This chapter discusses high liberalism, starting with its conception of equality based on an equal sharing of material goods. Compared to the classical liberal ideal pursued by Americans, the European vision of liberal equality saw property rights not as guardians of equality but obstacles to its realization. This notion of property rights extends back at least to Jean-Jacques Rousseau. The chapter first considers the high liberalist views on property and equality, focusing on the arguments advanced by Rousseau, Karl Marx, and John Stuart Mill, before discussing the rise of social justice and the decline of economic liberty. It then examines John Rawls' idea of justice as fairness and the emergence of libertarianism as the leading philosophical alternative to high liberalism. It also explores the fundamental ideas of high liberals with regard to economic liberty and the role of the state in regulating economic affairs in pursuit of the distributional requirements of social justice.

This need is manifest in the precision with which he describes in his Confessions the kinesthetic valence of his emotional experiences and the impact kinesic dialogues had on him. Several of the kinesic dialogues he records in his autobiography revolve around surprising shifts in tonicity, tone, and tempo in verbal utterances, gestures, and the vital action of breathing. This chapter considers four such passages, including a scene of writing in which Rousseau’s emotional state is specifically communicated by the very fact that his handwriting is unreadable owing to the trembling of his hand.

Sometimes it is claimed that not only have human beings always lived under a state, but that it is the only way they possibly could live. On this view, which is often associated with Aristotle, the state exists naturally in the sense of being natural to human beings. In response, some theorists argue that human beings have been able to live without the state. The chapter begins with a discussion of Rousseau's idea of the state of nature as well as the views of Rousseau and Hume on pity, justice, property, and deception. It then analyzes Rousseau's The Social Contract, an exercise in full-blooded Hobbesian sovereignty theory, and his attempt to start from a different place in the theory of sociability, and then offer a purposefully counter-Hobbesian theory of sovereignty. The chapter argues that Rousseau ultimately could not get past Hobbes, and ended up returning to the latter's positions.

Abstract:
This chapter examines the ways in which the distinctive conception of the moral order in conservative liberalism and Ordo-liberalism bears testament to the metaphysical and epistemological imprints of continental European ethical philosophy as it evolved in the period from the 1880s to the 1930s. Ethical philosophy helped to give flesh to their conception of liberalism as about human flourishing. The chapter begins by reflecting on the complex relationship with Adam Smith as political economist and moral philosopher and on the enormous importance of Immanuel Kant in shaping the broad parameters of the way in which conservative liberals and Ordo-liberals engaged with the ethical basis of liberalism. The founding thinkers of this tradition rejected Sigmund Freud, Karl Marx, Friedrich Nietzsche, and Jean-Jacques Rousseau. The chapter investigates in depth the complex connections—far from neat causal relationships—between conservative liberals and Ordo-liberals and a range of philosophers with whom they had often studied or knew as family friends: Rudolf Eucken, Edmund Husserl, Max Scheler, Nicolai Hartmann, William James, and G. E. Moore, as well as the special case of Louis Rougier and of French positivism in the work of Rougier and Jacques Rueff. Attention is also paid to the Euckenbund (Eucken Association). This context is important in understanding the hostility of the founding thinkers to determinism, subjectivism, utilitarianism, naturalism, empiricist Realism, and moral relativism. A contrast is drawn between the differing philosophical roots of the early Austrian tradition and Ordo-liberalism. The chapter closes with an examination of the implications of developments in philosophy for the reception of conservative liberalism and Ordo-liberalism and of the problematic relationship between truth and relevance as it arises in economic and financial crisis.
