Před projednáním návrhu Řádu habilitačního řízení a řízení ke jmenování profesorem na MU v akademickém senátu MU dne 24. dubna 2017 jsem jakožto senátor AS MU zpracoval soubor argumentů a postřehů k nejkontroverznějšímu ustanovení návrhu, které jsem zaslal panu rektorovi i všem členům AS MU. Tento dokument je přílohou zápisu z onoho jednání.

Abstract:
Author's thesis is concerned with differences between voting of parliamentary party groups within both chambers of Czech Parliament, Chamber of Deputies and Senate. It primarily focuses on senators and their relation to their respective parties. Author articulates three main hypothesis which he is trying to verify. Firstly, he anticipates senators to be less bounded to their parties than deputies. Secondly, he suggests that parliamentary party groups in both chambers become more united when it comes to more important voting. Lastly, the author considers the number of seats of parties in government in the Senate has no influence on either stability or legislative initiatives of the government. The theoretical part briefly describes Parliament of the Czech Republic, its composition, the role of the chambers and the legislative process. It also introduces outcomes of research made by Sociological Institute of Academy of Science of the Czech Republic in Parliament aimed at examining the role of deputies and senators from their own perspective. Abstract:
The presented diploma thesis focuses on the parliamentary immunity of Deputies and Senators in the Czech Republic and consists of two not explicitly titled parts. The first one deals with the genesis of the concept of immunity; the historical course describes the origin of the concept that goes back to the 13th century. Immunity might have been described as protection given by an English monarch towards Representatives; it gradually changed in privileged status recognition of a newly emerging institution, nowadays called Parliament. This excursion back into the 800 year history is supposed to help us understand the basic idea that the immunity of deputies or senators serves as an instrument of protection of a legislative body, or rather the Parliament of the Czech Republic. As for the immunity of deputies (senators) in the Czech Republic, relevant chapters deal with the first attempts to create functional constitutions at the end of the 19th century when Bohemia was part of the Austrian empire. Significant space is dedicated to the 1920 Constitutional Act, which may be considered as a crucial document for today's concept of the immunity of deputies and senators in the Czech Republic. Abstract:
The aim of this work is the interpretation of the available biographical data of all deputies and senators of the Czechoslovak National Assembly, who worked in a joint parliamentary club of the Sudeten German Party (SGP) and the Karpaten German Party (KGP) in the period from the entry of the czechoslovak parliament in 1935 to the Anschluss of Austria in the spring of 1938. The Sudeten German Party became after the elections in 1935 the strongest party in the interwar Czechoslovakia by number of votes and played a significant role in the pre- Munich era. The stated objective of the unification of the entire German population in Czechoslovakia was largely fulfilled, thus the party became very heterogeneous. Using the methods of collective biography the work is aimed at providing all available sources to obtain data on the social and political background as well as on the various political and professional careers of the particular party officials who represented the SGP resp. the KDP in the Czechoslovak parliament and on the basis of these data should the results be put into the historical and social context and their common and different features be interpreted. Abstract:
The goal of this thesis is to show the life and functioning of the Senate of the National Assembly of Czechoslovakia. The upper house of the Czechoslovak Parliament functioned between 1920 and 1939 after which it was officially dissolved during the Protectorate of Bohemia and Moravia. In the concerned period, the chamber was gradually saw 444 lawmakers of seven different nationalities. The biggest number consisted of Czechs and Germans. The functioning of the Senate is analyzed from multiple angles. First the debate accompanying the establishment of a second chamber before the adoption of the new Constitution in 1920 is analyzed. Attention is also paid to the period debates and unrealized proposals for a Senate reform at the end the 1920's, linked to the proposed creation of the Economic Parliament. Also shown is the proportional representation electoral system used for elections to the Senate. The results were reflected in a large number of political parties with low electoral gains, which in turn hindered the creation of a stable political environment. The thesis considers the party, ethnic, social, intellectual and oratory activities of individual senators. This PhD. thesis is dedicated to the legal regulation of instruments presenting guarantees of the independence of the member of parliament during the performance of his/her functions. The aim of this thesis is in particular to present a comprehensive picture of the topic concerning protection of independent performance of the parliamentary mandate, evaluate the Czech legal regulation in force and, last but not the least, to find an answer to the question to what extent is the Czech legal regulation in force complete and effective as well as present possible alternatives de lege ferenda. Member of parliament must be independent with regard to all aspects of the exercise of his/her mandate. Independency of the member of parliament is necessary precondition for his/her ability to exercise the mandate in such a way, which will enable him/her to face external pressures, not only from the state bodies, but also from other subjects or phenomenons. Instruments protecting independent performance of the mandate also support the possibility of members of parliament to fulfil their role freely and as a result to constitute working parliament.
