Full textHealth and security at work, occupational risk prevention (road risk, psychosocial risks), intensification of labor conditions… A number of questions that the enterprise has to take into account. Answering them assumes a variety of points of view and skills. Occupational health services, that have the exclusive mission to prevent any worker health alteration occurring from their work, contribute to this debate. Due to their unique position, as a field actor, they should be the master piece of the occupational health system ; these services are, however, victim of a collective disaffection. The delicate combination of the “medical fitness for work” concept and the occupational risk prevention concept contributes to this disaffection. Since 1942, the institution has seen deep metamorphoses, a number of them appearing from the combination (sometimes being a cause for tension) of the labor law and the public health law. After the Liberation, the incorporation of the institution to the Ministry of Labor, sealed a long domination of the Labor law. The growing power of the Public Health has been jeopardizing progressively this domination. The reform dated 20th July 2011 illustrates this change of balance. The analysis of the links between the Labor Law and the Public Health Law suggests to propose a new paradigm for the sake of the workers’ health, based upon the idea – which is also a fact – that the occupational health service cannot be compared to other providers : this service contributes to the general interest

Full textAfter focusing on the economic environment of firms trough the evolution of the human resources management, the control of the professional risks management and the economic constraints, a survey has been carried out in fourteen firms from various industrial sectors. The aim of this thesis is to pick out some links between the protection and economic rationality in order to direct future analyses. The gathered information in the survey focused on the different characteristics of firm, the hazards stemming from its exploitation and the results in terms of economic, social and technological consequences of the protective measures which have been adopted. Thirty-mine measures relating to the relating to the collective protection of the workers or of the public in the environment have been analysed by using a typology which makes it possible to understand the diversity of their mode of inserting in the production process. The study of the relations between the kind of measures, the reasons why they have been adopted and the means used to apply them shows that the "integrated" protective measures meet economic demands. It also shows that the burden of the economic constraints is dominating for the "added" protective measures. From the study of the consequences of these measures, on can remember that the actions of "added" protection prove to be costly measures. "integrated" protective measures seem to provoke an increase in the prise of the product less often and to. .

Full textSince the emergence of the CHSCT (health, safety and working conditions committee) in 1982, the elected representation of employees has profoundly changed. Employee representatives, works councils and the CHSCT have had to adapt to the considerable extension of the concepts of health and safety. The integration of the requirement to protect the mental health of workers in the Labour Code has radically altered the scope of competence of the CHSCT. The prevention of psychosocial risks quickly invited itself as the centre of its concerns, thereby extending the consultation obligation borne by the employer. Projects and measures that initially only required the consultation of the works council are now also subject to the prior opinion of the CHSCT. In this procedure of double consultation the employer is guided by the principle of specialty that turns the works council in a mere rubber stamp of the opinion of the specialized committee. The expansion of the CHSCT has caused reiterations and cumbersomeness. A reform must be considered. Transformation of the specialized body in a committee of the works council or redistribution of powers of each : the alternative offered requires discussion

Exploring the management system of health and safety at work has led us to highlight not only the international law sources of the Moroccan labor code, but also the different methods of managing health and safety in companies. We also propose a statistical study to better understand the management, prevention processes and technical management of health and safety within Moroccan companies. At the same time, in order to propose a management model as a basis for growth and economic and social development of the institution, intervention research was also conducted in a Moroccan company. Thus, the reasons for the lack of compliance with existing laws have therefore been highlighted and clear solutions from the use of tools to improve the organization and working conditions at a reduced cost, have been proposed

Full textTo save health and safety at work is today, in the language of the management and step-by-step of lawyers, bound with the notion of “corporate social responsibility”. Beyond legal pressures progressively integrated in the positive law, employers must take care about them in their decisions to have the adhesion of employees and to contribute to the conservation of a healthy environment. Goals are as those including by the “triple bottom line” of Elkington (economic, social and legal), as those corresponding to the logic via media and politicians with the management of the appearance of the firm. In addition, it’s possible to ask you: how long can we continue to have a balance about responsibility and reparation around health and safety? How firms can succeed with taking care about interests of actual and future employees too? The answer ask you to study how France choose a “corporate social responsibility” with an important place for the State in opposition of what could be prefered by some authors. But the problem is that this system can be excessively interpreted by Judges. They often accept the responsibility of the employer in cases while it’s not sure that he (or the activity of the firm) created the risk. In addition, the French “corporate social responsibility” can’t be adapted enough and quickly as it’s necessary concerning health and safety at work. That is why, you must see if other ways can been more satisfying. They can be with the same persons (employers and employees or their representatives) or with others stakeholders. It don’t mean that the State can’t be have a role in the “corporate social responsibility” about health and safety at work. But it’s important to see if it can be interesting to give firms possibilities to act voluntarily and ask you if we have to change the repartition of powers concerning this questions in France. An independent control of results must be planned

Full textThis thesis focuses on the object and scope of application of the Act respecting occupational health and safety (AOHS). It maintains that the purpose of this Quebec legislation is to protect not only workers, but also: 1) other persons at work and 2) persons other than those at work, namely the public at large. In this sense, the stated object of the AOHS, as worded in section 2, is incomplete and does not encompass its entire purpose. Moreover, this thesis re-examines the limits of the scope of application of the AOHS. With regard to the individual dimension of the Act, this thesis challenges the idea that the presence of workers is essential to its application. As for its territorial dimension, this thesis reiterates the idea that the AOHS goes beyond the strictly defined workplace itself and extends to any place where work is carried out. Finally, from the Act there emerges a new circumstantial dimension – based on work activity – that transcends the territorial and individual dimensions, but is not well defined and not fully reflected in the Act. However, this dimension would appear to further foster the achievement of the objectives of the AOHS. These findings regarding the object and scope of application are based, first of all, on an examination of the entire text of the Act and its attendant regulations. They are also explained by the origins and history of laws relating to occupational health and safety. Although these findings are supported by the fundamental rights stated in national and international labour law instruments and, more broadly, in legislation relating to the right to life and to personal security and inviolability, they nevertheless clash with the wording of many of the provisions of the AOHS, which refer strictly to “workers.” The rules of interpretation and the principles of administrative law cannot fully remedy this situation. Ultimately, this thesis invites the legislator to amend the AOHS to improve the protection of the health, safety and physical well-being of all individuals in the achievement of work activities, which is the fundamental object of this Act.

Full textThis thesis objective is to review the situation, concerning the state of health at work at the beginning of the twenty-first century in France. The matter of the study is more particularly about the health of workers in companies but also about people who live near industrial plants. . . The emphasis is put on the methodology followed, which combines the contribution of law (work, social,. . . ), economy, history and sociology. . . This thesis demonstrates through time and space, the confrontation between health at work and environment. It also shows how the law and other elements have allowed a parallel and then a collaboration. Owever the gap is Hobvious at the end of the 19th Century (with the Industrial Revolution), and the environment law which appears approximatively a century later (in 1970, with the economical crisis). This thesis is illustrated from an empirical point of view by a study realised inside Dunkerque area, whose aim was identify the consequences of air pollution on individuals. The research was led so as to retranscribe as well as possible the feeling or the disorders experienced by the people pollued, and then to translate them, during the analysis on effects on health, and also on social economic effects

Full textCompanies must respect the legal framework in terms of health and safety at work. This framework, even if it is based on a logic of prevention of professional risks, is due to its complexity, difficult to master for an employer. The first step in our research work was to reveal this legal framework by dissecting it, explaining its subtleties and confronting it with the reality on the ground. In addition, in many cases employers do not learn about the legal framework until they take responsibility. We then thought about how to offer employers effective solutions in order to help them to respect it better and at the same time, to develop the prevention of professional risks for the benefit of workers. Thus, the second stage of our research work consisted in making available to employers a guide to good practice made up of two types of elements: A selection after analysis, of the solutions implemented by collective bargaining, which can have a real and tangible effect in terms of prevention of professional risks and thus correspond to the effectiveness criterion set by case law, Devices allowing them to self-assess their level of compliance with general as well as specific obligations in terms of health and safety at work and to satisfy them with the help of compliance sheets

Full textThis doctoral research will study the devices of health and safety prevention at work, within a french large company, in the prism of affectivity. We think the devices of health and safety prevention at work as an affective communication. These devices respond to the general obligation of professional risks prevention, in which the employer is kept (article L. 4121-1 of the Labor code), spread since 2008 to the prevention of psychosocial risks. The affective communication is a double movement of emotional solicitation and codification, in modern informational and communicational dynamics, via some techniques of mediation and mediatization (Martin-Juchat, 2006). We considered the affective communication within organizational communication, as media of its affective culture. In the same field of the researches lead in social sciences (Halbwachs, 1947 ; Laflamme, 1995 ; Illouz, 2006 ; Fleury, 2007 ; Fernandez, Lézé et Marche, 2008), which overcome a dualist approach of affectivity (emotion versus cognition) and are opposed to think of the emotions out of the social and the cultural frameworks, we focused here our work on the normative role of communicational devices in the understanding of social function of emotion, in the organizations. We questioned, in our thesis, the dynamics of normalisation in the "semiotisation" within the devices of prevention, in order to study how they operate through logics of emotional regulation at work. So, we develop a communicational approach about the devices of health and safety prevention at work, based on conceptual contributions in the field of communication studies, especially the researches on the ACO (Communicational Approaches of Organizations, Bouillon, Bourdin et Loneux, 2007 ; Bouillon, 2013) and the researches on the affectivity, based on communicational dimensions (Martin-Juchat, 2008, 2014 ; Martin-Juchat et Staii, 2016). We based our work on the results of an action-research conducted during more than a year within a french large company, which has permitted us to discover that communicational strategies and logics of the different actors of prevention are linked to the elaboration of signs of emotion in the devices of prevention

Full textThis thesis investigates the extent to which the production of research in the field of occupational safety and health (OSH) in Canada, and its transfer mechanisms, support the use of research results. To achieve this goal a conceptual framework was conceived that emphasizes the importance of the knowledge production mode. The framework was then used to investigate and measure the transfer of knowledge and its determinants with questionnaire filled out by 217 researchers in the field of OSH. A first level of analysis made it possible to describe the profile of the different researchers and the characteristics of their research tasks. An association between the professional deaths and lesions compensated in Canada and the types of industries, populations and nature of lesions studied by researchers, was carried out. In a second level of analysis, we conducted a principal components factor analysis (PCFA) that revealed the organization of items of knowledge transfer in three factors (diffusion, active dissemination and implementation). These factors represent the mechanisms used by researchers to transfer research knowledge to managers, professionals and practitioners. To supplement this portrait, bivariated analyses of the transfer mechanisms taking into consideration mode of knowledge production, the statute, the discipline and the type of institution of the researchers, were done. Then, a third level of analyses was carried out to identify and hierarchyse the factors associated with the transfer mechanisms. With this, we developed an ordinary least squares model and applied it to the three transfer mechanisms (diffusion, active dissemination and implementation). In summary, the application of our model to the three transfer mechanism demonstrates many factors significantly associated with the three mechanisms. However, only one independent variable is associated with each of the three mechanisms, that is to use mode II as knowledge production mode, in comparison to mode I. Also, in general, the disciplines are rarely associated with transfer mechanisms. Thus, the researchers in OHS, no matter what their discipline is, seem to constitute a rather homogeneous unit.

Full textThe misnamed psychosocial risks at work reflect the expression of contempt for the absolute fundamental norm and matrix of human rights : the dignity of the human being. As a manifestation of suffering at work, indecent working conditions and organizations (as defined by the UN) lead to the commodification of humankind as a means of productionat the expense of worker’s fundamental rights, such as the right to health at work. Psychosocial risks at work, which are threats to public health, exempting them from the rule of law on which social order is based, and whose consequences of damage to the physical and mental health of workers affect society as a whole, break the social contract between individuals and the State. The legal obligations laid down by international, European and French texts, require the State and companies to exercise active and not only reactive prevention. The State, as guarantor and protector of respect for dignity and human rights, can use its prerogatives as a public authority to better protect workers’ health.Sociovigilance is then required as a new vigilance resulting from occupational health safety. Combined with the creation of an independent authority in charge of occupational health issues, sociovigilance is accompanied by a new proposal for the organisation of occupational risk prevention in France

Full textFaced with transformations of productive organizations and new dangers they create for physical and mental health, the prevention of occupational risks is changing. Its analysis requires an instrument to grasp the relationships between the variety of physical and psychosocial risks and the multiple aspects of subordinate work activity. The category of work organization is proposed for its ability to designate as much the technical dimension of the work activity as the social and hierarchical dimension of the management power of the employer. With this instrument, the thesis aims first of all to shed light on how the legal order weaves links between the categories of occupational risk and work organization. Built around notions of causality and imputation, the recognition of these links is revealed as a place of privileged observation of the relationships between law and science. The research, then, tries to explain how law acts on the links between the categories of work organization and occupational risk in order to prevent the realization of these. Attached to the structuring components of work organization, the law of health and safety at work is a space where the legal arrangement of things and worker and evolving

Full textThe health security-work conditions-committee is an independent employee representative bodie which is compulsory in establishments with more than 50 employees. His mission is to make participate workers, by the intermediary of employee representatives elected in second degree, at the protection of their health, their security and at the improvement of their working conditions. This institution symbol in the health working area is borned in 1947, nevertheless, the analyse of its real role and inscription in the game of social reports is a dead angle of sociological knowledge on the organization of prevention in high risks industries. This report tries to reveal the mechanismes of the real functioning of committees. Centred on the chemical industry, this research show that the realisation by the employee representatives of the tree more important missions of the committee (work accidents, occupational ilInesses, inspections of establishment) vary according two types of factories, which are : the social capital of employee representatives and the power struggle between workers and employer. The crossing of this two factories determines four types of committees: the employer committee, the preventive committee, the defensive committee and the leaving committee. The application of this roast analysis at tree case: lnéos Lavéra (13), plateforme chimique de Roussillon (38) et Adisséo Conunentry (03), show that the committees can pass by different types. Are also approached, in a fourth transversal case, subcontracting situations where the application of the typology and the legislation about committees find its limits

Full textWhile many companies monitor very closely the absence level of their employees, few of them are concerned about presenteeism. This behavior characterizes the situation of an employee who goes to work even though his health status would justify a sick leave. A still young literature, whose approaches of presenteeism are very heterogeneous, highlights some explanatory factors of this phenomenon as well as its negative implications on employees’ health and productivity. So far, the only way to collect data on presenteeism was to ask directly employees about their own behavior. The first purpose of our thesis is to introduce a new statistical instrument to measure quantitatively presenteeism. This can be done by applying a zero-inflated negative binomial model to individual sickness absence records, an easily available data in firms. Several behaviors are entangled in this variable, including presenteeism, which mainly manifests itself by an overrepresentation of nil values. The second goal of our thesis is to explain how an operational diagnosis can be performed, based on this tool. Two empirical applications, one in a hospital (4300 employees), the other in a regional bank (2700 employees), show the ability of the model to compute an individual presenteeism probability and to identify major presenteeism factors on a corporate scale. Among these factors, age, team responsibility or job insecurity are, for example, of particular importance

Full textThe concept of "psychosocial risks at work" gathers several work-related suffering risks. These risks are, at the same time, related to the generating acts of pain and to the expressions of suchpain on employees’ health. Despite its formulation, this concept refers to events affecting both mental and physical health of workers. Such affecting events share the same social ground. Indeed, psychosocial risks are mainly caused by the companies’ organization themselves, management methods or harmful relationships. Even though the expression of psychosocial risks was formerly developed out of the legal environment, it is now generally used in law to deal with issues of health and safety at work. However, the comprehensive understanding of such risks is not yet obvious from a legal perspective. These are complicated to define and delimit, tinged with subjectivity and unlikely to be understood in light of the employment law history. However, law is increasingly taking into account the different dimensions of the workers’ individuality. Also, if the psychosocial risks fail to be recognized, so far, as an independent and entire legal concept, both laws (domestic and international) and case law are more and more referring to it. Therefore, measures and legal solutions applicable to the working relationships in private companies enable to prevent such risks, punish or compensate them. As such, a wide range of people, whether related or not to the company, are able to duly face these factors

Full textAbstract : This aim of this study is to expose the legal limits and organisational factors which may affect decision-makers' discretion in the context of the employment injuries compensation system in the province of Québec. The findings of this study align with some empirical studies concerning different social security regimes in other jurisdictions from which it is inspired. Indeed, it reveals that administrative discretion is inevitable. It describes and comments the management techniques implemented in the organization. It also describes the particular functions of two categories of street-level workers, the agents d'indemnisation and the conseillers en réadaptation, in order to identify the matters about which they may use their judgment or exercise a discretion, as well as the particular decision-making processes that occur at the front lines of service delivery. It shows how the administrative structure concurs to the respect of the clients rights but may neverheless undermine the processes fairness.

Full textPour les industriels du secteur de la chimie pharmaceutique, qui comptent parmi les exploitants des systèmes à risques, le développement d'une culture de sécurité dans les sites de production est une nécessité. Des évolutions techniques et la mise en place de systèmes spécifiques de gestion leur ont en effet permis d'obtenir des résultats largement meilleurs que la moyenne des entreprises mais qui semblent plafonner dans le temps. Développer une culture de sécurité dans les usines nécessite cependant de changer de regard sur la maîtrise des risques. Cela nécessite en effet de prendre en compte toutes les dimensions de l'organisation en replaçant l'être humain au centre des préoccupations.
Ce travail de recherche se situe dans le domaine de la recherche en gestion, dans le courant de l'analyse de l'activité collective. Il vise à répondre à plusieurs objectifs. En premier lieu, décrypter les logiques d'action sous-jacentes à la notion de culture de sécurité afin de déterminer le projet managérial qu'elle implique. Ensuite, identifier les processus de gestion mis en œuvre pour concrétiser ces logiques d'action afin d'observer comment le projet managérial culture de sécurité se met en œuvre. Enfin, analyser certaines activités liées à ces processus, notamment la formation du personnel et le retour d'expérience, afin de faire émerger des leviers d'action permettant de développer la culture de sécurité.
Le terrain d'intervention est constitué des usines de production d'un grand industriel français de la pharmacie.
L'approche proposée a été mise en œuvre dans différentes usines de production de composés chimiques et à l'échelle de la branche chimie du partenaire industrielle. Elle a permis d'identifier les leviers de progrès dans les activités de maîtrise des risques qui contribuent à développer et à renforcer une culture de sécurité devant permettre d'améliorer les résultats de sécurité des sites chimiques étudiés.
La démarche de recherche mise en œuvre peut être adaptée à d'autres secteurs industriels désireux de développer ou renforcer une culture de sécurité et prêts à mettre à plat leurs pratiques de maîtrise des risques industriels.

Full textThis PhD thesis deals with the relationship between nuclear law and health law. Health law is understood in its wide sense, as a legal discipline governing environmental health, i.e. the health of man in his natural and work environment. Nuclear law and health law sharing the same objective of protecting the health of man in his environment, the former is necessarily influenced by the latter. My demonstration focuses in particular on how to characterize this obvious relationship between nuclear law and health law regarding health protection as well as liability for nuclear risks. From this point of view, it opposes the symbiosis of these two fields of the law with regard to health protection against nuclear risks and their split with regard to health liability. The relationship between nuclear law and health law is indeed characterized by a perfect symbiosis regarding health protection against nuclear risk, whichever its origin; the various components of nuclear law, crystallized around the core of radiation protection, complementing one another in order to protect environmental health. However, this symbiosis gives way to a real split regarding health liability for nuclear risks; this one being marked by plural regimes which depend on the professional, medical, civil or military origin of the nuclear risk. Full textLes troubles musculosquelettiques (TMS) représentent plus du tiers de toutes les lésions indemnisées au Québec par la CSST depuis plusieurs années. Dans le cadre de l'article 59 de la Loi sur la santé et la sécurité du travail, les entreprises visées par règlement doivent avoir un programme de santé spécifique à un établissement. Depuis 2008, le risque TMS jusque là non pris en compte est évalué au même titre que les autres facteurs de risque. Cette recherche qualitative vise à répondre à la question suivante : « quelles sont les pratiques d'intervention en prévention des TMS déployées par les équipes de santé au travail? ». Les résultats indiquent qu'une grande partie des pratiques d'interventions en prévention des TMS par les ÉSAT sont relationnelles. Celles-ci doivent en effet bâtir une relation de confiance avec l'établissement, lui démontrer son utilité et les convaincre d'agir en prévention des TMS.

Full textContext and objectives: In Benin, the "informal sector" represents almost 80% of workers with a predominance of craftsmen, followed by the modern private sector (11%) and the civil service (9%). The socio-professional situation of craftsmen is characterized by the lack of personal or collective protective equipment, exposure to physical and harmful chemical substances and a lack of social security. The main objective of this thesis was to study the impact of working conditions on the health of tinsmiths in the informal economy in Cotonou, Benin. This research also allowed us to evaluate the blood impregnation of trace elements in tinsmiths compared to the background levels of the non-occupationally exposed male population of Cotonou. This part of the study required a first survey of 70 blood donors in Cotonou, in order to propose reference values for 29 trace elements. Method: A cross-sectional study was carried out in Midombô on the site of the tinsmiths in the 3rd district of Cotonou in Benin. Study population: A total of 84 workshop managers out of 102 gave their agreement to participate in the study of work places and conditions (participation rate of 82.4 %). Among the 251 tinsmiths working in the 102 workshops investigated, 135 agreed to go to the “Erasmus” health center (53.8%) for free medical care. In this population, there were 31 apprentices (23.0 %) and 104 craftsmen or master craftsmen (77.0 %). Results: Noise levels greater than 85 decibels were observed in 58.3% of the workshops, with an average working time of 10 hours per day. This exposure can be the cause of hearing impairment (mild to severe) observed in 99, 3% of the cases. Direct exposure to metal fumes and dust (38.52 %) and the consumption of food at the workplace are the cause of metallic impregnation. For 6 trace elements, more than 20 % of the tinsmiths had blood concentrations above the reference values of the general population. These elements, classified from the lowest to the highest level of impregnation were molybdenum, copper, strontium, tin, antimony, and lead, respectively. Approximately 71% of the tinsmiths had lead levels above the 95th percentile of concentrations found in unexposed populations in Cotonou. 83% of the workers who were under 18 years of age had blood lead levels ≥ 100 μg / L. Uncorrected visual acuity (> 20%) and untreated arterial hypertension (27.4 %) were detected in the participating tinsmiths. Conclusion: Informal workers are in a very vulnerable situation due to poor social protection and a high level of exposure to occupational risks. Given the large number of employees in the informal sector, improving the occupational health and safety of these workers should help to strengthen human capital and reduce the incidence of occupational diseases that are still poorly documented

Full textSuite à la faillite des entreprises étatiques chargées du transport en commun dans la ville province de Kinshasa, la gestion de ce domaine a été reprise par les personnes privées. Cette situation a pu favoriser l’essor d’une activité caractérisée d’informelle, de par plusieurs caractéristiques notamment, le non respect de la réglementation du travail. Il s’est ainsi mise en place une activité du transport en commun avec des conditions d’emploi et de travail précaires, supposées être la source de plusieurs problèmes de sécurité et santé au travail (SST) pour les populations des travailleurs y exerçant.
Parmi tant d’autres externalités suscitées par cette activité du transport urbain telles, la faible qualité des services fournis, les fréquences aléatoires des véhicules, problèmes qui jusque là avaient fait l’objet des préoccupations de la ville, notre travail a plutôt trouvé un intérêt particulier aux problèmes relatifs au bien-être au travail dans ce secteur. Ainsi, portant notre démarche vers la compréhension du contexte de cette activité, nous nous sommes questionnés sur l’impact des conditions d’emploi et de travail sur la SST de ces travailleurs. L’évaluation de cet impact ainsi que la compréhension de l’organisation de la SST au Congo nous a permis de réfléchir et de poser les bases d’un cadre spécifique visant de la gestion de multiples risques professionnels auxquels sont exposés les travailleurs dans ce secteur, la conception classique de la SST ne paraissant pas assez large pour y garantir un bien-être au travail.
Matériels de Méthodes
Nos recherches se sont basées sur deux grandes enquêtes avec une administration d’un questionnaire ainsi qu’une étude d’observation sur terrain. Toutes ces études se sont réalisées dans la ville province de Kinshasa auprès des échantillons de travailleurs sectionnés parmi de la population des travailleurs du secteur informel.
Les résultats de l’étude d’observation nous a permis l’identification des dangers et facteurs de risques dans cette activité ainsi que la modélisation de la précarité dans lequel exercent ces travailleurs. Les résultats des enquêtes, quant à eux ont permis la réalisation de trois études transversales descriptives portant sur les problèmes de santé en rapport aux conditions d’emploi et de travail ainsi que sur les problèmes de sécurité à savoir les accidents du travail dans ce secteur. Ces études ont permis de présenter les statistiques usuelles et des Odds ratio en utilisant le logiciel SPSS.
Des revues de la littérature nous ont emmenés à comprendre les questions relatives aux limites et à l’opacité dans l’application de la réglementation du travail dans ce secteur informel ainsi que le modèle d’organisation de la SST en République Démocratique du Congo. Ce qui a conduit notre réflexion sur les éléments clés pour la mise en place d’un cadre spécifique de prise en charge de la SST dont un plus grand nombre de ces travailleurs pourraient aisément bénéficier en vue du bien être au travail dans ce secteur.

Full textStudies on occupational health and safety performance in small and medium sized enterprises (SMEs) are quite recent (mostly dating from the period after the 1990s). Although they are highly heterogeneous for they considerably vary in the approaches and the methods used, they all put into emphasis the vulnerability of these organisations when dealing with occupational health and safety issues. Enterprises of less than 50 employees are indeed more particularly exposed to such risks. An international review of the literature has put into light the internal and external determinants of health and safety management in this kind of organisations. The purpose of this thesis is to classify them and depict the way they interact to give a comprehensive representation of the determination of the level of prevention of occupational risks in SMEs. In a second part, a preventive action has been carried out on the basis of these determinants. It was based on a collective action which involved the chamber of commerce, health and safety technicians and the labour inspectorate. This pilot action has allowed the carrying out of a qualitative research in order to assess the device aforesaid but also to implement the results and conclusions of the international studies in the French companies. This survey has raised a new debate over the sustainability in SMEs and led to a questioning on the actors who are implement the prevention plan of prevention. A second qualitative survey has been carried out in a small and medium-sized enterprise in order to understand occupational health and safety management

Full textIn France, psychosocial risks (PSR) became a major concern for society by their stakes in termsof public health, costs for companies and workers. In the late 2000s, the Ministries of Labor and Health took up these challenges by initiating surveys, data collection and scientific works. Despite the development of knowledge about PSR and its consequences, the integration of these new risks into public and managerial policies is still very modest.Through an economic, institutional and empirical analysis, the main objective of this thesis is to contribute to a better knowledge of the consequences of PSR’ exposure for individual and for company, and to analyze the role of prevention authorities to reduce the perceived levels of PSR and preserving the workers’ health. The empirical analyzes carried out reveal that workers' exposure to PSR leads to a degradation of their mental health, more sick leave and presenteeism at work. It therefore seems necessary to put in place prevention measures to limit these harmful consequences. An institutional and economic analysis of the French prevention framework establishes the important role of the Health, Safety and Working Conditions Committee (CHSCT) in spite of the limited means of action available

Full textThe main objective of this thesis is to analyse the health consequences of career shocks in Europe. It considers two actual career shocks over the lifecourse: leaving full-time education in a bad economy, and, at the other end of the age spectrum, retiring. In-between these two critical periods, it investigates how an anticipated career shock -- i.e. anticipated job loss -- damages health. Empirical analyses are conducted using large European and British surveys. We use institutional features and natural experiments to find neat instruments for causal identification~: the existence of compulsory schooling laws, the cross-country variation in employment protection legislations, the cross-country variation in retirement systems and the 1973 oil crisis. The results emphasise the causal and health-damaging impact of career shocks, both in the short and in the long-term

Full textThe general purpose of this doctoral dissertation was to contribute to identify triggers to preserve workers’ psychological health and reduce some of their negative attitudes and behaviors which appear to be harmful to healthcare organizations. Moreover, we aimed to understand the mechanisms underlying such effects. Study 1 used a cross-sectional design to demonstrate that psychosocial safety climate (i.e., PSC) was negatively related to nursing staff’s work-family conflict (i.e., WFC) and turnover intentions, through the mediation of psychological need thwarting. Study 2 developed these results by showing how PSC, through its influence on psychological need thwarting, related to a decrease in burnout three months later. Burnout itself explained an increase in WFC and turnover intentions. Study 3 focused on managers’ psychological health and found that emotional dissonance and organizational resources influenced managers lack of psychological detachment and work engagement three months later, through psychological need thwarting and satisfaction. Altogether, these studies contribute to self-determination theory in the work setting and offer some perspectives on organizational practices that could lastingly alter healthcare employees’ professional experience
