It aims to identify the main similarities and differences between the Romanian development regions and the French regions, although Romania does not have a real administrative regional level. The study also considers the particular territorial features of the two states, along with the specific trends they are following in their administrative-territorial reorganization and which can determine different evolutions.

Abstract:
In the following study, we present the legal history of Transylvania following the unification of this territory with Romania at the end of the First World War, and until the installation in Romania of the Soviet-type dictatorship. The heterogeneity of the Romanian legal system resulting from the country’s territorial gains is discussed as well as the various attempts at integrating Transylvanian law into the nascent legal order of Greater Romania. We also present the short interregnum in which Hungarian private law was again applied between 1940 and 1944. The Romanian legislator, facing the imperative necessity of creating a unified national legal order, had the choice of two paths: extend the already outdated laws of the Old Kingdom of Romania to the newly acquired territories or adopt new unitary laws. Both paths were taken depending on the field of law and the historical period concerned, as presented. Finally, the legislator opted for the extension of the laws of the Old Kingdom at the end of the Second World War, even in fields where better-quality norms were enacted during the reign of King Carol II but were never implemented.

Within any legal system, implicitly also in the national one, the Constitution stands out as important, a fundamental law that represents the supreme system of political-legalnorms. Article 118 para. 2 of the The Constitution of Romania states that "The structure of the national defense system, the preparation of the population, economy and territory for defense, as well as the status of military personnel, are established by organic law" and, in light of the above regulation, the headquarters of the matter regarding the national defense system is represented by Law no. 45/1994 of the national defense of Romania, with the subsequent modifications and completions, this being established, at art. 6, the fact that the national defense system includes: leadership, forces, resources and territorial infrastructure. On the other hand, collaboration with partners or allies within NATO or strategic partnerships is an essential component of national and regional security.Thus, the participation of the armed forces in missions and operations outside the territory of the Romanian state, the entry, stationing, conduct of operations or transit of Romanian territory by foreign armed forces, or Romania's participation in the Missile Defense System, are legally substantiated issues. on a complex set of normative acts which, through their interpenetration, through the existing relations between them, manage to create a true pillar of the national and collective defense.Keywords: national defense system; Supreme Council of National Defense; defense planning.

At the 1914 Crown Council, which decided to keep Romania neutral in 1914, former Conservative prime minister Petre Carp offered his succinct and direct opinion about the direction of Romanian foreign policy in the opening days of the Great War. He admonished the Council that, if Romania wanted to remain among the ‘civilized states’ ( statele civilizate) it had to follow Germany and Austria-Hungary into war immediately. The idea of ‘civilized states’ that dominated the remainder of the Crown Council was not merely an intersubjective social construction. It was a legal term of art in fin de siècle international law that could be applied in the real world. It was only the legally-civilized states that enjoyed the full panoply of rights, privileges, and protections under international law. This is a study of how Romania’s policy-making elite, and Ion I. C. Brătianu’s government, in particular, confronted the challenges of ‘situational sovereignty’. It asserts that, during Romania’s two-year Period of Neutrality (3 August 1914–17 August 1916), Brătianu initially used bilateral conventions as both a method to establish recognition of Romania’s status (or at least a guarantee of territorial integrity) and as a litmus test to determine which (if any) foreign powers recognized Romania as a legal equal. Although he was able to achieve a short-term victory of having an equality clause inserted into the August 1916 political convention with the Entente, it is unclear if that clause could have been durable. Ultimately, Brătianu was trapped between a desire to secure Romania’s recognition through international agreement, but confronted with the reality that Romania’s lack of recognition as a legally-civilized equal meant those very conventions could be unenforceable.

Objective - The course of Business Law aims to provide students with the basic legal terms and concepts necessary in their economic activity. Teaching law through the English language does not mean translating the course or the laws from Romanian but involves applying interactive methods so that the information is well conveyed and language does not become a barrier in the process of learning. Methodology/Technique - By turning to action research, the aim of the study is to identify students' perception on the relevance of the content and the teaching methodology of the current Business Law course, to identify the key elements of the new Business law course to be designed, employing active learning methodology and designing specific activities to be proposed to students. Findings - Debates or discussions are never absent from class activities, in which I try to engage all students. The lectures are delivered with visual aids, i.e. Power Point program, while the slides are drafted in an enjoyable manner. Novelty - Most recently in Romania, there has been a legislative change which saw the introduction of new fiscal advantages into limited liability companies fulfilling certain requirements (SRL-D), a topic which exceeds the current curriculum. This article by Celia Beckett, Amanda Hawkins, Michael Rutter, Jenny Castle, Emma Colvert, Christine Groothues, Jana Kreppner, Suzanne Stevens and Edmund Sonuga-Barke examines attitudes regarding cultural and national identity in a group of 165 young people adopted from Romania. The attitudes of their adoptive parents are also explored. The adoptive parents were interviewed over three or four time periods, when their children were 4/6, 11 and 15 years, and the adopted young people at the age of 11 and 15. The majority of the adopted young people had an interest in Romania and expressed a wish to visit their country of origin. However, there was no association between this interest in Romanian identity and levels of self-esteem. The majority of the adoptees saw themselves as English or Anglo-Romanian. A small minority saw themselves as Romanian; these adoptees had both lower self-esteem and a higher level of deprivation-specific problems. The degree of sustained interest shown by adoptive parents in the importance of Romanian identity was associated with the adopted young people's interest in Romania. However, parental interest in this issue had significantly declined by the time the children were 11 years old, by which time fewer adoptive parents than young people had plans to visit Romania in the future.

Abstract The author analyses in this paper S. Bărnuţiu’s contribution to the establishment of the legal education and to the development of the sciences of the Law in the Romanian area during the mid-19th century. Adept of the natural law philosophy, ardent promotor of human and people’s rights, Bărnuţiu remains a personality of reference in the Romanians’ history not only for being the political leader and ideologist of the Transylvanian 1848 Revolution, but also for establishing the legal education at the University of Iasi by inspiring himself from the curriculum of the profile schools of law from the Western Europe. Having a unitary conception on the law and on the history of law, considering the law from a systemic perspective, Bărnuţiu contributed into the edification of a modern, constitutional, and democratic State in the united Romanian Principalities.

Abstract:
The present research addresses the challenges faced by the public service interpreter to find linguistic equivalence between English and Romanian in the framework of UK Criminal Law and manage the discontinuity between the UK and Romanian legal systems. The project’s objective is to examine specific lexical-contextual difficulties encountered in the professional practice and the availability of equivalent terminology in translation. Grounded on my professional practice and through investigations of practicing interpreters I analyse the structure and meaning of these non-equivalent terms, and establish equivalence by means of complex electronic queries using the collocation method. The findings validated by experienced practitioners are made available online as a concise glossary. The specific terminology is based on my observations in the UK courts for a period of three years and through professional inquiry among my colleagues. The second objective of my project is to empower both beginner and practicing interpreters across all languages to use the resources available to them in their workplace to resolve their terminological non-equivalence stepping further in their professional journey. A seven step model is established based on my practice and research project to provide guidance on how to turn the data available to them into resources they need for the non-equivalence of legal terminology in their specific language pairs. The project report is considered as a resource seeking to establish good practice provides relevant applications in certain contexts and as such can be recontextualised. The research contributes the profession by making available a concise but useful glossary for the Romanian interpreters and practitioners on the legal field in the UK. By means of cooperation with the fellow professionals, I developed a model of self-building glossary in easy to follow steps and with a minimum prerequisite of lexicographic knowledge or advance computing skills.

La thèse a pour but l’analyse de l’évolution récente du droit civil français et roumain de la responsabilité civile au cours de la période précontractuelle. Nous avons privilégié une approche comparative entre les deux droits nationaux à la lumière des droits européens. Au cours de la période précontractuelle les parties sont libres de négocier comme elles le veulent, mais sans causer un dommage à leur partenaire. Il y a un lien qui se crée entre les parties et qui ne peut être rompu que conformément au principe de la bonne foi. Nous avons pu constater que le fondement de la responsabilité est assez controversé et varie d’un ordre juridique à l’autre. En effet, la responsabilité civile balance entre sécurité juridique, autonomie privée et liberté contractuelle. En résumé, la phase précontractuelle a connu de profondes transformations au cours de son évolution. À l’heure de l’harmonisation européenne, voire de la globalisation, les droits français et roumain subissent des modifications afin de clarifier des règles de plus en plus compliquées et notamment celles relatives à la responsabilité civile précontractuelle
The thesis finds its main purpose in the study of the recent evolution of French and Romanian civil law of liability during the pre-contractual period. We favored a comparative approach between national rights, in the light of European laws. During the pre-contractual period, the parties are free to negotiate as they please, as long as they do not cause damage to their partner. A bond is created between the parties and it can only be broken in accordance with the principle of good faith. We noted that the basis of liability is fairly controversial and varies from one legal system to another. Indeed, the civil liability is balances between legal security, private autonomy and freedom of contract. In summary, the pre-contractual phase has experienced profound transformations in its evolution. At the time of European harmonization, or even globalization, French and Romanian law undergo modifications in order to clarify the most complicated rules, in particular those relating to pre- contractual civil liability

In the context of globalization, the idea of place is reputed to be losing its footing. This thesis explores the implications of these developments with respect to the way that place is constructed in law by focusing on tensions between the concept of jurisdiction and the ways that the contexts of law overspill it, threatening to engulf comparative analysis. Central to the idea that jurisdiction is losing its familiar moorings is the implication that other forms of thinking about legal normativity are emerging as more commonsensical alternatives to the state-based idea of jurisdiction that emerged in the eighteenth and nineteenth centuries. The thesis explores this hypothesis by bringing elements of the discipline of comparative law (conventionally state based) into play with elements of the discipline of legal anthropology (conventionally culture based). The focus for this theoretical intrigue is an Gitano population in the South of Spain that served as the fieldwork locale for seven months of ethnographic fieldwork carried out in 1995. Investigations are centered on the theme of family law. Familiar notions of state and culture, and the legal sensibilities associated with each, are examined through exploring the interplay between local expressions of Gitanitude in Jerez de la Frontera and regional, national, international, and global forces that structure legal sensibilities in the area. The first chapter explores the interplay by focusing on the context surrounding Spain's reforms to family law in the 1980s. The familiar frontiers of the state are prodded through this analysis. The second chapter then explores the frontiers of culture through an examination of a variety of expressions of Gitanitude in Spain. The third chapter brings modified versions of state and culture together in a reconceptualisation of family law. This thesis is as an attempt to overview the forms of trade secret protection presently in place in the United States, Canada, the European Union and Romania. These jurisdictions were selected because they present a diversity of legal background and a variety of forms of trade secret protection.
The introductory chapter deals with the historical and economic backgrounds of the trade secret protection. An overview of trade secret protection at international scale is also provided. The thesis compares the forms of trade secret protection available in each jurisdiction. Based on the survey, the thesis comes to an answer of the question of "What is the most appropriate form of trade secrets protection?".
The final chapter provides a number of conclusions and recommendations.

La ricerca consente una conoscenza più approfondita dei complessi forensi: delle loro fasi edilizie, della loro evoluzione, delle loro funzioni e delle architetture più significative che si trovano al loro interno. Si attesta come il foro prenda forma in base alle esigenze della città in quel determinato momento in cui esiste. Si configura come un’entità, di certo caratterizzata da una più o meno variabile forma di monumentalità ma allo stesso tempo pronta ad adattarsi a ciò di cui i suoi fruitori hanno bisogno e ad esprimere ciò che i suoi costruttori (intesi come finanziatori) intendono comunicare. Sin dall’inizio, lo spazio forense si caratterizza per la varietà di funzioni che può ospitare, una peculiarità che lo distingue non solo come realtà di valore architettonico ma che gli fornisce anche un grande valore antropologico. Il foro costituiva il centro politico-religioso urbano, ma anche il luogo di mercato e di svolgimento di eventi e spettacoli pubblici. Progressivamente, però, si svolse il trasferimento di alcune funzioni, ossia quelle relative agli spettacoli ludici e quelle commerciali, in modo tale da isolare le funzioni amministrative e cultuali, conferendo ad esse sempre maggiore rilievo. Questo isolamento ha trovato come tipica espressione architettonica quella del complesso forense concepito come un monumento unitario e non più come un aggregato di strutture diverse e connesse tra loro in vario modo. Il foro si trasforma da centro di convergenza e di guida della vita economico-sociale di tutto il territorio della civitas, in luogo dove risiede e si espone l’autorità. In definitiva, il foro isolato e monumentale è anche una conseguenza del venire meno della partecipazione attiva del popolo alla vita politico-amministrativa della città, che sarà gestita da magistrati locali scelti tra una sempre più ristretta cerchia di persone. Questo tipo di foro si sviluppò soprattutto nelle aree provinciali. L’argomento più rilevante del lavoro è certamente quello che riguarda i percorsi strutturali dei complessi forensi, i quali variano a seconda della natura stessa dei fora. Il tipo di sintassi spaziale adottato definisce il carattere del messaggio che il complesso forense intende trasmettere nel momento in cui ha preso forma (prima edificazione o ristrutturazione che sia). È possibile riconoscere due diverse tipologie: la prima, a percorso diretto; la seconda a percorsi biassiali bipolari. In genere, il messaggio è di natura cultuale nei casi dei fora a percorso diretto mentre è di natura politica, nel senso di rappresentazione della grandiosità dell’impero e della sua efficacia funzionale, nei casi dei percorsi biassiali e bipolari. A partire dall’età di Augusto, la morfologia urbana divenne uno strumento per mobilitare l’opinione pubblica e i percorsi istituiti all’interno dei complessi forensi, ma anche della città in generale, dovevano condurre al suo consenso. Dall’età augustea, dunque, l’analisi dei percorsi strutturali costituisce un elemento fondamentale nello studio dei complessi forensi. La ricostruzione dei rapporti tra gli spazi e, di conseguenza, dei percorsi necessari per raggiungerli è, infatti, direttamente correlata a necessità funzionali e a significati politico-culturali che non si potrebbero individuare con la semplice analisi architettonica. Il fenomeno dell’evergetismo è strettamente collegato con quello del culto imperiale che, seppure in misura variabile, ha interessato tutte le piazze delle città romane di età imperiale. Le sistemazioni iniziali delle città erano realizzate a spese dello stato mentre un reale processo di monumentalizzazione, in genere, non poteva avvenire finché non si fosse formata una élite capace di impegnarsi nel finanziamento di grandi imprese costruttive. La costruzione o la monumentalizzazione di un foro, inoltre, può essere strettamente correlata alla necessità di fornire alla città tutte le nuove strutture necessarie a seguito di un cambiamento di status giuridico.
The research allows a more in-depth knowledge of the fora, about their construction phases, evolution, functions and most significant architectures which are located inside them. It attests how the forum takes shape according to the needs of the city at that moment in which it exists. It is configured as an entity, certainly characterized by a more or less variable form of monumentality, but at the same time, ready to adapt to what its users need and also to express what its builders (intended as financiers) intend to communicate. From the beginning the forum is characterized by various functions, a peculiarity that distinguishes it, not only as a reality of architectural value, but also provides great anthropological value. Certainly the forum constituted the urban political-religious center, but also the place of market and of events and public performances. Little by little, there is a transfer of some functions, namely, those related to ludic events and to commerce, in order to isolate the administrative function, giving it an increasingly greater importance. This isolation has found as a typical architectural expression, that of the forum conceived as a unitary monument and no longer as a set of different structures. The forum changes from a center of convergence and guidance of the economic and social life of the whole territory of the civitas, in a place where authority resides and exposes itself. The isolated and monumental forum is also a consequence of the disappearance of the active participation of the citizens in the political and administrative life of the city, which will be managed by local magistrates chosen from an increasingly narrow circle of people. This type of forum, conceived as a unitary complex, was developed mainly in the provincial areas. The most relevant topic of the work, concerns the structural paths of the fora. The type of spatial syntax adopted defines the character of the message that each forum intends to transmit when it takes shape (in its first construction or in its subsequent restructuring). It is possible to recognize two types of structural trajectories: the first, with a direct trajectory; the second with biaxial-bipolar trajectory. In general, the message is of a cultual type in the case of a direct trajectory, while it is of political nature in cases of biaxial-bipolar trajectories. From the time of Augustus, urban morphology became a useful tool to mobilize public opinion and even the internal paths of the fora had to lead to imperial consent. Therefore, from the Augustan age, the analysis of the structural paths is a fundamental element in the study of fora. In fact, the reconstruction of the relationships between the spaces and, consequently, the identification of the paths necessary to reach them, is directly related to functional needs and to political-cultural meanings that, generally, can not be identified with a simple architectural analysis. The phenomenon of the evergetism has involved all the Roman cities and it is a phenomenon closely related to that of the imperial cult that, although in varying degrees, has also interested all the squares of the Roman cities of the imperial era. The first structures in the fora were certainly built at the expense of the state, while a real process of monumentalization, in general, could not take place until an elite was formed, capable of engaging in the financing of large constructive companies. Furthermore, the construction or the monumentalisation of a forum can be closely linked to the need to provide the city with all the new structures necessary as a result of a change in legal status.

Abstract:
The purpose of this thesis is to examine the educational disadvantage currently being suffered by Roma children in the Czech Republic, Hungary, Romania and Slovakia, and to identify the most appropriate human rights mechanism with which to remedy the situation. Education is vitally important for oppressed minorities such as the Roma since, without it, individuals will be unable to fully access the complete range of their fundamental rights and so will be unable to challenge the disadvantage and discrimination that they suffer. This thesis first submits, therefore, that the traditional liberal democratic model of governance as featured in contemporary Europe is insufficient to adequately address the needs of minorities. To address this insufficiency, states must recognise a version of multiculturalism that both embraces critical pluralism and is compatible with liberal theory. Secondly, this thesis suggests that the individualistic focus of rights protection should be enhanced through an increased recognition of children’s rights so that the individual child is firmly entrenched as an autonomous rights holder. The type of education system that would exist in such a rights environment should serve to develop the autonomy and competence of individual children but also to facilitate their security within their own culture. This type of multicultural education can only be achieved if the various international instruments concerning the right to education can be required to place a more onerous burden on states parties when it comes to minority accommodation. At a domestic level, this thesis suggests that the most appropriate means by which to accommodate the Roma within the national education systems of the four countries would be through a culturally sensitive mainstreaming approach adapted from that used in England.
