Abstract:
Tras diversos intentos de regulación de los matrimonios de personas del mismo por parte de algunas comunidades autónomas, la Ley 13/2005 supuso el reconocimiento de este tipo de uniones. La misma situó a España como uno de los países pioneros en reconocer este tipo de matrimonios. Este texto aborda la evolución de los divorcios de matrimonios compuestos por personas del mismo sexo, y diversos aspectos destacados, en uno de los territorios donde más enlaces se producen: Andalucía. El método empleado es cuantitativo, aplicando un análisis descriptivo mediante la utilización de la Estadística de Nulidades, Separaciones y Divorcios (ENSD, 2012-2018). Las principales conclusiones extraídas son que los divorcios de este tipo de matrimonios han ido aumentando de forma paulatina a lo largo del periodo analizado. La mayoría de estos divorcios se caracterizan por ser consensuados. Los matrimonios tienen, en su mayoría, una duración de 5 años o más y están compuestos esencialmente por cónyuges de nacionalidad española. Por último, dos tercios de los divorcios ocurren en parejas sin hijos menores.

In 2012, the Canadian federal government took a position in court that same-sex couples married in Canada were not legally married if the law of their domicile did not recognize such marriages. As a reaction to the subsequent media reports and political debate, the government introduced Bill C-32 to modify the Civil Marriages Act. This article analyzes the current treatment of same-sex marriages by foreign-domiciled spouses in Canadian private international law, criticizes the changes to the Civil Marriage Act, and replies to a recent academic commentary on the issue.

Abstract Recent work exploring links between stress processes and well-being within marriage suggest that women may be at an increased risk for exposure and emotional reactivity to daily stress. However, studies have focused primarily on heterosexual couples, raising questions concerning whether and how these gendered patterns might unfold differently for men and women in same-sex marriages. In the present study, we analyze 10 days of dyadic diary data from 756 midlife men and women in 378 gay, lesbian, and heterosexual marriages to consider how exposure and emotional reactivity to daily stress may differ across union types. We find that women are exposed to more daily stressors than men and that this exposure is especially detrimental to the well-being of women in different-sex marriages. These findings highlight the need to include same-sex couples when exploring gendered linkages between daily stress processes and well-being within marriage.

Abstract:
This article reviews the historical relationship of religious institutions to the performance of marriage ceremonies. It looks at what various religious traditions say officially about homosexuality and about same-sex relationships. It also considers how gay and lesbian couples have negotiated their places, especially in terms of same-sex ceremonies of commitment, within religious traditions which have offered varying degrees and kinds of affirmation. The author goes on to argue that there will be a variety of religious views concerning the legalization of same-sex relationships as marriages or marriage-like relationships. Religious institutions are not now obliged to marry all those who can be legally married, so the objections that arise within religious institutions should be handled as matters of policy within those religious institutions rather than as grounds for denying the legal right to marriage to gay and lesbian couples. The author further argues that all marriage as a legal entity should rest in the hands of the state, and that churches should bless relationships rather continue to be involved in legalizing marriages.

Against the legal recognition of same-sex marriage, many advocates of religious liberty argue that those who adhere to “traditional” understandings of marriage should not be forced to “recognize” same-sex marriages. This includes exempting individual business owners engaged in commercial activity from anti-discrimination laws. I argue that such exemptions overreach. Equal access to the commercial arena is an essential feature of life in America’s commercial republic, which means that public accommodations should not be given exemptions on religious grounds. Yet this does not require business owners to morally approve of same-sex marriage; nor does it require them to grant same-sex marriages “equal concern and respect.” Rather, it requires simple toleration, which is compatible with moral disapproval. Indeed, I argue that this is the very sort of toleration at the foundation of religious liberty in America. Efforts to grant religious exemptions to anti-discrimination laws invite the return of religious conflict and discrimination. Prohibiting discrimination on the basis of sexual orientation in public accommodations is necessary not only for equal citizenship, but to maintain the regime of toleration that undergirds religious liberty in a pluralistic democracy.

Thesis advisor: William A. Gamson<br>In 2006, Mariane Valverde announced the birth of what she called, “a new type in the history of sexuality” (155), the Respectable Same-Sex Couple. This work analyzes newspaper coverage of same-sex couples during the Massachusetts campaign for marriage equality to explore the content of and contours around that new socio-sexual category. The processes involved in the incorporation of lesbians and gay men into the governing relations of American society are used to explain the development of this type, and its replacement of the pathological Homosexual. The manufacture of respectability by movement activists is explored via the selection of “public face couples” as a framing strategy that links the lives of these couples to marriage itself and the hardships they suffer due to their inability to marry. The respectability of these couples and their incorporation as economic citizens is also linked to representations of professional status, upward mobility, economic success, and the creation of identity-based markets through entrepreneurial and consumptive practices. Boundaries around this respectability are evident in stories of failure, either to remain together as couples or to act in accordance with marital normative standards, while the boundaries between Heterosexuality and Homosexuality, and among and between same-sex and different-sex couples, are also being re-drawn as marriage becomes available. The broader historical transformation of lesbian and gay life is discusses in the development of new life-scripts becoming available. <p> In this study, I explored the impact legal marriage has had on gay men in legally sanctioned same-sex marriages. Participants included five gay men who were legally married in Massachusetts. Each participant was interviewed three times; twice using a semi-structured interview guide developed for this study plus a feedback session for clarification and validity check. Narrative information was coded for emergent categories and themes using a constructivist-interpretivist phenomenological approach. I sought to explore how gay men perceive their relationships after being able to marry, the extent to which being married has impacted how they view themselves and their relationships, as well as how the availability of legal marriage has affected social acceptance and community support. Three categories emerged from coded narrative data: (a) Entering Marriage, which included themes of how participants defined marriage, as well as processes that led them to marry; (b) Mechanics and Meaning-Making in Marriage, which included themes relating to changes participants noticed in themselves since being married, as well as differences in how aspects of marriage such as division of labor, finance, intimacy, and family expansion were navigated; and (c) Marriage in Context, which included themes relating to community, social, and political influences on participants&rsquo; marriages. The findings revealed that legal marriage has had a positive impact for these five men across intrapsychic, interpersonal, and social domains, though each participant experienced these impacts differently. I hope the information gathered will help contextualize the issue of gay male marriage equality reflected in real life experience as the field of psychology continues to expand the notions of healthy family relationships and their constellations.</p>

Abstract:
Due to social stigma, millions of sexual minorities have concealed their true sexual identities by entering into heterosexual relationships and marriages. Eventually, some transition to same-sex relationships and are able to live authentic lives. This latter group had identified as genuinely heterosexual, never questioning their sexuality until a particular time in their lives when same-sex desires spontaneously appeared. The experiences of transitioning from heterosexual to same-sex partners are not well known, particularly for women who have been legally married to both men and women. Diamond's dynamical systems theory for same-sex sexuality and McCarn and Fassinger's lesbian identity formation model provided the theoretical framework for this qualitative narrative study investigating the life stories of 15 female participants recruited from social media, who had experienced a transition from heterosexual marriage to same-sex marriage. Face-to-face interviews were conducted and data were coded and analyzed to identify emergent categories. The findings revealed that the women experienced shifts in private and public sexual identities over time. Despite external obstacles and personal concerns in transitioning from heterosexual to same-sex relationships, all the women had more positive experiences in their same-sex marriages than they did in their heterosexual marriages. Understanding these women's life stories will allow mental health professionals to better understand and address the needs of this population in more clinical and applied settings. This study will also help educate the general public about women who experience shifts in the desired gender of their relationship.

Same-sex marriage has been heavily debated in academics and in the public sphere. During the 2004 Presidential election same-sex marriage became an issue that polarized the candidates. It has become a lightning rod for public debate. Due to the increasing attention to the controversy of legalizing same-sex marriage, it is an important topic for research. This paper seeks to contribute to the research of same-sex marriage by providing insight into claims-making efforts to define same-sex marriage as a social problem. My findings shed light on this topic from a social constructionist perspective by examining the use of rhetorical idioms of the claims made by opposing parties in the debate over same-sex marriage as it relates to the court ruling in Goodridge v. Abstract:
The paper deals with couples in de facto unions, especially the ones formed by a man and a woman. It seeks to define cohabitation and differentiate the rights and duties of cohabitees from the ones connected with the status relations between both the opposite-sex couples (marriage) and the same-sex couples (registered partnership). As there are seldom any kinds of agreements between cohabitees, special attention is devoted to the relevant legal rules in all the Books of the Czech Civil Code and their applicability to cohabitees during their relationship and after the break-up or upon the death of one of them. It is stressed that there is no difference between children born out of wedlock and within marriage. Once parenthood is legally established, there is no discrimination of non-married mothers and non-married fathers towards the children. And besides, there are special provisions that protect the weaker party: property claims of the non-married mother from the child´s father for a reasonable time and within adequate limits.

Although approximately half of all marriages in the U.S. end in divorce (Amato, 2010; Cherlin, 2010), the remarriage rate has declined steadily in recent decades (Brown &amp; Lin, 2013; Schweizer, 2019). In this profile, we examine the trend in the remarriage rate since 1990 (see Note) and investigate geographic variation in the remarriage rate by gender using recent American Community Survey (ACS) data. This profile is an update of a previous profile on the Geographic Variation in the Remarriage Rate (FP-15-08).
