The ABC Murders is a novel about a serial murderer who kills his victims in an alphabetical order. What seems as actions of a murderous maniac is, however, a carefully elaborate murder plan whose motive is completely different from alleged motive. The ABC Murders is an atypical story of Agatha Christie. Murders in her novels are usually committed in private places where readers soon know everybody who could be a murderer. However, Franklin Clarke, a murderer in this novel, appears for the first time in the middle of the story. Murders are done in public places and victims seem to have nothing in common except for the fact that they are killed in an alphabetical order. Moreover, the murderer is not so much the least likely suspect as never suspected at all

The present work embraces multiple aspects related to the theme of serial murder, which is essentially addressed by a criminological and personological perspective. Attention will be focused first on the serial killer figure, which will analyze both the intrapsychic peculiarities and the most intrinsic motivations behind the homicidal action as well as the more technical and specific aspects of the modus operandi and the signature that convey this kind of offenders. At the same time, a victimological overview will be developed, focusing on the preferential victims in this delinquent mode. The article will also highlight a categorization of serial killings based on the motive, as well as different classifications of the major types of serial killers identified by multiple authors. Finally, criminal profiling will be analyzed, deepening the role of the profiler in investigations and outlining the presumed personality of the offender, thus circumscribing the field of potential investigators with particular reference to US reality. ---------- Il lavoro qui presentato abbraccia molteplici aspetti relativi al tema dell’omicidio seriale, che viene essenzialmente affrontato da una prospettiva criminologica e personologica. L’attenzione, infatti, si concentrerà inizialmente sulla figura del serial killer, di cui saranno analizzate sia le peculiarità intrapsichiche sia le motivazioni più intrinseche alla base dell’azione omicidiaria, nonché gli aspetti più tecnici e specifici quali il modus operandi e la firma, che connotano questo tipo di autori di reato. Parallelamente verrà sviluppata una panoramica vittimologica, con focus sulle vittime preferenziali in questa modalità delittuosa. L’articolo porterà inoltre alla luce sia una categorizzazione degli omicidi seriali in base al movente, sia diverse classificazioni dei principali tipi di serial killer individuati da più autori. Infine si parlerà di criminal profiling, e sarà approfondito il ruolo che il profiler assume nelle indagini, delineando la presumibile personalità del reo, e circoscrivendo così il campo dei potenziali indagati, con particolare riferimento alla realtà statunitense. ---------- El trabajo presentado aquí abarca múltiples aspectos relacionados con el tema del asesinato en serie, que se aborda esencialmente desde una perspectiva criminológica y personológica. De hecho, la atención se centrará en la figura del asesino en serie, que analizará las peculiaridades intrapsíquicas y los motivos más intrínsecos de la acción homicida, así como aspectos más técnicos y específicos, como el modus operandi y la firma, que transmiten este tipo de delincuentes. Al mismo tiempo, se desarrollará un panorama vistimológico centrado en las víctimas preferenciales en este modo delincuente. El artículo también destacará una categorización de asesinatos en serie basados en el motivo, así como varias clasificaciones de los principales tipos de asesinos en serie identificados por múltiples autores. Finalmente, se tratará sobre la caracterización delictiva, y se profundizará el papel que el perfilador tomará en la investigación, delineando la presunta personalidad del delincuente y circunscribiendo así el campo de investigadores potenciales, con referencia particular a la realidad estadounidense.

Abstract:
Theory and empirical research in criminology have paid less attention to intermittency in offending, that is, the brief lapses and sporadic episodes of crime that occur at sometimes unpredictable intervals (Piquero, 2004). This is mainly due to the problem of defining this phenomenon in a common operational way that can be tested empirically. This has thus led to its abandonment in most contemporary definitions of serial murder (Osborn & Salfati, 2014). Most up-to-date definitions have recognized the fact that serial murders are committed as discrete events (Adjorlolo & Chan, 2014). While psychological, sociological, and geographical theories of serial murder can be used to explain cooling-off periods, none of these theories have, thus far, been used in an empirical study. This article examines the phenomenon of cooling-off periods in relation to serial murder. Although definitions of serial murder have changed over the years, there is a consensus that between every two murders there must be a cooling-off period (Homant & Kennedy, 2014; Morton & McNamara, 2005). Unlike previous research, our study, which is based on the Encyclopedia of Serial Killers (Newton, 2005) found that the longest cooling-off period is between the first and the third murders (i.e., a series). We offer some theoretical psychological explanations for this pattern, although we were unable to study it empirically. We conclude that it is less important how different scholars define cooling-off periods; the important thing is that this phenomenon exists and has meaning for understanding, profiling, and even forecasting the time of the next murder.

Наведено визначення серійного вбивства та кла­сифікацію осіб, які їх вчиняють. Охарактеризовано типову поведінку сексуальних маніяків, надано їх психологічний портрет. Запропоновано комплекс заходів, які потрібно вживати оперативним підрозділам для протидії серійним убивствам. Проаналізовано відповідні по­переджувальні механізми оперативно-розшукового характеру. Обґрунтовано потребу в до­даткових функціях аналітичних підрозділів щодо протидії серійним сексуальним убивствам. In the article features are analyzed of operatively-search counteraction of serial murders, committed by sexual maniacs. The meaning of serial murder and classification of persons which are committed them is resulted. The typical conduct of sexual maniacs, their psychological portrait, is described. The complex of measures which must be carried out by operative subdivisions for counteraction ot serial murders is ottered. The proper preventive mechanisms of operatively-search character ore analyzed. The necessity of additional functions for analytical subdivisions is grounded on counteraction of serial sexual murders.

Between 1975 and 1980, 13 women, 7 of whom were sex workers, were murdered in the North of England. Aside from the femicide itself, the case was infamous for police failings, misogyny, and victim blaming. The article begins with a discussion of the serial murder of women as a gendered structural phenomenon within the wider context of violence, gender, and arbitrary justice. In support of this, the article revisits the above case to interrogate police reform in England and Wales in the wake of the murders, arguing that despite procedural reform, gendered cultural practices continue to shape justice outcomes for victims of gender violence. In addition, changes to prostitution policy are assessed to highlight how the historical and ongoing Othering and criminalization of street sex workers perpetuates the victimization of this marginalized group of women.

Serial murders attract attention from the media, mental health experts, academia, and the general public. We present a case of serial murders that took place in a limited area and which caused public anxiety and anguish in central India. All the victims were homeless beggars, who were bludgeoned to death (crush injury). Individual murders were initially investigated by different police stations; fortunately, since they sent all the bodies to a common autopsy centre, a forensic pathologist was able to link all the cases, the first person to do so. This emphasises the need for sharing information among police stations and autopsy centres.

A case of a 61-year-old African-American male who sexually assaulted and murdered four individuals, of different ethnicities and both genders, is reported. The subject additionally engaged in sexual activity with each victim postmortem. Each murder is reviewed in detail, and the subjective state of the offender during the murders is commented upon. Psychological test data are reviewed. The subject met criteria for several Axis I disorders, including Bipolar I Disorder, Pedophilia, and Sexual Sadism, and met criteria for Axis II diagnoses of Narcissistic and Antisocial Personality disorder. He was additionally classified as a Psychopath, which, in combination with his Sexual Sadism, general psychiatric state, and exquisite sensitivity to humiliation, led to his decision to murder.

Serial murder is a specific type of violent crime that falls into the crime category of multicide. According to the nomenclature of the Federal Bureau of Investigation’s Violent Crime Classification Manual and Academic Researchers for the Classification of Violent Crimes, most serial killers are adults. However, serial murder is also committed by young people, although to a lesser extent. Young serial killers are a topic of relevance in areas such as psychology, criminology, and the justice system. Given that the study of the variables that could be the basis of such multicide criminality is not conclusive, the need for further research is evident. The homicides perpetrated by children and young people point to a social panorama that is alarming due to their young age. This issue is prevalent enough to conduct a review. The performed review concludes the importance of psychosocial factors to better understand the process by which children and young people commit crimes as serious as serial murders. The scope of the problem of serial murders perpetrated by minors is controversial because it often depends on how the number of real cases is counted. Although official statistics indicate the low prevalence of juvenile serial killers, childhood is a period in which antisocial behaviour can have its beginning. Some authors consider that it is not uncommon for the first murder of this type to occur in adolescence. It is important to consider psychopathy as an influential factor in the various forms of serial criminal conduct committed by children and young people. The research works consulted provide evidence of the special relevance of psychopathy in the generation of serious juvenile delinquency.

Феномен серийных убийств на протяжении последних ста лет привлекает особое внимание ученых всего мира, в том числе в области судебной психиатрии, психологии, криминологии, виктимологии и других наук. Данные преступления всегда признаются резонансными, так как характеризуются особой жестокостью, агрессией и держат общество в страхе. Отсутствие развернутых характеристик серийных убийств подчеркивает их высокую степень латентности. Цель статьи - анализ и описание свойств, закономерностей, причин и условий совершения преступлений данного характера, а также свойств личности преступника. Методологическую основу исследования составляет диалектический метод научного познания, отражающий взаимосвязь теории и практики. При подготовке работы использовались также следующие частнонаучные методы: биографический - изучение личностных качеств серийных убийц, статистический анализ - оценка количественно-качественных признаков серийных преступлений, анализ документов - использование информации, зафиксированной на бумажном и электронном носителе. В статье рассматриваются вопросы криминологической характеристики серийных убийств: анализируется понятие серийных убийств, рассматриваются количественно-качественные показатели, определяются основные детерминанты, изучается виктимологический аспект. The phenomenon of serial murders over the past hundred years has attracted the special attention of scientists around the world, including in the field of forensic psychiatry, psychology, criminology, victimology and other sciences. These crimes are always recognized as resonant, as they are characterized by special cruelty, aggression and keep society in fear. The lack of detailed characteristics of serial kills emphasizes their extremely high degree of latency. The purpose of the article is to analyze and describe the properties, laws, causes and conditions of committing crimes of this nature, as well as the properties of the person of the offender. The methodological basis of the study is the dialectical method of scientific knowledge, which reflects the relationship between theory and practice. The following private scientific methods were also used: biographical - the study of the personal qualities of serial killers, statistical analysis - the assessment of quantitative and qualitative signs of serial crimes, document analysis - the use of information recorded on paper and electronic media. The authors consider issues of criminological characterization of serial murders: the concept of serial murders is analyzed, quantitative and qualitative indicators are considered, the main determinants are determined, the victimological aspect is studied.

Abstract:
How do the media react in the face of a violent phenomenon involving actors both embraced and marginalized by society? One such phenomena – the McArthur murders – encapsulates this dynamic considering how the media explained the murders to their audiences. McArthur, a white LGBTQ+ man, murdered over a seven-year period specifically targeting male victims of South Asian or Middle Eastern descent associated with the LGBTQ+ community and geographic area in Toronto, Canada. The victims embodied a variety of marginalized identities including race, ethnicity, sexual orientation, immigration status and houselessness. It is in this context that this qualitative study finds itself, investigating media coverage of the McArthur murders in two mediums/Canadian outlets. The Toronto Star, Canada’s largest daily newspaper representing newspaper coverage, and a podcast produced by the Canadian Broadcasting Corporation (CBC), Uncover: The Village representing podcast (or audio) media. Considering the context of the McArthur murders and the identities of the actors involved, the study is focused on how normativity and deviancy are constructed through mediatized eyes (or frames). Through a blend of deductive and inductive framing analysis relying on a queer phenomenologically-inspired theoretical framework, the study’s aim is threefold: (1) to uncover what frames are most prevalent across both outlets, (2) to understand, using deductively applied frames, how both outlets construct the events of the McArthur murders and, (3) to understand the interplay between mediatized reification or mitigation of normativity. The analysis found that both newspaper and podcast were most concerned with attributing responsibility in their coverage, which introduced the queer phenomenological understanding of institutions into the analysis, a pattern which continued throughout each deductively applied frame. Moreover, connections to analogous sets of murders in 1970s Toronto broadened the implications of the study across time. Finally, the analysis showed that rather than solely reifying or mitigating normativity, both outlets’ coverage despite similarities and differences, are illustrative of normativity and deviancy’s ongoing orientation towards one another. The conflict between societally standard and aberrant is shown to be a constant over time, after death, and across contexts – a dynamic relationship which has significance for how media scholars might approach cross-medium analyses of complex phenomena in further research.

Public perceptions about serial homicide are more mythical than fact. Myths about serial homicide are perpetuated through several sources, especially the entertainment media which is a dominant and influential mythmaker. The number of films depicting serial killers and serial killing themes has increased dramatically in recent years. However, the reality of these films is debatable. This research examines the reality, or lack thereof, of the most recent films involving a serial killing theme. Hickey provides a wealth of statistical information on a number of serial killers and serial killings. A content analysis of the fifty top grossing serial killer movies made between 1980 and 2001 was conducted using variables from Hickey research. Research shows similarities and differences between variables, however, results concludes the entertainment media does not accurately portray serial homicide.

This study focuses on the role of media portrayal and coverage in serial killing. The first objective of the study is to develop a conceptual structure that aids in the understanding of the cyclical relationship between media, serial killer, and audience. The media acts as a catalyst in this relationship, providing the stage on which serial killer and audience form a fatal relationship in which celebrity status forms the ultimate motivation. Media sensationalism of serial killing and the extreme glamorization in fictional representations has obviously negative consequences. In developing such a structure I hope to demonstrate that there is an alternative to the sensationalizing and glamorizing of serial killers in the media. This alternative will take the form education and a more documentary-style approach to films about serial murder. The study focuses mainly on developing a theoretical framework that emphasizes each of the three elements of the cyclical relationship mentioned above separately. The second chapter is devoted to the media and its role. The third chapter focuses on serial killers and the motivations involved. The fourth chapter deals with the audience attracted to serial killing as a source of identification. A number of thinkers’ work is used in coming to grips with this relationship, including both American and South African authors. The fifth and final chapter takes into consideration the moment of application by addressing the South African situation. I conclude by discussing the repercussions of media glamorization and possible documentary-style alternatives.

Abstract:
The study is a psychobiographical study, aiming to explore and describe the life of John Wayne Gacy. He was a well-respected man in his community, entertaining the neighbourhood as Pogo the clown. But there was a dark side to his nature that he tried to keep hidden; yet glimpses of it appeared throughout his life. This dark side was exposed to the public when the police found twenty-seven dead bodies ranging from boys of nine to young men twenty years of age hidden in his basement. The study utilises the Erikson’s psychosocial developmental theory in order to examine Gacy’s life and attempt to establish unique character traits. The study utilises a qualitative single case study approach, and the subject was selected through purposive sampling based on interest value. Archival data was collected from secondary sources to enhance validity. Data was analysed by first organising and reducing information obtained; and then displaying it for discussion of Gacy’s life. Gacy’s life was reconstructed from birth, through adolescence and adulthood and his death. The findings suggest that the theoretical approach considered the biopsychosocial as well as cultural and historical influences of situations and experiences in Gacy’s personality development throughout his lifespan. The main themes of discussion centre around the abuse he experienced and the influence this had on his development, the lack of crisis resolution and thus achievement of virtues, Gacy’s lack of difficulty in establishing attachment and the resulting narcissism and lack of self-abandon, as well his homosexuality, sadism and the murders he ultimately committed. The study highlighted the importance of psychobiographical studies and the value of Erikson’s theory in understanding development. Recommendations for future research in this field was made in the hope of further uncovering and understanding the personality and its development.

Geographic profiling is a technique used by crime investigators and the police to examine the locations of a connected series of crimes, to determine the most probable area of the offender’s residence. Using both qualitative and quantitative methods, Geographic profiling helps to better interpret the spatial behavior of an offender and focuses the investigation on a specific and smaller area of the community. From the abovementioned and from previous research, we know that Geographic profiling is useful in serial crimes such as in cases of serial murderers, serial rapists etc. Having as a point of reference Malmö, because of the many shooting incidents that have happened through the last years, in this master thesis dissertation, a systematic literature review on Geographic Profiling was conducted while at the same time the usefulness of the method in locating the serial murderers was examined.

Abstract:
Morphogenetic markers of predisposition to delinquent behavior are considered in the article on the example of congenital signs of papillary patterns of fingers. To do this, the fingerprints of 100 serial killers who committed crimes on a sexual basis and 100 law-abiding citizens were analyzed. According to the results of the study, informative combinations of pattern types were found, which are statistically more common in the group of people who committed serial murders. The similarity of a number of established dermatoglyphic markers of serial killers with dermatoglyphics observed in congenital diseases and diseases with hereditary predisposition is shown. The obtained results are proposed to be used in the system of a comprehensive assessment of the risk of delinquency in the person being checked and the formation of a psychological portrait of the criminal.

Abstract:
The author discusses different segments of the institute of euthanasia ("murder out of mercy"), especially the question of the justification of its legalization. The subject of the analysis are the solutions of certain European regulations that have completely or partially decriminalized euthanasia, and then the domestic one, in which there is a collision of the norms of criminal and medical law. According to the positive serbian criminal law, euthanasia is a criminal offense and a privileged form of murder, while the Law on Patients' Rights indirectly allows the so-called passive euthanasia, which is not the optimal solution, which introduces legal uncertainty. Тhe Preliminary Draft of the Civil Code of Serbia, which embodies the proposal for the future civil law of Serbia, proposes the decriminalization of euthanasia, which is a solution that needs to be commented on. The aim of the paper is a comparative analysis of domestic and foreign solutions of this controversial institute - through its concept, types (active and passive euthanasia) and critical analysis of the reasons for and against its introduction into the domestic law. The author evaluates the proposal of the Preliminary Draft as progress, with the idea that euthanasia, despite all the controversies that accompany it, represents the ultimate expression of a personal right to self-determination (subjective civil right sui generis), in both modalities, without distinction.

Abstract:
Human life and body represent social values that have always been and remain the subject of criminal law protection. Precisely, the authors in the first part of the work point to the incrimination of the crime of murder throughout the historical era of Serbia and the neighboring countries, and also that the life and body of members of certain social classes were not subject to criminal law protection, and in certain eras the criminal law protection of life and body was not provided equally to every person. The continuous development of society and changes in all spheres led to the need for more and more contact between people, and their relationships led to various conflicts and the desire to be resolved at their own discretion. The second part of the work deals with conflict situations that led to mutual attacks in order to resolve the situations that ended with an attack and endangering the physical integrity of people. Thus, when studying the criminal offense of murder, which is one of the classics, perhaps even the oldest criminal offense which has already been discussed so much from a theoretical point of view and, at first glance, it seems that everything has already been said, there are still a lot of disputed questions that need to be discussed, in a theoretical, criminological sense, as well as to clarify the problems that arise in judicial practice. Some research indicates that a high percentage (even over 80 percent) of perpetrators of criminal acts would not have started committing criminal acts if they had known for sure that they would be discovered as perpetrators of the same. Research data indicate that violence in Serbia has increased by 74%. The third part of the work deals with the incrimination of the most serious criminal offense from the aspect of modern and international criminal law, as well as their recommendations for the purpose of prevention and repression.

Abstract:
Following the collapse of the Kurdish revolution in 1975 in the wake of Algiers Agreement1975 between Iraq and Iran, the governing Baath regime in Baghdad found itself free against the National Kurdish Movement, carrying out a series of genocide and ethnic cleansing operations against Kurds in Iraq. The government lunched wide arrest campaign against members of Kurdish opposition and destroyed many border villages in order to create a 20-kilometer security belt alongside the borders with Turkey and Iran with mines planted there. That area was declared to be a military zone accessed only by the Iraqi army. That required evacuating 500 villages which caused thousands of Kurds to seek refuge in Iran in fear of apprehension or murder. These developments were accompanied by a displacement process carried out by the Iraqi government on March 31st 1975 against member of Al-Barzani clan in Barzan area, who were displaced to the desert in Al-Qadisiya province and were only allowed to return to Kurdistan in the 1980 in the condition that they do not go back to their original areas. This was followed by the Anfal campaign which destroyed more than four thousand villages and displaced more than half a million Kurds to the Iraqi southern deserts while other thousands fled to Iran. It was in the Anfal campaign that the tragedy of Halabja occurred where chemical weapons were used on March 16th 1988 causing the death of more than five thousand Kurds and horrible unprecedented scene.

Abstract:
Abstract Serial killers, rapists, terrorists, and other notorious criminals are often labeled "criminals forever." Recovery for this group is unusual, according to post-positivist studies. However, positive spiritual psychology says differently. In Christian theology, Saul, a notorious mass murderer, went to Damascus and became Paul, a righteous man. Hence, this study unraveled the breakthrough stories of real-life Pauls, or formerly convicted notorious criminals before, during, and after adhering to the Christian faith. Through narrative inquiry, ten purposively selected samples were assessed through Psychology's triad of affect, behavior, and cognitions (ABC). Thematic analysis revealed that participants were chronic malefactors with vile and remorseless compulsions for victimization before adhering to the Christian faith. Egotistical convictions drove their actions. Uniformly, a similar epiphany occurred through their spiritual encounters with the Divine. From then on, they insouciantly live with rectitude, compassion, and selfless credo, which is deemed undoable with their willpower but doable with God's might. The revolutionary study reveals that individuals repented, resisted compulsions, repaired harms, and recovered right after being changed, contrary to nonlinear relapses of recidivists. The study highlights the penumbra that "change can happen even to the worst of the wicked." No matter how notorious one can be, the power of spirituality can transcend beyond human understanding onward the inner workings of the mind, body, and spirit. Based on these results, the research suggests studying Quantum Change, an underutilized concept in psychology. Still, it has been linked to effective holistic transformations. Abstract:
"This work includes talking about the crime of Camp Speicher, in which 1,700 students of the Iraqi army of the Sheea creed were killed by the gangs of the terrorist organization ISIS, with the aim of eliminating the members of this sect because of the misleading ideology carried by those gangs. On 6-12-2014, Iraqi soldiers at Camp Speicher (Speicher Air Base) in Tikrit were subjected to murder and enforced disappearance by terrorist organizations because of their affiliation to the Sheea creed. This crime was among a series of brutal crimes for the genocide of Sheeas in Iraq. This is similar to what happened in the Badoush prison crime in the province of Mosul, which the Iraqi Parliament considered it as a crime of genocide, in which these gangs executed about (400) members of the prison inmates of the Sheea component. After ISIS took control of the city of Tikrit in Iraq, and one day after they took control of the city of Mosul, they captured (2000-2200) soldiers and led them to the presidential palaces in Tikrit, and they shot them there and in other areas and buried some of them alive. This disaster had a negative impact on the families of the victims of the Speicher where they went out in demonstrations demanded that the leaders who handed over the victims of Speicher to ISIS must be prosecuted, and in one of the demonstrations they managed to enter Parliament and demanded that the leaders who handed over Speicher to ISIS be held accountable. After that, many demonstrations took place by the families of the victims, some of which led to the closure of a bridge in Baghdad a few times Protesting the government's delay in clarifying the fate of their children or taking quick measures. The Iraqi parliament and government recently considered the Speicher incident “genocide” in reference to the premeditated murder of Badoush Prison inmates in Nineveh Governorate and the unarmed Speicher military base, the premeditated murder of members of the Albu Nimr, Jabour, al-Lahib, and al-Ubaid tribes, and the killing and displacement of civilians from Kurds, Christians, Yazidis and Shabaks in Sahel Nineveh, Sinjar, deliberate killing and displacement of Turkmens in Tal Afar and Bashir. This decision paves the way for obtaining international recognition from it as a ""genocide"" as stipulated in the Contract of the United Nations in 1948, and Iraq signed it in the fifties of the last century. This study attempts to explain the Al-Ikhnasas Court in looking into the crimes of genocide committed by ISIS against the bereaved students of the Air Force Base (Speicher) due to what this issue raised from the national and international public opinion, especially after the involvement of the Iraqi army leaders in this massacre, according to what witnesses reported in that area and what was reported by soldiers who survived the incident, in addition to the involvement of some members of the Sunni tribes in these crimes with the terrorist organization ISIS. The importance of this study lies in the following aspects: - That ISIS elements were tried according to Anti-Terrorism Law No. 13 of 2005, and from our point of view that the aforementioned law is vague and broader than it should be, and it applies to serious and simple crimes from murder to crimes of sabotage, and the list of crimes punishable by the death penalty according to the aforementioned law is a long list and spacious. - The Iraqi government has embarked on an attempt to develop a legal framework to prosecute ISIS elements, and its mission focused on understanding the procedures and results drawn from those judicial efforts, and its mission also focused on showing the efforts taken by the Iraqi government to address violations in the field of the right to life, including those committed by affiliated forces government as well as other international and domestic actors. The International Criminal Court is specialized in considering specific crimes under Article (5) of its Statute, which are war crimes, aggression and crimes against humanity, which necessitates the adaptation of Speicher's crime within any of the mentioned types of crimes. The assumption of the International Criminal Court in relation to the Speicher crime, includes several positive matters and results at the same time a set of negatives, which must be presented to those positives and negatives in order to give preference between them and the choice of authorizing the court to consider the crime or not. The terrorist organization ISIS has committed serious systematic violations, including war crimes and others, and perhaps those that are not under its control, and that none of these crimes can be addressed within the anti-terrorism law, which cannot address human rights violations. The international community has recognized the heinous violations committed by ISIS against the citizens of Iraq by adopting Resolution (2370) in September of 2017, issued by the Security Council, which authorizes the Security Council to appoint an investigation team to support local efforts to hold ISIS elements accountable by collecting and preserving evidence in Iraq, which can rise to a high level, and it was committed by the elements of the organization. It considers that the decision constitutes a burden and an obligation on Iraq to investigate all allegations of violations committed by government forces for the purpose of holding them accountable, as well as requiring the establishment of special courts and trained judges in relation to ISIS crimes to deal with them. Terrorism is a global curse that has recently spread horizontally to all countries of the world and its effects have been concentrated vertically in some countries, and no one denies that the parties to this phenomenon are increasing (perpetrators and victims) and the United Nations in particular and the international community in general has not succeeded in reducing it despite the fact that the resolutions of the UN Security Council It is increasing, but the proportionality is absent between these decisions and the practical reality. The phenomenon of terrorism is spreading rapidly, and the perpetrators of terrorist acts are on the rise, corresponding to an increase in the victims of terrorism. Also, the circumstances and events that Iraq is going through, especially after 2003, put it at the forefront of countries which suffers from terrorism that has killed the people, using methods and forms that were not previously known and brutal and bloody cruel. ) for the year 2005, and since terrorism was not limited to Iraq, but included many countries, and was not specific to a place or time, nor was it recent in terms of composition. In addition, the aforementioned law cannot be aware of all violations of international and humanitarian law, as we mentioned previously, which requires the necessity of referring the criminals to a competent court. The Court conducts its rule under Article (13) of its Statute when referred to it by a state party to the same system or by the Security Council or when the Public Prosecutor conducts the investigation on his own, and then how does the Court take its measures regarding the aforementioned crime if we take a look Considering that the State of Iraq is not a member of the Statute of the Court. The rule of the court is free from the death penalty, which makes the idea of authorizing the court to consider the crime rejected by most Iraqis, especially the families of the victims. What are the negative aspects of the Iraqi national judiciary’s view of the Speicher crime, and how can it be avoided if the International Criminal Court plays this role? What are the guarantees provided by the court in the event that it proceeds with its procedures regarding this crime? The research on this subject is according to the appropriate method, which is the analytical and comparative method, which works on studying and comparing topics by analyzing ideas and jurisprudential rulings, and the positions of the governments of countries and the United Nations, as well as the resolutions of the Security Council and the General Assembly, and comparing arbitration between Iraqi courts. And the international courts regarding the trial of the perpetrators of the Speicher base crime, and then come up with a set of conclusions and recommendations."
