Abstract:
The topic of the thesis is Regulation (EC) No 1896/2006 of the EP and of the Council of 12 December 2006 creating a European order for payment procedure. Regulation established an additional and optional means for the claimant, with the purpose to simplify, speed up and reduce the costs of litigation in cross-border cases concerning uncontested pecuniary claims and to permit the free circulation of European orders for payment throughout the Member States without any intermediate proceedings prior to recognition and enforcement. The aim of the thesis is to analyze the current shape of legislation, its interpretation by the ECJ and existing practical experiences with the application of the tool in the Czech Republic. Chapter one is devoted to the development in the field of judicial cooperation in civil matters, called as well as European civil procedure, and to the summary of the existing regulations. Chapter two deals with the thorough analysis of the laid down proceedings and its consecutive phases. It also contains the evaluation of these regulatory efforts. Chapter three focuses on the analysis of a reference for a preliminary ruling in the Case C-215/11 Szyrocka which is not yet decided. The reference depicts problematic points of coordination between the Regulation and civil procedures of Member States. Last chapter pursues the application of the European order for payment in the Czech judicial system. It summarizes the statistical data about usage of the procedure in the Czech Republic. Moreover, it presents the findings of the qualitative research carried out at thirty district and regional courts.

This Thesis is focusing on recycling waste paper, which became one of the main collecting commodities for its widespread use in many economic regions. The thesis presents information about product options, new materials from processed waste and waste paper. First mentioned option for using waste paper is the application in substrate production technology as an input material with excellent physical properties, which could become an indispensable component in the production of highquality substrates. The resulting values indicate a higher absorption capacity of fluids that are substrates of biodegradable materials. The next part of the thesis contains the practical information and value gained from the process of production of briquettes from waste paper, In both technologies there are present variations of the different samples and their ratios used to manufacture the final products and are shown in the resulting comparison.

Im interested in the topic of praying machine, because I want to analyze aspects of photography and its functions. It's known, that the reality is manipulated by photography. Bud we can also say, that the relationship between reality and photography is neutral in fact, that the manipulation is made by our interpretation of photography. The change of the reality can be realized just in the dialog between photography and reality. Can it be, that the mechanization change into the will? Does it prays praying mill or the buddhistic monk, who rotates the mill? When he believes into it, is it enough? Or is it enough if believes who watch the monk with his mill? ... Abstract:
The subject of this dissertation is to discuss Zigniew Kruszyński’s output. The paper was designed as a quite complete presentation of the problematic aspects of Kruszyński’s subsequent books although, the main body talks round problematic congeries being at the same time the key words pointed in the title of the paper: disintegration – writing – salvation. The aim of the dissertation is to order and systematise scattered views and opinions about the subject of Zbigniew Kruszyński’s prose and in the first place, presenting own interpretation of this phenomenal work based on belief that there are clear relationships between the condition of the literary words created by the author and the repertory of used rhetorical terms. The primary aim is an attempt to capture the core of the literary project created the author of ‘Alexander’s Return’ – extremely original as well as aesthetically and intellectually sophisticated. The initial chapter contains the general characteristics of Zbigniew Kruszyński’s works, it shows how his novels and stories were placed in the map of Polish prose after 1989, in what contexts it was discussed and how the initial reconnaissance of researchers and critics presented itself. In chapter I (related to the novel Schwedenkräuter, 1995) Anna, who is problematic and intriguing as well as crucial for the interpretation of Zbigniew Kruszyński’s later volumes, is (next to the author) acknowledged as the key character of the writing. The considerance is focused on ambiguous terms: moving, assimilation and rooting, and on the problems of the language used by the author to ‘capture’ disintegrating reality. Chapter II (related to Historical Sketches, 1996) begins the speculations on the subject of the genre type of the second novel in Kruszyński’s output. In the course of interpretation the problem of history/historicity rises – as if it was ‘cancelled’ or ‘suspended’. The key issue of disintegration and merging the life of the main hero of the writing returns. Chapter III (related to the storybook On Lands and Seas, 1999) – brings an attempt of showing the ‘spirit’ of the philosophy present in all the stories – the philosophy determining the whole plot and all the characters’ choices. The result of this philosophy is marginalisation of individuals who experienced the changes very sorely. Anna, the character who tries to merge the disintegrating reality reappears. The subject of a ‘new literature definition’ is also covered (the trace of Kruszyński’s theoreticalliterary interests). In part IV I (related to Alexander’s Return, 2006) all the stories from the volume are analysed however, in the centre of the author’s attention is Alexander – the motives of his actions, hidden intentions (the issue connected with his fake return from emigration to the home country). Behind the illusion of repatriation there are hidden failures of individual characters and the above all, the desire to meet the Other. Chapter V (related to The Last Report, 2009) starts with the contemplation about the subject of the writing. The Last Report only seemingly signs in the political-vetting encounters which were dealt with the most intensively in 2005-2006. The main hero of the novel is not an embodiment of today’s Wallendor and his attachment to the traitors and double agents circle is also doubtful or at least ambiguous. In fact, he is rather a compulsive voyeur, an artist and a graphomaniac, and above all a sensitive human being who tries to save the sense and integrity of the world through the writing. Chapter VI (related to micronovel Curator, 2014) – was composed as a quite vast interpretative draft presenting initial reconnaissance on the subject of the recently published work. On one hand Curator clearly breaks out of Kruszyński’s previous works, maybe it announces the turning point in writing – in order to communicate with less demanding audience. On the other hand however, Curator continuous the subject of disintegrating the reality and the loss of Anna.

Abstract:
The subject of the doctoral thesis: "Decades - memory decay. The record in clay", concerns autobiographical memory of an individual, attempt to find one's own identity. And the additional message included in the record shows relationship between the artist and the recipient. This work is a composition built of five painting objects depicting five decades of my life - the imprints made of one matrix being a mapping of a cavity - a trace in earth neighbouring my family house. The place evokes memories which form a personal record, a code of signs. My work is also an experience synthesis of various media that is a sensory feeling in the process of creation. In the interdisciplinary activity I have been trying to visualize my memories and the five objects I mentioned about are the place they were revealed. Searching for the most suitable method of performance which memory loss (having various reasons) or superimposition I have taken up painting activity on objects' planes from fired clay. I have adapted inlaying method, which according to me, is similar in its process to memory function. Some events, facts prevail, get recorded or embedded in our memory, others fall off, get lost like inlaid colored elements of clay compositions. Each and every record, being a trace-sign made by a man, confirms an unceasing interaction of perception on various planes, where the present time blends with pictures from our past. The interdisciplinary method enabled me to find the fullest way to materialize the issue concerning memories, recollections and imagination in my doctoral dissertation.

Abstract:
Plasmachemical processes are one of the methods used for wastewater treatment. Sewage and household wastewaters include a variety of organic substances that must be removed to reuse water in industry or households. The aim of this diploma thesisisthe observation of alkaloids decomposition by plasma chemical process. The theoretical part is focused on plasma generation in liquids and characterization of selected alkaloids. The decomposition of caffeine and quinine in direct current electrical discharge in liquid with diaphragm configuration is investigated in this work. The experiments were carried out in a batch reactor divided into two parts by a diaphragm made from ceramic material ShapalTM-M (thickness 3.0 mm, pin-hole diameter 1.0 mm). The stainless steel electrodes of 5×12 cm size were used. The mean electric power was set to 135 W for an operation time of 60 minutes in each experiment. Caffeine solutions (total volume of 4 L) were prepared in concentrations of 10, 25 and 50 ppm, quinine solutions in concentrations of 5, 10 and 15 ppm. The initial conductivity was adjusted by sodium chloride at three different values – 400, 750 or 1000 µS•cm-1. The experimental part consisted also of using analytical methods necessary for compound quantification. Hydrogen peroxide formation during the electrical discharge was determined by colorimetric method based on generation of yellow complex with titanium(IV) sulfate reagent. The caffeine concentration was measured by UV spectrometric method at wavelength 273 nmand thenHPLC/MS analysis was performed. Quinine degradation was monitored by UV-VIS spectrometry and fluorescent measurements. The plasma generation in water solutions induces formation of hydroxyl radical, hydrogen peroxide, oxygen, hydrogen and other reactive species. Hydrogen peroxide is produced and then utilized in degradation of organic compounds and thus lower concentration of H2O2was measured in solution with caffeine and quinine than in solution without alkaloids. However, the situation is different between cathode chamber and anode chamber. There is only negligible amount of H2O2used on degradation in cathode chamber. In contrary, the considerable degradation of caffeine and quinine and diminished concentration of H2O2 was observed in anode chamber.

Abstract:
In the soil, the plant material is decomposed by several factors. In the process, one part of the carbon returns to the atmosphere as carbon dioxide, whereas another part is stabilised in the soil. The aim of this study is decomposition and stability of organic matter in soil using a simple and innovative TBI method. Through this method, we examined the weight change after the incubation period of 90 days, where biomass of green tea was degraded in cambodia soil. Tea bags have provided us with valuable information on the decomposition and amount of carbon in the soil, because the biomass itself is of organic origin. This information is based on the fact that the soil and the decomposition processes have a direct impact on the change in climatic conditions. Thanks to further analytical methods, elemental analysis, thermogravimetric analysis and infrared spectroscopy with Furier transformation, was found indispensable information about tea composition.

Abstract:
This master’s thesis is focused on a study of temperature influence on ozone generation and decomposition by chosen solid surfaces. Ozone is unstable gas that is decomposed spontaneously. This decomposition can be accelerated by various factors such as increase in temperature or reaction with other substances. The aim of this study is to determinate how fast the ozone decomposition proceeds at different temperatures and how the homogenous decomposition of ozone is accelerated by heterogeneous processes on the walls of solid materials. Currently in practise ozone is used in many areas and the finding of the rate of its decomposition can help to increase efficiency of its production and subsequent specific applications. In the theoretical part of the thesis, these points are described: important properties of ozone, possibilities of its utilization, the ozone generation, some methods of determination of the ozone concentration, ozone relationship to various solid surfaces and present theoretical knowledge about the effect of temperature on the ozone generation and decomposition. In the experimental part, the rate of the ozone decomposition in reaction tubes made of copper and iron of two different surface to volume ratios was investigated at temperatures of 10, 25, 40, 55, 70 and 85 °C. Ozone generated from oxygen was closed in the reaction tube and the decrease of its concentration during the time was observed by absorption spectroscopy. From obtained exponential dependencies, the rate constants at different conditions of this experiment were evaluated. The rate of ozone decomposition significantly increased with higher temperature. The fastest ozone decomposition took place in the iron tube of larger inner diameter (8 mm).

Abstract:
Following thesis regards itself with Voronoi diagram creation in 3D using a graphics card. It focuses on and compares certain algorithms that construct the diagram when given set of points in space. For this purpose there have been two algorithms implemented.  First one creates Delaunay tetrahedralization using parallel splitting and flipping of present tetrahedra. Then it transforms it into a Voronoi diagram. The second algorithms utilizes planes to cut a mesh until required shapes are created.  Testing shows the advantages and disadvantages of these algorithms and their relative performance. Main takeaway from this work for these algorithms is the relative sensitivity of the second method to the use of inappropriate shape in relation to given set of points. For the other algorithm its slower start and relative unsuitability for use with smaller sets of points is apparent, but it is greatly optimized for big sets.

European Arrest Warrant is an institute of the police and judicial cooperation in the criminal matters. Based is on the mutual confidence of Member States in its legal systems. His formation was caused not only by the failed ratification of the international agreements governing extradition, but also by the terrorist attacks occurred on 11 September 2001 in New York. European Arrest Warrant meant the breakthrough into the national traditional sovereignty of Member States and that all to ensure the area of freedom, safety and justice inside Europe. Formation of the European Arrest Warrant led to the restriction of some principles, which dominated to the extradition, when between the most important ones belongs the principle of surrender of own citizens. This thesis describes events preceding the adoption of the Regulation, the procedure of adoption of the Regulation, as well as, development of the content of individual provisions of the Regulation and the content of the actual adopted and binding Regulation. In this thesis, the European order for payment procedure is also compared with nati- onal orders for payment procedures in the Czech Republic, France and Germany. The selection of these three countries was not unintentional. The Czech Republic was chosen because the thesis was written in the Czech language, in the Czech Republic and shall also be published in the Czech Republic, therefore the author believes the majority of potential readers know the Czech order for payment better than any other order for payment procedure. This aspect was also the main reason why the Czech order for payment is described at the beginning of this thesis. The German and French orders for payment procedures were chosen because the European Commission claims the French " injonction de payer" and the German "...

Electronic payment order in civil procedure Abstract Electronic payment order is introduced into the Czech legal system by the amendment of the Civil Judicial Procedure Rules no. 123/2008 Sb. implementing a new institution within the payment order procedure. Electronic payment order is presented as an institution able to help the Czech judiciary system within the shortened civil procedure by the application of the computerization of civil procedure. I decided to begin my thesis with a chapter trying to clarify the role of electronic payment order within the frame of the computerization of justice. I provided a brief account of the development and contemporary trends related to the computerization of justice and I approached the individual institutions which I regarded as appropriate to mention in order to understand the given institution within the whole context. The third chapter deals with reasons for which the institution was implemented into the Czech legal system. I carried out a detail analysis of the explanatory report to the Act introducing the institution of electronic payment order and I made an effort to outline the main reasons for the amendment and to arrange the objectives intended to be achieved by the implementation of the new institution. The third chapter focuses on the institution of the...

Resumé EUROPEAN ENFORCEMENT ODER AND EUROPEAN PAYMENT ORDER For my master thesis I chose the topic, the European enforcement order and the European payment order, which is mainly focused on two regulations : the Regulation (EC) No 805/2004 of the European Parliament and of the Council of 21 April 2004 creating a European Enforcement Order for uncontested claims (thereafter only as a "REEO") and the Regulation (EC)No 1896/2006 of the European Parliament and of the Council of 12 December 2006 creating a European order for payment procedure (thereafter only as a "REPO). The thesis is divided into five parts. The first part is Introduction. The second part named the General Part deals with general topics which have a certain relationship with the questions of the thesis. Firstly, I am writing about the enforcement order and the payment order in general. Then, I am writing about the enforcement order and how it has been regulated in a few European member states. The General part also describes main aspects of private international law and European private international law. The component of the General part is also the historical development of the European law. Finally, I am mentioning a general concept of the arrangement of the recognition and enforcement of foreign judgements. The third part named European...

Faculty of Law, Charles University in Prague, Department of Commercial Law Dissertation topic: European Order for Payment and European Small Claims Procedure Author: Mgr. Ing. Jakub E. Chmelík, LL.M. June 2010 1 General Overview The topic of my dissertation work is European Order for Payment and European Small Claims Procedure. In particular, I examine two European regulations relating to European private international law: (i) Regulation (EC) No 1896/2006 of the European Parliament and of the Council of 12 December 2006 creating a European order for payment procedure and (ii) Regulation (EC) No 861/2007 of the European Parliament and of the Council of 11 July 2007 establishing a European Small Claims Procedure. An older Czech translation of the term "European Small Claims Procedure" (Evropské řízení o drobných pohledávkách) essentially corresponds to the current official Czech translation (Evropské řízení o drobných nárocích). 2 Aim, Structure and Content The aim of my research is to analyze the legal provision of the European order for payment and the European small claims procedure. As a part of this analysis, I also attempt to describe the key correlations between these two regulations and Czech civil procedure regulations. Another aim of my research is to compare European regulation with...

Abstract:
The diploma thesis deals with the current legislation of a payment order procedure. It is focused on issues for which legislation does not have an explicit answer. The thesis in particular with the help of generalized conclusions from more significant court decisions tries to find solutions for situations that occur more or less often during the payment order procedure, but are not dealt with uniformly in the practice of lower courts. The existing legislation is also compared with a possible future modification in the new civil procedure code. At first, the concept of the payment order procedure and its basic principles are defined. Furthermore, the importance of this form of procedure for the current Czech judiciary is evaluated, as it helps to speed up and simplify activities of judiciary. This is also achieved by involving court emloyees in decision-making acitivity, whose specifics are also described by the thesis. The following sections are focused on a payment order, an electronic payment order, a payment order under a bill of exchange or a cheque and a European order of payment. The conditions for issuing a given type of decision, its content and the defense options of the defendant are always interpreted. The differences between each sub-type of payment order procedure from general civil proceedings...

in English: The Expression of Plea, Request and Order in Spanish (with Regard to Czech) The aim of this work is to examine the language forms for expressing a plea, request and order in Spanish, taking into account their Czech counterparts. The work is divided into theoretical and practical part. In the theoretical part of the work we start from the basic works that gave rise to the modern theory of politeness. These findings then serve as a pragmatic basis for the study of our selected structures. For analysis we choose: imperative, deontic use of infinitive and gerund, deontic use of paradigms hablaré and hablo, performative use of verbs mandar and ordenar, performative use of verbs pedir, rogar and suplicar, interrogative constructions with verb poder, interrogative constructions with por qué no, interrogative constructions with quieres and interrogative constructions with te importa / importaría que. We theoretically describe these constructions and then analyze them on the Intercorp v12 corpus and present their Czech counterparts. Our intention is a qualitative analysis, with special emphasis on the context in which the structure is located.

The thesis deals with the issue of dual criminality test under the European arrest warrant. The aim of the thesis is to analyze the way of applying the dual criminality test between the Member States of the European Union while surrendering persons. It focuses on the European arrest warrants issued against Catalan politicians in relation to the Catalan referendum regarding the independence from the Kingdom of Spain and the subsequent decisions of the Belgian and German courts. The thesis is divided into seven parts. The first part introduces the dual criminality test, including the methods of interpretation or its problematic aspects. The second part summarizes the long-standing genesis of judicial cooperation in criminal matters at the European level, leading to the adoption of the European arrest warrant, which will enable a better understanding of the continuing will to apply the dual criminality test. The provisions of the European arrest warrant are discussed in the following part. The case law of the Court of Justice of the European Union concerning the dual criminality test is introduced as well. As the thesis is set in the context of the Catalan crisis, the fourth part highlights the key moments, adopted legal acts and the acts of the main protagonists of the case, which not only led to the...

Grounds for Excluding Criminal Responsibility in International Criminal Law This thesis aims on currently two most discussed grounds for excluding criminal responsibility (defenses) in international criminal law: defense of duress and defense of superior order. First of them emerges from a situation in which a perpetrator is forced by threat to commit a crime under international law. The second one addresses a question whether a person should be re- sponsible for a crime committed pursuant to an order of a Government or of a superior. Regarding the structure of the army, it is not surprising that there these two defenses occur together in many cases and that they arise from the very same situation. However, they should not be mistaken one for another. The aim of this thesis is to analyze the most significant case law on the topic and to research what was the background for the formulation of the articles on defense of duress and superior order in the Rome Statute of ICC. The paper also examines the deficiencies of the regulation of duress and superior order in the Rome Statute and their possible improvement. The thesis is composed of 5 chapters. The first chapter is introductory and describes used meth- odology of the paper and its structure. Chapter number two deals with grounds for excluding...

1 ABSTRACT European international law - selected issues The subject of this thesis is an analysis of a new procedural measure of European law - European order for payment (hereinafter as "EOP") and exploration of its application in practice from the perspective of the Czech plaintiff and Czech court. I have chosen this topic because of my own experience concerning cross-border debt recovery through the EOP. In this context, I decided to find out how this legal measure works in practice with regard to its purpose of providing a simplified, accelerated and cost effective procedure for the recovery of uncontested pecuniary civil and commercial claims in cross-border cases. In the final part of the thesis, I made the conclusion that the Council Regulation 1896/2006 of 12 December 2006, in creating a European order for payment procedure, (hereinafter as "REOP") meets its objectives and its implementation is a valuable asset to the creditors against non paying debtors. The thesis is divided into 3 parts. The first part is as an introduction to European private international law containing five chapters. The first and second chapters explain the concepts of private international law and European private international law. The third chapter deals with their mutual relationship. The fourth chapter describes the...

in English This diploma thesis deals with the manner and extent of compensation for damage in civil law, which is systematically included in the fourth part of the Civil Code, entitled Relative property rights and in section named Obligations arising from torts. Specifically, the manner and extent of compensation for damage is defined in articles from 2951 to 2971. The thesis contains basic comparison of the conceptions of the manner and extent of compensation in the former Civil Code and in the new one, with emphasis on the most important reforms. It clarifies new terminology and describes the background of the newly established rules of law. It contains an analysis of the Czech legislation and its comparison with legislation of the neighboring states. It also mentions the European conception of the manner and extent of compensation for damage. The system of the thesis follows the organisation of the provisions on the manner and extent of compensation in the new Civil Code and is also divided into three chapters. In this work we deal with the Beveridge-Nelson decomposition of a linear process into a trend and a cyclical component. First, we generalize the decom- position for multidimensional linear process and then we use it to prove some of the limit theorems for the process and its special cases, processes VAR and VARMA. Further, we define the concept of cointegration and introduce the po- pular VEC model for cointegrated time series. Finally, we show a method how to deal with infinite sums appearing in calculation of the Beveridge-Nelson decom- position and apply it to real data. Then we compare the results of this method with approximations using partial sums.
