Full textEver since his thought was introduced to China via Japan at the end of the 19th century, Rousseau has for generations been a charming figure for many members from the intelligentsia in China. By citing The Social Contract and Émile as two examples, the author of the dissertation intends to discuss how the thought of Rousseau was accepted in China during a period from the end of the 19th century to 1949. The dissertation starts with an analysis of the textual differences by comparing a number of the Chinese translations of the two works, the translations, for example, of Du Contrat social by Nakae Chômin, Yang Tingdong and Ma Junwu, and of Émile by Yamaguchi Katarô and Shimazaki Tsunegoro, Xia Gaizun and Tan Juemin. Then the dissertation proceeds to look into the writings on the political and educational principles of Rousseau by Chinese men of letters living during various historical peorids so as to explore the way in which the thought of Rousseau spread to China via Japan, participated in and made impacts on the transformation of the traditional thought into the modern one. The dissertation ends up with a discussion of how Yan Fu, Liang Qichao and the other thinkers who had had a great influence on the modern Chinese culture accepted, understood and disseminated the politically democratic ideas of Rousseau, and how in the great debates that went on in the 1930s between Lu Xun and Liang Shiqiu the educational principles of Rousseau were made used of, the purpose of which is to show how the metamorphosis of the thought of Rousseau occurred in China

Full textCe mémoire affronte le problème de l'unité de la pensée de Rousseau, en particulier dans son versant politique. Il met en évidence la place centrale qu'occupe, dans sa philosophie, la thèse de la bonté naturelle de l'homme, et défend l'idée que les grandes articulations du Contrat social en sont des ramifications. Pour ce faire, il montre d'abord que les principes du droit politique représentent pour Rousseau la solution à un problème inhérent à la condition sociale de l'homme, problème développé dans le Discours sur l'inégalité. Les deux premiers chapitres du mémoire sont pour cette raison consacrés entièrement à une étude du second discours, où Rousseau pose le principe de la bonté naturelle de l'homme, puis décrit la façon dont celle-ci s'altère et finit par se corrompre dans la vie sociale. Les troisième et quatrième chapitres, quant à eux, contiennent une étude minutieuse du Contrat social, qui met d'une part en lumière le lien de continuité unissant l'ouvrage au Discours sur l'inégalité, et qui, d'autre part, démontre que ses tensions doctrinales résultent justement de son rattachement à la thèse de la bonté naturelle de l'homme.

Full textRousseau disputes the Aristotelian theory of natural sociability to which he supplements his doctrine of natural asociability. At the same time, he rejects the Hobbesian conception of man, which is naturally unsociable, and is also opposed to the dogma of original sin to which he contrasts his theory of original goodness which is, in reality, only an apology for justice and The divine omnipotence which led us to the question of the theodicy inspired by St. Augustine, theorized by Leibniz, contested by Voltaire and forbidden. By rejecting original sin and proclaiming the natural goodness of man, he exculpates God but also man before his integration into social life. It is therefore for him that social bonds corrupt man and make him bad. He causes this corruption to flow from the inequality created by property, for in the state of nature, where there was no property, where everything was common to all, man was not wicked and it was for Attempt to return to the state of natural equality that he instituted the law. But he noticed that once he entered social life, property became a sacred right, indispensable. A reversal has thus taken place in him. As a defender of the right to property, he became its defender. Also, some commentators have classified it in the category of individualists. Others rank him among the Communists and others connect him with the socialist doctrine. In order to better situate him, we chose to confront his ideas and positions with the supporters of these different ideological currents: Proudhon for individualism, Baboeuf for communism and Marx for socialism

Full textThe eighth chapter of the Book IV of the Social Contract, entitled “On the Civil Religion”, still remains problematic. Jean-Jacques Rousseau seems to have invented the concept of “civil religion” to find a way to guarantee the fidelity of each citizen to the Sovereign. But what is this “civil religion” precisely? By what kind of means can this religion guarantee the citizens' fidelity? To solve these problems, we will examine the expression used by Rousseau which seems to summarize precisely the essence of the “civil religion”: the “sentiments of sociability [sentiments de sociabilité].” We will be able to show the importance of this expression only after a detailed exploration of its historical and philosophical context, which can be divided into four Parts: Part I will offer an analysis of the concept of “sentiment” used by Rousseau in the late 1750s. This Part will also show the philosophical background of this concept. Part II will describe the historical background of the writing and the publication of the Social Contract, focusing on the chapter “On the Civil Religion.” Part III will offer a detailed examination of the concept of “sociability:” we will verify the theoretical and polemical aspect of this concept, as it is used by Rousseau. Part IV will offer a detailed analysis and commentary of the chapter “On the Civil Religion” of the Social Contract, weaving together the various threads of the explanations provided in the previous parts. As a whole, this dissertation asserts that religion was a necessary component of Rousseau's political system, insofar as it provided a tool to generate self-contradiction and, as its consequence, moral thought and moral choice in the citizens' conscience

O objetivo da pesquisa é compreender o conceito de Lei Natural e Lei Civil na obra de Rousseau e analisar a possibilidade de uma relação entre estes dois conceitos e formação de uma concepção única de Lei. Porém, constatou-se que existe uma interseção e uma interdependência entre conceitos de Lei Natural e Lei Civil construído dentro de uma linearidade que se inicia no plano hipotético do Segundo Discurso e se concretiza no plano histórico do Contrato Social, mas não há possibilidade de formar um único conceito de Lei. Ou seja, a Lei Natural emerge no estado de natureza e pode ser definida como conjunto de princípios naturais compartilhados entre o homem e a natureza, dentre eles: amor de si, piedade e princípios naturais que distinguem os humanos e dos outros seres, a saber: liberdade e perfectibilidade. Tais princípios impulsionaram o homem, naturalmente solitário e sem noções de moralidade, a perfazer modificações em sua relação com a natureza no sentido de melhorar as condições de sobrevivência e gradativamente intensificar suas interações sociais, situação que, apesar de ter trazido ampliação consciência de si e do outro e o amadurecimento moral, acentuou a progressão da desigualdade que culminou num estado de guerra que é finalizado com o pacto social ou pacto dos ricos. Este institui justiça e o direito, através de uma proposta de uma igualdade jurídica, que pode ser considerada uma expressão de maturação dos cidadãos no que se refere à concepção Lei. Porque esta, que até então, era um conjunto principiológico sem exigibilidade, passa, a partir do estabelecimento do contrato a ter força coercitiva que dará, diferentemente do pacto que é ato primitivo de natureza contratual, movimento e vontade ao corpo político. E nesse movimento legislativo os súditos devem primeiramente, se observar enquanto partícipes da autoridade...
The research is aimed to understand the concept of Natural Law and Civil Law in the work of Rousseau and to examine the possibility of a relationship between these two concepts and the formation of a single conception of Law. However, it was found that there is an intersection and interdependence between the concepts of Natural Law and Civil Law built inside a linearity that begins in the hypothetical plan of the Second Discourse and that is realized on the historical level of the Social Contract, but there is no possibility of forming a single concept of Law. That is, the Natural Law emerges in the state of nature and it can be defined as a set of natural principles shared between man and nature, among them: love of self, compassion and natural principles that distinguish humans and other beings, namely: freedom and perfectibility. Such principles drove the man, naturally lonely and without notions of morality, to make changes in his relationship with nature to improve the living conditions and gradually intensify his social interactions, a situation that, despite having brought expansion of his own conscience and self-awareness the other and moral maturity, highlighted the progression of inequality that culminated in a state of war that ends with the social pact or pact of the rich. It establishes justice and right, through a proposal for a legal equality, which can be considered as an expression of citizen maturation regarding the Law conception. Until then, this was a logical principle set without enforceability and from the establishment of the contract it begins to have coercive force that, unlike the pact that is a primitive act of contractual nature, is going to give movement and will to the political body. Full textIt is customary to mention the report of J.-J. Rousseau to History to enunciate his anthropological optimism to which, like a chiaroscuro, opposes a historical pessimism. Rousseau is above all a humanist, his work is mainly oriented on man and he finds a modern man under the irons, bending under drowsy regimes, with a few exceptions. In the (disastrous) dynamic of history, the citizen perceives only a linear, increasing and secularized degradation, far from any theodicy, the man is the main artisan of his misfortune. However, one cannot conclude to a pessimism without appeal, the citizen hopes in a providential man who can circumscribe this tendency. The historical productions of Jean-Jacques are few and focused mainly on public law. But in the sketch of the history of his republic, Jean-Jacques proved a formidable historian. But History does not interest him much and assigns many faults to him, even if he remains acquainted with ancient history. Rousseau is convinced that history reveals only a denatured man to whom "crutches" are necessary and the author of the Contrat social thinks of the primacy of politics or recourse to mediation. In the relations maintained by the citizen, in three stages, he is first of all the historian of a happy socialization, then evokes his anthropological optimism to which echoes a true process instructed in history; in the end, the last step, the citizen ideologizes History, especially ancient, with a view to a possible and beneficent socialization of man

Full textThe chapter VIII from book IV “De la religion civile” is a theory brought out by Jean-Jacques Rousseau during the redaction of the Contrat social. The idea is translated through a new conceptualization of the politico-religious link which assigns itself the main objective of changing man into citizen. As soon as the book came out May 1762, the chapter was refuted by quite a huge number of Christian authors who rose up against the antisocial vision of Christianity as built buy Rousseau. From the beginning of the Revolution, the chapter will experiment a true political life which will start in March 1790 by an exploitation of the concept. Then, after another minimalist application of the idea in May 1792, which leads to predict of all difficulty to use Rousseau’s notion, the Revolutionaries will truly start to build in a philosophico-political way the idea of civil religion. So, at the time of the Revolution’s patriotic fire, accelerated by the king’s death, citizenship will become a central political project, and Rousseau’s innovative vision will turn out to answer the Assembly demands. But, in spite of the intensified patriotism it should generate, remains in the XVIIIth century France a huge obstacle to its institution: Catholicism. However, with the ware of dechristianization which started in brumaire year II, the roman religion will go through a hasty decline allowing then a free hand to Robespierre and the “Comité de salut public” to implement the revolutionary civil religion. The 18th floreal decree will answer that will and will be very favourably received by the French population

Full textCe Tiers, au sortir de la théologie médiévale, s’est d’abord incarné dans le concept de Corps ;le corps de l’État dérive en droite ligne du corps du Christ d’abord, de celui de l’Église ensuite, et a offert à l’autorité, alors pensée sur un registre hétéronome, divin et naturel, un écrin la liant à une légitimité et une nécessité naturelles. Le mythe du Corps, pourtant, va petit à petit devenir celui du Père au fur et à mesure de la constitution de l’État, et singulièrement de la monarchie absolue. Le Père campe alors le caractère nécessaire de l’autorité devant être exercée par le créateur sur sa chose créée, mais permet de continuer dans le même temps à faire bénéficier les structures existantes de l’empreinte théologique représentée sur terre par des mandataires héréditaire – les princes. L’institutionnalisation de l’État, et la relative stabilité qui va en découler, va toutefois fournir le cadre apte à permettre à une pensée du sujet d’émerger, faisant naître des concepts qui, tels la multitude et le peuple, posent de plus en plus directement la question de la légitimité par la prise en compte de la volonté de ceux sur lesquels elle s’exerce. C’est ainsi que naîtront les théories du pacte social, qui tentent chacune à leur manière de concevoir un moment méthodologique où l’octroi du pouvoir soit a été cédé dans le passé, soit est toujours exercé par le peuple à chaque instant. Le mythe du contrat, ainsi, est celui par lequel la légitimité de l’autorité est conciliée avec l’origine du pouvoir. Cette liaison est rendue possible par le meurtre du Père, c’est-à-dire la suppression de l’autorité naturelle et nécessaire au profit d’une autorité conventionnelle et contingente. Or, le mythe du contrat est fragile ;il nécessite, pour juguler le flux de contingence qui émerge dès lors que la question de la légitimité se pose, que la question de la nature du pouvoir soit dûment maîtrisée. Cela demande que l’autorité ne prenne pas sa source dans le repli sur le présent permanent, c’est-à-dire sur le peuple, mais sur un critère de représentativité. Cela nécessite surtout un refoulement conscient de la nature et de l’origine de l’autorité vers un sur-moi qui constituera, à l’apogée de la modernité, le cœur abstrait de la notion de souveraineté.
Or cette conception de l’autorité se fissure elle-même sous le poids d’une contingence qui, comme flux permanent, tend par nature à excéder son cadre. A terme, ainsi, l’étiolement de la souveraineté coïncide-t-il avec l’avènement du dogme des droits de l’homme, appelés sur un registre immanent à compenser la perte de sens induite par l’insuffisance de verticalité assumée par la modernité.

Full textThis essay intends to analyze the principle of mutualism in light of the eighteenth century contractual theory produced by Jean-Jacques Rousseau, as a form of free association that brings benefits for all of its members, which benefits are to be reached through the gathering of forces of those members aiming the common good. It will be explored the similarities between the contractual theory of Rousseau and the principle of mutualism, since in both cases the members of a collectivity contribute to get benefits from this association. Thus, these members assure protection against occasional misfortunes and related damages arising from its occurrence. Then, we start to view the social pact as a more specific kind of association, as in the insurance agreements, and not as a political organization. We will also study the relation between the risk inherent to the social contract and to the insurance agreement, which has the principle of mutualism as cornerstone. It will be discussed the philosophical fundaments of the principle of mutualism in the insurance agreements, since the insurance agreements are based on the concepts of the common good, presented in Rousseau's contractual theory; allowing that all the members of the insured collectivity benefit from the tranquility of having their personal or material assets protected against future or uncertain misfortunes, or against damages caused at the time of the loss, that could not be borne by them individually. At last, we will analyze the principle of mutualism and the insurance agreements in the Civil Code of 2002, and on recent decision of the Appellate Courts of the State of São Paulo
O presente trabalho tem por proposta a análise do princípio do mutualismo à luz da teoria contratualista do século XVIII elaborada por Jean-Jacques Rousseau, como forma de associação livre que traz benefícios para todos os que dela participam, alcançados pela soma de esforços para o bem comum. Serão exploradas as semelhanças a teoria contratualista de Rousseau entre o princípio do mutualismo, visto que em ambos os casos os membros de determinada coletividade contribuem para se beneficiar dessa associação, garantindo, assim, a proteção contra eventuais infortúnios e danos decorrentes de sua ocorrência. Passa-se, então a considerar o pacto social sob um prisma menor de associação, como nos contratos de seguro, e não sob o ponto de vista de organização política da sociedade; assim como será abordada a relação entre o risco inerente ao contrato social e ao contrato de seguro, cujo pilar de sustentação está no princípio do mutualismo. Serão feitas considerações sobre a fundamentação filosófica do princípio do mutualismo nos contratos de seguro, na medida em que este é fundado nas concepções de bem comum, tais como apresentadas no contratualismo de Rousseau; possibilitando que todos integrantes da massa segurada desfrutem da tranqüilidade de garantir seus bens pessoais ou materiais dos infortúnios futuros e incertos, ou dos danos efetivamente causados quando da ocorrência de sinistros, o que de forma isolada não teriam condições de assumir. Por fim, serão feitas reflexões sobre o princípio do mutualismo e os contratos de seguro no Código Civil de 2002, bem como sobre recentes decisões do E. Tribunal de Justiça do Estado de São Paulo

Full textThis research focuses on the link between political participation and social bonds in Rousseau's political theory. We present a new interpretation of the concept of general will as relevant to individuals rather than the collective, focusing on its descriptive and emotionalrather than normative and rational dimensions. General will measures citizens' attachment to laws in so far as they see them as a means of promoting their own best interests as social beings.However, the general will of citizens could not be maintained if they did not regularly reassess the terms of their association and verify their effectiveness within specific institutions. The exorbitant demand for popular sovereignty, which is the direct exercise of legislative power, is rooted in the ideal of legal sociality at the heart of Rousseau’s political theory. This ideal finds counterfactual embodiment in the practices and demands of the Geneva bourgeoisie, to which the Social Contract gives a theoretical foundation ex post facto, especially during the first third of the eighteenth century. Rather than abstracting the Social Contract from its context in the hope of extending its scope, we argue that, paradoxically, its universality lies in this particular context. Through a dialogue with the theories of Rawls and Habermas, we show that the Social Contract supports the demand for a radical deliberative democracy

Full textThis research takes its position in the line of research on happiness in Rousseau, which goes from Robert Mauzi to Michel Delon. Encompassing this acquired knowledge, it sets out to prolong the analysis of it and to take into account the autobiographical, moral, ethical, and political work of Jean-Jacques Rousseau. This thesis probes the coherence of this recurring theme and confronts the multiple facets of it disseminated in the work. There exists in the work a dynamic of happiness subject to oscillatory movements. The first concerns the theory of ecstasy and gives rise to the opposition between a happiness as the withdrawal into oneself and another happiness as the expansion beyond oneself. This movement then affects the forms of sociability, going from the happiness of solitude to the happiness of the limited social relationship, eventually broadening out by moving between its moral dimension and its political dimension, between the happiness of the man and that of the citizen. This regular and rhythmical dynamic, involving a duality, is however exceeded to the benefit of a happiness as a unity, revealing a dialectic of bliss. This dynamic, in short, allows an understanding of the fiction as the matrix of bliss

Full textIn the france of the 17th and the 18th century some prominent writers like corneille, bossuet, montesquieu and rousseau, simple essayists like saint-evremond, and revolutionaries like marat and robespierre did not adhere to the admiration of ancient rome that had become traditional in europe since the renaissance. The author makes this point by a detailed study of the works of these writers who, in spite of texts written with certain precautions of style, denounce the excessive cult of rome of modern europeans, its aspiration to universal domination, its institutions and the corruption which takes over after several centuries of existence. These studies are accompanied by analyses which link these critical opinions of rome to the political views which are implicit or explicit in each work. Resumo: Esta dissertação é uma leitura da noção de convívio social em diversos escritos de Rousseau. É uma análise de como o autor dialoga com o seu tempo a partir de temas voltados à vida em sociedade. No primeiro capítulo, dedico-me a apresentar os pressupostos que dão surgimento ao debate, os quais se encontram no Discurso sobre as Ciências e as Artes e no Discurso sobre a desigualdade. No segundo capítulo, examino pontos importantes da proposta educacional de Rousseau no Emílio, a fim de destacar a necessidade de preparar o indivíduo livre e autônomo, antes dele ser inserido na sociedade. No terceiro capítulo, a partir do romance A Nova Heloísa, analiso a busca do autor por uma perfeita socialização dentro de um contexto familiar comunitário. No quarto capítulo, faço uma leitura do Contrato Social como um projeto político que também persegue uma perfeita socialização, porém aqui buscando recursos para atrair o indivíduo para dentro da comunidade, e dando-lhe uma nova identidade, pautada sobretudo nos interesses comuns
Abstract: This dissertation is a reading of social life notion in several Rousseau¿s writings. It is author¿s discussion with his time, from questions related to life in society. In the first chapter, I dedicate myself to present the basic ideas that give rise to the debate, which are on Discourse on the origin of inequality and Discourse on the Sciences and Arts. In the second chapter, I examine important points about Emile¿s educational proposal, in order to highlight the need to prepare the individual free and autonomous, before insert him into society. In the third chapter, from the novel The New Heloise, I analyze the author¿s seek for a perfect socialization within a family and communitarian ambient. In the fourth chapter, I read the Social Contract as a political project that pursues a similar perfect socialization, but seeking resources to attract the individual into the community and giving him a new identity, based on common interests

Resumo: Analiso na presente dissertação o nexo entre opinião e virtude em Rousseau. São discutidas, principalmente, quatro obras do filósofo: o Discurso sobre os fundamentos e a origem da desigualdade entre os homens, a Carta a d¿Alembert, as Considerações sobre o governo da Polônia e, por fim, o Emílio. É observado a importância da opinião e o caráter ambivalente desta no pensamento rousseauniano. Enquanto no Discurso sobre a desigualdade a alienação na opinião do outro é vista como um elemento corruptor, na Carta a d¿Alembert e nas Considerações sobre o governo da Polônia, a opinião pública torna-se diretriz da conduta do cidadão. Nesta dicotomia, o Emílio apresenta-se como tentativa de educação do homem virtuoso que sabe viver em sociedade sem alienar-se na opinião alheia
Abstract: In this dissertation I present the connection between opinion and virtue in Rousseau. Four works of the author are examined: the Discourse on Inequality, the Letter to D'Alembert, the Considerations on the Government of Poland, and the Emile. It is observed the importance of the opinion and its ambivalence in Rousseau¿s thought. Whereas in the Discourse on Inequality, the alienation in the other¿s opinion is view as corrupter element, in the Letter to D'Alembert and in the Considerations on the Government of Poland, the public opinion became the directive of the citizen¿s conduct. In this dichotomy, Emile presents an attempt of a virtuous man education who knows how to live in society without the alienation in the other¿s opinion

By the immanent analysis of the libretti, scores and recordings of the operas La découverte du nouveau monde, Le devin du village, Daphnis et Chloé, Les muses galantes, Pygmalion, romances and motets, composed by Jean-Jacques Roussseau, our work s theme is the history of the Enlightenment society through the composer s critic to what he named tourbillon social. Such critic was built on the hypothesis of a state of nature foreseen to correct a turbulent and corrupt society. Our starting point is the idea that Rousseau s sensitivity, as an artist of the XVIII th. Century, explains a paradoxal world and expresses a contradiction which opposes the natural to the modern . It is an idealization that confronts nature with the corrupt society; that materializes, in music and text, a modern vision of world, which moved away from a state of nature idealized by the composer. A design about the bourgeois world of the XVIII th. Century, and about the way a woman behaved in that social dynamics
Pela análise imanente dos libretos, partituras e gravações das óperas La decouverte du nouveau monde, Le devin du village, Daphnis et Chloé, Les muses galantes, Pygmalion, romanzas e motetos compostos por Jean-Jacques Rousseau, nosso trabalho tematiza a história da sociedade iluminista pela crítica do compositor ao que denominou tourbillon social. Crítica construída com a hipótese de um estado de natureza previsto para corrigir uma sociedade turbulenta e corrupta. Partimos da idéia de que a sensibilidade de Rousseau, como um artista do século XVIII, explica uma paradoxalidade de mundo e expressa uma contradição que opõe o natural ao moderno. Uma idealização que confronta natureza e sociedade corrompida. Que materializa, em música e texto, uma visão de mundo moderna, que se afastou de um estado de natureza idealizado pelo compositor. Um desenho do mundo burguês do século XVIII e da forma como a mulher agia naquela dinâmica social
