Abstract:
This chapter examines the impact of the 2007–08 global financial crisis on the regulation of private investment funds in the United States and in the European Union. It begins with a review of Dodd-Frank, which can be seen as the U.S. movement towards the international consensus that private fund managers should be directly regulated by the national financial regulator. It then considers Dodd-Frank’s repeal of the so-called ‘private adviser exemption’ previously found in the Investment Advisers Act of 1940, along with its exemption of ‘foreign private advisers’ from registration. It also explains the distinction between ‘US advisers’ and ‘non-US advisers’, Dodd-Frank’s compliance requirements for various types of investment advisers, and Rule 204(b)-1, jointly approved by the Securities and Exchange Commission and the Commodity Futures Trading Commission under the Investment Advisers Act. The chapter concludes with an analysis of the Alternative Investment Fund Managers Directive (AIFMD) and future outlook for Dodd-Frank.

Abstract:
This chapter examines the questions that sovereign wealth funds (SWFs) pose for analysts of foreign policy insofar as their operating preferences could be either geostrategic, and seek to advance the interests of the home state, or economic, and seek to maximize profits. To sort through the related issues, the chapter considers “home” and “host” country issues with respect to the democratic features attached to each. It thus offers insight into the strengths and weaknesses of various foreign policy arguments that have been offered in the existing literature. Next, the chapter offers observations on attempts to coordinate the behavior of SWFs at the international level, chiefly the Santiago Principles. It concludes with the relationship between pooled investment vehicles and state power in foreign affairs.

Abstract:
This chapter focuses on the increase in the amount of litigation and enforcement actions against private investment funds in the United States, the UK, and across the globe as a result of the global financial crisis. As more disputes arose during the course of the global financial crisis, the legal and regulatory regime impacting private investment funds has been the subject of closer scrutiny than has been seen in previous decades. The chapter first considers the Securities and Exchange Commission’s (SEC) enforcement actions against hedge funds as well as U.S. civil litigation prior to the financial crisis before discussing Dodd-Frank and its effect on enforcement. It then examines the SEC’s enforcement actions regarding broker-dealer registration, along with some of its key enforcement actions after Dodd-Frank. It also analyses the Financial Conduct Authority’s enforcement priorities after the global financial crisis and key litigation in the UK involving private investment funds.

If the International Monetary Fund and World Bank did not exist, then the global financial crisis of 2007–2008 may well have given rise to something like them. Though they have undergone many changes since their birth in 1944, their rules reflect the political relationships of the past more than the economic realities of the present. Whether and how India—a historically important actor for both institutions—and other ascendant stakeholders can contribute to a new consensus vision for global economic governance remains to be seen. And given India’s ‘emergence’, how these institutions and India will adapt to each other in the future will be important for all concerned.

This concluding chapter focuses on Herukhuti's explanation of why he founded the Black Funk Center. His states that black people can and do create revolutionary sexual cultures that can become the foundation for centers of sexual health, well-being, and decolonization. Black communities need more sexual cultural centers like Black Funk, but since sexuality and eroticism tend to be ignored, there are few political ideologies or organizations that see such centers as a part of black revolutionary movements. By exploring spaces and sites where narratives and performances of the body provocatively intersect with expressions of interior movement, the chapter argues that the need for such centers has already been articulated elsewhere—in profane sites of memory.

This chapter examines initial public offerings (IPOs) as funding rounds for high-tech companies and exit mechanisms for investors, as well as the stringent corporate governance requirements that apply to newly listed companies in the growth stages of their development. Current investment trends seem to indicate that the IPO market is aging: More and more high-tech companies decide to remain private longer. Moreover, public market investors, such as hedge funds and mutual funds, increasingly invest in non-listed high-tech companies, making “IPO-like” investment rounds at massive valuations a normal phenomenon in the private market. These developments have led to the belief that we are in the next tech bubble. Fortunately, however, a new “establishment” amongst investors is emerging. They realize that in order to prevent the bursting of the bubble, they must collaborate with management and actively contribute to a company’s medium-term and long-term performance.

Science can provide a rationale and a basis for policy decisions; therefore, corporate planners see it as a crucial resource. This chapter draws on our structural data to show how science policy organizations play a role in pursuing corporate strategy. Corporations create ‘sound science’ lobby and front groups, and they fund libertarian and neoliberal think tanks and groupings to attack and undermine scientists. They try to influence and capture public and policy debates on issues related to the regulation of addictive substances or services. Specifically, they help to provide a range of experts and advisors that can be tapped by the policy and decision-making apparatus at the national and EU levels. Regulatory systems at national and EU levels are mostly insufficient to monitor or manage the conflicts of interest that arise as a result.

This chapter advances the case for a Constructivist Institutionalist (CI) approach to the analysis of ideational change, making the case for ‘bricolage’ rather than paradigm shifts. It foregrounds actors’ cognitive and ideational filters, underlining the importance of how Fund staff see themselves and their role. The analysis charts key facets of the Fund’s internal workings, including its hierarchical nature, internal review processes, and how internal interactions are evolving. The complexities of institutional mediation leads to the sedimented but ongoing influence of multiple economic ideas. Four mechanisms of IMF ideational change—reconciliation, operationalization, corroboration, and authoritative recognition—are identified to explain which ideas come to prevail, why and how. Ideas need to be framed and packaged to jump through the hoops of internal social recognition. The chapter delineates the permissive conditions necessary for key actors to navigate internal power structures to effect ideational change.

Abstract:
Remittances sent by international migrants have become an increasingly important source of social welfare in the developing world. This chapter explores what remittances are, why migrants send them, and how poor families use them. I argue in this chapter that remittances are more than just gifts from one relative to another. They play a larger social welfare role that complements funds that governments spend on social welfare programs. This social welfare function has become particularly important in recent decades as developing countries have prioritized austerity and integrated into volatile global markets. I argue that by filling a welfare gap in an age of austerity, remittances help to reduce the suffering and anger that so often trigger political and social instability during times of economic crisis.

Corporations confront civil society in a field of power. Occasionally, they will partner together by trading power through cause marketing. For such a trade, corporations need a strong and independent civil society. But they do not want civil power to be used against them. This chapter examines how En+ deals with this apparent contradiction through its partnership with local environmental organizations. Specifically, the company designs and funds socialization projects that affirm environmental values while still giving the values of business a higher priority. These “value projects” seek to create a system of stratification among socially held values. While pluralist society offers a profusion of various types of socialization projects, these endeavors have variable ideological degrees of freedom. By socializing young people to take business norms for granted, En+ insulates itself from civil society’s power.
