Chapter 2 examines the uneven responses by government officials to populations displaced by genocide. In response to genocide in Iraq, Rwanda, Bosnia and Kosovo—the case studies in this chapter—millions crossed international borders in search of safety, destabilizing the countries that reluctantly hosted them. The case studies show how perceptions of the refugees’ politics, ethnicity, race, and overall “worthiness” influenced decisions about intervention, humanitarian assistance, and opportunities for parole or refugee status. Refugee advocates had to convince government officials and a reluctant American population that assistance to these populations was in the national interest; when they were unable to do so, refugees suffered the consequences.

Abstract This book provides a systematic analysis of the political processes shaping the distribution of social transfers in six countries in sub-Saharan Africa and South Asia. In doing so, the book addresses a notable gap in recent research on social protection concerning the politics of implementation. While considerable attention has been devoted to debating the merits of different policy designs and the political factors shaping the adoption and diffusion of different policy models, ultimately the ability of any social transfer programme to deliver on its promises is dependent on the effective implementation and distribution of social transfers in line with intended objectives. The chapters in this book examine international and sub-national variation in programme implementation in Bangladesh, Ethiopia, Ghana, Kenya, Nepal, and Rwanda, drawing on a common analytical framework that highlights the importance of state capacity and reach, rooted in histories of state formation, and contemporary political competition in shaping the distribution of social transfers. Comparative analysis of the case studies supports the view that variation in the capacity and reach of the state within countries is a centrally important factor shaping the effectiveness and impartiality of distribution. Yet state capacity alone is insufficient. Rather, political competition and power relations shape how this capacity is actually deployed in practice. As such, the book underscores the inherently political nature of implementation and questions common technocratic efforts to improve implementation by de-politicizing the social protection policy process.

Abstract:
Genocide is described as the most extreme form of crime against humanity; Winston Churchill even called it the “crime with no name.” The word “genocide” was coined by Raphael Lemkin, a Polish lawyer who embarked on a mission to persuade the international community to accept genocide as an international crime under international law. In 1946, the first session of the United Nations General Assembly adopted a resolution declaring genocide as a crime under international law. This resolution became the basis for the Convention on the Prevention and Punishment of the Crime of Genocide, introduced in 1948. However, it would take another fifty years before the Genocide Convention would establish an International Criminal Court that would prosecute international war criminals. In the 1990s, special ad hoc tribunals were created for Yugoslavia and Rwanda to deal with international crimes such as genocide, crimes against humanity, and war crimes. In reaction to the failure of the international community to deal with genocide in Rwanda, a great deal of emphasis has been placed on the norm of “the Responsibility to Protect.” The Genocide Convention was tested in the case brought by Bosnia and Herzegovina against Serbia (originally Serbia and Montenegro) in 1993. It was the first time in history that a sovereign state was placed on trial for the commission of genocide. The implications and ramifications of the International Court of Justice’s ruling that the Serbian government did not commit genocide in Bosnia became a subject of considerable debate among legal scholars.
