Then, Pauline hamartiology, anthropology, and finally, nomism are investigated. The conclusion is that VOl-lOS' in Rom. 7 mostly denotes the universal moral law of God, both written and unwritten, not just the Mosaic law; though in some cases it denotes "principle" or "rule" as in vv. 21-25. Rom. 7 as a whole is a refutation of the objection or misunderstanding that might be raised regarding Paul's statements of the law in previous chapters. In Rom. 7 Paul elaborates the relationship between believers and the law, and the function of the law in relation to sin in an unregenerate person. In so doing, he vehemently denies that the law is sin, and vividly indicates the function of the law using his own experience.
AFRIKAANSE OPSOMMING: Hierdie navorsing fokus op Rom. 7 met spesifieke verwysing na die wet. Hoewel sowel die wet by Paulus en Rom. 7 moeilike onderwerpe is om te verstaan, is beide van besondere belang vir In verstaan van die teologie van Paulus en die evangelie. In die verlede is gewoonlik van histories-kritiese studies gebruik gemaak in die bestudering van sulke probleme. Hier word van In sosio-retoriese benadering gebruik gemaak. Daar word eers aandag gegee aan vorige navorsing om In beeld te kry van die wyse waarop die wet in die verlede verstaan is. By die bestudering van die kulturele intertekstuele analise kom voorbeelde van Joodse intertekstuur aan die orde: Rom. 7:8-10 as toespeling op Gen. 3 en Eks. 3, Paulus se gebruik van die "ek", die wet, die beeld van slawe en die bose begeerte. Verder kan Rom.7:15, 19 en die "ek" as toespelings op Griekse tragedies, die sonde as mag, en slawemy as Grieks-Romeinse kulturele intertekstuur gesien kan word. Wat die sosiale intertekstuur betref word bevind dat die analogie van die huwelik meer verwantskap met die Joodse huwelik as met die Grieks- Romeinse huwelik vertoon. Ten slotte word die teologiese tekstuur ondersoek. Eers word aandag gegee aan die heilsgeskiedenis en die verbond van God om In begrip van die teologiese wereld van Paulus te verkry. Daama word die hamartologie, antropologie en ten slotte die wet by Paulus ondersoek. Daar word bevind dat VOl-lOS" in Rom. 7 meestal die universele morele wet van God, geskrewe en ongeskrewe, en nie net die wet van Moses nie, aandui. In bepaalde gevalle, soos in Rom.7:21-25, beteken dit "beginsel" of reel." Rom.7 is in sy geheel'n verwerping van die beswaar of misverstand wat na aanleiding van Paulus se uitsprake oor die wet in die vorige hoofstukke kon ontstaan het. Paulus stel in Rom.7 die verhouding tussen gelowiges en die wet aan die orde asook die funksie van die wet met betrekking tot sonde by die onbekeerde. Op hierdie wyse ontken hy ten sterkste dat die wet sonde is terwyl hy ook die funksie van die wet met behulp van sy eie ervaring uitbeeld.

Resumo: Este estudo tem por finalidade analisar as cortes de justiça senatorial e imperial, através das obras Cartas e Panegírico a Trajano escritas por Plínio, o Jovem, e Diálogo dos Oradores, Agrícola, Histórias e Anais I-VI de Tácito. A organização judiciária da cidade de Roma, durante o Principado, contava com diferentes cortes de justiça. Apesar de perpassar a jurisdição de diferentes cortes de justiça, a presente tese irá se centrar na interpretação das acusações de maiestas e repetundae, relatadas por esses dois senadores romanos, que foram instauradas perante as cortes senatorial e imperial. Ambas as cortes se configuraram como ambientes privilegiados para a análise das negociações entre o Senado e o princeps e, por esta razão, serão objetos do nosso estudo. Veremos como a escolha de uma corte de justiça e os procedimentos empregados no julgamento dos processos eram permeados por negociações entre o Senado e os imperadores atuantes. Como discorremos, Tácito e Plínio centraram suas narrativas no (des)equilíbrio da distribuição das funções e dos poderes jurídicos e político-administrativos entre o Senado e o princeps. Assim, investigaremos a hipótese da existência de um entrelaçamento entre as práticas político-administrativas e as práticas jurídicas durante o Principado. Abstract: This study’s goal is to analyze the senatorial and imperial law courts through Pliny the Younger’s works Letters and Panegyric to Trajan, as well as Tacitus' works Dialogue on Oratory, Agricola, Histories and Annals I-VI. The judiciary structure of the city of Rome, during the Principate, featured different law courts. Although it encompasses the jurisdiction of different law courts, this thesis will focus on the interpretation of the accusations of maiestas and repetundae reported by these two Roman senators that were installed in the senatorial and imperial law courts. Both courts of justice became privileged environments for the analysis of the negotiations between the Senate and the princeps, and, for this reason, they are the objects of our study. We will see how the choice for a law court and the procedures employed in the trials of the processes were permeated by negotiations between the Senate and the regent emperors. As discussed, Tacitus and Pliny centered their narratives around the (im)balance of function distribution and legal and political-administrative powers between the Senate and the princeps. Thus, we will investigate the hypothesis of an interweaving between the political-administrative practices and the legal practices during the Principate. In this way, we will proceed to the study of the accusations of repetundae and maiestas identified in our sources. Résumé: Cette étude vise à analyser les cours sénatoriales et impériales, à travers les oeuvres Correspondance et Panégyrique de Trajan, écrites par Pline le Jeune et le Dialogue des orateurs, la Vie d’Agricola, les Histoires et les Annales I-VI de Tacite. L’organisation judiciaire de la ville de Rome, pendant le Principat, avait différentes cours de justice. Malgré aborder la juridiction des différentes cours de justice, cette thèse se concentra sur l’interpretation des accusations de maiestas et de repentundae, rapportées par ces deux sénateurs romains, qui ont été instaurées devant les cours sénatorial et impérial. Les deux cours ont été configurées comme des environnements privilégies pour l’analyse des négociations entre le Sénat et le princeps et, pour cette raison, feront l’objet de notre étude. Nous verrons comment le choix d’une cour de justice et les procédures suivies lors du procès ont été imprégnés de négociations entre le Sénat et les empereurs actifs. Comme nous avons discouru, Tacite et Pline ont centré leur récit sur le (dés)équilibre de la répartition des fonctions et des pouvoirs juridiques et politico-administratifs entre le Sénat et le princeps. Esta tesis se va a desarrollar en el siguiente orden: en primer lugar, analizaremos la institución de las guardas a partir del derecho romano, en forma más o menos profunda, esto, porque ahí se encuentra la base juridica de ellas y sin mayores cambios, fue adoptada por el derecho español, el que tomaremos a partir de la Siete Partidas. Posteriormente, analizaremos brevemente la regulación de ellas en el derecho indiano, ya que no tiene mayores diferencias con el derecho español, a pesar que tuvo algunas características propias, generadas por las circunstancias. En el segundo capítulo, analizaremos la legislación actual en Chile, con las modificaciones que se introdujeron con la entrada en vigencia de la ley 19.585, a partir de octubre de 1999. En el tercer capítulo, haremos un paralelo de los aspectos más relevantes entre el derecho romano y la legislación vigente en Chile. En el cuarto capítulo, analizaremos el tratamiento de las guardas en legislación paraguaya. Esta elección fue absolutamente fortuita, debido a que contábamos con ese material, el cual contiene normas similares a las nuestras pero vigente desde el año 1981, es decir, se nos adelantaron en 18 años. Finalmente expondremos nuestras conclusiones.

O trabalho consiste na análise do processo de internacionalização dos Direitos Humanos com base no Direito Internacional Penal. Partindo de abordagens interdisciplinares na criação do Tribunal Penal Internacional, é feita uma leitura jurídico-penal do Estatuto de Roma a partir da aproximação dos conceitos oriundos do Common Law e do Civil Law em busca de um maior aprimoramento na construção de uma Parte Geral do Direito Internacional Penal. Assim, pretende-se contribuir para uma maior preocupação no tocante à responsabilização penal no plano internacional, sempre com o foco voltado para o incremento da proteção internacional dos Direitos Humanos.
The work analyses the process of internationalization of the Human Rights based upon International criminal law. Beginning with an interdisciplinary approach on the creation of the International Criminal Court, the Roman Statute is analyzed through a criminal law reading, that acknowledges an approach between Common Law and Civil Law traditional concepts. Therefore, the work seeks to contribute to an improvement on criminal law enforcement on the international level, always focusing on assuring the international protection of the Human Rights.
