ENGLISH ABSTRACT: Traditionally, the common law rule as interpreted by South African case law required that mutual consent be obtained in order to relocate a specified servitude of right of way. Since the Linvestment judgment, the legal position pertaining to the unilateral relocation of a specified servitude of right of way is that the location of an existing specified servitude of right of way may be altered unilaterally by the owner of the servient tenement. Unilateral relocation of a specified servitude of right of way will only be allowed if strict requirements are met, namely that the servient owner will be materially inconvenienced in the use of his property if the status quo is maintained; that the relocation will not prejudice the owner of the dominant tenement; and that the servient owner pays all costs incurred in the relocation of the servitude. In order to justify the departure from the common law, the court in Linvestment relied on historical argument, comparative law, and policy arguments to reach the conclusion that a servitude may be relocated unilaterally if it is in the interest of fairness, equity and justice. The court relied on section 173 of the Constitution, which entitles the courts to develop the common law. This decision of the Supreme Court of Appeal has far-reaching implications. A servitude is a limited real right to the property of another person which grants the holder of that right specific entitlements. South African law requires that registration in the deeds registry take place in terms of section 63(1) of the Deeds Registries Act 47 of 1937 as soon as a limited real right in immovable property is created or transferred. Once the servitude is registered, it will be enforceable against the owner of the servient tenement and all his successors in title. When the servient owner is allowed to relocate the servitude unilaterally, it will have the effect of undermining the limited real right that the dominant owner holds in the property in question. This thesis evaluates the extent to which the courts may change common law principles on the basis of fairness, justice and equity. The conclusion is that the policy grounds on which the court based its decision are convincing, as the law cannot remain rigid and needs to be continually changed in order to meet changing conditions. However, the comparative and historical reasons provided for the decision are insubstantial and unconvincing. The thesis points out that there are no historical grounds for the decision, but that more extensive and contextual comparative research does support the decision. This thesis considers the constitutional implications of a flexible legal approach to the unilateral relocation of a specified servitude of right of way and concludes that an approach that allows for unilateral relocation will not amount to an expropriation and will not establish an arbitrary deprivation either, provided that the requirements set out in the decision are applied strictly and that a court order is required for the relocation.
AFRIKAANSE OPSOMMING: Die tradisionele gemeenregtiglike beginsel rakende die verlegging van 'n gespesifiseerde reg van weg het vereis dat wannneer 'n roete eers vasgestel is, die eienaar van die dienende erf dit nie mag verander nie tensy hy toestemming verkry het van die eienaar van die heersende erf. Sedert die uitspraak in Linvestment, is die regsposisie dat die eienaar van die dienende erf wel die ligging van 'n serwituut eensydig mag verander. Die eienaar van die dienende erf sal slegs gemagtig wees om die servituut te verskuif onder omstandighede waar die huidige ligging van die serwituut wesenlike materiële nadeel vir hom meebring, die verskuiwing van die serwituut geen nadeel vir die eienaar van die heersende erf sal veroorsaak nie en mits die eienaar van die dienende erf die kostes wat verband hou met die verskuiwing van die serwituut sal dra. Die hof het ook beslis dat die howe die inherente bevoegdheid het om die gemenereg te ontwikkel ingevolge artikel 173 van die Grondwet. Die beslissing het verreikende implikasies. 'n Serwituut is 'n beperkte saaklike reg op die saak van iemand anders wat aan die reghebbende bepaalde genots- en gebruiksbevoegdhede ten aansien van daardie saak verleen. Artikel 63(1) van die Registrasie van Aktes Wet 47 van 1937 vereis dat 'n beperkte saaklike reg ten aansien van onroerende goedere geregistreer moet word sodra 'n beperkte saaklike reg gevestig word. Die doel van hierdie tesis is om te evalueer tot watter mate howe daartoe in staat is om die gemenereg te verander op grond van billikheid en geregtigheid. Die gevolgtrekking is dat die hof se beleidsargumente oortuigend is aangesien die reg voortdurend moet verander ten einde te voldoen aan die veranderende omstandighede. Die regsvergelykende en historiese gronde vir die hof se gevolgtrekking is egter onoortuigend. Die tesis illustreer dat daar geen historiese gronde bestaan vir die beslissing nie asook dat meer ekstensiewe en kontekstuele regsvergelykende navorsing wel die hof se beslissing staaf. Hierdie tesis evalueer ook die grondwetlike implikasies van die nuwe reël en kom tot die gevolgtrekking dat die toepassing van 'n benadering ingevolge waarvan die eienaar van „n dienende erf gemagtig word om 'n serwituut eensydig te verskuif, nie 'n onteiening of 'n arbitrêre ontneming teweegbring nie op voorwaarde dat die vereistes soos uiteengesit in die uitspraak aan voldoen word en dat die verkryging van 'n hofbevel 'n moontlike voorvereiste is vir die verskuiwing van 'n serwituut.

This work is based mainly on Etienne de La Boétie’s text, studied, in broad outline, from a humanist and socio cultural standpoint .To what extend is the text a reflection of the time when it was written and to what extend does it transcend it ? What motivates servitude: is it part and parcel of the psyche of the human mind ? And how does it link up with the individual and collective levels ? Does the layout of the text answer the academic canons or does it show signs of liberation from these rules, first step towards the liberation of the subject ? Were the solutions put forward by La Boétie efficient from his time till nowadays ? Are they still efficient today or is servitude a component of the subject himself ? Does the psychoanalytic theory offer a liberating alternative that the cure can implement ? So many questions this thesis which intertwines literature and psychoanalysis tries to answer

Abstract:
Notre analyse vise l'elucidation des processus psychologiques en jeu chez un sujet lorsqu'il realise une action contraire a ses valeurs morales dans le cadre de son travail. Nous avons utilise les methodes de la psychologie clinique du travail pour analyser, ;dans un premier temps, des situations de travail "ordinaires" actuelles. Nous avons en un second temps, elargi notre recherche du cote de l'extreme, vers les temps de la terreur nazie. Au-dela des differences, la psychologie clinique du travail nous permet de preciser certains processus a l'oeuvre dans l'action immorale. Tout d'abord, les sujets ne sont pas asservis de maniere totale, ils participent activement a l'action immorale. Meme si les actions analysees se deroulent dans le cadre de relations de travail hierarchisees sous-tendues par des relations de pouvoir, ils n'agissent pas comme des automates mais mobilisent au contraire leurs capacites : cognitives et leur subjectivite pour parvenir a realiser leur tache. Il nous a alors semble necessaire de differencier l'etat de servitude, qui serait purement passif, de l'etat de soumission. La soumission ainsi concue ne se resume pas a un assujettissement passif du sujet a l'organisation. Ensuite, la realisation de l'action immorale entraine un conflit entre morale et pratique, source d'une souffrance que nous avons qualifiee de moralepratique. Enfin, nos cas cliniques nous ont revele la possibilite de controler cette souffrance par la mise en place de defenses collectives qui consolident et renforcent la soumission, de sorte qu'elles trouvent place parmi les causes de la soumission. La soumission defensive permet de perpetrer l'action immorale et de rester normal.

Centree sur les oeuvres d'eschyle, sophocle et euripide, cette etude analyse a partir du contexte ideologique de la tragedie l'idee de la servitude a la fois comme realite sociale et comme metaphore. Dans son ensemble elle se veut avant tout une reflexion sur l'idee largement repandue et meme determinante dans la tragedie grecque de la servitude comme expression de la "non-liberte". L'etude s'ouvre sur une etude semantique du vocabulaire de la servitude couvrant non seulement le champ specifique de l'esclavage mais aussi l'espace plus large de rapports de soumission. Cette parite d'etude, renvoyant aux esclaves dans la sphere denominative est suivie par une reflexion sur le role de personnages "soumis". Examinant le role de personnages secondaires elle met en evidence leur fonction de mediateurs a la fois reels et symboliques. L'esclave-serviteur est non seulement une voix, il est un agent regardant, de meme qu'il est un visage et un corps: trois elements qui fonctionnent comme de criteres sociaux qui au fond avancent des comportements discriminants et antagonistes. Restant dans un contexte comparatif qui oppose maitres et esclaves l'auteur constate que divers traits d'inferiorite et d'exclusion sont filtres par la figure de l'esclave: etre de mepris qui s'exprime par l'absence de l'individualite propre, oppose aux valeurs de l'homme libre, en l'occurrence du heros, l'esclave incarne la vulnerabilite et assume son exclusion par une serie de signes exterieurs qui puisent leur prototypes dans les moeurs vestimentaires, les attitudes corporelles ou l'expression visuelle et faciale. L'etre servile devient de la sorte le miroir sur lequel exclusion et differences se projettent.

La France trouve à Madagascar, en Afrique et en Inde des conditions favorables qui lui permettent de prélever et de mettre en mouvement des asservis, des captifs ou des indigents. Cette thèse vise à interroger la légitimation morale de ces pratiques serviles. De quelle manière les discours parviennent-ils à rendre moral ce qui, par essence, est immoral ? Toutes les sociétés ont produit des spéculations mythico-religieuses en vue de sacraliser leurs servitudes. La meilleure façon de moraliser et de normaliser une servitude est de la présenter comme procédant du surnaturel, de la main de Dieu. Il ressort des discours religieux et mythologiques un triptyque idéologique faisant intervenir une structure dynamique à deux dimensions : l’arrière-monde et le monde réel. Toute conception religieuse de la servitude pose une métaphysique dégradée de l’âme et du corps de l’asservi, qui réclame de lui une posture ascétique et purificatrice contre l’espérance d’une amélioration ontologique, d’une élévation axiologique de l’âme : une theoria [un paradigme de l’altérité], une éthique [une praxis transfigurante] et un salut [les espérances métaphysiques]. La généalogie des idéologies montre qu’elles prennent leur source dans les plus anciennes pensées religieuses des antiques civilisations. Ironie de l’histoire, certaines d’entre elles – en particulier l’idée d’une âme immortelle - sont d’origine africaine. This thesis aims to question the moral legitimization of these servile practices. How do discourses manage to moralize what, in essence, is immoral? All societies have produced mythico-religious speculations with a view to sacralizing their servitudes. The best way to moralize and normalize servitude is to present it as proceeding from the supernatural, from the hand of God. What emerges from religious and mythological discourse is an ideological triptych involving a dynamic two-dimensional structure: the hinterland and the real world. Any religious conception of servitude poses a degraded metaphysics of the soul and the body of the enslaved person, who demands from him an ascetic and purifying posture against the hope of an ontological improvement, an axiological elevation of the soul. : a theoria [a paradigm of otherness], an ethics [a transfiguring praxis] and a salvation [metaphysical hopes]. The genealogy of ideologies shows that they originate in the oldest religious thoughts of ancient civilizations. Spinoza nous présente une conception intrinsèquement démocratique du pouvoir politique, où la constitutions de le plus libre régime ou la plus odieuses tyrannie sont toujours entre les mains de la multitude. Nous commençons notre travaile pour l etude de l Èthique, et de la une conception spinoziste de l immanence absolue, qui interdisent tout archétype d une pouvoir transcendante. Pour Spinoza la puissance de la multitude est la cause immanente de le pouvoir politique. Le sujet poitique multitude n est pas organisé par le calcul rationnel d un contract entre les individus, mais par une mécanique affective immanente qui imprègne le domaine social. Nous étudions comment le philosophe afirme l expérience politique comme un champ d affects et de conflits, et nous visitons les principaux concepts et formules spinozistes sur la politique, énoncée dans son Traité Théologique-Politique et son Traité Politique. Nous analysont de quelle façon la loi naturelle est afirmée par Espinosa comme expression de la puissance positive et actuelle de la multitude et la loi civile perçue comme une expression immanente des propres relations constitutives de la multitude. Enfin, à notre thème central, nous analysons l obéissance politique comprise par l auteur comme cause immanent du pouvoir politique et par conséquent cause de son caractère démocratique ou tyrannique. En passant par la distinction entre l obéissance libre des citoyens et l obéissance servile de l esclave, nous étudions comment l imagination peut engendrer l obéissance comme désir de servir, et les affects que, au-delà de la peur, peut accompagner la servitude politique.
Espinosa nos apresenta uma concepção intrinsecamente democrática do poder político, onde a constituição do mais libertário dos regimes ou da mais odiosa das tiranias encontra-se sempre nas mãos da multidão. Neste trabalho, começamos analisando como o filósofo constrói, em sua Ética, uma concepção da imanência absoluta, que o permite recusar qualquer arquétipo de poder transcendente. Em Espinosa, o poder político não se distancia de sua causa imanente, a potência da multidão. O sujeito político espinosano não se organiza pelo cálculo racional de indivíduos contratantes, mas por uma mecânica afetiva imanente que perpassa o campo social. Estudamos como, próximo da reflexão maquiaveliana, o filósofo se dispõe a analisar a experiência política como campo dos afetos e dos conflitos, e visitamos os principais conceitos e formulações espinosanos acerca da política, enunciados em seu Tratado Teológico-político e seu Tratado Político. Comentamos de que maneira o direito natural é analisado por Espinosa como potência sempre atual e positiva, e o direito civil entendido como expressão imanente das próprias relações constituintes da multidão. Por fim, chegando a nosso tema central, analisamos a obediência política, entendida pelo autor como causa imanente do poder político, e causa, portanto, de seu caráter democrático ou tirânico. Passando pela distinção entre a obediência livre do cidadão e a obediência servil do escravo, estudamos como a imaginação pode engendrar a obediência como desejo de servir e quais afetos, além do medo, podem acompanhar a servidão política.

Abstract:
The current study seeks not only to place into focus the general patterns of social and economic organization prevalent in Colombia in the late nineteenth century and the early twentieth (such political and economic organization has been ably illustrated by several authors), but also strives to elucidate the systems of thought or 'ideologies' to which such socio-economic and political structures gave rise. It is concerned with the thought-systems that influenced the development of the Colombian labor movement, those of actors external to organized labor and indigenous systems of thought of labor activists themselves. The hypothesis is that class and party-based interests channelled the early development of organized labor toward a path that would further, or failing that, not conflict with dominant elite interests. Artisans, proudly independent, exerted inordinate influence over the movement, hindering the development of working class consciousness. As the result of dominance by élites external to the labor movement itself, workers were never able to forge an independent voice that would allow them to define their own interests in society.

This thesis is an assessment of Walter Benjamin's contribution to critical theory. I will argue that the animating problem behind his vision of critical theory is the question of voluntary servitude: why do the many willingly accept the rule of the few when it is against their interests to do so? I will argue that Benjamin extends our understanding of this quandary in three different respects. This thesis begins by considering Benjamin's account of what human freedom is, paying careful attention to his account of which cognitive faculties give rise to it, and what internal and external factors frustrate its realization. The central sect ion of this thesis analyses Benjamin's account of domination, which purports to offer a novel perspective on the ideological reasons why people relinquish their freedom en masse. The final section of this thesis examines Benjamin's account of liberation, giving particular attention to the strategies that he advocates to bring about this desideratum and the reasons why he considers emancipation to be morally necessary. On the one hand this thesis stands as a contribution to the hi story of Post-Kantian philosophy insofar as it provides the first systematic assessment of Benjamin's contribution to the Frankfurt School. On the other hand this thesis outlines a novel solution to a persistent problem in political philosophy.

Abstract:
This thesis offers a spatial analysis of the representation of female servitude and rebellion in contemporary French cinema through the archetype of the 19th century rebellious maid figure. The rebellious maid figure is an historical, social and cultural construct upon which a series of spatialised iconographic features were grafted during the nineteenth century and that continue to be employed in contemporary cinematic mise en scène. This thesis uncovers dual spatial translation processes. The first process under study is the translation of the maid’s ‘space syntax’ (a spatial and architectural iconography) into the cinematic medium. Film, by way of its spatial diegesis and mise-en-scène, manifests in a particular manner the archetypal maid’s narrative of servitude and rebellion. This will be demonstrated through the study of Chabrol’s La Cérémonie (1995) and Dercourt’s La Tourneuse de pages (2006), two films that represent, in a typological ma nner, the domestic architectural setting associated with the 19th century bonne à tout faire and her syntax of space. The second process that I refer to is that of the translation of the maid’s space syntax onto updated, contemporary social contexts and spatial settings of female servitude and rebellion in cinema that are divorced from the original domestic environment of the traditional maid figure. Achache’s Le Hérisson (2009), Klapisch’s Ma part du gâteau (2011), Charef’s Marie-Line (2000), and Mennegun’s Louise Wimmer (2012) will be analysed in that context. By examining how the maid figure is translated across time, space and medium, this thesis demonstrates the power of social and cultural constructions of space to endure radical temporal and environmental changes. In effect, this thesis will argue, the archetypal 19th century maid figure and her attendant space syntax survive as a latent construct that filmmakers draw upon in order to stage narrati ves of servitude and rebellion. The findings of this underta! king seek to inform critical understandings of the politics and poetics of the representation of rebellion in films that present narratives of female servitude.

Abstract:
The poetry of Edwin Muir has inspired a distinctive body of criticism. Realizing that his poetry is inexorably linked with his life, Roger Knight, Michael Phillips, Peter Butter and others have produced fine studies of his work against a biographical background. Margaret Anderson has contributed an important dissertation on the importance of dualism in the poems. R. P. Blackmur, J. R. Watson and Kathleen Raine have published articles that are central in informing any new Muir scholarship.This study intends to illuminate the source of Muir's inspiration, to show that his imagery is drawn from the mythos. A general review of Muir criticism supports the theory that the imaginative background he knew as the Fable, which underlies all temporal human behavior (labeled as the Story) is also the collective unconscious of Jung, the Spiritus Mundi of Yeats, the "inseeing" of Rilke, and the Mythos of Aristotle.The study reviews Muir criticism and the poetic technique of Muir, develops a special definition of "mythos" and goes on, through the explication of selected Muir poems, to show how his poetic and philosophical growth was influenced by his unique ability to gain access to the most powerful of Aristotle's four modes of Rhetoric. Finally, the study crystalizes Muir's overall aesthetic in the oxymoronic conclusion to his 1956 masterpiece, "The Horses," the term "free servitude."Muir felt that we can only function at our full potential when we use the power of our imagination to realize the essential duality of the human condition. We are, to an extent, free, and in a state of servitude. In Freudian terms, the superego enslaves us through guilt and our debt to the concept of civilization, while the id urges us on the ultimate freedom represented by the unchecked expression of violence and sex.The study concludes with an examination of Muir's final enigmatic symbol, found in the title of his last collection of poems: One Foot in Eden. Man, through the imaginative realization of his immortality, may plant one foot in Eden; the other foot remains trapped in the Labyrinth, Muir's symbol for the bewildering, impersonal complexity of our twentieth century beaurocractic wasteland. The transcendence of this entrapment gave Muir his purpose, in life and in art.

Qu'il soit objet de perception par les sens (dans la réalité virtuelle par exemple), ou social (dans les interactions intentionnelles qu'il renferme), la conscience entretient avec l'objet virtuel une relation qui oscille entre perception enrichie et illusion. L'objet virtuel sert en effet, à la fois, de lecture améliorée du monde tendant vers une meilleure compréhension de ce qui entoure la conscience percevante et de dénaturation du réel au profit de faux-semblants illusoires qui au contraire éloignent la conscience de la réalité. La conscience est ainsi tiraillée entre deux phénomènes opposés et doit, dans cette configuration, chercher un moyen d'identifier l'objet virtuel au-delà de l'illusion qu'il engendre ou des lectures intentionnelles qu'il propose. Proteiform and dematerialized, the digital virtual object never stops interacting with our senses and our consciousness in a relationship that is also plural. Whether it is an object of perception by the senses (in virtual reality, for example), or social (in the intentional interactions it contains), consciousness maintains a relationship with the virtual object that oscillates between enriched perception and illusion. The virtual object serves indeed, at the same time, of improved reading of the world tending towards a better comprehension of what surrounds the perceiving consciousness and of denaturation of the real in favor of illusory false pretenses which on the contrary move the consciousness away from the reality . Consciousness is thus torn between two opposing phenomena and must, in this configuration, seek a way to identify the virtual object beyond the illusion that it generates or intentional readings it proposes. The digital virtual object then generates complex relationships from consciousness to reality, both in the aspects of individual and cognitive consciousness and in consciousness immersed in society, to the point of being able to cause a phenomenon of digital servitude

Cette thèse aborde un phénomène du changement linguistique spécifique à la langue française en tant que langue romane : la généralisation de l'emploi des personnels sujets considérée comme acquise au 17e siècle. Les relevés opérés dans un corpus littéraire en prose réparti sur le 16e s. montrent que cette progression, bien qu'elle soit continue, est inégale selon que les personnels sujets réfèrent au locuteur ou à l'allocutaire de la situation contextuelle ou qu'ils réfèrent à un élément cotextuel. Aussi, pour expliciter cette disparité, cette étude s'appuie sur l'hétérogénéité interne au paradigme des personnels sujets et distingue les personnels déictiques locutifs je/nous, et allocutifs tu/vous, et les anaphoriques il(s)/elle(s), et propose la raison énonciative comme principal facteur d'emploi. Elle s'efforce de démontrer que leur emploi correspond à un choix émanant de l'énonciateur qui s'effectue dans des cadres cotextuels repérables, illustrés par deux corpus, les assertions fictionnelles postérieures à un discours direct fictif (chap. 3) et un ensemble de propositions subordonnées (chap. 4). Dans le premier, le recours aux personnels sujets quel que soit leur mode référentiel pallie une saturation textuelle traditionnelle en voie de disparition. Dans le second, l'énonciateur (fictif ou fictionnel) signifie son intention de prendre en charge la représentation des instances de la situation coénonciative (je ou vous) au lieu de la laisser à l'initiative de son allocutaire. Au terme de cette thèse, le passage d'une morphosyntaxe variée à la progressive fixation de l'ordre phrastique PSV se trouve justifiée par trois critères, énonciatif, pragmatique et textuel.

Malgré l'abolition de l'esclavage et du système hiérarchique de 1896, les différents termes relatifs à l'ancienne stratification sont maintenus. Pour légitimer leur présence dans les villages des anciens maîtres, les descendants des anciens andevo ont construit une identité selon les critères des anciens libres : terre, tombeau et ancêtre. Malgré cette identité, ils n'ont pas acquis la même position que les descendants des anciens maîtres. Ces derniers essaient de maintenir les descendants des anciens andevo dans une position de dépendants afin de garder leur position d'anciens dominants
The old merina society was divided into four hierarchical groups. The andevo ("slaves") formed the lowest rank. Despite the 1896 abolition of slavery, the term "andevo" is still used in present-day Imerina along with the other terms which designated the former masters. The former slaves who did not leave the villages of their masters alter abolition, had to legitimize their presence. They adopted former master criteria of identity: ancestors, tomb and land. In spite of this newly acquired identity former slave descendants do not obtain the same position as former master descendants. The latter keep the former in their ancient position of dependants in order to maintain their own position as ancient dominants

Abstract:
My dissertation argues that domestic service alters a culture’s relationship to the laboring body. I theorize this relationship via popular literary and cultural antebellum texts to explore the effects of servitude as a trope. Methodologically, each chapter reads a literary text in context with social and legal paradigms to 1) demonstrate that servitude undergirds myriad articulations of antebellum power and difference; 2) show how servitude inflects the construction of these paradigms; and 3) trace Americans’ changing relationship to the concept of servitude from the Early Republic through the Civil War. I begin with James Fenimore Cooper’s The Pioneers (1823), exploring the famous Leather-stocking character – not (as has canonically been the case) as an icon of American independence, but as an icon of American servitude. I historicize this reading with the legal history of master/servant statutes in the early nineteenth century. While public opinion quarantined servitude to an oppressed racial minority, the apparatuses of the law were dramatically expanding servitude’s purview, rendering the master/servant relation the touchstone from which to understand all employment relations. Following, my second chapter examines Caroline Kirkland’s A New Home, Who’ll Follow? (1833). I show that Kirkland’s text dramatizes the narrativity of identity-formation and its potential class consequences. Throughout, Kirkland suggests that this is particularly a women’s problem, whose narratives of self are charged with maintaining the narratives of the family and, synecdochically, the nation. Maria Susanna Cummins’s The Lamplighter (1854) is a revolutionary intervention into the narratives of laborless-ness. I read the adoptions within the novel alongside the legalization of bounded servitude for children, since antebellum minors could be adopted or sign indentures if doing so was determined to be in their “best interest.” In my fourth and final chapter, I examine Civil War draft resistance. In her House and Home Papers columns for The Atlantic (1863-4), Harriet Beecher Stowe turned to the tropes of servitude to make sense of these violent eruptions. Yet this strategy laid bare servitude’s place as the basis for many other forms of state power (including military service) and servitude’s incompatibility with principles of individual sovereignty.

This is an investigation and analysis of the institution of indentured servitude in the English colonies of Virginia and Barbados in the first half of the seventeenth century. It argues that the system of indentured servitude contributed to the development of property rights in individuals and thereby provided early examples of treating people as property that would ultimately lead to the rise of chattel slavery in both colonies. It investigates servitude in law, politics, and practice providing examples of the treatment, trade, and resistance of servants throughout this period. Included are chapters examining the trade in servants and a statistical breakdown of the servant population, a comparison of the practice of servitude in both colonies, and a description of the factors that led to the eventual transition to black slavery.

Abstract:
This thesis examines the establishment of servitudes by positive prescription in Scots law, with particular reference to the doctrine’s conceptual development and the nature of possession required under section 3 of the Prescription and Limitation (Scotland) Act 1973. The thesis is divided into three main parts. The first provides a historical account of the law of positive prescription as applied to servitudes from the 17th century to the 20th century, culminating in its statutory expression in section 3(1) and (2) of the 1973 Act. The second considers what the 1973 Act means when it says that a servitude must be “possessed” for the prescriptive period. While jurists in Scotland have traditionally thought that a right cannot be possessed as such, since it lacks a physical corpus, they have tended to view the apparent exercise of a right as equivalent to the detention of a corporeal object and concluded that servitudes can be “possessed” (or “quasi-possessed”) by analogy. An alternative approach is to say that, while possession denotes a comprehensive factual control of an object for one’s own benefit, certain lesser degrees of factual control are also protected by the law. On this view, the (apparent) exercise of a servitude constitutes a limited “possession” of the land itself and is protected accordingly. Part two argues that this alternative approach is the more coherent and provides helpful analytical tools for understanding what is really going on when a servitude is “possessed” for the purposes of prescription. The third part of the thesis consists of a detailed analysis of the nature of the possession required to establish a servitude by positive prescription. In particular, possession “as if of right” is shown to consist of two “steps”: firstly, the prescriptive claimant must show sufficient possession to indicate that a servitude is being asserted; and, secondly, the possession must not be “by right”, i.e. referable to another right already held by the claimant. After this, the statutory requirements of openness and peaceableness are considered in detail.

This thesis predominantly seeks to explore the entanglements of class, patriarchy and global capital embedded within North Indian domestic work. The thesis firstly examines how the neoliberal policies of the 1980s and 90s shattered village economies and brought about the mass displacement of tribals and landless farmers, forced to leave the land they have cultivated for generations in pursuit of employment in India’s urban centers. While male migrants often find work in the informal sector and settle in slum communities, female rural migrants constitute the immense population of domestic workers within the confines of urban middle class homes. This thesis explores the histories, past and present, of Indian cultures of servitude that have brought migrant motherhood to a crisis point. The interdisciplinary analyses of the political economy of intimate labor are supplemented by a micro-level analysis of my own positionality within a middle class urban home in Jaipur, Rajasthan to bring an alternative perspective to the multiplicity of dialogues about ethical relationships with domestic workers. This thesis ultimately aims to open lines of inquiry about the inequalities embedded within domestic work in order to bring about a radical re-imagining of one’s own participation in the layers and chains of exploitative labor.

O trabalho pretende lançar uma luz sobre o início dos tempos modernos abordando a riqueza das experiências de subjetividade na cultura renascentista. Suas complexidades são tematizadas no exame das complicadas relações entre o ideário humanista e o movimento das reformas religiosas, e suas respectivas evoluções. Destaca-se primeiro, nos primórdios da Renascença, um impulso pela interiorização do sentimento religioso, que aliado ao resgate dos valores da Antiguidade, se faz cerne do anseio por um cristianismo renovado, centrado na valorização do homem e do mundo, do poder do espírito em alcançar a salvação, sem a intermediação das instituições da Igreja. O movimento das reformas religiosas, fundado no anseio renovador humanista de homens como Nicolau de Cusa, Pico Della Mirandola e Erasmo de Rotterdã, não tardará entretanto em se apartar dele a partir de Lutero, numa religiosidade que condena o espírito humano e sua experiência mundana. O exame da discussão sobre o livre arbítrio entre Erasmo e Lutero nos mostra o embate entre duas concepções distintas sobre o homem, que surtirão conseqüências, não raro, inesperadas sobre a formação do mundo moderno.
The study wants to iluminate the begining of modern times treating the richness of the subjectivity experiences in Renaissance culture. The complexities of that should be look in the analysis of the complicated relations between the humanistic ideals and the religious reformations movements and his respective evolutions. First, in the relief, emerges in primeval Renaissance, a impulse for interiozation of religious sentiment, which, in alliance with the rescue of the values of the Antiquity, makes itself in the roots of a new cristianity, centralize in the valorization of man and the world, in the power of the spirity in reaching the salvation, without the intermediation of institutions of the Church. The religious reformations movements, first in the roots of the humanistic renovator impulse of men like Nicholas de Cusa, Pico Della Mirandola and Erasmo de Rotterdã, should be, in a second time, aparted of him, since Lutero and his religious sentiment which condemn the human spirity and his mundane experience. The analyses of the discussion about the free arbitre between Erasmo and Lutero shows to us the confrontation of two diferent conceptions of man, which have their impact, many times imprevisible, in the formation of modern times.

Abstract:
The thesis engages with a dynamic discourse on the human rights approach to human trafficking. Building on the traditional doctrine of human rights, the thesis demonstrates that human trafficking is not a human rights violation, save for a state involvement in it, either directly or through a failure to observe its positive obligations imposed by the existent human rights. In situations that do engage human rights law, the thesis defends an argument that conceptually, human trafficking falls within a domain of the right to be free from slavery, servitude and forced labour. This argument is grounded in both a doctrinal and a conceptual analysis. In particular, the thesis conducts a unique conceptual and legal analysis of Article 4 of the European Convention of Human Rights offering an original interpretation of the concept of exploitation in the context of practices associated with trafficking and 'modern slavery'. This type of inquiry is missing in the existent scholarship. The thesis also conducts a detailed analysis of the jurisprudence of the European Court of Human Rights on positive obligations to protect vulnerable individuals arising out of 'absolute' rights. In addition to providing a complete analysis and classification of these positive obligations, the thesis draws attention to the important difference between the scope of the right and the scope of state responsibility in situations of private infringements of 'absolute' rights. Accordingly, the thesis demonstrates that whereas the prohibition contained in these rights is absolute for the state, positive obligations in situations of their infringements by private individuals are of a limited scope. The analysis of the jurisprudence of the Strasbourg Court is supplemented by a comprehensive discussion of the obligations established in the trafficking-specific instruments. The thesis explains how victim protection provisions contained in these instruments may inform human rights obligations, yet, it demonstrates that these do not represent such obligations on their own. This analysis provides a roadmap for practitioners and activists when arguing cases before the Strasbourg Court and domestically. In addition to this practical dimension, the thesis intends to provide an important contribution to the scholarship on human rights law, and on human trafficking specifically.

Cette étude explique la condition de la femme moderne coréenne. Cette condition a son origine dans les valeurs traditionnelles élaborées pendant la dynastie des Yi (1392-1910) en Corée. Ces valeurs traditionnelles proviennent de la doctrine du néo-confucianisme chinois de Zhu Xi (1130-1200) le principe de la cosmologie de Zhu Xi est caractérisé par la prépondérance de l'homme sur la femme la dynastie des Yi adopte cette doctrine comme philosophie morale et politique. Fondée sur le caractère absolu de l'autorité royale, elle s'appuie sur une élite privilégiée de fonctionnaires lettrés, exerçant le pouvoir politique : les Yang-Ban. Pour former cette élite, le régime institue un système de sélection par concours national ouvert. Cependant, les femmes ne peuvent pas être candidates. Mais, avec le temps, il est nécessaire de prendre de nouvelles mesures afin de préserver le monopole détenu par les seuls Yang-Ban de "sang pur". Désormais, l'accès au concours sera lie au statut et à la condition maritale de la mère des candidats. C'est dans ce but que la dynastie des Yi contrôlera strictement la "vertu "de la femme. De là découlent les "servitudes" de la femme. Alors, la "vertu" de la femme devient le fondement de la dynastie des Yi qui règnera pendant cinq cents ans sur la Corée. A partir de 1960, le gouvernement coréen moderne met en place une planification économique et industrielle. Ce plan mise sur une main d'œuvre abondante sans qualification à bon marché. Les femmes entrent massivement dans le monde du travail salarié. Mais, les coutumes de la dynastie des Yi sont toujours pratiquées. Ainsi, malgré les possibilités d'émancipation offertes par le développement économique, d'une part, et la promulgation de la loi sur l'égalité des sexes, d'autre part, les femmes demeurent inférieures toujours aux hommes dans tous les domaines. Il en résulte que toute tentative de se libérer des coutumes anciennes légalement abolies, expose la femme à la violence sexuelle des hommes et la condamne à la "dévalorisation".

À travers les principaux critères des discours normatifs, et d’autres discours sociaux, l’on peut ici discerner de quelle manière se construit l’image publique des personnes esclavisées. Dans la logique des relations de pouvoir, apparaît, avec des caractères distinctifs, le traitement particulier que cette société multi-ethnique réserve aux nombreux membres de la servitude. Bien qu’il rend compte de la violence des pratiques esclavagistes, ce travail cherche à démontrer que l’expérience du sujet captif n’est pas limitée à la sphère de la soumission mais possède une dimension sociale plus large. This research examines the historical experience of the Afro-descendant and indigenous population from the Lowlands of Charcas who were in servitude in the city of La Plata between 1560 and 1650. Through the main criteria of normative discourse, and of other social discourses, we can discern how the public image of the enslaved people was constructed. Whitin the logic of power relations, appears, with distinctive characteristics, the particular treatment that this multiethnic society gave to its noumerous members in situation of servitude. S'il existe une différence fondamentale entre l’espèce humaine et les autres, elle réside sans doute dans la capacité de la première à « faire monde ». Cette capacité repose sur le fait que l'homme est un « animal symbolique ». La symbolisation lui confère une liberté, une aptitude à l’innovation et une inventivité sans commune mesure avec celles que manifestent les autres espèces. La construction d’un monde, qui mêle ainsi disposition à l’innovation technique et inventivité culturelle, est au fondement de l'historialité. L’histoire, en particulier au 20e siècle, a été marquée par le développement sans précédent de la technique et par le fait que l’innovation technique repose de plus en plus sur les savoirs scientifiques. Or si l’on en croit certains penseurs, dont Heidegger, Ellul, Mumford ou Anders, la mutation de la technique en technologie, son organisation en système et l’autonomisation rapide dudit système de toute régulation politique et éthique mettent en péril la liberté, individuelle et collective, créatrice de culture et d’histoire. Autrement dit, franchi un certain seuil du développement de la technique, la liberté donnée avec la disposition à l’innovation et l’invention se serait retournée contre elle-même. L’ordre technique, qui pour Heidegger est un « non-monde », serait ainsi devenu un lieu d’asservissement. Cette thèse commune aux penseurs critiques de la modernité technique, doit- elle être considérée comme définitive? L'homme est-il vraiment en train de perdre sa liberté au détriment de la machine devenue la mesure et le maître de toute chose? Voilà la question que tente de réfléchir cette étude.

Cette thèse tente d’écrire l'histoire de la servitude - l'esclavage, la dépendance et le travail forcé dans le nord-est de l'Inde du point de vue de l'histoire globale, sous des formes d'enchevêtrements et de connexions et ce, entre le début du dix-neuvième siècle et du vingtième siècle. Elle cherche à savoir pourquoi certains types de récits sur l'esclavage sont devenus dominants dans la région (dont la délimitation forme une frontière) en raison des dites connexions alors que, dans un même temps, l’utilisation certains des apports les moins connus remet en question ces positions. La thèse essaie également de déterminer comment le travail sous la forme de travail forcé dans la région est devenu une forme prédominante mise à l’œuvre et utilisée par le gouvernement colonial dans ses efforts pour ouvrir la région et la mettre en contact avec différentes parties de l'empire. Cela passe également par le débat et le processus par lesquels le gouvernement colonial a résolu et normalisé la relation entre l'esclavage et le travail forcé face à de nouvelles critiques de missionnaires et de citoyens locaux et soutient que l'utilisation d'un langage juridique était cruciale dans ce discours. La thèse traite également de la question étroitement liée de la manière dont les gens ont résisté à ce processus de normalisation et de changements, et enfin questionne la manière dont cette normalisation a affecté certains groupes de personnes et de tribus - en particulier les femmes et les enfants
The thesis is an attempt to write the history of servitude – slavery, dependency, and forced labour in the North-East India from the global history perspective in the forms of entanglements and connections between the early nineteenth and early twentieth century. It addresses the questions of why certain kinds of narratives on slavery became dominant in the region (being demarcated as a frontier) as a result of these connections, and at the same time using some of the less known accounts challenges these positions. It also tries to locate how labour in the form of forced labour in the region became the predominant form that was extracted and used by the colonial government in its effort to open up the region and connect it with different parts of the empire. It also goes through the debate and the process through which the colonial government resolved and normalized the relation of slavery and forced labour in the face of an emerging critics from missionaries and public back home and argues that the use of legal language was crucial to this discourse. The thesis also deals with the closely related question of how people resisted to this process of normalization and changes, and finally the question of how these normalization affected certain groups of people and tribes – especially women and children

Some Asian countries such as Malaysia and Singapore have been experiencing economic growth which, in its turn have been stimulating migrant workers, mainly un-skilled, to migrate into those countries. The present paper tries to examine the human rights violations of domestic workers in Malaysia and Singapore which are occurring in the form of modern servitude or servitude. Moreover, the paper also tries to elaborate the working conditions of foreign domestic workers in Malaysia and Singapore. The present paper is using human rights coupled with intersectionality theories in order to examine whether enacted migration policies in Malaysia and Singapore in relation to migrant workers, though migration policies imposed to domestic workers are aimed to fulfill the national interests, can be regarded as a form of modern slavery or servitude . The present thesis is a case study which is examined by elaborating numerous literatures regarding the working conditions of foreign domestic workers in Malaysia and Singapore. The factual conditions of domestic workers in Malaysia and Singapore, namely the conditions and policies concerning the limitation of several rights of domestic workers will be described and analyzed under the human rights coupled with intersectionality perspectives.

The economic changes occurred in the 90s, with the restructuring and privatization of various sectors of the economy have led to a redefinition of the State role, assuming a position of regulator and supervisor of public services in place to direct its role as straight intervenor. Human trafficking of adolescents is estimated to be a multi-billion dollar industry in the United States and adolescents (ages12-18) are at a high risk for being the victims of human trafficking and being sexually exploited during the process of human trafficking. Social workers are ones of the human services practitioners who often encounter potential or actual victims of human trafficking in their social work practice. Thus, it is very important for social workers to be able to identify, intervene, and advocate for this population. The purpose of this study was to examine social workers’ knowledge about human trafficking and their awareness to identify human trafficking of young women and adolescents in the cities of San Bernardino and Riverside. The study utilized a survey questionnaire design with the use of online software, Qualtrics. Data were collected from 30 social workers who belonged to the National Association of Social Workers, Region F. Participants were asked of their knowledge and awareness about human trafficking and some demographic variables. Descriptive and inferential statistics were used to analyze the data collected. Participants in the study indicated various levels of knowledge regarding human trafficking, with 80% of the participants identifying forced labor or forced prostitution as a major part of human trafficking. Just over half of participants (53.3%) indicated that young children were not the most trafficked persons in San Bernardino and Riverside counties. The study also found that there was an ethnicity difference in the level of knowledge about human trafficking. White participants were likely to have more knowledge about human trafficking than those of other ethnicities. In order to have better understanding of this crime, and to be better able to detect, and identify these victims, the findings of the study suggest that social workers need to increase their knowledge about human trafficking, as well as their skills to better build rapport, and trust. Another recommendation is that more training, and advanced comprehensive education should be provided to social workers to increase their knowledge, awareness about human trafficking, competence, and effectiveness.

In keeping with the official bibliography that the popular Haitian “zombification” images have never really been the object of an ethnographic exploration likely to give back with depth and meticulously detail, the subtle logics, the complexity, the scope and eventual significant, the author devotes himself completely to the retracing of the processes by which a zombie is created such that he had conceived in the Haiti, that which favours a regulated exploration of his different stages given back depending on inspired local chronic logical conceptions. Posing that the collective Haitian imagination of zombification would be made up of the refuge space of a collective, of the infra-conscience, incorporated slipping out from the social construction process of the memory, but composed of memorized prints inherited at the time of slavery, the author takes a census and questions the various places which within that space, would soundly testify this collective presentation

Ce travail doctoral porte sur la servitude pour dette au Campa du Sud, territoire formé par la région la plus méridionale du Campa, le Panduranga, et qui correspond approximativement aux actuelles provinces vietnamiennes du Ninh-Thuận et du Bình-Thuận. Le corpus de sources utilisé provient uniquement du fonds de la Société Asiatique de Paris. Ces sources manuscrites à caractère juridique et administrative, datées du XVIIIe siècle et rédigées en cam et en hán-nôm, sont connues sous l’appellation d’Archives Royales du Panduranga. Notre travail de recherche envisage de définir les différentes formes d’asservissement et les principales situations qui les engendrent, en privilégiant une approche par le droit. Les documents juridiques tels que les contrats de vente et de prêt, les actes de donation, les plaintes et les requêtes nous renseignent sur la condition des asservis, les halun, leurs statuts, droits et recours possibles en cas de litige. Ces documents permettent d’offrir une définition juridique de l’halun, plus légitime, et collant au plus près de la réalité, que celle floue, indécise, et fluctuant depuis de longues décennies, entre esclave et serviteur. Cette thèse se répartie en cinq chapitres. Le premier chapitre est consacré à la présentation du corpus, ses fondements et limites. La deuxième partie s’attache à présenter les différents types de contrats de vente de personnes, qui, étroitement liés à l’endettement, fait l’objet d’une analyse dans la troisième partie. Enfin, les modalités de remboursement de prêts et le statut des personnes asservies sont les deux dernières thématiques abordées dans ce travail
This doctoral work focuses on debt bondage in Southern Campa (Champa)--a territory then known as the Panduranga, and corresponding to the provinces currently known as Ninh-Thuận and Bình-Thuận in Southern Vietnam. The corpus of documents consulted is housed within the Société Asiatique, Paris. Known as the Royal Archives of Panduranga, legal and administrative documentation examined dated from the 18th Century and was handwritten in Cam and Han-Nôm characters. Favoring a legal approach and close examination of archived sales contracts, loans, donations, and complaints and petitions related to debt, the research intends to define forms of bondage and some of the circumstances from which it arose. These legal documents provide an additional angle from which to interpret the conditions of bonded people, i. E. The Halun, their status and rights, and offers clarification on the difference between ‘slaves’ and ‘servants’. This thesis is divided into five chapters. The first chapter presents the corpus of documents, its foundations and limitations. The second chapter attempts to identify the various types of contracts related to the sale of persons--and as these sales are often closely related to debt, the third chapter provides analysis in this regard. Lastly, repayment of loans and the status of bonded people are themes addressed within the last two chapters of this work

Tragédie humaine et crime que l'on préfère croire d'un autre temps, l'esclavage n'a jamais été aussi prospère que depuis la proclamation officielle de son abolition. Dès lors, son éradication se heurte à un manque flagrant de juridictionnalisation et à l'absence de mise en oeuvre de politiques publiques concrètes. Dans le même temps, l'intervention vigoureuse des forces de l'ordre est entravée, ce qui permet aux trafiquants de jouir d'une relative impunité. De prime abord, il peut paraître simple de définir ce qu'est l'esclavage tant la notion semble entendue et le sujet d'actualité. Mais au-delà de cette image d'Epinal véhiculée par la traite transatlantique négrière, l'esclavage perdure et ses avatars modernes se superposent à ses formes anciennes. La nature transnationale de ce crime, l'anonymat de ces auteurs facilité par l'évolution des technologies et la difficulté d'en identifier ses victimes amènent à se demander si la sphère internationale n'est finalement pas la plus à même de lutter contre les pratiques esclavagistes. De plus, faire respecter l'interdiction des pratiques esclavagistes passe aujourd'hui par une approche multidisciplinaire du phénomène qui doit être réalisée à l'échelle internationale de manière à saisir pleinement l'envergure de ce qu'est réellement l'esclavage, mais implique toutefois une coopération des Etats. En effet, bien plus qu'une simple problématique juridique, fut-elle d'envergure internationale, la lutte contre l'esclavage contemporain implique également une prise de conscience de la sphère politique et un engagement de la société civile sans lesquelles aucunes mesures ne pourraient être efficacement appliquées
Human tragedy and crime that we prefer to think of another time, slavery has never been so prosperous since the official announcement of its abolition. Therefore, its eradication is facing a serious lack of jurisdictionalisation and a lack of enforcement of specific public policies. At the same time, the vigorous intervention of the authorities is obstructed that which allow a relative impunity to the traffickers.Prima facie it may seem easy to define slavery as the concept seems to heard and the current topic. But beyond this idyllic picture conveyed by the transatlantic slave trade, slavery persists and its modern avatars overlap with its ancient forms. The transnational nature of this crime, the anonymity of the authors facilitated by technological developments and the difficulty of identifying his victims, lead us to wonder if the international sphere is not actually the best able to fight against slavery. Furthermore, enforcing the prohibition of slavery going on today by a multidisciplinary approach to the phenomenon which must be done internationally in order to fully grasp the scale of what slavery really is, but involves, however, cooperation of States. Indeed more than a simple legal question, even with an international scope, the fight against contemporary slavery also involves an awareness of the political sphere and a commitment of the civil society without which no measures could be effectively applied

L'acquisition d'un appartement dans un immeuble en copropriété semble être aujourd'hui une opération banale tant pour les consommateurs que pour les praticiens, chacun semblant considérer que l'objet de l'acquisition se limite à "la propriété" d'un appartement dans un ensemble immobilier.La notion de copropriété en France est définie par l’article 1° de la loi du 10 juillet 1965 qui dispose : « La présente loi régit tout immeuble bâti ou groupe d'immeubles bâtis dont la propriété est répartie, entre plusieurs personnes, par lots comprenant chacun une partie privative et une quote-part de parties communes. ». Le lot de copropriété se présente donc comme un lien de droit à vocation perpétuelle instaurée entre des parties de l’immeuble pour permettre la répartition de sa propriété. Le lot de copropriété est finalement la résultante d’une appropriation individuelle (la partie privative) à l’aide d’un procédé collectif (l’indivision généralisée des parties communes) et entre dans la notion plus large de propriété privée.L'analyse de la nature juridique du lot de copropriété vient cependant démontrer que l'objet de l’acquisition par le candidat acheteur est de nature bien différente. Celle-ci réside en une forme d’appropriation complexe en raison des distinctions qu’elle implique entre les différentes composantes du lot mais aussi en raison de la multiplicité des qualifications juridiques qu’elle conjugue.Les droits attachés à la notion de lot de copropriété semblent être des droits complexes, tantôt droits personnels, tantôt droits réels, combinant pleine propriété, indivision, servitudes, usufruit et nue-propriété, ce que l’on pourrait appeler « la propriété plurielle », une forme de propriété « caméléon » avec des composantes hétérogènes.Le candidat acquéreur n’achète pas un appartement dans un immeuble mais, en réalité, une quote-part indivise dans des choses communes dont il ne connait ni l’étendue ni l’état ainsi que la jouissance exclusive d’un volume dénommé « partie privative » dont l’étendue est à la fois le critère et la conséquence (l’usage exclusif)L’analyse met en exergue une réelle discordance entre ce que les copropriétaires pensent posséder et la complexe réalité juridique de l’étendue de leur propriété et des droits et devoirs qui en découlent. The concept of ownership in condominium in France is defined by the Article 1 of the Law of 10 July 1965 states: "This Act governs any building or group of buildings whose ownership is divided among several people, composed each one by a private part and a part of common areas. ".The Lot of condominium is as a legal relationship established between perpetual vocation parts of the building to allow the distribution of its property. The condominium lot is the result of an individual appropriation with a collective process and into the wider concept of private property.Private property was designed by the French Revolution as a natural and inalienable human right, just as freedom. It is an inviolable and sacred right which no one can be private.The analys however highlights one hand great complexity on the scope of rights forming the components of the condominium lot but also its materiality. Difficulty identifying the physical reality of size lot suggests the distortion that may exist between the reality of this form of property and what the owner thinks .This Illusion present a real legal insécurity for the owner who does not measure extent of their rights and duties with respect to the nature of his property

Abstract:
This thesis describes the environmental former emergency colonies (settlements) Kamenná čtvrť, the highlights of some local issues, among which the property buildings on a foreign land are also included. It identifies the possibility of legislative relations between the owner of the house and the different landowner, which is the municipality Brno. The author chooses one family house, in which he describes its genesis and develops the issue more thoroughly. Subsequently, the house and the land beneath it were valued according to valuation rules in different valuation methods which are comparative method and cost method. A secondary aim was to determine the market value (the usual price) of this house without the land and try to map out (realization) process of purchasing the land under the property from the municipality of Brno.
